The Intersection Between Young Adult Sentencing And Mass Incarceration, Josh Gupta-Kagan Jan 2018

The Intersection Between Young Adult Sentencing And Mass Incarceration, Josh Gupta-Kagan

Faculty Publications

This Article connects two growing categories of academic literature and policy reform: arguments for treating young adults in the criminal justice system more leniently than older adults because of evidence showing brain development and maturation continue until the mid-twenties; and arguments calling for reducing mass incarceration and identifying various mechanisms to do so. These categories overlap, but research has not previously built in depth connections between the two.

Connecting the two bodies of literature helps identify and strengthen arguments for reform. First, changing charging, detention, and sentencing practices for young adults is one important tool to reduce mass incarceration. Young …

Faculty & Staff Scholarship

Introduction: With the current hepatitis C (HCV) epidemic in the Appalachian region and the risk of human immunodeficiency virus (HIV) co-infection, there is a need for increased secondary prevention efforts. The purpose of this study was to implement routine HIV and HCV screenings in the urgent care setting through the use of an electronic medical record (EMR) to increase a provider’s likelihood of testing eligible patients.

Methods: From June 2017 through May 2018, EMR-based HIV and HCV screenings were implemented in three emergency department-affiliated urgent care settings: a local urgent care walk-in clinic; a university-based student health services center; and …

Police Executive Opinions Of Legal Regulation, Stephen Rushin, Roger Michalski Jan 2018

Police Executive Opinions Of Legal Regulation, Stephen Rushin, Roger Michalski

Faculty Publications & Other Works

By conducting a national survey, this Article empirically assesses how American police leaders perceive external legal regulation.

At various times, policymakers have decried external police regulations as too expensive, too complicated, or too difficult to apply to different factual scenarios. Critics have also alleged that police regulations change too frequently, inadequately consider input from the law enforcement community, and unduly risk the safety of officers or the broader community.

These complaints underscore an uncomfortable but unavoidable reality: efforts to regulate police behavior often require policymakers to make compromises. A rule that promotes one goal may necessarily compromise another important goal. …

Interrogation Parity, Stephen Rushin, Kate Levine Jan 2018

Interrogation Parity, Stephen Rushin, Kate Levine

Faculty Publications & Other Works

This Article addresses the special interrogation protections afforded exclusively to the police when they are questioned about misconduct. In approximately twenty states, police officers suspected of misconduct are shielded by statutory Law Enforcement Officer Bills of Rights. These statutes frequently limit the tactics investigators can use during interrogations of police officers. Many of these provisions limit the manner and length of questioning, ban the use of threats or promises, require the recording of interrogations, and guarantee officers a reprieve from questioning to tend to personal necessities. These protections, which are available to police but not to ordinary criminal suspects, create …

Law Enforcement Formal Academic Educational Hiring Requirements And Deputy Sheriff Disciplinary Issues, Chase Dennis Wetherington Jan 2018

Law Enforcement Formal Academic Educational Hiring Requirements And Deputy Sheriff Disciplinary Issues, Chase Dennis Wetherington

Walden Dissertations and Doctoral Studies

There is a lack of research as to what impacts law enforcement disciplinary issues. This is important due to the recent emphasis of officer performance and accountability. In 2008, the Southeast Sheriff's Office (SSO) increased their formal academic educational hiring requirement from a high school diploma to 60 college credits. The impact of this increase has never been analyzed. The purpose of this study was to determine through the theoretical lens of Kohlberg's 6 stages of moral development if an increase in the formal academic educational requirement influenced the number of deputy sheriff disciplinary issues. A quantitative nonexperimental study was …

Preferential Pathways For Vapor Intrusion: Site Screening And Field Sampling Of Sewers To Assess Inhalation Exposure Risks, Evan James Willett Jan 2018

Preferential Pathways For Vapor Intrusion: Site Screening And Field Sampling Of Sewers To Assess Inhalation Exposure Risks, Evan James Willett

Theses and Dissertations--Civil Engineering

Hazardous waste sites and aging wastewater infrastructure are common in the United States. There are hundreds of thousands of contaminated sites and more than a million miles of sewer pipes. Populations living close to hazardous waste sites often suffer from increased risk of adverse health effects due to exposure to contaminated environmental media. Vapor intrusion is one process by which nearby populations can be exposed to volatile organic compounds (VOCs). Aging wastewater infrastructure is important for vapor intrusion site assessments because sewer pipes can serve as preferential vapor transport pathways. Near contaminated sites, pipe deterioration allows migration of contaminants into …

A Game-Theoretic Model For Regulating Freeriding In Subsidy-Based Pervasive Spectrum Sharing Markets, Mostafizur Rahman Jan 2018

A Game-Theoretic Model For Regulating Freeriding In Subsidy-Based Pervasive Spectrum Sharing Markets, Mostafizur Rahman

Electronic Theses and Dissertations

Cellular spectrum is a limited natural resource becoming scarcer at a worrisome rate. To satisfy users' expectation from wireless data services, researchers and practitioners recognized the necessity of more utilization and pervasive sharing of the spectrum. Though scarce, spectrum is underutilized in some areas or within certain operating hours due to the lack of appropriate regulatory policies, static allocation and emerging business challenges. Thus, finding ways to improve the utilization of this resource to make sharing more pervasive is of great importance. There already exists a number of solutions to increase spectrum utilization via increased sharing. Dynamic Spectrum Access (DSA) …

Sinkhole Detection And Quantification Using Lidar Data, Amirarsalan Rajabi Jan 2018

Sinkhole Detection And Quantification Using Lidar Data, Amirarsalan Rajabi

Electronic Theses and Dissertations

The state of Florida is highly prone to sinkhole incident and formation, mainly because of the soluble carbonate bedrock which is susceptible to dissolution and groundwater recharge that causes internal soil erosions. Numerous sinkholes, particularly in Central Florida, have occurred. Florida Subsidence Incident Report (FSIR) database contains verified sinkholes with Global Positioning System (GPS) information. In addition to existing detection methods such as subsurface exploration and geophysical methods, a remote sensing method can be an alternative and efficient means to detect and characterize sinkholes with a wide coverage. the first part of this study is aimed at developing a method …

This note addresses the injustice of pretrial detention on juveniles, minors, and youths aged eighteen to twenty-one, in New York State. This note will address juveniles, aged eighteen to twenty-one, who are subject to criminal proceedings in adult criminal court and incarceration in adult criminal facilities as well as juveniles or minors below the age of criminal responsibility who are subject to juvenile delinquency proceedings and incarceration in juvenile detention facilities. So many youths are in unnecessary detentions under horrific conditions in adults and juvenile correctional facilities across the country. Serious bail reform is long overdue to provide humane …

The End Of Special Treatment For Cubans In The U.S. Immigration System: Consequences And Solutions For Cubans With Final Orders Of Removal, Lindsay Daniels

Dickinson Law Review (2017-Present)

In January 2016, former President Obama announced the end of the “Wet-Foot, Dry-Foot” Policy, which granted special immigration benefits to Cuban migrants. As part of the agreement to end this policy, the Cuban government agreed to take back its citizens with final orders of removal for criminal convictions, an action that it had refused to take for decades. This Comment will begin by exploring past and present immigration policies between the United States and Cuba, including recent developments like the normalization of relations and the impact of President Trump’s immigration policies.

This Comment will then explore possible avenues of relief …

Holding The Harmful Harmless: Lessons From Gold King Mine, Timbre Shriver Jan 2018

Holding The Harmful Harmless: Lessons From Gold King Mine, Timbre Shriver

University of Colorado Law Review

The disaster at Love Canal focused the nation's attention on hazardous waste sites left behind by years of corporate recklessness and mismanagement. To fill the regulatory gap and prevent future incidents like Love Canal, Congress passed the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). The statute not only empowers the EPA to retroactively hold parties responsible for the mismanagement of hazardous waste, but it also provides a funding mechanism-Superfund-to ensure that the most dangerous sites are cleaned up even when responsible parties cannot be found or, more likely, are insolvent. However, an often-overlooked provision in the CERCLA framework grants …

Shooting Down Oliphant: Self-Defense As An Answer To Crime In Indian Country, Adam Crepelle Jan 2018

Shooting Down Oliphant: Self-Defense As An Answer To Crime In Indian Country, Adam Crepelle

Lewis & Clark Law Review

Crime is a dire public safety problem in Indian country as Indians suffer violent crime at twice the rate of any other racial group. Indian country’s unique and confusing jurisdictional scheme combined with a shortage of police leave Indians easy targets for those looking to commit crimes. A largely unexplored answer to crime in Indian country is self-defense. This Article posits that the United States self-defense jurisprudence may make self-defense the most practical solution to crime in some parts of Indian country.

The Article discusses the history of self-defense laws and the relationship between self-defense laws and firearms. The Article …
