Medicalization Of Rural Poverty: Challenges For Access, Elizabeth Weeks
Medicalization Of Rural Poverty: Challenges For Access, Elizabeth Weeks
Scholarly Works
This article was prepared for a live conference, on “The Medicalization of Poverty,” held at the University of Illinois College of Law, and a symposium to be published in the Journal of Law, Medicine & Ethics. My piece focuses on a constellation of challenges for health care delivery and access to care in rural areas. Discussions regarding health and poverty often seem to focus on the admittedly persistent and multilayered problems of the urban poor: unemployment, substandard and unaffordable housing, violent crime, nutrition and “food desserts,” recreation and safe outdoor spaces, and under-resourced public schools, to name a few. While …
Why Autonomy Must Be Contract's Ultimate Value, Hanoch Dagan, Michael A. Heller
Why Autonomy Must Be Contract's Ultimate Value, Hanoch Dagan, Michael A. Heller
Faculty Scholarship
In “The Choice Theory of Contracts”, we develop a liberal theory of contract law. One core task of the book was to persuade advocates of economic analysis that they must situate their enterprise within our liberal framework. Autonomy, rightly understood, is the telos of contract.
Oren Bar-Gill pushes back strongly in “Choice Theory and the Economic Analysis of Contracts”. He offers a penetrating – perhaps devastating – critique of our approach. Bar-Gill notes the substantial convergence between choice theory and a welfarist view. If he is right, then what does choice theory add?
Our task in Part I of this …
Brain Development, Social Context And Justice Policy, Elizabeth S. Scott, Natasha Duell, Laurence Steinberg
Brain Development, Social Context And Justice Policy, Elizabeth S. Scott, Natasha Duell, Laurence Steinberg
Faculty Scholarship
This article examines the role played by biological and psychological factors associated with adolescent criminal activity in the context of justice policy reform and its critics. Scott, Duell, and Steinberg assert that risk-taking behavior in adolescence is not solely associated with biological and psychological immaturity, but rather exists as a dynamic interaction between those factors and the individual social context. This interactive model of juvenile offending supports the trend of treating juveniles differently than adults in the criminal justice system and clarifies how correctional programs are crucial in either undermining or promoting healthy development in adolescents.

Critique & Praxis: A Pure Theory Of Illusions, Values, And Tactics, And An Answer To The Question: "What Is To Be Done?", Bernard E. Harcourt

We are going through an unprecedented period of political instability. With the rise of the alt-right and of xenophobic sentiment, and the fallout of neoliberal government policies, our political future is at stake. These times call for the type of critical theory and praxis that gave rise to the Frankfurt School in the 1920s and to the critical ferment of the 1970s. Yet, in the face of our crises today, contemporary critical theory seems disarmed.
Critical theory is in disarray because of a wave of anti-foundational challenges in the 1960s that shattered the epistemological foundations of the Frankfurt School. The …
Do The Ends Justify The Means? Policing And Rights Tradeoffs In New York City, Amanda Geller, Jeffrey Fagan, Tom R. Tyler
Do The Ends Justify The Means? Policing And Rights Tradeoffs In New York City, Amanda Geller, Jeffrey Fagan, Tom R. Tyler
Faculty Scholarship
Policing has become an integral component of urban life. New models of proactive policing create a double-edged sword for communities with strong police presence. While the new policing creates conditions that may deter and prevent crime, close surveillance and frequent intrusive police-citizen contacts have strained police-community relations. The burdens of the new policing often fall on communities with high proportions of African American and Latino residents, yet the returns to crime control are small and the risks of intrusive, impersonal, aggressive non-productive interactions are high. As part of the proffered tradeoff, citizens are often asked to view and accept these …
Social Capital And Academic Achievement Of African American Male High School Students, Sabreen Ayesha Mutawally
Social Capital And Academic Achievement Of African American Male High School Students, Sabreen Ayesha Mutawally
Walden Dissertations and Doctoral Studies
Although more researchers have focused on academic deficits of male African American students, it is also important to understand the social factors that contribute to those who perform at a proficient level. Drawing on social capital theory as forwarded by Coleman and Putnam, this qualitative case study of 3 African American male high school students examined how their parent(s), teacher, mentor, peer or sibling, and pastor or community leader influenced the creation of social capital surrounding the students' academic achievement. Interview protocols and research interview instruments were developed and used to collect data from a total of 16 research participants, …
College Rotc Cadets' Perceptions Of Gender Fairness With Selective Service Registration, Barrett Peavie
College Rotc Cadets' Perceptions Of Gender Fairness With Selective Service Registration, Barrett Peavie
Walden Dissertations and Doctoral Studies
The U.S. Selective Service System currently excludes women from the talent pool based upon the DoD's 1981 ban on women in direct combat. The DoD has removed the exclusion and has implemented a gender-neutral policy standard for assignments. However, there appears to be a misalignment of national security policy as it relates to gender fairness that impacts Reserve Officer Training Corps (ROTC) participants in particular. Using Durkheim's functionalism theory as the theoretical foundation, the purpose of this phenomenological study was to examine institutional differences in policies regarding justice and gender among ROTC participants who are between 18 and 26 years …
A Grounded Theory Of Millennials Job-Hopping, Deborah L. Rivers
A Grounded Theory Of Millennials Job-Hopping, Deborah L. Rivers
Walden Dissertations and Doctoral Studies
Corporations are finding it challenging to attract and retain the top talented Millennials. Their frequent job-hopping is costing the U.S. economy $30.5 billion annually despite corporations' best efforts to retain them. The central research question concerns the decision-making process that Millennials use to decide whether to job-hop or stay with an organization. The purpose of this qualitative study was to develop a theory that explains the Millennials' process for deciding whether to job-hop or stay with an organization. The conceptual framework for this grounded theory research is generational theory, Herzberg's hygiene and motivational factors, and psychological contract theory. The data …
Perceptions Of Word-Of-Mouth Referral Programs On Recruiting Clients, Jean Louise Goers
Perceptions Of Word-Of-Mouth Referral Programs On Recruiting Clients, Jean Louise Goers
Walden Dissertations and Doctoral Studies
Abstract
Word-of-mouth (WOM) personal referrals are more efficient and influential than other forms of advertising; however, there is a lack of information regarding the value of referral programs. The purpose of this qualitative case study was to explore the perceptions of business owners, staff, and customers of alternative health care organizations in a Midwestern U.S. state about efficient referral strategies, measuring the effect of those strategies, and motivations of consumers to make referrals. Maslow's hierarchy of needs theory of motivation and customer decision-making theories provided the conceptual framework. The research questions addressed how industry leaders perceived and ranked referral strategies …
Exploring Relationships Of Meaning, Co-Occurring Diagnoses, And Attitudes About Substances, Misty Grant
Exploring Relationships Of Meaning, Co-Occurring Diagnoses, And Attitudes About Substances, Misty Grant
Walden Dissertations and Doctoral Studies
It is increasingly important to understand the factors associated with individuals struggling with addiction and their quality of life, especially with those struggling with co-occurring diagnoses (CODs). The purpose of this study was to explore the extent to which meaning, and CODs of anxiety and depression predict an individual's attitudes and beliefs about addiction among persons receiving treatment for substance use disorders (SUDs). The theoretical foundation used to guide this study was logotherapy, which emphasizes the importance of increasing meaning in life through choices, while also centering on being able to find meaning in all situations. A cross-sectional correlation design …

Introduction To Jesuit Pedagogy In Colonial Brazil. Humanist Education And The Ratio Studiorum, Karl M. Lorenz
Education Faculty Publications
In 1599 the Society of Jesus approved the Ratio atque Institutio Studiorum Societatis lesu (Method and System of the Studies of the Society of Jesus). The document outlined policies and procedures on the administration, curriculum and teaching practices in its educational institutions in Europe and abroad. Part of the Ratio detailed a secondary program of studies in classical languages and literature. The subject of this study is the program of humane letters and the focus of the analysis is the professional behavior of the Jesuit teacher responsible for its implementation. This paper identifies the actions that a Brazilian Jesuit would …
Revisiting Revocation Upon Divorce?, Naomi R. Cahn
Revisiting Revocation Upon Divorce?, Naomi R. Cahn
GW Law Faculty Publications & Other Works
In an increasing number of states, divorce presumptively renders an ex-spouse ineligible to benefit from the testator’s will. Divorce may also impact other revocable dispositions in favor of the ex-spouse and exclude the ex-spouse’s family members from benefitting in any way from the decedent’s death. Revocation upon divorce statutes have become more common as divorce itself has become more common, and courts have been quite rigorous in interpreting the statutes, creating an almost irrevocable presumption of revocation. By contrast, other countries vary in their approaches to the effect of a divorce on testamentary and nonprobate transfers to an ex-spouse and …

Government officials like President Donald J. Trump and Maryland Governor Larry Hogan are increasingly using popular social media sites like Twitter and Facebook to connect and interact with their constituents and to solicit public comment on matters of public importance – whether on officially-designated government platforms (like https://www.facebook.com/GovLarryHogan/) or on unofficial platforms used for the same purposes. In recent years, government officials have increasingly turned to social media platforms like Twitter and Facebook in place of (and in addition to) actual town halls and other real-space forums to solicit public participation in policy formulation and to engage with their constituents. …
Sexism In The 'Bathroom Debates': How Bathrooms Really Became Separated By Sex, W. Burlette Carter
Sexism In The 'Bathroom Debates': How Bathrooms Really Became Separated By Sex, W. Burlette Carter
GW Law Faculty Publications & Other Works
This article challenges two widely-embraced theories about how public intimate spaces (e.g., toilets, locker rooms, showers, etc. hereinafter called "bathrooms") first became separated by sex. The first challenged theory claims that the very first instance of sex-separation in public bathrooms occurred in 1739 at a ball held in a restaurant in Paris. Under this first view, sex-separation first emerged as a sign of upper-class gentility and elitism. The second challenged theory argues that a consistent practice of differentiating bathrooms by sex did not emerge until the late nineteenth century. According to this view, bathroom sex-separation was imposed when authorities overreacted …

Looking The Part: An Examination Of Longitudinal Gender Presentation Among Children With Gay, Lesbian, And Heterosexual Adoptive Parents, Samuel T. Bruun
Looking The Part: An Examination Of Longitudinal Gender Presentation Among Children With Gay, Lesbian, And Heterosexual Adoptive Parents, Samuel T. Bruun
Theses and Dissertations--Psychology
Gender presentation, appearing in a way that fits social expectations of one’s gender role, represents one of the most obvious ways in which one’s gender identity becomes salient to others. This quality is especially relevant to note given the continued controversy surrounding children’s gender role development when raised by non-heterosexual parents. The current study is an examination of how gender presentation develops in adopted children with lesbian, gay, and heterosexual parents across two time points (Wave 1: N = 106, Mage = 36.07 months; Wave 2: N = 90, Mage = 8.34). Children’s gender presentation was analyzed using …

Publications and Research
Global integration of information in the brain results from complex interactions of segregated brain networks. Identifying the most influential neuronal populations that efficiently bind these networks is a fundamental problem of systems neuroscience. Here, we apply optimal percolation theory and pharmacogenetic interventions in vivo to predict and subsequently target nodes that are essential for global integration of a memory network in rodents. The theory predicts that integration in the memory network is mediated by a set of low-degree nodes located in the nucleus accumbens. This result is confirmed with pharmacogenetic inactivation of the nucleus accumbens, which eliminates the formation of …

Re-Evaluating The Demise Of The Average, Ordinary, Reasonable Person: Unintended Consequences In The Law Of Nuisance, George P. Smith Ii, William P. Lane
Scholarly Articles
This Article advocates for a wider pleading use of the tort of nuisance—this, because of the unresolved complexities in the doctrine of causation which continue to plague an effective use of negligence. The confusing awkwardness or, perhaps, the actual demise, of the notion of an average, ordinary, reasonable person so essential to improving negligent wrongdoing has caused aggravation over the years and, indeed, given rise to a state of torbidity.
The judiciary can more easily resolve this evidentiary quagmire by shifting its judicial attention and analysis to the tort of nuisance. With alarming social indicators and statistical projections, confirming the …

The Relevance Of Extracurricular Activities For Citizenship: Why Cutting Budget For Student Associational Activity Is A Bad Policy, Jason A. Laker, Tomaž Deželan, Domen Kos

Universities are tasked with providing rigorous education and training for successful entry into disciplinary and professional fields. Their instrumental roles are situated within broader commitments to political communities through cultural stewardship. As such, the process of socializing students with the knowledge, skills, and dispositions of democratic citizenship is a complementary and acute obligation of institutions of higher education. Student Associations arguably serve as strategic enablers of this key responsibility through their unique identities as laboratories of shared governance. When students participate in co-creating their educational and community experiences, the dividends for learning and development escalate. The deliberative processes and activities …

Scientific Representation And Human Action, Brandon Boesch
Scientific Representation And Human Action, Brandon Boesch
Theses and Dissertations
Increasingly, many philosophers of science agree that an account of representation in science must include an irreducible reference to the intentions, actions, and agency of a scientist. Though these pragmatic accounts of scientific representation have numerous advantages over alternatives, very little has been said about the reference to agency found within. My dissertation uses work from the philosophy of action to fill in some of the missing details, offering a better foundation and more complete picture of the nature of representation in science. I begin with an overview of the literature in an encyclopedia article. I then argue for the …
The Importance Of Outcome Fairness: Revisiting The Role Of Distributive Justice, Kyle Mclean
The Importance Of Outcome Fairness: Revisiting The Role Of Distributive Justice, Kyle Mclean
Theses and Dissertations
Distributive justice, or the perceived fairness of outcomes, has played a minimal role in research into procedural justice and legitimacy in policing. However, allegations of racial bias that have contributed to the present legitimacy crisis in policing are more consistent with the concept of distributive justice than procedural justice. As such, the present study attempts to re-orient distributive justice within policing research. This study proposes that individuals infer the fairness of outcomes from the treatment that they receive from police officers. These judgments about outcome and treatment then combine to influence individuals’ perceptions of the legitimacy of police. In addition …
Teaching Musically: Incorporating Dalcroze Pedagogy Into Flute Instruction For The Elementary-Age Student, Emily M. Stumpf
Teaching Musically: Incorporating Dalcroze Pedagogy Into Flute Instruction For The Elementary-Age Student, Emily M. Stumpf
Theses and Dissertations
The current practice of flute pedagogy for the elementary-age student is often focused on skill-building: finger technique, tone development, and note-reading and rhythm skills. Often the teacher will delve into concepts of musicianship only after the student develops a high level of technical skill. I have found it is possible to include musical concepts such as expressive playing, developing an internal sense of rhythm, and improvisation at all stages of the learning process. When the flute teacher functions as the initiator of an aesthetic experience, the development of musicianship becomes just as important as skill-building.
The Dalcroze philosophy of music …

Breaking The Silence: Extending Theory To Address The Underutilization Of Mental Health Services Among Chinese Immigrants In The United States, Jo-Yun Queenie Li
Theses and Dissertations
Mental health services underutilization has been a prevalent issue in Chinese immigrant community in the United States. Using a nation wide survey of 445 Chinese immigrants in November 2017, this study investigates the effects of cognitive barriers (i.e., acculturation levels) and affective obstacles (i.e., mental illness stigma) on Chinese immigrants’ perceptual, attitudinal, and behavioral responses toward mental health services, by combining situational theory of problem solving and the theory of planned behavior. This study also examines the effects of mainstream and ethnic media use on acculturation and perceived stigma. Findings provide empirical support for the combined model, showing that all …

Making Cents Of It: How The Focus On Financial Aid By Selective Universities May Not Be Enough To Attract More Low-Income, High-Achieving Students, Troy A. Mothkovich
Theses and Dissertations
Most low-income, high-achieving students in the United States neither attend nor apply to selective universities despite research that shows that they are just as likely as their high-income peers to succeed if they do apply to those schools. Despite the fact that many universities have begun offering substantial financial aid packages that would often make it cheaper to attend a selective private university than a state school, low-income, high-achievers tend not to apply to selective universities. Researchers have carried out many quantitative studies testing possible variables that could influence these students’ college application decisions. However, there has been a lack …

From Rhetoric To Response: Climate Change, Conflict, And Development In Karamoja, Uganda, Daniel Abrahams
Theses and Dissertations
This dissertation addresses the broad question: How do the discourses of climate change and conflict travel across time and space to become policy, programming, and ultimately a development initiative that exist on the ground? To answer this question, I broke the research into three separate papers. The first examines how the US policy community approaches, understands and seeks to address the discourses of climatesecurity. The second examines the ways in which climate change affects conflict outcomes in Karamoja, Uganda. And the third, using the efforts of Mercy Corps in Karamoja as a case study, examines the realities and opportunities in …

Aporetic Rhetoric: The Use Of Uncertainty In Healthcare Contexts, Adam S. Lerner
Theses and Dissertations
This project examines how uncertainty is rhetorically deployed in healthcare contexts. Investigating four major healthcare contexts, I study how different forms of uncertainty produce distinct rhetorical effects and consequences. In Chapter 1, I explore how the haphazard use of Agent Orange during the Vietnam war makes it difficult for veterans to prove their exposure to this deadly chemical. In Chapter 2, I examine the rhetorical strategies of mental illness skeptics and denialists, looking at how each deploys uncertainty in different and related ways. In Chapter 3, I investigate the intersection between design, emotion, and uncertainty as it appears in the …

Translating Slavery As Told To My Daughter, Victoria L.A. Carvelli
Theses and Dissertations
I am translating an excerpt of the work L’esclavage raconté à ma fille, by the French Guianese politician Christiane Taubira. A former Minister of Justice of France, Taubira is famous for her legislative work in recognizing slavery as a crime against humanity and instituting national educational efforts on the subject. The book is an exposition of the history of slavery, set in a storytelling, question-and-answer style, which has the merit of bringing a conversational and accessible aspect to a difficult topic.
I chose this work at the recommendation of one of my professors, and when I was unable to find …
