Assessing The Experiences Of Women Who Have Suffered Intimate Partner Violence Living In Shelters, Queencilla N. Hammond
Assessing The Experiences Of Women Who Have Suffered Intimate Partner Violence Living In Shelters, Queencilla N. Hammond
Theses and Dissertations
According to the Centers for Disease Control on National Intimate Partner and Sexual Violence in 2010, more than 1 in 3 women (35.6%) and more than 1 in 4 men (28.5%) in the United States have experienced rape, physical violence, and/or stalking by an intimate partner in their lifetime. Throughout history, someone they knew has most often victimized women. Over the past thirty years, feminist organizers of the domestic violence (DV) movement powered public awareness regarding the prevalence of intimate partner violence (IPV) dominantly. This led to the development of a network of shelters and other support services for victims, …

Supporting Lgbtq+ Survivors On Campus, Ethan Levine, Molly Sapia
Title IX Summit
Title IX protections have provided a much-needed resource for addressing sexual violence on campus. However, the benefits of Title IX may not apply equally to all students in practice. This workshop will explore strategies for addressing sexual violence in lesbian, gay, bisexual, trans, and queer (LGBTQ+) communities. How can we improve support for LGBTQ+ students? How effectively does Title IX address same-sex violence – and might this shift under the current administration? What other policy and programmatic options would support students in these communities? Workshop participants will discuss and strategize around these and other contemporary challenges for supporting LGBTQ+ survivors …

“Who Will Judge The Many When The Game Isthrough?”: Considering The Profound Differencesbetween Mental Health Courts And “Traditional”Involuntary Civil Commitment Courts, Michael L. Perlin
Seattle University Law Review
For forty years, we have known that involuntary civil commitment hearings are—in most jurisdictions—“charades.” When the Supreme Court noted, in Parham v. J.R., that the average length of a civil commitment hearing ranged from 3.8 to 9.2 minutes, the reaction of many who had done these cases was, “What? So long?!” The characterization of such hearings as being a “greased runway” to a state institution has never been disputed. Lawyers representing these individuals were bored or contemptuous; judges simply wanted to get cases moving; opposing counsel looked at their wrist watches to see when the cases would be done. This …
Rape By Fraud: Eluding Washington Rape Statutes, Michael Mullen
Rape By Fraud: Eluding Washington Rape Statutes, Michael Mullen
Seattle University Law Review
Existing Washington law does not sufficiently safeguard its citizens from “rape by fraud,” an action whereby a person obtains sexual consent and has sexual intercourse of any type by fraud, deception, misrepresentation, or impersonation. Rape by fraud is a form of sexual predation not always prosecutable under existing Washington law. In recent years, twelve states have adopted expanded rape by fraud statutory provisions. Presently, Washington’s rape statutes lack the expansive rape by fraud statutory language adopted by these twelve states. A recent sexual scam in Seattle has revealed holes in Washington’s rape statutes. This Note examines the history of rape …

"On The Murder Of Rickey Johnson": The Portland Police Bureau, Deadly Force, And The Struggle For Civil Rights In Oregon, 1940 - 1975, Katherine Eileen Nelson
Dissertations and Theses
On March 14, 1975, twenty-eight year old Portland Police Officer Kenneth Sanford shot and killed seventeen-year-old Rickie Charles Johnson in the back of the head during a sting operation. Incredulously, Johnson was the fourth person of color to be shot and killed by Portland police within a five-month period. Due to his age and surrounding circumstances, Johnson's death by Sanford elicited extreme reactions from varied communities of Portland. Unlike previous deaths of people of color by the police in Portland, Johnson's death received widespread attention from mainstream media outlets. In response, some white citizens decried Johnson's death as unjustified police …

Campus Sexual Assault And (In)Justice: An Inquiry Into Campus Grievance Professionals' Roles, Responsibilities, And Perspectives Of Justice, Liane Kehaulani O'Banion
Dissertations and Theses
Approximately one in four women experience sexual violence in college. Public institutions of higher education identify professionals specifically responsible for Title IX compliance, campus grievance processes, and survivor advocacy. Success in these roles depends upon a variety of institutional, legal, and procedural factors, and the ability to balance compliance, accountability, transparency, confidentiality, and care for students in pursuit of institutional justice. However, the literature has failed to acknowledge the complexities and individual cost of serving in these contentious roles. Moreover, facets of organizational culture can hinder grievance professionals' efficacy in fulfilling their duties, facilitating consistent and fair resolutions, and ensuring …

This longitudinal, qualitative study analyzed BSN students' perceptions of identifying and addressing SDOH with their clients.
Big Law, Public Defender-Style: Aggregating Resources To Ensure Uniform Quality Of Representation, Eve Hanan
Big Law, Public Defender-Style: Aggregating Resources To Ensure Uniform Quality Of Representation, Eve Hanan
Washington and Lee Law Review Online
Stories abound of public defenders who, overwhelmed with high caseloads, allow defendants to languish in pre-trial detention and guilty pleas to be entered without examining the merits of the case. Most defendants cannot afford to hire an attorney, and, thus, have no choice other than to accept the public counsel appointed by the court. In this Essay, I consider whether Professor Benjamin Edwards’ central argument in The Professional Prospectus: A Call for Effective Professional Disclosure that attorneys should provide potential clients with a prospectus disclosing their performance history—applies to criminal defense. I reject the proposition that most people …

The Lived Experience Of 'Carrots' And 'Risks': Voices From Within The Criminal Justice System., Jm Parsons, S Hocking
School of Law, Humanities and Social Sciences
The current Justice Minister David Gauke has recently announced plans to increase the use of workplace Release on Temporary Licence or ROTL. In this article we draw on data from an on-going Photographic electronic Narrative (PeN) project, initially funded through an ISRF mid-career fellowship, collected from ROTL men on enhanced work placements at LandWorks, an offender resettlement charity based in South Devon. The voices of those on the margins of the criminal justice system, in the spaces between prison and release, are rarely captured. Reflecting on their narratives, we argue that whilst Gauke’s employment and education strategy is laudable, the …

The Changing Shape Of Youth Justice: Models Of Practice, R Smith, P Gray
School of Law, Humanities and Social Sciences
This article reports on a two-year investigation, which maps out contemporary approaches to the delivery of youth justice in England, in light of substantial recent changes in this area of practice. The findings are derived from a detailed examination of youth offending plans and a series of corroborative semi-structured interviews with managers and practitioners from selected youth offending services. Our inquiry has enabled us to develop a detailed three-fold typology of youth justice agencies’ orientations towards practice, represented as ‘offender management’, ‘targeted intervention’ and ‘children and young people first’; as well as a small number of ‘outliers’ where priorities are …

In Her Place: Subverting the Woman/Terrorist Binary in Marco De Franchi's La Carne e il Sangue.
Militant women tend to be sensationalized or denigrated by the media, frequently portrayed as being 'doubly deviant'; first, for committing a crime against the state, and, second, for having transgressed the boundaries of tolerable female behavior. Marco De Franchi, chooses a refreshing approach in his crime novel, La carne e il sangue (2008), focusing on commonality, rather than exceptionality, in his depiction of the terrorist, Lucia. Serena, a police investigator in charge of this case, contemplates how she would behave if …

Contextual Perspectives On Heroin Addiction And Recovery: Classic And Contemporary Theories, Sarah L. Callahan
Contextual Perspectives On Heroin Addiction And Recovery: Classic And Contemporary Theories, Sarah L. Callahan
College of Science and Health Theses and Dissertations
Drug use and recovery have received considerable attention from social scientists over the past few decades. However, many studies involving heroin use continue to focus on person-centered risk factors surrounding use and, to a lesser extent, recovery processes. There is a need to further develop and use theories that focus on contextual approaches that include opportunity structures and behavioral economic factors. In this article, two classic criminological theories (Differential Opportunity and Subcultural) are reviewed as well as the more recent Social Resource theory (SRT). Differential Opportunity theory focuses on the fact that those involved in illegitimate means of opportunity require …
Anti-Lgb Hate Crimes: Political Threat Or Political Legitimization?, Johanna R. Shreve
Anti-Lgb Hate Crimes: Political Threat Or Political Legitimization?, Johanna R. Shreve
Dissertations and Theses
While activists and others have argued that the legitimization of biased attitudes and stereotypes by political leaders foments violence against minority groups, criminological research in the U.S. has focused more on "threat" hypotheses that view hate crime as a retaliatory response to perceived gains or encroachment of targeted groups. Another view suggests that heightened public visibility of hate crimes or other bias issues, usually in the form of media coverage, increases hate crimes. This study compares the effect on anti-LGB crimes of events representing political threat (a court decision legalizing marriage equality) and political legitimization of bias (passage of a …

Police Officer Perspectives On Public Views Of Police, Current Events Involving Police, And The Impact On Police-Community Relationships, Donjae Catanzariti
Seton Hall University Dissertations and Theses (ETDs)
The media has presented current tensions between police officers and the communities they serve, particularly the Black community. These tensions have led to calls for reforms in law enforcement and the criminal justice system. However, there has been little focus on the police perspective. Thus, this study sought to address the gaps in the literature by shedding light on the perspective of police officers through the following research question: a) How do police officers perceive the public’s view of them? b) How do police officers’ think the public’s view of them impacts the relationship between police officers and the communities …
Reconciling The Opportunities And Obstacles Of Motherhood Following Corrections Involvement, Summer Brooke Newell
Reconciling The Opportunities And Obstacles Of Motherhood Following Corrections Involvement, Summer Brooke Newell
Dissertations and Theses
This mixed methods dissertation is comprised of three papers that consider interrelated ways in which social bonds, within the context of parenting, are experienced by women recently involved with the corrections system. Types of social bonds considered include agency professionals, romantic partners, and children--all previously theorized to play a role during the reentry period. These social bonds are considered within the context of the challenges experienced during this period, and how and why these social bonds may--or may not--support women as they transition back into the community.
Evaluating The Effectiveness Of Justice Reinvestment Legislation In Oregon: Analyses Of State And County Implementation, Christopher Wade Dollar
Evaluating The Effectiveness Of Justice Reinvestment Legislation In Oregon: Analyses Of State And County Implementation, Christopher Wade Dollar
Dissertations and Theses
Sentencing reform and "tough on crime" policies have assisted in the inflation of the United States' prison population by nearly 400% over the last 50 years. In 2003, justice reinvestment was conceptualized as a way to decrease recidivism and remedy the exorbitant correctional spending by reinvesting funds on rehabilitation and reentry assistance to those leaving custodial institutions. Early implementations of justice reinvestment in Connecticut and Texas achieved both savings and reductions in prison populations. This led to the creation of the Justice Reinvestment Initiative by the U.S. Bureau of Justice Assistance in 2010. Officials of the Justice Reinvestment Initiative sought …

Addressing Women And Minorities On Social Media By The 2016 U.S. Presidential Candidates, Mandi Bates Bailey, Steven P. Nawara
Political Science Department Faculty Articles
Donald Trump’s bombastic statements regarding women and minorities were a constant theme in the 2016 presidential election and attracted attention from both the mainstream media and his opponent, Hillary Clinton. Given the increasing use of social networking sites among political actors and the public, as well as the focus given to women and minorities in the 2016 election, we utilize a content analysis of presidential candidates’ social media activity in the months preceding the election in order to better understand how the candidates addressed women and minorities. We ultimately find that Democratic candidate Hillary Clinton out-posted Trump in both positive …
Reconsidering Policy Barriers For Justice-Involved College Students, Bradley D. Custer
Reconsidering Policy Barriers For Justice-Involved College Students, Bradley D. Custer
Journal of College Access
Student affairs professionals are concerned about the access and success of diverse groups of students in U.S. higher education, but systematic barriers continue to confront one understudied population of college students. Justice-involved people–those who have experienced the criminal justice system–face unique challenges on our campuses but are often ignored in discussions of access, retention, and success. To raise awareness about the barriers these student face, this paper offers a descriptive examination of the federal, state, and institutional policies that target justice-involved college students, including policies related to admissions, financial aid, campus housing, student employment, student athletics, and others. Analysis suggests …
