Achieving Substantive Justice In Mediation Through Procedural Justice: An Illusory Or Realizable Goal?, Dorcas Quek Anderson Jan 2018

Achieving Substantive Justice In Mediation Through Procedural Justice: An Illusory Or Realizable Goal?, Dorcas Quek Anderson

Research Collection Yong Pung How School Of Law

Mediation has been plagued with a problem of legitimacy. Genn stated that mediation “does not contribute to substantive justice because mediation requires the parties to relinquish ideas of legal rights during mediation and focus, instead, on problem-solving”. Mediation appears to be all about procedural justice, a concept that is associated with perceptions of fair treatment. And procedural justice does not seem to have any discernible link with substantive justice, in terms of giving effect to well-accepted norms. This blog entry is drawn from a paper that was presented at the Australasian Dispute Resolution Research Network 6th Annual Roundtable and the LSAANZ …

Research Collection School Of Computing and Information Systems

The Internet has emerged as the most effective and a highly popular medium for advertising. Current contextual advertising platforms need publishers to manually change the original structure of their Web pages and predefine the position and style of embedded ads. Although publishers spend significant effort optimizing their Web page layout, a large number of Web pages contain noticeable blank regions. We present an innovative stylewise advertising platform for contextual advertising, called PageSense. The "style" of Web pages refers to the visual appearance of a Web page, such as color and layout. PageSense aims to associate style-consistent ads with Web pages. …

Online social media platforms generally attempt to mitigate hateful expressions, as these comments can be detrimental to the health of the community. However, automatically identifying hateful comments can be challenging. We manually label 5,143 hateful expressions posted to YouTube and Facebook videos among a dataset of 137,098 comments from an online news media. We then create a granular taxonomy of different types and targets of online hate and train machine learning models to automatically detect and classify the hateful comments in the full dataset. Our contribution is twofold: 1) creating a granular taxonomy for hateful online comments that includes both …

All Peer-Reviewed Publications

The shea caterpillar Cirina butyrospermi is an important insect, highly valued as a human food item in Burkina Faso. However, its appearance is seasonal due to its univoltine cycle. This study therefore investigated the possibilities of breaking the nymphal diapause by changing the environmental factors and through the hormonal treatment of prepupae and pupae using bovine insulin and 20-hydroxyecdysone. Changes in humidity and temperature did not result in emergence, suggesting a mandatory nature of the diapause in C. butyrospermi. Injection of 20-hydroxyecdysone between 20 and 40 ng on 20 C. butyrospermi pupae resulted in 15.24 and 47.5% emergence, respectively. The …

FAW is an invasive polyphagous pest that causes damage to economically important crops and has recently been reported in the Indian sub-continent. Effective control of FAW through use of synthetic chemical pesticides and genetically modified crops such as Bt maize faces challenges including improper use, unaffordability by smallholder farmers and development of resistance by the pest. Additionally, dispersal …

Independence And Impartiality Of Arbitrators: A Rule Of Law Analysis, Stefanie Schacherer Jan 2018

Independence And Impartiality Of Arbitrators: A Rule Of Law Analysis, Stefanie Schacherer

Research Collection Yong Pung How School Of Law

Investor-State dispute settlement (ISDS) through arbitration remains in a state of legitimacy crisis and discussions on reform are ongoing. Much of the criticism is focussed on who is deciding investment dispute cases. Investment arbitrators have been called “private judges” who operate in secrecy, are biased in favour of big multinational companies and have no regard for conflicts of interest. The course of the negotiations on the Transatlantic Trade and Investment Partnership between the European Union (EU) and the United States, highlighted to what extent ISDS through arbitration is perceived as unfair and biased (at least in Europe). As a reaction …

African American Faculty: A Study Of Their Experiences Related To Intercultural Competence At Predominantly White Institutions, Hervey A. Taylor Iii

University of the Pacific Theses and Dissertations

Underrepresentation of faculty of color in higher education is a phenomenon that has been studied and well documented by researchers for many years (e.g., Aguirre, 2000; Aguirre, Martinez, & Hernandez, 1993; Bair, Bair, Mader, Hipp, & Hakim, 2010; Chai et al., 2009; Collins, 1990; Turner & Myers, 2000). This issue is even more evident as it relates to the underrepresentation of African American faculty at predominantly White institutions (PWIs). Many studies have addressed the underrepresentation of African American faculty at PWIs (e.g., Alexander & Moore, 2008; Bower, 2002; Brown & Dancy, 2010; Cleveland, 2004).

According to the United States Department …

Design And In Vitro Characterization Of Lipids With A Ph-Sensitive Conformational Switch And Their Liposomes For Anticancer Drug Delivery, Shen Zhao

University of the Pacific Theses and Dissertations

The traditional anticancer drugs are distributed in vivo through systemic blood circulation with a very small portion reaching the tumor site. Targeted drug delivery systems are developed in efforts to concentrate the drug molecules in the tissue of interest while reducing the drug distribution to healthy tissues to reduce the side effects. Liposomes are colloidal systems composed of amphiphilic molecules that assemble into vesicle structures in aqueous media. They are common carriers for targeted drug delivery with the advantages of low toxicity, low immunogenicity and the ability of encapsulating both lipophilic and hydrophilic drugs.

Prior research indicated the advantages of …

Performance Pedagogy: Utilizing Alternative Methods In The Classroom, Alexander Paez

University of the Pacific Theses and Dissertations

Teaching methods and styles at the collegiate level have not changed all that much: Professors still generally give lectures from the lectern or stand in the front of the class, while writing on the board or pointing to a slide projected on a screen. Some questions and answers can occur with the occasional group activity; however, the focus seems always to come back to the text. Students read the required textbook, listen to a lecture and take tests. There are however alternative methods that engage the students as well as the professor in the learning process. Active learning is one …

Evidence That A Partner-Switching Regulatory System Modulates Hormogonium Motility In The Filamentous Cyanobacterium Nostoc Punctiforme, Kelsey Wynne Riley

University of the Pacific Theses and Dissertations

Partner-switching regulatory systems (PSRSs) are utilized by many different bacteria to regulate a wide array of cellular responses, from stress response to expression of virulence factors. The filamentous cyanobacterium Nostoc punctiforme can transiently differentiate motile filaments, called hormogonia, in response to various changes in the environment. Hormogonia utilize a Type IV pilus (T4P) complex in conjunction with a secreted polysaccharide for gliding motility along solid surfaces. This study identified three genes, designated hmpU, hmpW, and hmpV, encoding the protein components of a PSRS involved in regulation of hormogonium motility in N. punctiforme. Although mutant strains with in-frame deletions in hmpU, …

Rational Design Of Peptides Binding Towards Human Pd-L1 Using Knob-Socket Model, Xingchen Zha Jan 2018

Rational Design Of Peptides Binding Towards Human Pd-L1 Using Knob-Socket Model, Xingchen Zha

University of the Pacific Theses and Dissertations

Programmed death-ligand 1 (PD-L1) is a type 1 transmembrane protein that has been reported to play a vital role in mediating suppressed immunity. The interaction between PD-L1 and PD-1 delivers a negative signal that reduces the proliferation of these T cells and induces apoptosis at the same time. Antibodies that can block the Programmed death-ligand 1 (PD-L1) on tumor cells have been shown to alleviate cancer-induced immunosuppression. While antibodies have a great potential in various therapeutic uses, many drawbacks such as the high cost of production, huge molecular size, and poor permeability impose restrictions on the extensive use of full-length …

Holacracy And The Law, Matthew T. Bodie

All Faculty Scholarship

No law requires companies to have CEOs, officers, supervisors, chains of command, or even employees. But traditional managerial structures are so ingrained in our political economy that legal doctrines take them for granted. What if they were to disappear? Under holacracy, a new version of participatory management adopted at companies like Zappos and Medium, companies are replacing managers, organizational charts, and subordinates with governance circles, roles, and lead links. The promise of holacracy is a system of management that devolves responsibilities to teams, empowers workers to act freely within specified zones of authority, and energizes the entire organization around an …

Revisiting Innovative Technologies To Determine Substantial Similarity In Musical Composition Infringement Lawsuits, Yvette Joy Liebesman

All Faculty Scholarship

A music video by Sir Mashalot2 combines six award-winning popular country-western songs,3 demonstrating the amazing similarity among the tunes. Not mentioned by the mash-up4 artist is that none of the songs are infringing on any of the others. While all copied the same chord progressions, none copied any protected copyrightable expression, and thus none of the authors of the melodies are infringing.

It is often difficult to determine if there has been unlawful copying of a song. Currently, a judge or jury relies on music experts who analyze the songs based on a limited number of characteristics …
