Protesting On Bended Knee: Race, Dissent And Patriotism In 21st Century America, Eric Burin

Protesting on Bended Knee eyes the modern crusade for racial equality through the prism of the demonstrations associated with Colin Kaepernick, a professional football player who in 2016 began kneeling during the national anthem to draw attention to discrimination and injustice. Sensitivity Of Offshore Tropical Cyclone Wave Simulations To Spatial Resolution In Wave Models, Xuanyu Chen, Isaac Ginis, Tetsu Hara

This study investigated and quantified the sensitivity of tropical cyclone (TC) wave simulations in the open ocean to different spatial resolutions (1/3°, 1/6°, 1/12° and 1/24°) using two wave models, WAVEWATCH III (WW3) and Simulating WAves Nearshore (SWAN). Six idealized TCs of different radii of maximum winds (25 km and 50 km), and of different translation speeds (3 m/s, 6 m/s and 9 m/s) were prescribed to force these two wave models. Results from both models show that the coarsest resolution (1/3°) introduces significant errors in both the significant wave height (SWH) and the mean wavelength. Moreover, results reveal that …

Requires that individuals sentenced for certain non-serious, non-violent, and nonsexual felonies after November 3, 2020 serve their time in state prison—rather than in county jail, as 2011 law requires. Requires that individuals released on parole for these low-level felonies after November 3, 2020 be supervised by state parole authorities rather than county probation departments. After November 3, 2020, prohibits courts from suspending the concluding portion of the prison sentence of individuals convicted of these low-level felonies and placing such felons on mandatory supervision by county authorities. Repeals provision in the Racial and Identity Profiling Act of 2015 that requires state and local agencies that employ peace officers to collect specified data on all stops and searches, including the reason for the stop or search, and perceived race, ethnicity, gender, and age of person stopped, and to report such data to the Attorney General annually. Reduces transparency by eliminating mandated data collection about stops and searches used by Attorney General, other law enforcement officials, the public, and researchers to identify and prevent racial and identity profiling. Law By Non-Lawyers: The Limit To Limited License Legal Technicians Increasing Access To Justice, Rebecca M. Donaldson

For the first time in the American legal profession, non-lawyers can openly, independently, ethically, and legally engage in activities recognized by bar associations as the practice of law. In 2012, the Washington Supreme Court passed Admission and Practice Rule 28 (APR 28), establishing the profession’s first paraprofessional licensing scheme that allows non-lawyers to give legal advice. The process authorizes qualified non-lawyers to provide legal advice without the supervision of a lawyer. Washington’s Supreme Court intends for Limited License Legal Technicians, or “LLLTs” as they are known, to increase access to justice by responding to the unmet civil legal needs of …

This Comment explores the current constitutional discourse of sanctuary laws and compares their various components. Part I provides background on the basic policy components of sanctuary laws and modern policies. Part II explores and compares the substantive legal and political value of sanctuary laws. This section will first assess the impact of sanctuary policies on existing immigration and constitutional law. In doing so, specific sanctuary jurisdictions involved in litigation, Seattle, San Francisco, and Chicago, and their likelihood of withstanding preemption under existing doctrine will be compared. The impact sanctuary laws may have on the Tenth Amendment will next be discussed. …

Voila! Taking The Judge Out Of Divorce, Margaret Ryznar, Angélique Devaux

This Article examines the possibility of non-judicial divorce in the United States based on the French model. Part I begins by examining the recognition of divorce by agreement of the parties in France. Part II analyzes the judicial role in American divorces, and whether it bars either domestic non-judicial divorce or recognition of foreign non-judicial divorce. Part III undertakes a comparative analysis, concluding that the United States may be amenable to non-judicial divorces that occur not only abroad but, eventually, within its own borders.

President Trump’s nomination of jurist Brett Kavanaugh to the U.S. Supreme Court presents significant, potential changes on health law and policy issues. If confirmed by the U.S. Senate, Kavanaugh’s approaches as a federal appellate court judge and scholar could literally shift the Court’s balance on consequential health policies. Judge Kavanaugh has disavowed broad discretion for federal agency authorities, cast significant doubts on the constitutionality of the Affordable Care Act, and narrowly interpreted reproductive rights (most notably abortion services). He has supported gun rights pursuant to the Second Amendment beyond U.S. Supreme Court recent interpretations. His varying positions related to consumer …

The applications of Big Data continue to expand, due to the many possibilities and unprecedented insights it offers to people, organizations, and communities. However, Big Data poses serious challenges as well, including challenges to the privacy and security of individuals and their data. This paper considers how to best address one concern related to Big Data: the social problems that the pervasiveness of data collection, analysis, and storage create with regard to individuals' ability to control their own data.
