“A Promise To Support Us:” Undocumented Experiences On A Sanctuary Campus, Elaine Allard, Jonathan Hamel Sellman , '19, Brandon Torres , '18, Sydnie Schwarz , '20, Freddy Bernardino , '18, Rebecca Castillo , '20

Educational Studies Faculty Works

This exploratory study examines the experiences of undocumented students at Hawthorne College, an elite, liberal arts institution with sanctuary status. Drawing primarily on a questionnaire and qualitative interviews, it considers 1) whether undocumented and Deferred Action for Childhood Arrivals (DACA) students on a sanctuary campus experience the characteristic psychosocial difficulties that mark the lives of undocumented students elsewhere and 2) the extent to which institutional policies mitigate these challenges. The research reveals that sanctuary is neither a panacea for undocumented students’ concerns nor is it a meaningless symbol. Students are protected from some typical barriers to college success, experience other …

The first half of the article surveys the ABA’s involvement in rule of law initiatives. Part I explores the origins of the ABA’s work in this field, which date back to the organization’s founding and took shape after the demise of the former Soviet Union. Part II surveys the expansion of the ABA’s programs beyond Eastern Europe to other regions—a growth …

Access To Justice Through Limited Legal Assistance, Deborah L. Rhode, Kevin Eaton, Anna Porto Jan 2018

Access To Justice Through Limited Legal Assistance, Deborah L. Rhode, Kevin Eaton, Anna Porto

Northwestern Journal of Human Rights

This article describes an empirical survey of a limited legal assistance program designed to assist low-income individuals with family law matters. It begins by exploring the need for such research, given the nation’s shameful level of unmet legal needs, and the lack of rigorous evaluation of strategies designed to address those needs. The article discussion then describes the methodology of a survey of Alaska Legal Services’ limited legal assistance program, and the survey’s major findings. Among the most critical conclusions are that limited assistance is a cost-effective use of resources, but that more effort should center on provision of hands-on …

Housing Defense As The New Gideon, Kathryn A. Sabbeth Jan 2018

Housing Defense As The New Gideon, Kathryn A. Sabbeth

Faculty Publications

New York City is the first jurisdiction in the United States to create a right to appointed counsel for poor people facing eviction. This Article is the first to analyze NYC’s ground-breaking legislation. The Article draws on NYC’s housing defense statute to highlight three ways in which the creation of a civil right to counsel has the potential to build on and expand beyond the Gideon v. Wainwright model. The right to appointment of criminal defense counsel, as recognized in Gideon, was part of the Supreme Court’s indirect response to the Civil Rights Movement. In contrast, the NYC legislature …

Ethics In The Legal Industry, Michael Ariens Jan 2018

Ethics In The Legal Industry, Michael Ariens

Faculty Articles

A brief item in the Hearsay section of the June 2017 ABA Journal was headlined "2%." This number indicated an increase in the percentage of lawyers, from 2012 to 2016, "who worked remotely within the legal industry." Making one's "office" a location other than the physical space leased or owned by oneself or by an employer is hardly news, even as applied to the work of lawyers. Lawyers know as well as anyone that technology allows one to work almost anywhere and, unfortunately, almost any time. What is striking in this brief news item is the use by the flagship …

Intimate Partner Violence In Mexico: An Analysis Of The Intersections Between Machismo Culture, Government Policy,And Violence Against Women (2018), Stefany Sterling

International Studies Undergraduate Honors Theses

This paper investigates the root causes of intimate partner violence against women in Mexico, as well as the factors that are closely linked to an increased risk of partner abuse. Intimate partner violence is commonly referred to as gender-based violence, or any form of recurring physical, emotional, economic, or sexual abuse against one’s partner. Gender-based violence is a global problem and is prevalent in many Latin American countries. Mexico has some of the highest rates of intimate partner violence in the region, and for this reason will be the focus of the study. “Machismo culture” is the Latin American variant …

Lawyers Serving Gods, Visible And Invisible, Jonathan R. Cohen Jan 2018

Lawyers Serving Gods, Visible And Invisible, Jonathan R. Cohen

UF Law Faculty Publications

A critique of the American legal profession can be framed through the metaphor of idolatry, specifically the proclivity of lawyers to serve visible rather than invisible interests in their work. This proclivity has ramifications ranging from broad matters like lawyers' responses to deeply embedded social injustices to specific matters such as the excessive focus on pecuniary interests in ordinary legal representation and the high level of dissatisfaction that many lawyers experience in their careers. Using as a lens biblical teaching concerning idolatry, this article begins by describing "visible" as opposed to "invisible" interests in the context of legal practice. It …

A Simple Low-Cost Institutional Learning-Outcomes Assessment Process, Andrea A. Curcio Jan 2018

A Simple Low-Cost Institutional Learning-Outcomes Assessment Process, Andrea A. Curcio

Faculty Publications By Year

Law school institutional learning outcomes require measuring nuanced skills that develop over time. Rather than look at achievement just in our own courses, institutional outcome-measures assessment requires collective faculty engagement and critical thinking about our students’ overall acquisition of the skills, knowledge, and qualities that ensure they graduate with the competencies necessary to begin life as professionals. Even for those who believe outcomes assessment is a positive move in legal education, in an era of limited budgets and already over-burdened faculty, the new mandated outcomes assessment process raises cost and workload concerns. This essay addresses those concerns. It describes a …

Legal Deserts: A Multi-State Perspective On Rural Access To Justice, Lisa R. Pruitt, Amanda L. Kool, Lauren Sudeall, Michele Statz, Danielle M. Conway, Hannah Haksgaard

Faculty Publications By Year

Rural America faces an increasingly dire access-to-justice crisis, which serves to exacerbate the already disproportionate share of social problems afflicting rural areas. One critical aspect of the crisis is the dearth of information and research regarding the extent of the problem and its impacts. This Article begins to fill that gap by providing surveys of rural access to justice in six geographically, demographically, and economically varied states: California, Georgia, Maine, Minnesota, South Dakota, and Wisconsin. In addition to providing insights about the distinct rural challenges confronting each of these states, the legal resources available, and existing policy responses, the Article …
