Informing Quality In Emergency Care: Understanding Patient Experiences, Esmat Swallmeh, Vivienne Byers, Amr Arisha

Articles

Purpose: Assessing performance and quality in healthcare organisations is moving from focussing solely on clinical care measurement to considering the patient experience as critical. Much patient experience research is quantitative and survey based. The purpose of this paper is to report a qualitative study gathering in-depth data in an emergency department (ED).

Design/methodology/approach: The authors used empirical data from seven focus groups to understand patient experience as participants progressed through a major teaching hospital in an Ireland ED. A convenience sampling technique was used, and 42 participants were invited to share their perceptions and outline key factors affecting their journey. …

The Use, Integration And Perceived Value Of Performance Analysis To Professional And Amateur Irish Coaches, Denise Martin, Alan Swanton, Jonathan Bradley, Denise Mcgrath

Articles

Research into the perceptions, practices and engagement of coaches with performance analysis is fundamental to informing the continued development of the discipline and its practitioners. The aim of this study was to survey a large sample of coaches of varying profiles, regarding their use and integration of performance analysis, to explore its perceived value and barriers to its use. Survey data were analysed from 538 Irish coaches qualified at Level 1 and above (82% male), from 37 sports. A spectrum of coaches’ engagement with performance analysis, ranging from no formal performance analysis (49%), to coaches doing their own analysis (coach-as-analyst, …

Legal Jurisdiction And The Deterritorialization Of Data, Paul Schiff Berman Jan 2018

Legal Jurisdiction And The Deterritorialization Of Data, Paul Schiff Berman

GW Law Faculty Publications & Other Works

Electronic data—everything from e-mails and text messages to Facebook and Instagram posts to Twitter pronouncements to drone warfare data to search algorithms to financial transactions to cloud data storage—travels around the globe with little relationship to physical territory. In addition, all of this data is often in the custody and control of data intermediaries such as Google, Facebook, Twitter, Apple, Microsoft, Amazon, private military contractors, and so on.

Three important consequences flow from this ubiquitous technology-enabled, data-driven global societal activity. First, the territorial location of data becomes increasingly arbitrary and substantively unimportant. If I, as a U.S. citizen based in …

Emerging Policy And Practice Issues (2018), Steven L. Schooner, David Berteau

GW Law Faculty Publications & Other Works

This paper/chapter, presented at the West Government Contracts Year in Review Conference (covering 2017), attempts to identify the key trends and issues in U.S. federal procurement for 2017. Consistent with prior practice, this chapter offers extensive coverage of the federal procurement, grant, and defense spending trends and attempts to predict what lies ahead, particularly with regard to legislative and executive activity. The paper discusses, in addition to a deep dive into the spending data, the surprisingly slow pace of acquisition regulation promulgation, lack of progress with regard to infrastructure, changes to DoD's acquisition leadership and the USD(AT&L) reorganization, the OFPP …

Tale Of Three Regulatory Regimes -- Dynamic, Distracted And Dysfunctional: Sweden, The United Kingdom And The United States, Christopher R. Yukins, Andrea Sundstrand, Michael Bowsher Qc

GW Law Faculty Publications & Other Works

It was the best of times, it was the worst of times -- a year marked by genuine progress in public procurement law in some nations, and partial paralysis in others. This article presents the experience of Sweden (as part of the European Union), the United Kingdom (which is slated soon to depart from the EU, via “Brexit”), and the United States (in the first year of the Trump administration). While Sweden and other members of the European Union continue to develop a vital and evolving body of public procurement law, the United Kingdom has been distracted by Brexit, and …

False Claims Act: Greater Doj Scrutiny Of Frivolous Qui Tam Actions?, Steven L. Schooner Jan 2018

False Claims Act: Greater Doj Scrutiny Of Frivolous Qui Tam Actions?, Steven L. Schooner

GW Law Faculty Publications & Other Works

This short piece discusses recent (internal) Justice Department guidance for attorneys handling False Claims (FCA) Act cases. In a dramatic policy and practice shift, the memorandum recommends that “when evaluating a recommendation to decline intervention in a qui tam action, attorneys should also consider whether the government’s interests are served. . .by seeking dismissal pursuant to 31 U.S.C. § 3730(c)(2)(A).” The essay applauds DOJ's apparent acknowledgement that its attorneys have more than a pro forma duty to consider moving to dismiss frivolous qui tam suits.

The essay discusses DOJ's new rubric or menu of factors for deciding whether to dismiss …

Unbundling Populism, David Fontana Jan 2018

Unbundling Populism, David Fontana

GW Law Faculty Publications & Other Works

Populism is having its moment on our constitutional center stage, but the way we are treating this moment is adding to the risks that populism poses to our liberal democratic constitutional order. Populism has primarily been defined in our public discussions by the loudest self-identifying populists active in democratic politics at the moment. Populism has therefore often been treated as a bundled-together concept, merging not just anti-establishment sentiments, but also authoritarian and xenophobic ones as well. Populism is an eight-letter word that is then treated like a pejorative four-letter one. Populism, though, is a they, and not an it. The …

Cost-Plus Patent Damages, Michael B. Abramowicz Jan 2018

Cost-Plus Patent Damages, Michael B. Abramowicz

GW Law Faculty Publications & Other Works

This Article assesses recent proposals to use risk-adjusted costs of producing an invention as a basis for either setting patent damages or valuing patents taken by eminent domain. In theory, cost-plus damages can address one of the central challenges of patent law: ensuring that a patentee does not obtain excessive rents for an invention. But cost-plus damages have three principal problems. First, risk may be difficult to estimate, and estimates may be infected by hindsight. Second, if the permitted rate of return is too low, there may be insufficient incentives to invent.

Indeed, even a rate of return that seems …

The Golden Years, Gray Divorce, Pink Caretaking, And Green Money, Naomi R. Cahn Jan 2018

The Golden Years, Gray Divorce, Pink Caretaking, And Green Money, Naomi R. Cahn

GW Law Faculty Publications & Other Works

This Article considers the impact of changing family structures on aging in contemporary America. It looks at two critical and interrelated aspects of aging—economic security and caretaking—and offers policy suggestions on how to improve the financial stability of and caretaking possibilities for elders. The core thesis is that our current social, legal, and economic structure for growing old is organized around the nuclear family with respect to both caretaking and financial security. As family structures change in terms of partnering (and re-partnering and non-partnering) and number of children, and with the increase in economic inequality, support for old age needs …

Corruption In Public Education, Cade M. Olmstead Jan 2018

Corruption In Public Education, Cade M. Olmstead

Undergraduate Student Work

Public education is a key civil institution, and its functions have important implications for the well-being and development any modern society. But as a public institution, it is not free from crime and corrupt influence, especially in areas dealing with monetary exchange. Much research has been conducted looking at corruption, but investigations and analyses specifically concerned with corruption in education are sparse. Inquiries into the state of corruption in the former Soviet bloc and China are present but research into the United States’ situation has hitherto been neglected. Reliable data must first be identified before such analyses can take place. …

Moving Words: Building Community Through Service-Learning In The Arts, Anne Marie Gruber, Angela L. Pratesi, Angela Waseskuk

Library Faculty/Staff Publications

In this unique project, college students in a first-year Three-Dimensional Concepts art course are partnered with a local youth writing project to create short films based on participants’ writings. This experience was born out of a campus Service-Learning Institute (SLI) to train faculty on best practices. The mutual goals included giving voice to area youth and connecting college students to the community. All participants explored and reflected on the importance of community engagement and citizenship by acknowledging their similarities and differences through creative lenses.

Participants from both groups generated ideas through shared journal exercises that the youth writers then used …

Tom And Jerry: Performative Queerness In Action, Cade M. Olmstead Jan 2018

Tom And Jerry: Performative Queerness In Action, Cade M. Olmstead

Undergraduate Student Work

This presentation’s theoretical focus is a return to the performative dimension of identities and social life. Its vehicle for doing such is Tom and Jerry, a series of animation shorts. This American “cat chases mouse” series produced hundreds of shorts and has become a classic in American media memory. Drawing upon Judith Butler’s queer theoretical work and a justification from Eve Sedgwick, a selection of episodes has been subject to analysis. This analysis lays out basic descriptions of performative gender identity in the series while making a normative assessment of their effects. Ultimately, I claim that through ironic detachment, the …

Listening To The Song Of Life: An Autoethnographic Account Of Teaching An Undergraduate Listening Course, E. James Baesler

Communication & Theatre Arts Faculty Publications

A new approach to teaching the listening course at the undergraduate level provides opportunities for students to experience the SONG of life. SONG is an acronym for listening to the whole of life in the contexts of Self (e.g., discerning inner wisdom), Others (e.g., connecting with feelings and needs), Nature (beholding the beauty of nature), and God (e.g., discovering and connecting with the divine). A rationale and description of the new listening course is provided followed by a chronological autoethnographic account of teaching/learning the SONG of life using the four contexts as verses of the SONG with twenty undergraduate students …

Failing Better: Scaffolding Learning With The Metaliteracy Badging System, Kelsey L. O'Brien

University Libraries Faculty Scholarship

The Metaliteracy Badging System, collaboratively produced by educators from across the State University of New York (SUNY), has undergone several trials and transformations. Over the course of this iterative journey, this resource has served in often-unexpected ways as a flexible educational tool that facilitates meaningful curriculum design and collaborative teaching. This chapter provides an overview of the design and implementation of the system, along with our challenges and goals moving forward. Just as we teach our students to fail better, we too have drawn on our setbacks as opportunities for growth and improvement.

Rock ‘N’ Roll Radio: A Case Study Of ‘Tactics’ And Teenage Identity In Perth, Wa, 1955-1960, Lorna Baker

Theses : Honours

Post-war Australia was a time of celebration, of prosperity, abundance and consumerism. The booming economic and technological forces within Australia propelled the rise of popular culture and led to a transformation of traditions and identities. Most notable of these transformations was that of youth culture. The rise of the teenager, as a category of person and a consumer of culture, had an impact on the social interactions of many communities. At the same time, new technologies combined with newfound prosperity meant that popular culture, such as music, was available to all and radio became a prominent feature of everyday life. …

The Rhythmic, Harmonic And Phrasing Language Of Lennie Tristano: Analysis And Strategies For Incorporation In Modern Jazz Improvisation, Austin Salisbury Jan 2018

The Rhythmic, Harmonic And Phrasing Language Of Lennie Tristano: Analysis And Strategies For Incorporation In Modern Jazz Improvisation, Austin Salisbury

Theses : Honours

Pianist Lennie Tristano is regarded as one of the most original voices in jazz history. His uncompromising adherence to artistic ideals led to both great innovation and obscurity, limiting his impact on future generations of musicians. Until recently, his music has been largely overlooked by musicians and academics alike. Coinciding with a revival in interest in Tristano and his music by modern jazz musicians, this dissertation seeks to investigate the transferability of several aspects of Tristano’s rhythmic, harmonic and phrasing vocabulary to modern jazz improvisation. Building upon existing literature concerning his pedagogy and musical analysis, this research emphasises Tristano’s relevance …

A Survey To Investigate The Participation Of Female Jazz-Trained Instrumentalists At Waapa And In Perth’S Professional Music Scene, Talya Valenti Jan 2018

A Survey To Investigate The Participation Of Female Jazz-Trained Instrumentalists At Waapa And In Perth’S Professional Music Scene, Talya Valenti

Theses : Honours

Traditionally, men have dominated jazz music in terms of participation and professional acknowledgement, but even in present times, female instrumentalists remain under-represented in jazz performance and education. Various studies such as Kathleen M. McKeage’s Gender and Participation in Undergraduate Jazz Ensembles: A National Survey and Erin L. Wehr’s Understanding the Experiences of Women in Jazz: A Suggested Model, have produced statistics that illustrate the low participation of female instrumentalists in jazz, and have also provided social-psychological theories to explain why these patterns continue to prevail.

As a working jazz-trained female instrumentalist myself, I have noticed the under-representation of female jazz …

African American Faculty: A Study Of Their Experiences Related To Intercultural Competence At Predominantly White Institutions, Hervey A. Taylor Iii

University of the Pacific Theses and Dissertations

Underrepresentation of faculty of color in higher education is a phenomenon that has been studied and well documented by researchers for many years (e.g., Aguirre, 2000; Aguirre, Martinez, & Hernandez, 1993; Bair, Bair, Mader, Hipp, & Hakim, 2010; Chai et al., 2009; Collins, 1990; Turner & Myers, 2000). This issue is even more evident as it relates to the underrepresentation of African American faculty at predominantly White institutions (PWIs). Many studies have addressed the underrepresentation of African American faculty at PWIs (e.g., Alexander & Moore, 2008; Bower, 2002; Brown & Dancy, 2010; Cleveland, 2004).

According to the United States Department …

Performance Pedagogy: Utilizing Alternative Methods In The Classroom, Alexander Paez Jan 2018

Performance Pedagogy: Utilizing Alternative Methods In The Classroom, Alexander Paez

University of the Pacific Theses and Dissertations

Teaching methods and styles at the collegiate level have not changed all that much: Professors still generally give lectures from the lectern or stand in the front of the class, while writing on the board or pointing to a slide projected on a screen. Some questions and answers can occur with the occasional group activity; however, the focus seems always to come back to the text. Students read the required textbook, listen to a lecture and take tests. There are however alternative methods that engage the students as well as the professor in the learning process. Active learning is one …

Rational Design Of Peptides Binding Towards Human Pd-L1 Using Knob-Socket Model, Xingchen Zha Jan 2018

Rational Design Of Peptides Binding Towards Human Pd-L1 Using Knob-Socket Model, Xingchen Zha

University of the Pacific Theses and Dissertations

Programmed death-ligand 1 (PD-L1) is a type 1 transmembrane protein that has been reported to play a vital role in mediating suppressed immunity. The interaction between PD-L1 and PD-1 delivers a negative signal that reduces the proliferation of these T cells and induces apoptosis at the same time. Antibodies that can block the Programmed death-ligand 1 (PD-L1) on tumor cells have been shown to alleviate cancer-induced immunosuppression. While antibodies have a great potential in various therapeutic uses, many drawbacks such as the high cost of production, huge molecular size, and poor permeability impose restrictions on the extensive use of full-length …
