Prison Officer Legitimacy, Their Exercise Of Power, And Inmate Rule Breaking, Benjamin Steiner, John Wooldredge Aug 2018

Prison Officer Legitimacy, Their Exercise Of Power, And Inmate Rule Breaking, Benjamin Steiner, John Wooldredge

Criminology and Criminal Justice Faculty Publications

Prison officers are directly responsible for transmitting penal culture and prison policy to the confined, yet few studies of officers’ impact on inmate behavior have been conducted. We examined the effect of inmates’ perceptions of officer legitimacy on rule breaking within prisons, as well as the effects of officers’ reliance on different power bases on rates of rule breaking across prisons. The findings from bi-level analyses of data from inmates and officers from 33 prisons revealed that inmates who held stronger views regarding officer legitimacy committed fewer nonviolent infractions but that perceived legitimacy did not affect the number of violent …

Measuring Inequity: A Systematic Review Of Methods Used To Quantify Structural Racism, Maya Groos, Maeve Wallace, Rachel Hardeman, Katherine P. Theall

Abstract

Objective: To summarize the ways in which researchers have quantified measures of structural racism for the purposes of empirical, quantitative investigation of its associations with physical and mental health outcomes.

Methods: Systematic review of literature published January 1, 2007-June 30, 2017. We searched PubMed and EMBASE databases for studies including at least one of the following search terms in the title or abstract: “structural racism”, “systemic racism”, “institutional racism”, “institutionalized racism”. The Criminal Justice System And Latinos In An Emerging Latino Area, Betina Cutaia Wilkinson Aug 2018

The Criminal Justice System And Latinos In An Emerging Latino Area, Betina Cutaia Wilkinson

Latino Public Policy

The topic of my study is Latinos’ attitudes and experiences with the criminal justice system in an emerging Latino area. There is an extensive amount of research on African Americans’ experiences and views of the criminal justice system yet our knowledge of Latinos’ experiences with the criminal justice system is quite scant. Still, a few studies have provided some foundation for our understanding of this topic. We know that immigrant policing is associated with Latinos’ reduced trust in government agencies and its programs (Cruz Nichols et al. 2018a). Restrictive immigration policies negatively impact Latinos’ physical and mental health (Cruz Nichols …

The Longevity Of American Terrorists: Factors Affecting Sustainability, Brent L. Smith, Jeff Gruenewald, Katie Ratcliff, Paxton Roberts, Madeline Brice

Research Projects

This project was an outgrowth of two previous NIJ projects being conducted under NIJ’s Research and Evaluation on Domestic Radicalization to Violent Extremism program area. The first of these projects, which ended in 2015, focused upon testing one of the most prominent theoretical models of extremist radicalization -- identity and framing theory. One of the findings from examination of this theoretical model is consistent with the notion that “people want to be associated with a winner.” Recruitment and commitment, crucial to the lifespan of any terrorist movement, improve when the movement has been able to commit successful terrorist incidents (Freilich, …

Sexual Assault And Health: Understanding The Interplay Of Trauma-Related Appraisals And Physical Health Outcomes, Kerry Lyn Gagnon Aug 2018

Sexual Assault And Health: Understanding The Interplay Of Trauma-Related Appraisals And Physical Health Outcomes, Kerry Lyn Gagnon

Electronic Theses and Dissertations

Women who have been sexually assaulted are at risk for negative mental and physical health outcomes; however, limited research has tested how psychological responses to sexual assault may influence physical health. The present study tested a longitudinal model examining the association between posttrauma appraisals and physical health problems. Drawn from a larger study, the sample included 156 ethnically diverse women who had been sexually assaulted within the last year. The study used cross-lagged panel models to test for reciprocal relationships between posttrauma appraisals and physical health problems over time. A secondary aim of the study was to test whether other …

The Consequences Of Legalizing Recreational Marijuana: Evidence From Colorado And Washington, Ty Miller Aug 2018

The Consequences Of Legalizing Recreational Marijuana: Evidence From Colorado And Washington, Ty Miller

Open Access Dissertations

In December of 2012, Washington and Colorado implemented the legalization of possession and use of marijuana for recreational purposes. Following this, January of 2014, Colorado opened the first recreational marijuana dispensaries in the United States. Although the debate about recreational marijuana has been fought in the public and academic spheres, we have limited empirical data as to the effect of these policies. With this, arguments in regard to whether marijuana should be legalized in the United States have far outpaced reliable scientific research. As more states, and potentially the federal government, begin to vote on whether to legalize, reliable research …

The Case Against Qualified Immunity, Joanna C. Schwartz Aug 2018

The Case Against Qualified Immunity, Joanna C. Schwartz

Notre Dame Law Review

If the Court did find an appropriate case to reconsider qualified immunity, and took seriously available evidence about qualified immunity’s historical precedents and current operation, the Court could not justify the continued existence of the doctrine in its current form. Ample evidence undermines the purported common-law foundations for qualified immunity. Research examining contemporary civil rights litigation against state and local law enforcement shows that qualified immunity also fails to achieve its intended policy aims. Qualified immunity does not shield individual officers from financial liability. It almost never shields government officials from costs and burdens associated with discovery and trial in …

Qualified Immunity: Time To Change The Message, Karen M. Blum Aug 2018

Qualified Immunity: Time To Change The Message, Karen M. Blum

Notre Dame Law Review

This Essay will proceed in four parts. Parts I, II, and III will highlight, through some recent illustrative cases, areas where the qualified immunity defense has been especially ineffective and inefficient by: (Part I) hampering the development of constitutional law and impeding the redress of constitutional wrongs; (Part II) draining resources of litigants and courts through interlocutory appeals that are frequently without merit and often jurisdictionally suspect; and (Part III) breeding confusion into the roles of the judge and the jury in our judicial system, effectively enhancing the judge’s role at the expense of the constitutional right to jury trial. …

Non-Merit-Based Tests Have No Merit: Restoring District Court Discretion Under § 1915(E)(1), John R. Fitzgerald Aug 2018

Non-Merit-Based Tests Have No Merit: Restoring District Court Discretion Under § 1915(E)(1), John R. Fitzgerald

Notre Dame Law Review

This Note evaluates the circuit split regarding the provision of counsel in prisoner civil rights cases and proposes a uniform test. Part I describes the historical background of the right to counsel and prisoner litigation in the United States. Part II outlines the current circuit split regarding § 1915(e)(1). Part III explains why all district courts should consider merit and substance, using a case study to illustrate the deficiencies of non-merit-based tests. Part IV demonstrates why merit and substance are the best metrics for deciding when to provide counsel. Ultimately, this Note asserts that all district judges should consider: (1) …
