Law enforcement officials have begun to use the connection of cell phones as a major tool in their investigations and subsequent apprehension of criminal suspects. One such tool officials are using is a cell-site simulator, otherwise known as a “Stingray.” This device is currently being used by law enforcement to identify and track cell phones of criminal suspects in criminal investigations. These devices, posing as cell towers, capture information relayed from a suspect’s cell phone and can be used by law enforcement to track and locate the cell phone being used by the suspect. In this study, I will look at the problem from a health communication perspective with a focus on the linkage between the theories of attitude and behavioral change in the health communication field and the application of mine-risk education programs in Vietnam. This research will contribute to the field of risk education, specifically in communication campaigns to save lives and limbs in landmine affected communities. วิทยานิพนธ์ฉบับนี้มุ่งศึกษาถึงการรับรองและคุ้มครองสิทธิในที่อยู่อาศัยที่เพียงพอตามกฎหมายไทย ทั้งในมิติด้านกฎหมาย และด้านนโยบาย โดยจะเป็นการศึกษาเปรียบเทียบกับประเทศฟิลิปปินส์ และมาเลเซีย จากการศึกษาพบว่า สิทธิในที่อยู่อาศัยที่เพียงพอเป็นรากฐานสำคัญที่จะทำให้มนุษย์สามารถดำรงชีวิตได้อย่างมีเกียรติ และเป็นรากฐานที่จะทำให้มนุษย์สามารถอุปโภคสิทธิและเสรีภาพอื่น ๆ อย่างไรก็ตาม ทั้งไทย ฟิลิปปินส์ และมาเลเซีย ไม่มีการรับรองสิทธิในที่อยู่อาศัยที่เพียงพอไว้ในรัฐธรรมนูญ แต่มีกฎหมายระดับพระราชบัญญัติ และรัฐบัญญัติที่ส่งเสริมองค์ประกอบสิทธิในที่อยู่อาศัยที่เพียงพอในบางประการ และทั้งสามประเทศก็มิได้ให้น้ำหนักความสำคัญกับองค์ประกอบของสิทธิในที่อยู่อาศัยที่เพียงพอทั้ง 7 องค์ประกอบอย่างเท่าเทียมกันโดยแตกต่างกันไปตามบริบทของแต่ละประเทศ ซึ่งสำหรับไทยให้ความสำคัญกับการเข้าถึงที่อยู่อาศัยของผู้มีรายได้น้อย และไม่มีกฎหมายหรือมาตรการใด เพื่อส่งเสริมให้สิทธิดังกล่าวได้รับการปฏิบัติอย่างองค์รวม ในการนี้ เพื่อส่งเสริมการรับรองและคุ้มครองสิทธิในที่อยู่อาศัยที่เพียงพอ จึงเห็นสมควรออกกฎหมายกลาง กล่าวคือ พระราชบัญญัติการส่งเสริมสิทธิในที่อยู่อาศัยที่เพียงพอ เพื่อส่งเสริมการรับรองและคุ้มครองสิทธิดังกล่าว และเป็นแนวทางไปสู่การพิจารณารับรองสิทธิในที่อยู่อาศัยที่เพียงพอในรัฐธรรมนูญของไทยต่อไปในอนาคต

Drought is a recurring—and likely increasing—challenge to water rights administration in western states under the prior appropriation doctrine, where “first in time” senior rights are often allocated to non-survival uses such as commercial agriculture, rather than to drinking water supply for cities. While states and localities facing severe drought have used a variety of voluntary programs to reallocate water, these programs by their very nature cannot guarantee that water will in fact be redistributed to the uses that best promote public health and community survival. In addition, pure market solutions run the risk that “survival water” will become too expensive …

As the investigation into President Trump's campaign ties to Russia grows increasingly intense, it is critical to understand how much control the President has over the Attorney General and the Department of Justice. Some critics claim that the President has absolute power to direct federal prosecutors and control their decisions. The President and his lawyers, joined by several scholars, take this claim one step further by arguing that the chief executive could not be guilty of obstruction of justice because his control over all prosecutorial decisions is absolute. Research on bail practices has shown that most of the people are in jail because of their inability to pay bail set by the court. A 2016 study by the Vera Institute of Justice concluded that the use of the cash bail system disproportionately impacts poor black people in Orleans Parish Prison, the entity that serves as the principal driver of the mass incarceration. With a focus on poor black people in Orleans Parish Prison, the experiences of the impact of the cash bail system on poor black women are still missing.

In July 2017, a group of five Florida teenagers taunted a drowning disabled man while filming his death on a cell phone. In the video, the teenagers laughed and shouted harsh statements like "ain’t nobody finna to help you, you dumb bitch." At the moment the man’s head sank under the water for the very last time, one of the teenagers remarked: "Oh, he just died" before laughter ensued. None of the teenagers helped the man, nor did any of them report the drowning or his death to the authorities.

This Article addresses the special interrogation protections afforded exclusively to the police when they are questioned about misconduct. In approximately twenty states, police officers suspected of misconduct are shielded by statutory Law Enforcement Officer Bills of Rights. These statutes frequently limit the tactics investigators can use during interrogations of police officers. Many of these provisions limit the manner and length of questioning, ban the use of threats or promises, require the recording of interrogations, and guarantee officers a reprieve from questioning to tend to personal necessities. Punishing Criminals For Their Conduct: A Return To Reason For The Armed Career Criminal Act, Sheldon Evans

For over twenty-five years, the Armed Career Criminal Act has produced inconsistent results and has taxed judicial economy perhaps more than any other federal sentencing mechanism. This recidivist sentencing enhancement is meant to punish habitual criminals based on their numerous past crimes, but the Supreme Court’s application of the Act too often allows habitual criminals to escape the intended enhancement on a legal technicality. This comes as a result of the Court’s categorical approach, which punishes habitual criminal offenders based on the statutory elements of their past crimes rather than the conduct of their past crimes.

In this thesis, I will analyze five films that have a rape-revenge narrative: Ms. 45 (1981), M.F.A. (2017), I Spit on Your Grave (1978), I Spit on Your Grave (2010), and The Girl with the Dragon Tattoo (2011). I will argue that the violent actions taken by the female protagonist during her revenge against her rapist(s) serve to allow her to reclaim her agency that was stolen from her during the rape(s). I will show that the rape-revenge narrative is more diverse than it might seem, as the five films I analyze deal with rape, and responses to rape, in …

Infrastructure in the US is severely aged and outdated. This presents a seemingly paradoxical problem in the field of construction management: In order to fix and make roads and highways more safe, construction zones must become inherently less safe in the process. There is a high cost to taxpayers and drivers, as work zones experience a significant amount of crashes and fatalities each year. This article describes a participatory geographical information system (PGIS) demonstration project used as part of the stakeholder engagement efforts undertaken by the Citizen Engagement Working Group of the Hampton Roads Sea Level Rise Preparedness and Resilience Intergovernmental Planning Pilot Project. The PGIS demonstration project was conducted in the Little Creek/Pretty Lake case study area in the Hampton Roads region of southeastern coastal Virginia. PGIS served as a deliberative and participatory mechanism to obtain local knowledge from residents about the location of valued assets within the community and locations challenged by increased flooding and sea level rise. Parallel civil and criminal enforcement dominates public enforcement of everything from securities regulation to immigration control. The scholarship, however, lacks any structural analysis of how parallel enforcement differs from other types of interagency coordination. Drawing on original interviews with prosecutors, regulators, and white-collar defense attorneys, this Article is the first to provide a realistic presentation of how parallel enforcement works in practice. It builds on this descriptive account to offer an explanatory theory of the pressures and incentives that shape parallel enforcement. As a matter of constitutional doctrine, the right to keep and bear arms is coming of age. But although the doctrine has begun to mature in the decade since District of Columbia v. Heller, scholars, advocates, and judges disagree about (and sometimes simply do not know) how to characterize it.
This Article is the first comprehensive empirical analysis of post-Heller Second Amendment doctrine. Beginning with a set of more than one thousand Second Amendment challenges, we have coded every available Second Amendment opinion — state and federal, trial and appellate — from Heller up until February 1, 2016. Background: According to a 2014 report, approximately 1 in 100 American adults are incarcerated, which represents a 500% increase over the past 40 years and accounts for the largest population of prisoners in the world. Despite research that suggests incarceration is not an effective deterrent for crime, incarceration continues to increase at a historically unprecedented rate. Mass incarceration disproportionately affects communities of color. In Montana, Native Americans are overrepresented at all levels of the correctional system. In addition, Native American ex-offenders are just over twice as likely as non-Native Americans to recidivate and be returned to a correctional institution, mostly …

The court record has three components, each historically paper-based and tangible: (1) filings; (2) transcripts; and (3) exhibits. Given technology changes, filings and transcripts now are often kept as digital files. Exhibits, however, continue to be received and held by the court in tangible form. As the Internet continues to replace the brick-and-mortar store as the main place for purchasing goods, web-based companies are looking for ways to reduce the cost of delivering those goods. The use of Unmanned Aerial Vehicles, or UAVs, is one delivery method that is increasingly being used. These UAVs can be programmed with delivery routes and destinations and can complete the job while requiring limited intervention from human controllers. The Third Generation Partnership Project (3GPP) selected an in-band modem to transmit emergency data over cellular voice channel for the European Union emergency call (eCall) system. However, the road test results presented by the Harmonized eCall European Pilot project showed that the success rate of data delivery was only 71%, indicating that there is significant potential to improve its performance.

As the achievement gap between African American and Latino students and their White counterparts continues to grow, lawmakers are searching for ways to decrease the disparity. As a result, college access programs that focus on improving basic skills and strengthening academic achievement have become essential to fostering student success. With Upward Bound being one of the longest running federally funded college access programs, its success and effectiveness have been the focus of several studies. Surprisingly, very little qualitative phenomenological research exists that is solely devoted to student perceptions.
