Using Federal Nondiscrimination Laws To Avoid Erisa: Securing Protection From Transgender Discrimination In Employee Health Benefit Plans, Bridget Schaaff Dec 2018

Using Federal Nondiscrimination Laws To Avoid Erisa: Securing Protection From Transgender Discrimination In Employee Health Benefit Plans, Bridget Schaaff

Duke Journal of Gender Law & Policy

Recent attempts to repeal the Affordable Care Act and the potential rollback of the interpretation of the protections the Act affords transgender people put transgender people at risk of being denied services and coverage for gender-affirming care. This Article provides advocates with alternative legal arguments to help employees bring claims when their employer provides a health benefit plan that discriminates on the basis of gender identity. These arguments can avoid the Employee Retirement Income Security Act’s broad preemption scheme and lack of nondiscrimination provisions. This Article proposes that, based on a narrow exception to preemption regarding the Employee Retirement Income …

Meditation On The Soles Of The Feet Practice Provides Some Control Of Aggression For Individuals With Alzheimer’S Disease, Nirbhay N. Singh, Giulio E. Lancioni, Oleg N. Medvedev, Rachel E. Myers

Faculty Articles

Alzheimer’s disease is a progressive neurodegenerative condition that affects cognition, mental and physical health, and functionality of older people. As the disease progresses from the mild to moderate stage, there is a concomitant increase in several behavioral variables, chiefly agitation, anger, and aggression. Currently, there are no evidence-based treatments for these behaviors in this population. Three individuals with moderate Alzheimer’s disease were taught an informal mindfulness practice, meditation on the Soles of the Feet (SoF), as a self-management strategy within a multiple-baseline design across participants. All three were able to learn and use the SoF practice to manage their verbal …

Gender Differences In Patient-Reported Outcomes Among Adults With Atherosclerotic Cardiovascular Disease, Joseph Salami

All Publications

Background

Atherosclerotic cardiovascular disease ( ASCVD ) accounts for approximately one third of deaths in women. Although there is an established relationship between positive patient experiences, health-related quality of life, and improved health outcomes, little is known about gender differences in patient-reported outcomes among ASCVD patients. We therefore compared gender differences in patient-centered outcomes among individuals with ASCVD.

Methods and Results

Data from the 2006 to 2015 Medical Expenditure Panel Survey, a nationally representative US sample, were used for this study. Adults ≥18 years with a diagnosis of ASCVD , ascertained by International Classification of Diseases, Ninth Revision ( ICD-9) …

Slower Alpha Rhythm Associates With Poorer Seizure Control In Epilepsy, E Abela, Ad Pawley, C Tangwiriyasakul, Sn Yaakub, Et Al

School of Psychology

Objective Slowing and frontal spread of the alpha rhythm have been reported in multiple epilepsy syndromes. We investigated whether these phenomena are associated with seizure control. Methods We prospectively acquired resting-state electroencephalogram (EEG) in 63 patients with focal and idiopathic generalized epilepsy (FE and IGE) and 39 age- and gender-matched healthy subjects (HS). Patients were divided into good and poor (≥4 seizures/12 months) seizure control groups based on self-reports and clinical records. We computed spectral power from 20-sec EEG segments during eyes-closed wakefulness, free of interictal abnormalities, and quantified power in high- and low-alpha bands. Analysis of covariance and post …

Narrating The Collapse: The Use And Limits Of A Phenomenology Of Depression, James Bodington Dec 2018

Narrating The Collapse: The Use And Limits Of A Phenomenology Of Depression, James Bodington

Philosophy ETDs

This project is an attempt to apply certain of the insights of phenomenological philosophy to the analysis of the lived experience of depression. I argue that the centering of experience in phenomenology can, and should, motivate its use in the context of the philosophical analysis of mental health, and may contribute to therapeutic aims as well. While this has been remarked upon in recent and current literature, this project motivates, engages with, augments, and challenges existing philosophical approaches to mental health and depression. I begin by surveying the existing literature, and bringing the critiques of classical phenomenology suggested by Guenther’s …

Fighting For Their Lives: Why The Marginalized Irish From The 1840s-1910 Dominated American Prizefighting, Owen Marshall Dec 2018

Fighting For Their Lives: Why The Marginalized Irish From The 1840s-1910 Dominated American Prizefighting, Owen Marshall

Honors Program Theses and Projects

One of the most recognizable figures in the world during his lifetime, heavyweight boxing champion Muhammad Ali, previously Cassius Clay and Cassius X, put his self-esteem on display with the simple declaration “I am the greatest.” This was a phrase he told himself long before he truly was the greatest, but he proved it to the world in 1964 when he defeated defending champion Sonny Liston. Upon knocking out his dangerous, violent, and cheating opponent, Ali whipped himself into a frenzy, as onlookers saw him fall over the ropes, scream at the ringside reporters who had previously doubted him, and …

The Role Of Interest Groups In Shaping U.S. Governmental Responses To Military Sexual Trauma, Patricia Ann Harnois-Church Dec 2018

The Role Of Interest Groups In Shaping U.S. Governmental Responses To Military Sexual Trauma, Patricia Ann Harnois-Church

Nursing ETDs

Military sexual trauma (MST) is a significant problem in U.S. military service branches, service academies, and National Guard units, with both immediate and longer term traumatic effects on survivors who are disproportionately female. MST includes sexual harassment or assault during military service and the ensuing consequences for physical health and psychosocial well-being of service members and veterans. The Department of Defense is committed to reducing the incidence of sexual assault and harassment among service members, encouraging victims to report, and mitigating the impact of MST. However, the estimated prevalence of sexual assault among active duty service members remains unacceptably high, …

Test Of Personal Intelligencemini-12 (Topi Mini-12): Brief Manual And Test (9th Edition), John D. Mayer, Abigail T. Panter, David R. Caruso Dec 2018

Test Of Personal Intelligencemini-12 (Topi Mini-12): Brief Manual And Test (9th Edition), John D. Mayer, Abigail T. Panter, David R. Caruso

UNH Personality Lab

Personal intelligence can be defined as the capacity to reason about personality and to use personality and personal information to enhance one’s thoughts, plans, and life experience (Mayer, 2008, p. 209). It is a “hot” intelligence in the sense of operating on information that is personally relevant and of importance to the individual.

The gold standard for measuring intelligences is through the use of ability scales. The Test of Personal Intelligence (TOPI), a 134-item ability measure, has been developed over three versions (1.0, 1.1., and 1.2) to test the existence of personal intelligence and to provide for its measurement (Mayer, …

I See What You Meant To Say: Anticipating Speech Errors During Online Sentence Processing, Matthew W. Lowder, Fernanda Ferreira Dec 2018

I See What You Meant To Say: Anticipating Speech Errors During Online Sentence Processing, Matthew W. Lowder, Fernanda Ferreira

Psychology Faculty Publications

Everyday speech is rife with errors and disfluencies, yet processing what we hear usually feels effortless. How does the language comprehension system accomplish such an impressive feat? The current experiment tests the hypothesis that listeners draw on relevant contextual and linguistic cues to anticipate speech errors and mentally correct them even before receiving an explicit correction from the speaker. In the current visual-world eye-tracking experiment, we monitored participants’ eye movements to objects in a display while they listened to utterances containing reparandum-repair speech errors (e.g., …his cat, uh I mean his dog…). The contextual plausibility of the misspoken …

Representing Outside The Box: Identity-Based Constituencies And Surrogate Representation In U.S. State Legislatures, Julia Hellwege Dec 2018

Representing Outside The Box: Identity-Based Constituencies And Surrogate Representation In U.S. State Legislatures, Julia Hellwege

Political Science ETDs

This project asks: whom do representatives seek to represent and how do they do it? Specifically, I seek to understand how marginalized state legislators define the concept of “constituency” and the implications for their legislative behavior. I argue that marginalization affects legislators through two avenues: socially through their identity, and institutionally through the proportion their identity group holds in the state legislature. I argue that when legislators are marginalized their awareness of identity and identity-based issue needs are prioritized and they will come to define group members as a salient identity constituency. Furthermore, they will seek to represent this salient …

S.O.S. Eisberg Versus S.O.S. Iceberg - Two Nations' Visualizations Of Arctic Landscapes, Kerstin Anne Aloia Dec 2018

S.O.S. Eisberg Versus S.O.S. Iceberg - Two Nations' Visualizations Of Arctic Landscapes, Kerstin Anne Aloia

English

This project is a comparison of the perspectives on Arctic nature that are featured in the 1933 films S.O.S. Eisberg and S.O.S. Iceberg. I am arguing that the director of each version was influenced by his cultural background in visualizing the relationship between Arctic nature and the white explorers that encounter it in their films. Both Arnold Fanck, who created S.O.S. Eisberg, and Tay Garnett, who created S.O.S. Iceberg, worked with the same documentary footage that was filmed at Greenland's Arctic shores, but turned it into two different films. S.O.S. Eisberg turns the Arctic into a space whose hostile forces …

Positive Behavior Supports And Interventions: Is It The Best Approach For Juneau Elementary Schools?, Bobbie Anderson Dec 2018

Positive Behavior Supports And Interventions: Is It The Best Approach For Juneau Elementary Schools?, Bobbie Anderson

Counseling

The US public educational system strives to assist students to develop the academic and social skills they will need to be competitive in the world market. A considerable obstacle to this goal is behavioral problems in schools, which disrupt important learning time for both the student who is demonstrating the behavior and for his or her peers. Additionally, current literature asserts that behavioral problems interfere in social and academic relationships, create stress for school faculty, and are linked to school failure and increased high-school dropout rates, which have a negative economic impact on both the student and community. Given the …
