The Culture Of Misdemeanor Courts, Jessica A. Roth Jan 2018

The Culture Of Misdemeanor Courts, Jessica A. Roth

Articles

The misdemeanor courts that preside over the majority of criminal cases in the United States represent the “front porch” of our criminal justice system. These courts vary in myriad ways, including size, structure, and method of judicial appointment. Each also has its own culture – i.e., a settled way of doing things that reflects deeper assumptions about the court’s mission and its role in the community – which can assist or impede desired policy reforms. This Article, written for a Symposium issue of the Hofstra Law Review, draws upon the insights of organizational culture theory to explore how leaders can …

The Development Of Secondary Mathematics Teachers’ Pedagogical Identities In The Social Context Of Classroom Interactions, Hyung Won Kim Jan 2018

The Development Of Secondary Mathematics Teachers’ Pedagogical Identities In The Social Context Of Classroom Interactions, Hyung Won Kim

School of Mathematical & Statistical Sciences Faculty Publications

Research demonstrates a disjuncture between the practices encouraged by teacher education programs and what teachers actually do in the classroom. It also informs us that the cognitive and social characteristics of individual teachers such as their attitudes, beliefs and knowledge contribute to their classroom practices. This qualitative study investigates how the teacher identity of mathematics teachers – the person’s sense of who he/she is as a mathematics teacher – is related to the disjuncture between encouraged and actual classroom practices. Specifically, the study looks into how mathematics teachers form their teaching practices in the social context of their classroom interactions, …

Double- And Triple-Duty Caregiving Men: An Examination Of Subjective Stress And Perceived Schedule Control, Nicole Depasquale, Steven H. Zarit, Jacqueline Mogle, Phyllis Moen, Leslie B. Hammer, David M. Almeida Jan 2018

Double- And Triple-Duty Caregiving Men: An Examination Of Subjective Stress And Perceived Schedule Control, Nicole Depasquale, Steven H. Zarit, Jacqueline Mogle, Phyllis Moen, Leslie B. Hammer, David M. Almeida

Psychology Faculty Publications and Presentations

Based on the stress process model of family caregiving, this study examined subjective stress appraisals and perceived schedule control among men employed in the long-term care industry (workplace-only caregivers) who concurrently occupied unpaid family caregiving roles for children (double-duty child caregivers), older adults (double-duty elder caregivers), and both children and older adults (triple-duty caregivers). Survey responses from 123 men working in nursing home facilities in the United States were analyzed using multiple linear regression models. Results indicated that workplace-only and double- and triple-duty caregivers’ appraised primary stress similarly. However, several differences emerged with respect to secondary role strains, specifically work–family …

Malleable Rationality, Stephanie Plamondon Jan 2018

Malleable Rationality, Stephanie Plamondon

Faculty Scholarship

In 1998, Christine Jolls, Cass Sunstein, and Richard Thaler published A Behavioral Approach to Law and Economics, one of the most important pieces of scholarship in decades. Their article famously proposes a departure from the neoclassical law and economics approach to legal analysis. Breaking from neoclassical law and economics’ rational actor construct, the authors apply empirical insights about human behavior to introduce the concept of a boundedly rational actor limited by cognitive constraints. Over the past two decades, the behavioral law and economics approach, with its focus on the boundedly rational actor, has contributed needed realism to legal analyses. Unfortunately, …

Deal Structure, Cathy Hwang, Matthew Jennejohn Jan 2018

Deal Structure, Cathy Hwang, Matthew Jennejohn

Faculty Scholarship

Modern commercial contracts—those governing mergers and acquisitions and financial derivatives, for instance—have become structurally complex and interconnected. Yet contract law largely ignores structural complexity. This Article develops a theory of “contractual structuralism” to explain the important role of structure in every aspect of contract law, from the design of a contract to courts’ interpretation and enforcement.

For generations, scholars have debated whether a court should consider only the text of a contract or also consider broader context to determine parties’ intent. More recently, scholars have shown that parties can choose between textual and contextual interpretation by drafting a contract provision …

Islam And Religious Freedom: The Experience Of Religious Majorities And Minorities, Brett Scharffs Jan 2018

Islam And Religious Freedom: The Experience Of Religious Majorities And Minorities, Brett Scharffs

Faculty Scholarship

It seems likely that change in Islam will be affected both by outside and internal sources, as was the case for the Catholic Church and its journey to Dignitatis Humanae. However, one thing the Catholic experience suggests is that meaningful and profound change does not simply come from outside pressures; it comes from authentic and sincere evaluation and interpretation by insiders of a religious tradition of that tradition itself. Thus, if Islam is going to come to embrace religious freedom as an important value, this will be the result, significantly if not primarily, of Muslims interpreting their own sacred …

Optimal Deterrence And The Preference Gap, Brook Gotberg Jan 2018

Optimal Deterrence And The Preference Gap, Brook Gotberg

Faculty Scholarship

It is generally understood that the way to discourage particular behavior in individuals is to punish that behavior, on the theory that rational individuals seek to avoid punishment. Laws aimed at deterring behavior operate on the assumption that increasing the likelihood of punishment, the severity of punishment, or both, will decrease the behavior. The success of these laws is evaluated by how much the targeted behavior decreases. The law of preferential transfers—which punishes creditors who have been paid prior to a bankruptcy filing at the expense of other, unpaid creditors—has been defended on the grounds that it deters a race …

Borscht, Bliny, And Burritos: The Benefits Of Peer-To-Peer Experiential Learning Through Food, Naomi Caffee, Colleen Lucey Jan 2018

Borscht, Bliny, And Burritos: The Benefits Of Peer-To-Peer Experiential Learning Through Food, Naomi Caffee, Colleen Lucey

Russian Language Journal

Like other disciplines in the humanities, Russian Studies faces an ongoing crisis of recruiting and retaining majors and minors for the longevity of undergraduate programs (Looney and Lusin 2018). Shrinking budgets and limited resources compound the problem as language and culture departments across the United States are asked to do more with fewer resources (Gerber 2015). In the context of an increasingly corporatized academy where language and cultural studies are marginalized, faculty in Russian Studies have a powerful means at their disposal to attract new students and build cross-campus alliances: the common language of food. Courses on foodways can reinvigorate …

Review: Limits To Interpretation: The Meanings Of Anna Karenina; Russian Science Fiction Literature And Cinema: A Critical Reader, Serenity Stanton Orengo, Alla A. Smyslova Jan 2018

Review: Limits To Interpretation: The Meanings Of Anna Karenina; Russian Science Fiction Literature And Cinema: A Critical Reader, Serenity Stanton Orengo, Alla A. Smyslova

Russian Language Journal

Limits to Interpretation is a staple of Tolstoy scholarship. Newly reprinted in paperback, it is worth revisiting, even for those already familiar with this work. Alexandrov’s aim in the book, outlined on the first page, is to “propose a text-specific reading methodology, one that is tailored as much as possible to a particular work, and that is thus designed to minimize the circularity of interpretation, or the process of mediation, inherent in any act of reading” (3). Alexandrov seeks to demonstrate how a work of literature can prompt a fixed range of contradictory and divergent interpretations simultaneously. He wants to …

Examining The Effects Of Behavioral Skills Training On Movement Patterns In Youth Female Soccer Athletes, Marrissa Harris Jan 2018

Examining The Effects Of Behavioral Skills Training On Movement Patterns In Youth Female Soccer Athletes, Marrissa Harris

Electronic Theses and Dissertations Archive

In certain sports, the ability of an athlete to change direction while sprinting is considered a vital skill required to be successful. Soccer is one of those sports and because of that learning to properly execute change of direction movements become very important. Statistics show a growing increase in youth female participation in soccer and as a result, injuries within this population has also increased. Because female athletes are at a greater risk for ACL injuries than males, coaches have acknowledged the need for proper training that will assist female athletes in executing skills safely. Current training programs for ACL …

Professional Identity, Commitment, And Intent To Persist: The Facilitative Role Of Mindfulness For Pre-Service Teachers, Sean Holden Jan 2018

Professional Identity, Commitment, And Intent To Persist: The Facilitative Role Of Mindfulness For Pre-Service Teachers, Sean Holden

Electronic Theses and Dissertations Archive

Researchers have long observed issues with teacher retention, particularly early in ones career (Ingersoll, 2003; Gray & Taie, 2015). In order to address this issue, many researchers have investigated retention by exploring the development of ones perceptions and beliefs about the profession. Encompassing this trend, interest has been placed on teachers professional identity, a comprehensive construct acknowledging the influence of personal factors and internalized external experience (Schaefer et al., 2014). Based in this perspective, Hong (2010) proposed that ones beliefs about teaching and perceptions of self-efficacy, value, empowerment, burnout, and commitment are particularly salient in the decision to remain in …

Examining Cerebellar Modulation Of Mesolimbic Dopamine Transmission Using Fixed Potential Amperometry, Zade Ramses Holloway Jan 2018

Examining Cerebellar Modulation Of Mesolimbic Dopamine Transmission Using Fixed Potential Amperometry, Zade Ramses Holloway

Electronic Theses and Dissertations Archive

Elucidating how dopamine neurons operate regularly in aspects of neurochemical release and in pathological systems is essential for understanding their role in behavior, drug treatment, and disease. Fixed-potential amperometry (FPA) combined with carbon fiber microelectrodes has proven to be effective at probing these dynamic microsystems and precisely describing the regulatory mechanisms that govern dopamine neurotransmission. To date, we have utilized FPA to: a) observe and quantify differences in the neurochemical profile of phasic dopamine release in major dopaminergic afferents including the striatum, nucleus accumbens (NAc), amygdala, and prefrontal cortex through stimulation of the medial forebrain bundle (MFB), b) provide evidence …

Biomarkers To Localize Seizure From Electrocorticography To Neurons Level, Bahareh Elahian Jan 2018

Biomarkers To Localize Seizure From Electrocorticography To Neurons Level, Bahareh Elahian

Electronic Theses and Dissertations Archive

Epilepsy—a disorder that is far more common than is widely realized—results in high morbidity and even mortality. It is defined semiologically in part, but it is a disorder caused by the disturbed synchronization of natural brain oscillations. The current standard treatment is implanting intracranial electrodes that are continuously connected to an acquisition system while the patient waits in an Epilepsy Monitoring Unit (EMU) until the patient has a seizure. Given enough seizures, this information can be taken to the operating room. Then, the electrodes, which had shown pathologic activity, are marked and surgical resection of the determined pathologic …

Avoidance Of English Phrasal Verbs Among Saudi Esl Students, Abdullah Saleh Alshayban Jan 2018

Avoidance Of English Phrasal Verbs Among Saudi Esl Students, Abdullah Saleh Alshayban

Electronic Theses and Dissertations Archive

Students of English as a second language (ESL) are often perplexed by English phrasal verbs (PVs) and must seek aid to understand the meanings of such phrases. Understanding an independent verb is simple, but the meaning of a verb can change depending on the context in which it is used as well as its object(s). In other words, since PVs using the same verb or particle do not correspond semantically, many English learners struggle with understanding some sentences. For example, when a preposition (as a particle) is used with a verb to form a PV, the meaning of the sentence …

Longitudinal Examination Of Forms Of Childrens Antipathetic Relationships And Peer Social Competence: An Autoregressive Cross-Lagged Panel Analysis, Sarah Elaine Barnes

Electronic Theses and Dissertations Archive

The present research (N = 121) examined a) the stability of previously established, empirically derived profiles of forms of childrens dislike relationships (i.e., unilateral-received dislike, unilateral-given dislike, mutual dislike) at two time points (one academic year apart) and, b) the reciprocal, cross-lagged relations between these antipathetic profiles and a number of peer social competence measures (i.e., loneliness, peer optimism, self-perceived social competence, mutual friends, sociability nominations, and popularity nominations). The three profiles included a High Disliked profile (characterized by high unilateral-received and mutual dislike nominations), an Average Dislike profile (characterized by average dislike nominations across all indicators), and a High …

The Voices Of Low-Income African American Single Mothers As Potential Agents For Change: Education For Transformative Learning, Heather Bonds Jan 2018

The Voices Of Low-Income African American Single Mothers As Potential Agents For Change: Education For Transformative Learning, Heather Bonds

Electronic Theses and Dissertations Archive

AbstractMany African American single mothers have embarked on an academic journey, which oftentimes symbolizes the desire of these mothers to fight against structural and personal forces that have prevented them from achieving life goals, one of which is moving beyond poverty. Despite their efforts, this population continues to encounter barriers to access, retention, and completion of their educational endeavors. There is much literature documenting public and political discourse surrounding poverty policy and the dominant imagery created by this discourse that influence policy decisions. However, is this discourse taking space from individuals who most need to talk? Historically, this is a …

James Baldwin On The Question Of The Identities Of Americans And The Black Muslim Movement, Minzhao Liu Jan 2018

James Baldwin On The Question Of The Identities Of Americans And The Black Muslim Movement, Minzhao Liu

Outstanding Gateway Papers

One of the tactics the director Raoul Peck employed to make the I Am Not Your Negro documentary so powerful is the juxtaposition of violence against the black population in the 1960s and the brutalities taking place right now. He reveals on a more profound level the wretchedness of the current racial situation and the lack of real change. Peck’s film is built on James Baldwin’s unfinished manuscript Remember This House. Baldwin’s treatment of the racial issue is uniquely interrogative, demanding a clear picture of the reality of both the environment and individuals’ identities. This principle of digging for …

Danish Creativity And Resilience In The Face Of Adversity, Delane Ingalls Vanada Jan 2018

Danish Creativity And Resilience In The Face Of Adversity, Delane Ingalls Vanada

The Bridge

Danish people are known for being innovative thinkers. They are independent, willing to take risks, able to stand up for their thoughts and beliefs, daring enough to commit themselves without fear of failure, and deeply trusting of each other. They are hardworking, flexible, and intellectual (Nordic Reach 2008). This is the stuff of creativity and the dispositions that support it, according to current research on the psychology of creativity (Piirto 2001). As the granddaughter of Jens Peder Jensen, a Danish immigrant who homesteaded in South Dakota in 1907, my life was shaped by the influence of our close family in …

Photography And Mourning: Excavating Memories Of My Great-Grandmother, Eva Weiner Jan 2018

Photography And Mourning: Excavating Memories Of My Great-Grandmother, Eva Weiner

Scripps Senior Theses

This paper explores how photographs have affected mourning processes in the past and how photo-technology may be able to change the way in which we mourn in the future. It includes an overview of the history of post-mortem photography and discusses the perspectives of well-known media theorists such as Roland Barthes and Susan Sontag. It engages with psychologists by including their perspectives on the effect that photographs have on the mourning process. A project was created to investigate how photo-technology can affect the bereaved. The project places photographs of a mother into pictures of her children taken after she had …

Why Weight? Zines As Effective Health Communication Tools Against Fat Phobia, Evelyn Gonzalez Jan 2018

Why Weight? Zines As Effective Health Communication Tools Against Fat Phobia, Evelyn Gonzalez

Scripps Senior Theses

The current models for health care hold at their core a pathologization of fat bodies informed by discriminatory methods and ideologies leading to an explicit lack of quality medical care for those who fail to meet normative standards of health and size. This project is interested in examining alternative public health models that provide interventions into those systems. Specifically, this work will seek to understand how the grassroots movement, Health at Every Size (HAES), serves to interrupt current limited understandings of health and weight. HAES individualized, weight-neutral approach to health and wellness exists in seeming opposition to contemporary ideas around …

Men's Receptivity To Mental Health Help Seeking Intervention Messages: The Effects Of Message Sender Gender And Message Content, Faye Lafond Jan 2018

Men's Receptivity To Mental Health Help Seeking Intervention Messages: The Effects Of Message Sender Gender And Message Content, Faye Lafond

Scripps Senior Theses

Men are much less likely to seek out mental health care services than women, despite having equally significant mental health related needs. The purpose of this study was to explore the impact of the construction and delivery of intervention messages designed to encourage men to seek help for mental health concerns. 225 men in the United States were randomly assigned to one of 4 vignette conditions featuring a pro-mental health help seeking message, varying based on the gender of the sender of the message (male vs. female) and based on the inclusion of information concerning misconceptions about therapy (inclusion vs. …

Heap of Birds’ monoprints address and allude to indigenous struggles to undermine insensitive …

Analysis Of Newspaper Coverage Of Offshore Wind Energy In The United States, Christine Gilbert Jan 2018

Analysis Of Newspaper Coverage Of Offshore Wind Energy In The United States, Christine Gilbert

Open Access Master's Theses

The Block Island Wind Farm (BIWF) is the first operational offshore wind farm in the United States. Two different theoretical frameworks are applied in an attempt to understand the nature of media coverage about offshore wind energy in the United States. Chapter 1 utilizes gatekeeping theory (Shoemaker & Vos, 2009) in comparing the local and regional newspaper coverage of the BIWF. Specifically, chapter 1 is focused on understanding the use of sources. The data from chapter 1 suggests that the gatekeeping processes at regional and local outlets are more similar than different, but business sources are more dominant than has …

Living With No: Political Polarization And Transformative Dialogue, Erik Cleven, Robert A. Baruch Bush, Judith A. Saul Jan 2018

Living With No: Political Polarization And Transformative Dialogue, Erik Cleven, Robert A. Baruch Bush, Judith A. Saul

Hofstra Law Faculty Scholarship

We argue that dispute resolution processes should not be seen as a substitute for the political process, but rather a complement that can help strengthen it. Based on this view, and on the authors’ experience with dialogue work in the former Yugoslavia, as well as in urban and rural settings in the United States, we argue that transformative processes, specifically an approach we call Transformative Dialogue, are best suited to addressing the challenges of political polarization both in the United States and internationally. This is because the primary goal of transformative processes is not to reach agreement or find common …

Unusual: The Death Penalty For Inadvertent Killing, Guyora Binder, Brenner M. Fissell, Robert Weisberg Jan 2018

Unusual: The Death Penalty For Inadvertent Killing, Guyora Binder, Brenner M. Fissell, Robert Weisberg

Hofstra Law Faculty Scholarship

Can a burglar who frightens the occupant of a house, causing a fatal heart attack, be executed? More generally, does the Eighth Amendment permit capital punishment of one who causes death inadvertently? This scenario is possible in the significant minority of American jurisdictions that permit capital punishment for felony murder without requiring a mental state of intent to kill or reckless indifference to human life. Thus far, Eighth Amendment death penalty jurisprudence has required a culpable mental state of recklessness for execution of accomplices in a fatal felony but has not yet addressed the culpability required for execution of the …

Machismo Predicts Prejudice Toward Lesbian And Gay Individuals: Testing A Mediating Role Of Contact, Michiyo Hirai, Serkan Dolma, Jason R. Popan, Mark H. Winkel

Psychological Science Faculty Publications

This study examined the relationship between traditional machismo and prejudice toward lesbian and gay individuals as mediated by contact in a Latino college sample. Gender was examined as a potential moderator. Undergraduate students from a public university in South Texas (128 males and 447 females; mean age = 22.1. SD = 4.75) completed online measures of prejudice toward lesbian and gay individuals, machismo, and contact experience with lesbian and gay individuals. Contact significantly mediated the relationship between machismo and anti-gay prejudice, yet this indirect effect was relatively small. Significant direct and indirect effects of machismo on prejudiced attitudes toward lesbian …

Factor Structure And Administration Measurement Invariance Of The Beliefs Toward Mental Illness Scale In Latino College Samples: Paper-Pencil Versus Internet Administrations., Michiyo Hirai, Laura L. Vernon, George A. Clum

Psychological Science Faculty Publications

The psychometric properties of the paper–pencil and online versions of the Beliefs Toward Mental Illness Scale (BTMI) were examined in two studies with Latina/o individuals. In Study 1, 316 Latina/o participants completed the BTMI in a paper–pencil mode. The original three-factor model was found to be a poor fit model for the sample. Subsequent exploratory and confirmatory factor analyses identified a four-factor model as the best fitting model for the sample. The identified factors were Dangerousness, Social Dysfunction, Incurability, and Embarrassment. In Study 2, the identified best fit model was tested with 280 Latina/o participants who completed the BTMI online. …

A Gender Invariant Model Of Disgust Propensity In Blood-Injection-Injury Phobia In Latina/O Individuals, Michiyo Hirai, Laura L. Vernon, Serkan Dolma Jan 2018

A Gender Invariant Model Of Disgust Propensity In Blood-Injection-Injury Phobia In Latina/O Individuals, Michiyo Hirai, Laura L. Vernon, Serkan Dolma

Psychological Science Faculty Publications

Latinas/os have been underrepresented in research investigating the role of disgust propensity in phobias. The current study was the first to examine associations between disgust propensity and Blood-Injection-Injury (BII) phobia, when acculturation was controlled for, in Latina/o Americans (n = 376). A structural model was developed with a BII fear latent variable consisting of fears of injection, blood, and sharp objects (causing injuries). The disgust propensity latent variable was formed with three domains of core, animal reminder, and contamination disgust elicitors. In the model, disgust propensity predicted BII fear when controlling for acculturation. A series of measurement and structural invariance …
