The impetus for the recognition of the need for legal partners in healthcare came from Boston City Hospital in 1993. The hospital provided care to the largest uninsured and underinsured population in the New England states. The pediatric patients were noted by Dr. Barry Zuckerman to have difficulty in recovering from medical illnesses. He linked their inability to improve their health to poor housing, food insecurity, and basic social determinants of health. His hiring of a part-time lawyer led to a national movement for the development of medical-legal partnerships. The American Bar Association, the National Center for Medical-Legal Partnerships at …

Casco Northern Bank V. Jbi Associates: Imputed Disqualification For Maine's Migratory Lawyer, Michael J. Canavan
Maine Law Review
The practice of law in Maine, as elsewhere in the United States, is changing. Problems that previously have been considered insignificant are more pronounced because of the increase in the number of practicing attorneys. One problem likely to be confronted by Maine lawyers on an increasing basis is that of determining the appropriateness of representing a party against a former client of the lawyer or the lawyer's firm. This problem is complicated by today's competitive job market for lawyers, which forces inexperienced lawyers to switch firms more frequently than in the past. While it is a generally accepted axiom that …

Addressing Extreme Vulnerability: Remaining Barriers To Neonatal Healthcare Delivery In Conflict Areas, Olivia Palmer
Addressing Extreme Vulnerability: Remaining Barriers To Neonatal Healthcare Delivery In Conflict Areas, Olivia Palmer
Independent Study Project (ISP) Collection
Global statistics show that world-wide neonatal mortality rates are not yet within the target range set by Sustainable Development Goals and reflect persistent violations of the fundamental right to health for newborns around the world. While there is a wide base of knowledge on the main causes of death and minimum standards of care for neonatal health in stable and low-resource settings, there is a significant gap in knowledge regarding the unique circumstances of neonatal healthcare situated in conflict settings. The main objectives of this research are to elaborate on the current state of neonatal healthcare in conflict areas and …

How Technology Has Changed Direct Selling, Robert Anthony Norris
How Technology Has Changed Direct Selling, Robert Anthony Norris
Honors Projects in Marketing
Traditional direct selling has undergone a dramatic transformation as new technology, products, and methods have developed over the last few years. The industry has adapted to these advancements in order to stay relevant in today’s changing market place. In some ways, these technological advancements have created opportunities, though some believe the essence of direct selling is now at risk. There has been little research in the field of direct selling and even less on the impact technological advances have on the industry or players involved. The purpose of this research is to uncover how the development of technology and social …

Privileging Public Defense Research, Janet Moore, Ellen Yaroshefsky, Andrew L. Davies
Faculty Articles and Other Publications
Empirical research on public defense is a new and rapidly growing field in which the quality of attorney-client communication is emerging as a top priority. For decades, law has lagged behind medicine and other professions in the empirical study of effective communication. The few studies of attorney-client communication focus mainly on civil cases. They also tend to rely on role-playing by non-lawyers or on post hoc inquiries about past experiences. Direct observation by researchers of real-time defendant-defender communication offers advantages over those approaches, but injecting researchers into the attorney-client dyad is in tension with legal and ethical precepts that protect …
Coming Off The Bench: Self-Represented Litigants, Judges And The Adversarial Process, Jennifer Leitch
Coming Off The Bench: Self-Represented Litigants, Judges And The Adversarial Process, Jennifer Leitch
Canadian Forum on Civil Justice
In 1976, Abram Chayes explained how a paradigm shift was taking place in civil litigation. Procedural innovations were linked to a series of substantive changes in the American legal order that signaled a move away from a traditional private law model of litigation toward a newer and more expansive public law model of litigation. In charting this shift, Chayes explored a whole new approach to thinking about the legal process undertaken by judges. His overall assessment was very much to the point: “our traditional concept of adjudication and the assumptions on which it is based provide an increasingly unhelpful, indeed …

An Examination Of Sectoral Growth’S Impact On Income Inequality In The United States, Josh Paton
An Examination Of Sectoral Growth’S Impact On Income Inequality In The United States, Josh Paton
Honors Projects in Economics
This paper is threefold in purpose; it aims to explore the relationship between the growth of manufacturing and service sectors and income inequality, determine if GDP growth helps reduce income inequality, and establish the existence of the Kuznets Curve from 1967-2017. The data supports an inverse relationship between growth in the manufacturing sector and income inequality however is not sufficient enough to conclude growth in the manufacturing sector impacts income inequality. Growth of GDP is shown to decrease income inequality which supports the notion that “a rising tide lifts all boats” and makes everyone better off than before. The positive …

Accessible Reliable Tax Advice, Emily Cauble
Accessible Reliable Tax Advice, Emily Cauble
University of Michigan Journal of Law Reform
Unsophisticated taxpayers who lack financial resources are disadvantaged by a shortage of adequate tax advice. The IRS does not have the resources to answer all questions asked, and the IRS’s informal advice comes with no guarantee as to its accuracy and offers the taxpayer no protection when it is mistaken. Furthermore, non-IRS sources of advice have not sufficiently filled the void left by a lack of satisfactory IRS guidance. These biases against unsophisticated taxpayers have been noted by existing literature. This Article contributes to existing literature by proposing several novel reform measures to assist unsophisticated taxpayers.
First, with respect to …
Establishing A More Effective Safmr System: The Cost And Benefits Of Hud's 2016 Small Area Fair Market Rent Rule, John Treat
University of Michigan Journal of Law Reform
This Note analyzes the new HUD rule finalized in November 2016, which dramatically changed the structure of the Housing Choice Voucher program in select metropolitan areas. In August 2017, HUD suspended automatic implementation of the rule until 2020 for twenty-three of the twenty-four selected metropolitan areas, but in December 2017, a preliminary injunction was granted requiring HUD to implement the rule as of January 1, 2018. The rule as written changes the method for calculating the vouchers from using a metropolitan area-wide average to calculating a separate level for each zip code. Such a change could greatly deconcentrate poverty and …

Navigating The New York Courts With The Assistance Of A Non-Lawyer, Fern Fisher
Dickinson Law Review (2017-Present)
This Article discusses a program implemented by the New York State Unified Court System in order to address the justice gap for unrepresented litigants. Part I of this Article discusses the process behind creating the New York Navigator’s Program (discussed in more detail Part II), a program designed to help non-lawyer “Navigators” to assist unrepresented litigants in a limited capacity when the litigants appear before different types of state courts. The Navigators must complete training before they are able to assist the litigants. This program has been well received, as Part IV discusses, and has helped more and more unrepresented …

Washington’S Limited License Legal Technician Rule And Pathway To Expanded Access For Consumers, Stephen R. Crossland, Paula C. Littlewood
Dickinson Law Review (2017-Present)
Washington’s 2012 adoption of a Limited License Legal Technician (LLLT) rule has been a topic of great interest throughout the United States and elsewhere. This Article is co-written by Steve Crossland, who is the Chair of the Washington Supreme Court’s Limited License Legal Technician Board, which is responsible for implementing the rule, and Paula Littlewood, who is the Executive Director of the Washington State Bar Association, which is the unified bar association charged, inter alia, with lawyer and LLLT regulation. This Article builds on the authors’ previous articles about Washington’s LLLT program by providing previously unpublished information about the …

Parenting In The Context Of Deportation Risk, Jodi Berger Cardoso, Jennifer L. Scott, Monica Faulkner, Liza Barros Lane

Nearly 5.1 million children younger than age 18 live with at least one undocumented parent, about 7% of the U.S. child population. Between 2010 and 2013, an estimated 300,000 parents of U.S. citizen children were deported. Raising children in the context of deportation risk increases overall parenting stress for undocumented Latino parents. To investigate this and understand the experience of undocumented parenting, the authors interviewed 70 undocumented parents in two Southwest cities from 2012 to 2013. The authors frame their analysis using the lens of the problem of “illegality.” There are three domains of stressors associated with parenting in the …
“Encroachments And Oppressions”: The Corporatization Of Procedure And The Decline Of Rule Of Law, J. Maria Glover
“Encroachments And Oppressions”: The Corporatization Of Procedure And The Decline Of Rule Of Law, J. Maria Glover
Georgetown Law Faculty Publications and Other Works
This Article begins by providing a brief account of the corporatization of procedure through judicial decision-making and noting some of the detrimental effects it has had on the preservation of rule of law and access to justice. Part II goes on to explore how the judiciary does not retain full control over procedure and how corporate entities have little care for whether a procedural reform simply cuts back at litigation or goes further and cuts back at judicial power and the judicial role itself. To illustrate these points, Part II examines the most recent attempt at "procedural reform" by corporate …
