The Origins (And Fragility) Of Judicial Independence, Tara Leigh Grove

Articles

The federal judiciary today takes certain things for granted Political actors will not attempt to remove Article III judges outside the impeachment process they will not obstruct federal court orders and they will not tinker with the Supreme Court's size in order to pack it with likeminded Justices And yet a closer look reveals that these "selfevident truths" of judicial independence are neither selfevident nor necessary implications of our constitutional text structure and history This Article demonstrates that many government officials once viewed these courtcurbing measures as not only constitutionally permissible but also desirable and politically viable methods of "checking" …

Government Standing And The Fallacy Of Institutional Injury, Tara Leigh Grove

Articles

There is a new plaintiff in town In cases involving the Affordable Care Act the Defense of Marriage Act and partisan gerrymandering government institutions have gone to federal court to redress "institutional injuries" "” that is claims of harm to their official powers or duties Jurists and scholars are increasingly enthusiastic about these lawsuits arguing for example that the Senate should have standing to protect its power to ratify treaties that the House of Representatives may sue to preserve its role in the appropriations process and that the President may go to court to vindicate his Article II prerogatives This …

Criminalizing Battered Mothers, Courtney K. Cross Jan 2018

Criminalizing Battered Mothers, Courtney K. Cross

Articles

How a domestic violence survivor responds to the abuse she is experiencing depends on many factors. Some critical considerations include her access to resources, desire to stay in her relationship, and assessment of her own safety. Criminal and civil court systems place enormous pressure on survivors to separate from their abusive partners. Not only are survivors with children pressured to leave, they are punished when they stay. That punishment can come in any combination of diminished custody rights, limited parental rights, and incarceration. Yet a survivor who flees with her children is not immune to these same consequences: if she …

Searching The Internet To Estimate Deer Population Trends In The U.S., California, And Connecticut, G. Webb Jan 2018

Searching The Internet To Estimate Deer Population Trends In The U.S., California, And Connecticut, G. Webb

Faculty Research, Scholarly, and Creative Activity

Information for decision making may be publicly available, but costly to obtain. As an experiment in environmental scanning, the internet was searched on a daily basis over several years to collect information and provide analysis related to decisions on deer management. The process discovered that, contrary to common assumptions, the U.S. deer population has apparently been falling since about the year 2000 based on analysis of available state data that had not been aggregated. In some cases, state population estimates were created using standard procedures on available data. Results indicate that differences in survey methods appear to be relatively constant …

Validation Of Multisource Feedback In Assessing Medical Performance: A Systematic Review, Sag Stevens, J Read, R Baines, A Chatterjee, J Archer

Peninsula Medical School

Introduction Over the past ten years, a number of systematic reviews have evaluated the validity of multisource feedback (MSF) to assess and quality assure medical practice. The purpose of this study is to synthesise the results from existing reviews to provide a holistic overview of the validity evidence. Methods This review identified eight systematic reviews evaluating the validity of MSF published between January 2006 and October 2016. Using a standardised data extraction form, two independent reviewers extracted study characteristics. A framework of validation developed by the American Psychological Association (APA) was used to appraise the validity evidence within each systematic …

Beyond The Tipping Point: Modifying The Five C'S To Empower Transgender And Gender Expansive Youth, Jonah De Chants, Heather Kennedy, Yolanda Anyon

Faculty Research, Scholarly, and Creative Activity

Transgender people have entered an unprecedented moment of visibility in American society and across the globe. However, transgender and gender expansive youth remain vulnerable to family rejection, harassment at school, and discrimination in healthcare and employment. Positive Youth Development (PYD) is an established framework for strengths-based practice with young people that is focused on helping youth develop the skills they need to become healthy, productive adults. In this manuscript, we reconceptualize the 5 C's of PYD to address the unique needs and experiences of transgender and gender expansive youth. We also provide specific guidance for empowering service providers to help …

The aim of Study 2 was to develop the UKBTAT (UK Bilingual Toddlers Assessment Tool), the first screening tool for assessing the vocabulary size of bilingual 2-year-olds, in this case learning British English and one of the 13 target Additional Language. The aim of Study 3 was to establish the reliability of UKBTAT for bilingual children learning British English and any other non-target Additional Language. Norms for bilingual vocabulary in English were obtained through regression equations in linear mixed models, using variables shown to be predictive of comprehension and production in the previous analyses (Chapter 3). Similarly, norms for the …

Effects Of Superficial Heating And Insulation On Walking Speed In People With Hereditary And Spontaneous Spastic Paraparesis: A Randomised Crossover Study., Amanda L. Denton, Alan D. Hough, Jennifer A. Freeman, Jonathan F. Marsden

School of Health Professions

OBJECTIVES: Cooling of the lower limb in people with Hereditary and Spontaneous Spastic Paraparesis (pwHSSP) has been shown to affect walking speed and neuromuscular impairments. The investigation of practical strategies, which may help to alleviate these problems is important. The potential of superficial heat to improve walking speed has not been explored in pwHSSP. Primary objective was to explore whether the application of superficial heat (hot packs) to lower limbs in pwHSSP improves walking speed. Secondary objective was to explore whether wearing insulation after heating would prolong any benefits. METHODS: A randomised crossover study design with 21 pwHSSP. On two …

School of Health Professions

BACKGROUND: A wide variety of interventions exists in physical therapy (PT), but knowledge about their use across different geographical regions is limited. This study investigated the use of PT interventions in people with multiple sclerosis (MS) across Europe. It aimed to determine whether regions differ in applying interventions, and explore whether factors other than regions play a role in their use. METHODS: In an online cross-sectional survey, 212 respondents from 115 European workplaces providing PT services to people with MS representing 26 countries (four European regions) participated. Cluster analysis, Pearson Chi-squared test and a Poisson regression model were used to …

Creativity And Cognitive Control: Behavioral And Erp Evidence That Divergent Thinking, But Not Real-Life Creative Achievement, Relates To Better Cognitive Control., Darya L. Zabelina, Giorgio Ganis

School of Psychology

Two studies used event-related potentials (ERPs) to examine whether and how divergent thinking and creative achievement are linked to attentional flexibility and cognitive control as indexed by response times and by the amplitude of the anterior N2 ERP component. Both experiments used an oddball paradigm in which participants viewed hierarchical letter stimuli and identified target letters in frequent and rare target trials. The successful identification of targets required attentional flexibility when switching levels of attention (from the frequent global to the rare local attentional level, or vice-versa). Divergent thinkers showed smaller switching times on rare target trials, indicating higher levels …

Smiles In Face Matching: Idiosyncratic Information Revealed Through A Smile Improves Unfamiliar Face Matching Performance, Mila Mileva, A. Mike Burton

School of Psychology

Unfamiliar face matching is a surprisingly difficult task, yet we often rely on people's matching decisions in applied settings (e.g., border control). Most attempts to improve accuracy (including training and image manipulation) have had very limited success. In a series of studies, we demonstrate that using smiling rather than neutral pairs of images brings about significant improvements in face matching accuracy. This is true for both match and mismatch trials, implying that the information provided through a smile helps us detect images of the same identity as well as distinguishing between images of different identities. Study 1 compares matching performance …
