A Human Rights Code Of Conduct: Ambitious Moral Aspiration For A Public Interest Law Office Or Law Clinic, Lauren E. Bartlett

Part I of this Article argues that the lack of moral aspiration in legal ethics rules helps contribute to unhappy and unhealthy law students and lawyers, undermining the legal profession. Part II reviews the existing rules and standards that guide the ethical behavior of lawyers in the United States, arguing that all too often the binding rules focus on providing guide posts, signaling where behavior is unacceptable and disciplinary action is possible, instead of providing moral aspiration and options or next steps to describe what a lawyer should do to deal with an ethical dilemma.

Consecrated life in the Catholic Church is a vital and healing presence in Indian society. Religious men and women make an integral contribution to the society through their institutions in the fields of education, spirituality, medical care, social services, and other charitable activities. In the present context of India, however, consecrated men and women can experience challenges of relevance and identity in their vocations. These concerns have their basis in the fundamental need for a renewal of religious life itself in India, one which is imbued with a Christ-centered spirituality and reflects the prophetic charism that marks apostolic religious life. …

Virtues/Pāramitās: St. Ignatius Of Loyola And Sāntideva As Companions On The Way Of Life, Tomislav Spiranec

This dissertation conducts a comparative study of the cultivation of the virtues in Catholic spiritual tradition and the perfections (pāramitās) in the Mahāyāna Buddhist traditions in view of the spiritual needs of contemporary Croatian young adults. The comparison is carried out through the exploration of two key texts: The Spiritual Exercises of Ignatius of Loyola, a sixteenth-century Basque Catholic, and the founder of the Society of Jesus, and The Way of the Bodhisattva (Bodhicaryāvatāra) of Śāntideva, an eight-century Indian Mahāyāna monk.

Questioning Polst: Practical And Religious Issues, Lloyd Steffen

The Physician Orders for Life Sustaining Treatment (POLST) is a one-page transferrable medical chart insert designed to facilitate physician-patient communication about a patient's wishes at the end of life. The document as a chart addition is in widespread use today, but various criticisms have been leveled at POLST, the most serious being that POLST creates a slippery slope to illicit active euthanasia. This article examines the criticisms and finds that they fit two categories, the first being practical implementation problems. These problems are correctable given more and better training of medical care staff. The second and more serious ethical charge …

The paper explores historical positions on suicide and philosophical, theological, and moral positions on physician-assisted suicide and euthanasia. In 1900, most people died from infectious diseases, which have relatively short periods of morbid decline. With advances in the biomedical sciences, people are living longer, and most people die from chronic diseases, which are usually accompanied by prolonged periods of morbid decline. In addition to living longer, people today are generally more individualist and seek methods to control many aspects of life. While assisted death is rarely used, it represents a means to control end-of-life suffering. The paper demonstrates that there …

Eighteenth-Century Forerunners Of Vatican Ii: Early Modern Catholic Reform And The Synod Of Pistoia, Shaun London Blanchard

This dissertation sheds further light on the nature of church reform and the roots of the Second Vatican Council (1962-65) through a study of eighteenth-century Catholic reformers who anticipated Vatican II. The most striking of these examples is the Synod of Pistoia (1786), the high-water mark of "late Jansenism." Most of the reforms of the Synod were harshly condemned by Pope Pius VI in the Bull Auctorem fidei (1794), and late Jansenism was totally discredited in the increasingly ultramontane nineteenth-century Catholic Church. Nevertheless, many of the reforms implicit or explicit in the Pistoian agenda - such as an exaltation of …

Libraries at Seventh-day Adventist affiliated colleges and universities collect their denominational materials exhaustively. Many use the Library of Congress Classification Scheme (LCC). The challenge is that these exhaustive collections must fit in a classification scheme based on a general collection that does not typically hold much on this topic. LCC uses BX6151- 6155 for Seventh-day Adventists. Following the LCC notation without modification or expansion results in the proliferation of decimals, impeding both library users and staff. When a number of institutions share this same need, finding a standard notation they all can use is a mutual benefit. This paper reports …

This essay examines the groundbreaking contribution that John Courtney Murray, SJ made to bring about a paradigm shift in Roman Catholic teaching on religious freedom. In his classic essays in We Hold These Truths, John Courtney Murray developed an understanding of “the American proposition” that integrated a theological account of human good with the search for public consensus in a constitutional democracy. While this understanding of the relationship between religious freedom and political life was incorporated into Catholic social teaching at the Second Vatican Council, subsequent developments in both political theory and theology call Murray’s understanding of public discourse into question. Religious freedom is too important a right to be politicized. Religions have an important role to play in the public sphere and are an indispensable voice in ethical conflicts of different kinds. Therefore, religions are necessarily political. But this does not mean that they should follow a political theology which claims that only those laws are valid that concord with the natural and, ultimately, divine law. I analyze the theological context of the religious freedom debate in the twentieth century, adding a theological-ethical analysis to the legal interpretations. Contingent or “adjunct” professors are highly educated and often excellent educators, yet they are suffering from a nationwide epidemic of low wages, a lack of benefits, poor working conditions, short and sporadic contracts, and—to make ends meet—long commutes that often involve two, three, or even more institutions. The three Cs, competence, conscience, and compassion, are fundamental to Santa Clara University's distinctive identity as a Jesuit and Catholic university. The contemporary context presents countless ideologies and conflicting views about what femininity is and what it is not. In particular, the modern pursuit of equality and autonomy has resulted in the perception of motherhood as inconvenient in some quarters or, worse yet, inconsequential. This thesis considers the question as whether or not motherhood is separable from womanhood, and if there is indeed any inherent value to motherhood. The thesis of the unity of the virtues—one must possess all of the virtues to possess even one of them—was upheld in different forms by Plato, Aristotle, Augustine, and Aquinas. However, contemporary moralists almost universally decry this thesis as distorting the nature of virtue as it is materialized in the lives and actions of ordinary people. Unfortunately, academic discourse regarding the unity of the virtues has tended to be either entirely theoretical or narrowly limited to particular individuals or groups as “test cases” regarding the validity of the thesis. The widely publicized British case of Charlie Gard became an international cause célèbre when the treating physicians petitioned the British courts to prevent the parents from taking their dying child to America where a physician held out promise of an unproven experimental therapy. The case became more sensationalized when the press reported that Pope Francis had intervened in the case against the position of the Vatican’s Academy for Life on the appropriate response to a patient with a lethal genetic disorder for which there was no known treatment.
