Stigma At Every Turn: Health Services Experiences Among People Who Inject Drugs, Catherine E. Paquette, Jennifer L. Syvertsen, Robin A. Pollini
Clinical and Translational Science Institute
Background—People who inject drugs (PWID) encounter varying forms of stigma in health services contexts, which can contribute to adverse outcomes. We explored the lived experience of stigma among PWID to elucidate pathways by which stigma influences health care access and utilization. Methods—We conducted 46 qualitative interviews with PWID in California’s Central Valley between March and December 2015, as part of a multi-phase, multi-method study examining implementation of a new pharmacy syringe access law. A “risk environment” framework guided our data collection and we used a deductive/inductive approach to analyze the qualitative data. Results—Participants repeatedly cited the impact of stigma on …

Injection Drug Use, Hiv/Hcv, And Related Services In Nonurban Areas Of The United States: A Systematic Review, Catherine E. Paquette, Robin A. Pollini
Clinical and Translational Science Institute
Background—Injection drug use (IDU) in nonurban areas of the United States is a growing public health concern, but there has been no comprehensive assessment of existing research on injection-related HIV and hepatitis C (HCV) in nonurban communities. We conducted a systematic review to assess the current literature and identify knowledge gaps. Methods—We systematically searched six databases for relevant articles published between January 1990 and June 2016 and screened, extracted, and analyzed the resulting data. Studies were included if they reported original findings from the nonurban U.S. related to 1) IDU and its role in HIV/HCV transmission, and/or 2) HIV/HCV services …

The Race For Privacy: Technological Evolution Outpacing Judicial Interpretations Of The Fourth Amendment: Playpen, The Dark Web, And Governmental Hacking, Wade Williams
Florida State University Law Review
Despite complying with the new amendments to Federal Rule of Criminal Procedure 41, the Federal Bureau of Investigation's (FBI) broad authorization to remotely access computers at anytime and anywhere within the United States is at odds with the reasonableness and particularity requirements of the Fourth Amendment. The exponential growth of technology has made life in the twenty-first century something our ancestors would envy, but the idea of allowing the government to perform unknown and undetected searches across the United States, especially in the hidden world of cyberspace, would have our founding fathers turning in their graves. Recognition is owed to …

Intergenerational Justice, Environmental Law, And Restorative Justice, Chaitanya Motupalli
Intergenerational Justice, Environmental Law, And Restorative Justice, Chaitanya Motupalli
Washington Journal of Environmental Law & Policy
Global climate change is well underway and its impacts are reaching far into the future. As these impacts progress, they present core questions of intergenerational justice. What does justice require of the current generation in tackling climate change to safeguard the wellbeing of future generations? How is the current generation to achieve a just relationship with those to come in light of the atrocious violations represented by global climate change? Taking the Juliana v. United States lawsuit as an example, I argue that we are not equipped to address the current climate crisis using existing environmental law, and therefore our …
Comparative Analysis As An Antidote To Tunnel Vision In Criminal Law Reform: The Example Of Complicity, Luis E. Chiesa
Comparative Analysis As An Antidote To Tunnel Vision In Criminal Law Reform: The Example Of Complicity, Luis E. Chiesa
Journal Articles
In the context of criminal law reform, the tunnel vision that is produced by deeply embedded paradigms or patterns of criminality has the effect of stifling creativity. If left unchecked, the assumptions that serve as the backdrop to our criminal justice system will likely prevent reformers from giving serious consideration to alternatives that are in tension with the dominant patterns of criminality. I will end by arguing that one way of avoiding this outcome is by engaging in the comparative analysis of criminal law. Comparative analysis serves as a kind of “second opinion” that may help criminal law reformers to …

Routine Activities And Adolescent Deviance Across 28 Cultures, Alexander T. Vazsonyi, Magda Javakhishvili, Albert J. Ksinan
Family Sciences Faculty Publications
Purpose
The current study tested the links between routine activities and deviance across twenty-eight countries, thus, the potential generalizability of the routine activities framework.
Methods
Data were collected as part of the Second International Self-Report Delinquency Study (ISRD-2) from 28 cultures, from seventh, eighth, and ninth grade adolescents (N = 66,859). Routine activities were operationalized as family, peer, solitary, and community activities. Country-level predictors included unemployment rate, prison population, life expectancy, and educational attainment.
Results
Three-level, hierarchical linear modeling (individual, school, and country) was used to test both individual and country-level effects on deviance. Findings supported predictions by the …

Reshaping A Fractured System: Arlen Specter’S Footprint On The Criminal Justice System In The U.S., Kaitlyn Brown
Arlen Specter Center Research Fellowship
The criminal justice system in the United States of America has been in peril since the beginning of the 1960’s, spiraling downward as the rates of crime shot upward across the country. Such drastic changes to a major system within the United States brought the issue of criminal justice to the forefront of nearly every political agenda of politicians in office. This paper examines the work one such politician, the late Pennsylvania Senator Arlen Specter, performed in his fight against the crippling system. This paper evaluates the actions and policies Specter introduced, from his controversial Armed Career Criminal Act to …

Dual-Process Theory Of Racial Isolation, Legal Cynicism, And Reported Crime, John Hagan, Bill Mccarthy, Daniel Herda, Andrea Cann Chandrasekher
Sociology Faculty Publications
Why is neighborhood racial composition linked so strongly to police-reported crime? Common explanations include over-policing and negative interactions with police, but police reports of crime are heavily dependent on resident 911 calls. Using Sampson’s concept of legal cynicism and Vaisey’s dual-process theory, we theorize that racial concentration and isolation consciously and nonconsciously influence neighborhood variation in 911 calls for protection and prevention. The data we analyze are consistent with this thesis. Independent of police reports of crime, we find that neighborhood racial segregation in 1990 and the legal cynicism about crime prevention and protection it engenders have lasting effects on …
