Challenging The Internet, The Predator Of Libraries, Sandip Das, Shiv Shakti Ghosh
Library Philosophy and Practice (e-journal)
The internet with its growing wings is slowly shadowing the library. It is true that the internet has brought a revolutionary change in the way information is dealt with, but the internet has also brought some perils with it. Throughout the ages, libraries have been considered as the bank of knowledge. But nowadays this faith has been challenged quite unreasonably. The evil side of the internet has manifested itself in the form of fake, false, manufactured news and information. At this juncture, it is important to burst the myth of the internet as the sole distinguished source of information and …

Library Philosophy and Practice (e-journal)
In this era of Cyberage, the information needs of the users have grown so enormously that no individual library can fulfill their information needs on its own. This has urged the need for cooperation between libraries and information centers for sharing of available resources and information through networking. Thus consortia are considered as a vital move towards library cooperation. A library consortium combines the purchasing power of its members and reduces the repetitive, laborious process of acquiring resources from each member. In a short span of time, numerous consortia have been formed all over the globe. As more and more …

The article highlights how librarians and faculty can collaborate to prepare pre-service teaching students to select culturally appropriate juvenile books. Results show how the students’ misconceptions or poor knowledge about multiculturalism impact their decision in the selection of material. This case study approaches the importance of the connection between textual and visual content in juvenile books, and how a collaborative approach between a faculty member and an academic librarian can improve the acquisition of lifelong learning skills.

The protection of copyright is an obligation of nations in order to promote and encourage innovation and creativity The copyright law gives the owner of copyrighted work the exclusive right to control the reproduction of copyrighted works. This right, however, does not bestow on the copyright owner an absolute monopoly to control access to copyrighted information. The paper highlighted that illegal photocopying practice of copyrighted work is damaging to the rights of owners of copyrighted materials as it stifles creativity, innovation and development, and the introduction of the doctrine of ‘fair use’ is aimed at balancing the exclusive rights of …

Shareholder Voting And The Symbolic Politics Of Corporation As Contract, Matthew T. Bodie, Grant M. Hayden
Shareholder Voting And The Symbolic Politics Of Corporation As Contract, Matthew T. Bodie, Grant M. Hayden

American corporations are structured in such a way that shareholders, and shareholders alone, have the right to vote in all significant corporate decisions. Over the years, this exclusive shareholder franchise has been supported by an ongoing procession of justifications. But as those arguments have fallen by the wayside, shareholder primacists have circled back and latched upon a final argument for the special voting status of shareholders, arguing that this fundamental feature of corporate governance is the product of the set of freely-bargained-for agreements among all corporate constituents. Because this set of agreements reflects the preferences of all parties to the …

Teaching The Transformative Fourteenth Amendment, Joel K. Goldstein

If the constitutional law casebooks are a reliable guide, most teach the Fourteenth Amendment, like other parts of the Constitution, by presenting separately the various doctrinal topics it has raised.[1] The principal clauses of the Amendment, or really those in the second sentence of Section 1[2]—the Equal Protection, Due Process, and Privileges or Immunities Clauses—are generally extracted from its text and classes are structured around the leading cases decided under each and the resulting doctrine. Cases under the Equal Protection or Due Process Clause may be further separated. Based on the class of claimants, for instance, the cases involving racial …

Keeping The Rule Of Law Simple: Comments On Gowder, The Rule Of Law In The Real World, Chad Flanders

Let me start by just stating my experience of reading The Rule of Law in the Real World1 because it will help make sense of the structure of my remarks. The first third of the book: I am utterly convinced, even blown away, by the elegance and persuasiveness of the argument and the analysis; even when there is merely a summary, I am helped and bettered by it. The second third of the book: I am inclined, based on the enormous goodwill generated by the first third of the book to accept-almost uncritically-the historical discussion and the conclusions drawn …

I want to begin by sketching a point of view that, at best, makes only an implicit showing in Tebbe's persuasive, thoughtful, and challenging book. That viewpoint looks something like this:2 religion is unique, not just in substance but also in form. Start with substance: religion is a way of looking at the world as not exhausted by secular values or concerns; for money, prestige, or for "utility" broadly construed, or even exhausted by morality. Religion asks, repeatedly of those who believe in it, to do seemingly impossible things. It counts on miracles. Religion sees the world and our lives, …

Under Attorney General Jeff Sessions, the U.S. Department of Justice (DOJ) has inactivated or rescinded numerous rules and guidelines issued by prior administrations, sometimes attracting considerable public attention in the process. Little noticed, however, was a decision by the DOJ on December 26, 2017, to formally withdraw four Advance Notices of Proposed Rulemaking related to Titles II and III of the Americans with Disabilities Act (ADA), including rulemaking that addressed making medical diagnostic equipment accessible to people with disability. For now, this step halts efforts on a national level to ensure accessibility of such equipment, which includes exam tables, weight …
