Jurisdictional Idealism And Positivism, John F. Preis
Jurisdictional Idealism And Positivism, John F. Preis
William & Mary Law Review
“If I should call a sheep’s tail a leg, how many legs would it have? Four, because calling a tail a leg would not make it so.” This old quip, often attributed to Abraham Lincoln, captures an issue at the heart of the modern law of subject matter jurisdiction. Some believe that there is a Platonic ideal of jurisdiction that cannot be changed by judicial or legislative fiat. Others take a positivist approach and assert that jurisdiction is nothing more than whatever a legislature says it is. Who is right?
Neither and both. Although neither idealism nor positivism is the …

Background: Gestational diabetes mellitus (GDM) is associated with perinatal health risks to both mother and offspring, and represents a large economic burden. The DALI study is a multicenter randomized controlled trial, undertaken to add to the knowledge base on the effectiveness of interventions for pregnant women at increased risk for GDM. The purpose of this study was to evaluate the cost-effectiveness of the healthy eating and/or physical activity promotion intervention compared to usual care among pregnant women at increased risk of GDM from a societal perspective. Methods: An economic evaluation was performed alongside a European multicenter-randomized controlled trial. A total …

The distribution of parasites across mammalian hosts is complex and represents a differential ability or opportunity to infect different host species. Here, we take a macroecological approach to investigate factors influencing why some parasites show a tendency to infect species widely distributed in the host phylogeny (phylogenetic generalism) while others infect only closely related hosts. Using a database on over 1400 parasite species that have been documented to infect up to 69 terrestrialmammal host species,we characterize the phylogenetic generalism of parasites using standard effect sizes for three metrics: …

Integration And Leveling Of Nutritional Principles In Traditional Asn Nursing Curricula, Candace Pierce, Robyn Caldwell
Nursing Education Research Conference (NERC)
Appropriate nutritional content is a vital component in all nursing programs. This content may be integrated into traditional ASN curricula. Additionally, leveling of nutritional content is important to ensure progression of knowledge. Leveling fosters clinical reasoning, which ultimately influences safe and effective care in nursing practice.

Discovering Agriculture-Related Careers Through Cypress, Audrey Mccrary-Quarles, Christopher C. Mathis Jr.
Professional Agricultural Workers Journal
The primary objective of the Combining Youth Passion and Resources for Environmental Sciences Studies (CYPRESS) Project was to increase awareness and generate interest among minority students regarding agriculture-related careers, in rural SC. The students participated in 4H after-school programs, summer camps, and an Ag-Science course. There were also workshops for teachers and parents for them to support the students. Data from the project were analyzed using pre- and post-survey methods. The results revealed that 26% of 4H after-school participants were interested in pursuing agriculture-related careers; 43% of summer camp participants were interested in pursuing such careers, and 5% of the …

An Analysis Of The Characteristics And Practices Of Selected Florida Small Livestock Producers: A Focus On Production And Processing, Jannette R. Bartlett, David Nii O. Tackie, Dana Reid, Akua Adu-Gyamfi, Angela Mckenzie-Jakes
Professional Agricultural Workers Journal
The study assessed the characteristics and practices of small livestock producers, emphasizing production and processing. Data were obtained from a convenience sample of seventy small producers from selected counties in Florida, and analyzed using descriptive statistics, including chi-square tests. The socioeconomic characteristics showed that part-time producers, White producers, middle-aged producers, fairly educated producers, and moderate-income producers dominated the group. A majority of the producers practiced rotational grazing, fed a combination of forage and concentrate, and less than half conducted soil tests regularly. Moreover, over half had parasite problems and treated them primarily with anthelmintics. Nearly all producers sold animals live, …

Use Of Placebo In Supplementation Studies-Vitamin D Research Illustrates An Ethical Quandary., Leigh A. Frame, Jonathan P. Fischer, Gail Geller, Lawrence J Cheskin
Clinical Research and Leadership Faculty Publications
History has shown that without explicit and enforced guidelines, even well-intentioned researchers can fail to adequately examine the ethical pros and cons of study design choices. One area in which consensus does not yet exist is the use of placebo groups in vitamin supplementation studies. As a prime example, we focus on vitamin D research. We aim to provide an overview of the ethical issues in placebo-controlled studies and guide future discussion about the ethical use of placebo groups. Research in the field of vitamin D shows variation in how placebo groups are used. We outline four types of control …

Validation Of A Dietary Screening Tool In A Middle-Aged Appalachian Population, Melissa Ventura Marra, Sowmyanarayanan V. Thuppal, Elizabeth J. Johnson, Regan L. Bailey
Clinical and Translational Science Institute
Proactive nutrition screening is an effective public health strategy for identifying and targeting individuals who could benefit from making dietary improvements for primary and secondary prevention of disease. The Dietary Screening Tool (DST) was developed and validated to assess nutritional risk among rural older adults. The purpose of this study was to evaluate the utility and validity of the DST to identify nutritional risk in middle-aged adults. This cross-sectional study in middle-aged adults (45–64 year olds, n = 87) who reside in Appalachia, examined nutritional status using an online health survey, biochemical measures, anthropometry, and three representative 24-h dietary recalls. …
