The Enforceability Of Consent-To-Assign Provisions In Texas Oil And Gas Leases, T. Ray Guy, Jason Wright Jan 2018

The Enforceability Of Consent-To-Assign Provisions In Texas Oil And Gas Leases, T. Ray Guy, Jason Wright

SMU Law Review

Oil and gas leases are unique instruments that, on their face, appear to be contracts or traditional landlord–tenant leases. Indeed, landowners often desire to have them treated as such by including provisions giving a lessor power to limit or control any assignment of the lease. Typically, this takes the form of a consent-to-assign provision seen in many types of ordinary contracts and leases. In Texas, however, an oil gas lease actually conveys a fee simple property interest; and property law, far more than contract or landlord–tenant law, greatly disfavors any restraint that acts to restrict the free transferability (or “alienation”) …

Richard Posner: A Class Of One, Robert C. Farrell Jan 2018

Richard Posner: A Class Of One, Robert C. Farrell

SMU Law Review

Judge Richard Posner, best known for his contributions to the field of law and economics, has also made an outsized contribution to another area of the law—the equal protection class-of-one claim. By some combination of happenstance and design, Posner was able to shape the class-of-one doctrine even where his views were inconsistent with Supreme Court precedent. The Supreme Court’s initial exposition of the doctrine had identified an equal protection violation when there was intentionally different treatment of similarly situated persons without a rational basis for the difference in treatment. Posner insisted that this language included within it a requirement that …

Policing Narrative, Tal Kastner Jan 2018

Policing Narrative, Tal Kastner

SMU Law Review

Counter narrative, a story that calls attention to and rebuts the presumptions of a dominant narrative framework, functions as an essential tool to reshape the bounds of the law. It has the potential to shape the collective notion of what constitutes legal authority. Black Lives Matter offers a counter narrative that challenges the characterization of the shared public space, among other aspects of contemporary society, as the space of law. Using the concept of necropower—the mobilization and prioritization of the state’s power to kill—I analyze the contested physical and conceptual space of law exposed by the counter narrative of Black …

“Heal Thyself.”—An Argument For Granting Asylum To Healthcare Workers Persecuted During The 2014 West African Ebola Crisis, Bethany Echols

SMU Law Review

This article argues for a change in United States asylum policy at a time when change is needed most. Those seeking asylum must prove that they fear persecution in their home country based on one of five protected categories and that their government is the persecutor or is unable to control the actions of the persecutors. Multiple articles have recognized that the “particular social group” is the most difficult category of asylum seeker to analyze. Not only do the standards for particular social groups (PSGs) vary among circuit courts, but judicial consistency is lacking.

This article focuses on a particular …

Preparation And Antimicrobial Activity Of Caprylic Acid Emulsion For Food Coating, Raweewan Bunyovimonnat

Chulalongkorn University Theses and Dissertations (Chula ETD)

Antimicrobial food coating is the interesting method for food preservation, especially in fruits and vegetables. Previous studies have been reported that the caprylic acid had the antimicrobial activity against a variety of microorganisms. However, little research has been conducted on the use of caprylic acid in the form of food coatings. Therefore, this study aims to determine the optimum conditions for the caprylic acid emulsion preparation and to evaluate the antimicrobial activity of the emulsion, including the effect of food coatings with caprylic acid emulsion on physical properties and microbial growth inhibition. Emulsions containing 4% w/v caprylic acid (oil) and …

Chulalongkorn University Theses and Dissertations (Chula ETD)

Flood is still a major climate hazard in Pursat province, a potential province for agricultural development in Cambodia. The consequences of this water-related disaster are social problems such as poverty, food insecurity and health problems, which indirectly prolong the growth of the country's economy. To propose a proper flood mitigation measure, flood damage assessment is considered as a fundamental step to implement so that the value of elements at risk is initially evaluated. The objectives of this research are to assess flood damage in agriculture and affected people in Bakan and Phnom Kravanh districts, Pursat province from 2000 to 2014, …

Extraversion And Person-Environment Fit: Towards Consideration Of Jungian Theory In Organizational Psychology, Nicholas Rosemarino

Theses and Dissertations

Historically, the field of Industrial/Organizational (I/O) Psychology has relied on the Big 5 taxonomy of personality. The purpose of this study was to examine the value of a Jungian conception of extraversion in the context of the relationship between the physical work environment and person-environment (PE) fit. The MBTI and the NEO-IPIP, representing a Jungian and a taxonomic conception of personality, respectively, were hypothesized to predict the within-person relationship between extraverted environment and PE fit. PE fit was hypothesized to predict perceived satisfaction and perceived performance. To examine these hypotheses, 110 participants were recruited from Mturk and responded to 18 …

Developing An Automated System For Supporting Strut Arrangement In Deep Excavation, Pisal Nov Jan 2018

Developing An Automated System For Supporting Strut Arrangement In Deep Excavation, Pisal Nov

Chulalongkorn University Theses and Dissertations (Chula ETD)

In strut arrangement, current software could detect the constructible problems like clashes. However, this software had some limitations including (1) unable to visualize all clash occurrences on each strut, (2) unable to distinguish between occurrence and non-occurrence of the clash, and (3) unable to check tolerance and spacing problems. Thus, the strut arrangement was still an inefficient process. The research objective was to develop an automated system for supporting strut arrangement in deep excavation. In the methodology, an in-depth interview was conducted to collect the information and knowledge of strut arrangement and analyzed with transcription analysis. This information and knowledge …

Characterization Of Graphene Grown By Direct Liquid Injection Cvd Method With N2 Carrier Gas, Taworn Intaro

Chulalongkorn University Theses and Dissertations (Chula ETD)

We have studied the graphene growth on copper (Cu) foil substrate by direct-liquid-injection chemical vapor deposition (DLI-CVD). Cyclohexane (C6H12) and N2 were used as a liquid carbon precursor and carrier gas, respectively. Structural and electrical properties of graphene were characterized various techniques. Before the growth of graphene, optimization of Cu foil surface was performed as follows by: (i) etching by hydrochloric (HCl) acid to eliminate impurities and copper oxide on the Cu foil surface, then, (ii) electro-polishing process was used to remove the rolling lines and improve the surface roughness, and (iii) thermal annealing treatment was done to increase grain …

Rheology, Morphology And Electronic Properties Of Hybrid Copper Organic Decompose Conductive Ink, Chaiwat Klaewwigkij

Chulalongkorn University Theses and Dissertations (Chula ETD)

Hybrid Metal-Organic Decomposition (HMOD) inks containing alkanol amines copper complex solution with fine copper particles show high potential for flexible printed electronics application. Conductive patterns are fabricated from HMOD inks by screen printing onto a polyimide substrate. This work studies the effects of co-solvent, copper particles loading, and viscosity of the inks on properties of the conductive patterns obtained. Firstly, the effects of co-solvent related to the stability of the HMOD inks and the impact of preparation time related to the crack of the conductive pattern are examined. The HMOD inks are prepared from copper formate (CuF), and alkanol amines …

Effect Of Non-Hermiticity On Adiabatic Elimination In Coupled Waveguides, Rahman Sharaf, M. Dehghani, Hamidreza Ramezani Jan 2018

Effect Of Non-Hermiticity On Adiabatic Elimination In Coupled Waveguides, Rahman Sharaf, M. Dehghani, Hamidreza Ramezani

Physics & Astronomy Faculty Publications

We investigate the influence of non-Hermiticity on the adiabatic elimination in coupled waveguides. We show that although the total norm of the system is not conserved in parity-time symmetric phase, the dark state intensity remains constant. However, in broken phase the eliminated waveguide loses its darkness, i.e., its field amplitude starts increasing. In both exact and broken phases, the effective Hamiltonian derived from the adiabatic elimination condition describes the dynamics of all states except the dark state. Specifically, it cannot predict the amplification in the intensity of the dark state. Our results can strengthen the control of the dynamics in cavities …

Block Copolymer Elastomer With Graphite Filler: Effect Of Processing Conditions And Silane Coupling Agent On The Composite Properties, Denis M. Panaitescu, Raluca Augusta Gabor, Cristian Andi Nicolae, Anca Constantina Parau, Catalin Vitelaru, Valentin Raditoiu, Mircea Chipara

Physics & Astronomy Faculty Publications

The control of morphology and interface in poly(styrene-ethylene/butylene-styrene) (SEBS) composites with graphitic fillers is extremely important for the design of piezoresistive sensors for body motion or flexible temperature sensors. The effects of a high amount of graphite (G) and silane coupling agent on the morphology and properties of SEBS composites with anisotropic mechanical properties are reported. The physical and chemical bonding of silane to both G and SEBS surface was proved by EDX and TGA results; this improved interface influenced both the thermal and mechanical properties of the composite. The vinyltriethoxysilane (VS) promoted the formation of char residue and, being …

Searches are under way in Advanced LIGO and Virgo data for persistent gravitational waves from continuous sources, e.g. rapidly rotating galactic neutron stars, and stochastic sources, e.g. relic gravitational waves from the Big Bang or superposition of distant astrophysical events such as mergers of black holes or neutron stars. These searches can be degraded by the presence of narrow spectral artifacts (lines) due to instrumental or environmental disturbances. We describe a variety of methods used for finding, identifying and mitigating these artifacts, illustrated with particular examples. Results are provided in the form of lists of line artifacts that can safely …

Translinguality And Disciplinary Reinvention, Bruce Horner Jan 2018

Translinguality And Disciplinary Reinvention, Bruce Horner

Faculty and Staff Scholarship

Dominant narratives of disciplinarity that WAC/WID confronts conflate disciplines with departments and material institutional structures, such as departments and professional organizations—what is here called “departmentality.” The relative autonomy of disciplinarity from departmentality means that challenges to foundational concepts of disciplines are in fact normal to disciplinary work and do not threaten the material institutional structures associated with those disciplines, as illustrated by the history of challenges to foundational disciplinary concepts of basic writing and second language acquisition carried out in disciplinary writing. The relative autonomy of disciplinarity enables us to accept the legitimacy of the challenges translingual theory poses to …

Community-led total sanitation (CLTS) is a common method for promoting sanitation in low-income settings. This cluster-randomized trial evaluated an intervention to improve inclusion of people with disability in CLTS through training facilitators. A qualitative study examined intervention acceptability. The trial included 171 people with disabilities (78 control and 93 intervention) living in 15 intervention and 15 control communities. In the intervention arm, respondents were more likely to participate in a community meeting about sanitation (+18.7%, 95% confidence interval [CI]: 3.2, 34.2) and to have been visited to discuss sanitation (+19.7, 95% CI: 0.6, 37.8). More intervention households improved latrine access …

From Exemptions To Censorship: Religious Liberty And Victimhood In Obergefell V. Hodges, Calvin Coker Jan 2018

From Exemptions To Censorship: Religious Liberty And Victimhood In Obergefell V. Hodges, Calvin Coker

Faculty and Staff Scholarship

This article analyzes the Supreme Court decision in Obergefell v. Hodges, showing that a subset of the dissent constructed devout religious groups as victims to re-articulate power relations between the state, LGBT groups, and religious entities. This re-articulation is possible as a consequence of ambiguity in the legal concept religious liberty, which is explored in depth. That ambiguity is employed to mount an argument against the decision, moving LGBT individuals from oppressed to oppressor of religious groups. The study contextualizes this inversion against the material and symbolic conditions of both the LGBT, and devout Christian, communities in the United …

The first neutron star-neutron star (NS-NS) merger was discovered on August 17, 2017 through gravitational waves (GW170817) and followed with electromagnetic observations. This merger was detected in an old elliptical galaxy with no recent star formation. We perform a suite of numerical calculations to understand the formation mechanism of this merger. We probe three leading formation mechanisms of double compact objects: classical isolated binary star evolution, dynamical evolution in globular clusters, and nuclear cluster formation to test whether they are likely to produce NS-NS mergers in old host galaxies. Our simulations with optimistic assumptions show current NS-NS merger rates at …

Evaluating Blackbird Behavioral Response Toward Unmanned Aircraft Systems (Uass): Exploiting Antipredator Behavior To Enhance Avoidance, Conor C. Egan, Lucas Wandrie, Bradley F. Blackwell, Esteban Fernandez-Juricic, Page E. Klug

United States Department of Agriculture Wildlife Services: Staff Publications

Animals respond to nonlethal forms of human disturbance using behavior strategies adapted to detect, avoid, and evade natural predators. This phenomenon suggests antipredator behavior can be exploited to optimize efficacy of wildlife management tools such as visual deterrents. According to models of antipredator theory, wildlife managers could encourage animals to abandon a resource patch in zones of human-wildlife conflict by enhancing perceived predation risk associated with disturbance stimuli. One human-wildlife conflict of interest is the economic loss and human safety hazards caused by birds. For example, blackbirds (Icteridae) pose a significant risk to the commercial aviation industry through …

European starlings are an invasive bird species in North America that are known to cause damage to commercial dairies through the consumption of total mixed rations (TMR) destined for dairy cows. We hypothesized that large foraging flocks of starlings alter the physical composition of TMR, and that this change may be significant enough to affect milk production. To better determine if production losses could potentially occur in commercial dairies as a consequence of feed consumption by foraging flocks of starlings, we conducted controlled feeding experiments using a TMR sourced from a commercial dairy that is chronically plagued with seasonal starling …

Effects Of Vulture Exclusion On Carrion Consumption By Facultative Scavengers, Jacob E. Hill, Travis L. Devault, James C. Beasley, Olin E. Rhodes Jr., Jerrod L. Belant Jan 2018

Effects Of Vulture Exclusion On Carrion Consumption By Facultative Scavengers, Jacob E. Hill, Travis L. Devault, James C. Beasley, Olin E. Rhodes Jr., Jerrod L. Belant

United States Department of Agriculture Wildlife Services: Staff Publications

Vultures provide an essential ecosystem service through removal of carrion, but globally, many populations are collapsing and several species are threatened with extinction. Widespread declines in vulture populations could increase the availability of carrion to other organisms, but the ways facultative scavengers might respond to this increase have not been thoroughly explored. We aimed to determine whether facultative scavengers increase carrion consumption in the absence of vulture competition and whether they are capable of functionally replacing vultures in the removal of carrion biomass from the landscape. We experimentally excluded 65 rabbit carcasses from vultures during daylight hours and placed an …

Perspectives On Existing And Potential New Alternatives To Anticoagulant Rodenticides And The Implications For Integrated Pest Management, Gary W. Witmer

United States Department of Agriculture Wildlife Services: Staff Publications

Comprising over 1400 species worldwide, rodents are the largest taxonomic group of mammals (Nowak 1999). Rodent use of habitats is extensive and varied. Most rodent species are relatively small, secretive, prolific, adaptable, and have continuously growing incisors which require constant eroding by gnawing. Rodents are known for their high reproductive potential; however, there is much variability between species as to the age at first reproduction, size of litters, and the number of litters per year. All rodent species have ecological, scientific, social, and/or economic values. They recycle nutrients, aerate soils, distribute seeds and spores, and affect plant succession. Some provide …

Chemical Composition Of Glandular Secretions From A Pair-Living Monogamous Primate: Sex, Age, And Gland Differences In Captive And Wild Owl Monkeys (Aotus Spp.), Andrea Spence-Aizenberg, Bruce A. Kimball, Lawrence E. Williams, Eduardo Fernandez-Duque

United States Department of Agriculture Wildlife Services: Staff Publications

Broadening our knowledge of olfactory communication in strictly monogamous systems can inform our understanding of how chemosignals may facilitate social and reproductive behavior between the sexes. Compared to other social and mating systems, relatively little is known about olfactory communication in strictly monogamous non-human primates. Furthermore, platyrrhines are not well represented in chemical analyses of glandular secretions. We conducted semi-quantitative headspace gas chromatography with mass spectrometry to investigate the chemical components of glandular secretions from the subcaudal and pectoral glands of a strictly pair-living platyrrhine, the owl monkey (Aotus spp.). In this study, the first chemical analysis of a …

Anticoagulant Rodenticide Toxicity To Non-Target Wildlife Under Controlled Exposure Conditions, Barnett A. Rattner, F. Nicholas Mastrota Jan 2018

Anticoagulant Rodenticide Toxicity To Non-Target Wildlife Under Controlled Exposure Conditions, Barnett A. Rattner, F. Nicholas Mastrota

United States Department of Agriculture Wildlife Services: Staff Publications

Our knowledge of the toxicity of anticoagulant rodenticides (ARs) can be traced to investigations of Karl Paul Link and colleagues on “bleeding disease” in cattle, the eventual isolation of dicoumarol from moldy sweet clover, synthesis of this causative agent, and its application as a therapeutic anticoagulant in clinical medicine in 1941 (Link 1959). The notion of a coumarin-based rodenticide as a better “mouse-trap” occurred to Link in 1945 while reviewing laboratory chemical and bioassay data. By 1948, the highly potent compound number 42, warfarin, was promoted as a rodenticide (Link 1959; Last 2002). Through laboratory studies and clinical use of …
