Liberals Vs Romantics: Challenges Of An Emerging Corporate International Criminal Law, Carsten Stahn Jan 2018

Liberals Vs Romantics: Challenges Of An Emerging Corporate International Criminal Law, Carsten Stahn

Case Western Reserve Journal of International Law

Holding bystanders and corporate agents accountable for international crimes is often at the periphery of international criminal justice. Based on its liberal foundations, international criminal law has traditionally been strongly centered on individual agency. In the industrialist cases after World War II, individual criminal responsibility was used to demonstrate and sanction corporate involvement in crime. Ideas of corporate criminal responsibility have been voiced in the post-war era and in the context of the negotiations of the Statute. In recent years, they have witnessed a renaissance in several contexts: the jurisprudence of the Special Tribunal for Lebanon, the Malabo Protocol of …

Historical Determinism And Women's Rights In Sharia Law, Mackenzie Glaze Jan 2018

Historical Determinism And Women's Rights In Sharia Law, Mackenzie Glaze

Case Western Reserve Journal of International Law

Although women's rights in many countries reflect Sharia Law, the interpretation of Sharia Law is not uniform across these countries. As a result, not all countries that follow Sharia Law protect women's rights to the same degree. We can hypothesize that the interpretation of Sharia Law in various countries, and therefore the protection of women's rights, is determined by the historical forces that have shaped that country's cultural life. To test this hypothesis, this Note traces the history of three countries in order to explore what led each country to develop vastly different beliefs surrounding the rights of women under …

Rising Levels Of Temperature And Co2 Antagonistically Affect Phytoplankton Primary Productivity In The South China Sea., Yong Zhang, Tifeng Wang, He Li, Nanou Bao, Jason M. Hall-Spencer, Kunshan Gao Jan 2018

Rising Levels Of Temperature And Co2 Antagonistically Affect Phytoplankton Primary Productivity In The South China Sea., Yong Zhang, Tifeng Wang, He Li, Nanou Bao, Jason M. Hall-Spencer, Kunshan Gao

School of Biological and Marine Sciences

Coastal and offshore waters in the South China Sea are warming and becoming acidified due to rising atmospheric levels of carbon dioxide (CO2), yet the combined effects of these two stressors are poorly known. Here, we carried out shipboard incubations at ambient (398 μatm) and elevated (934 μatm) pCO2 at in situ and in situ+1.8 °C temperatures and we measured primary productivity at two coastal and two offshore stations. Both warming and increased CO2 levels individually increased phytoplankton productivity at all stations, but the combination of high temperature and high CO2 did not, reflecting an antagonistic effect. Warming decreased Chl …

Regulating For Creativity And Cultural Diversity: The Case Of Collective Management Organisations And The Music Industry, John Street, Dave Laing, Simone Schroff Jan 2018

Regulating For Creativity And Cultural Diversity: The Case Of Collective Management Organisations And The Music Industry, John Street, Dave Laing, Simone Schroff

School of Law, Humanities and Social Sciences

This paper explores the role of intermediary institutions in promoting creativity and cultural diversity in the music industry, and the impact of cultural policy on the performance of those intermediaries. It reviews some of the existing literature on the relationship between economic conditions and innovation in music, and argues that too little attention has been paid to intermediaries. Focusing on collective management organisations (CMOs) as one example of overlooked intermediaries, we illustrate, by way of comparison, the different priorities and incentives that drive CMO practice. These variations, we suggest, are important to appreciating how CMOs operate as intermediaries in different …

Nupt St-Data Miner: An Spatio-Temporal Data Analysis And Visualization System, Zhiqiang Zou, Junjie Xiong, Xuerong He, Haihong Dai

Computer Science Faculty Research & Creative Works

Given the increasing popularity and availability of location tracking devices, large quantities of Spatio-Temporal data (ST-data) are available from many different sources. For the ST-data, reflecting the mobile characteristic of the world, it is essential to build a functional system to perform quickly interactive analysis. In this paper, we present an analysis and visualization system, NUPT ST-data Miner, which facilitates users to visualize and analyze ST-data. It (1) provides a flexible and extensible framework based on cloud computing platform, (2) is able to quickly retrieve specified ST-data, (3) integrated multiple functions for the ST-data. To demonstrate its efficiency, we validate …

Inequities In Antenatal Care, And Individual And Environmental Determinants Of Utilization At National And Sub-National Level In Pakistan: A Multilevel Analysis, Ambreen Sahito, Zafar Fatmi

Community Health Sciences

Background: Nationally representative surveys are vital for gauging progress in health and planning health services. However, often marred with inadequate analysis to provide any guidance to health policy and planning. Most recent Pakistan Demographic and Health Survey (PDHS) 2012-2013 is an inclusive nationally representative investigation. Nonetheless, its published report offers limited evidence regarding antenatal care (ANC). Furthermore, after 18th constitutional amendment, policies are principally made at provincial level in Pakistan; therefore, it is imperative to have contextual evidence at sub-national level to feed programs and policies.
Methods: We analysed 7142 women with a recent birth, to assess the …

Recorded Objects: Time Based, Technologically Reproducible Art, 1954-1964, Gerald J. Hartnett Jan 2018

Recorded Objects: Time Based, Technologically Reproducible Art, 1954-1964, Gerald J. Hartnett

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

Illuminating experimental, time-based, and technologically reproducible art objects produced between 1954 and 1964 to represent “the real,” this dissertation considers theories of mediation, ascertains vectors of influence between art and the cybernetic and computational sciences, and argues that the key practitioners responded to technological reproducibility in three ways. First of all, writers Guy Debord and William Burroughs reinvented appropriation art practice as a means of critiquing retrograde mass media entertainments and reportage. Second, Western art music composer Richard Maxfield mobilized chance techniques and indeterminacy to resist scientific and philosophical determinism’s pervasive influences upon post-1945 art and life. Third, author and …

Understanding Nitrogen Uptake In The Rhizosphere Of A Mycorrhizal Fungus And Plant System, Tiffany Whitney Victor Jan 2018

Understanding Nitrogen Uptake In The Rhizosphere Of A Mycorrhizal Fungus And Plant System, Tiffany Whitney Victor

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

The mechanistic links between plants and growth promoting micro-organisms in an eco-system involved in the production of biomass are currently very poorly understood. Observing the nutrient changes in the rhizosphere is a key step to understanding the molecular dynamics involved in these symbiotic interactions and nutrient pathways that facilitate plant growth. To study such a nutrient flow, a new application of Fourier Transform Infrared Imaging (FTIRI) was developed that entailed growing Populus tremuloides seedlings on a thin, nutrient-enriched Phytagel matrix that allows pixel to pixel measurement of the distribution of nutrients, in particular, nitrate and ammonium and sucrose added as …

Using Instructed Response Times To Compare Inattentive Responding Across Paper And Online Modalities: Measuring Research Participant Inattention, Olivia B. Brooks Jan 2018

Using Instructed Response Times To Compare Inattentive Responding Across Paper And Online Modalities: Measuring Research Participant Inattention, Olivia B. Brooks

EWU Masters Thesis Collection

It is important to examine the equivalence of paper and online data collection methods across several domains. The current study compared paper versus online modalities from a data quality standpoint, with a specific focus on inattentive (i.e., careless) responding by using an easily-implemented method to capture participants’ careless responses: interspersing instructed response items (e.g., “Please select option 3, ‘Strongly disagree,’”) throughout a collection of 15 established measures. A between-subjects design compared the percentage of instructed response items missed (hence, inattentive responses) across three conditions: 1) lab paper, 2) lab online, and 3) non-lab online. The non-lab online condition was predicted …
