Community Support Systems For Reentering Young Adults, Samantha Staffin

Honors Scholar Theses

Young adults reentering into society after incarceration encounter a variety of obstacles that make their transition particularly difficult. Recidivism is a threat that becomes increasingly present in an environment that has negative societal pressures. In consideration of this, the presence of a healthy community support system is crucial for this population. In depth interviews were conducted with seven young adult participants of the Reentry Program at Our Piece of the Pie, Incorporated (OPP) to determine the quality of their current community support systems. Based on the information collected from interviews, it is evident that the full needs of the population …

Ten Ideas For Community Based Justice, Ab Currie Dec 2018

Ten Ideas For Community Based Justice, Ab Currie

Canadian Forum on Civil Justice

Community-based legal services have long been a part of national legal services programs in countries that introduced legal aid programs in the early years of the access to justice movement. Because of inadequate funding for legal services the pressure to do more with less has been a constant in legal aid and access to justice services. This rationing of resources has driven much creativity, innovation and a wealth of ideas for improving the delivery of legal services and continues to do so. The ten ideas about community-based justice presented in this short paper are a small part of that much …

Public And Private Spending On Justice In Canada, Lisa Moore, Mitchell Perlmutter, Trevor C. W. Farrow Dec 2018

Public And Private Spending On Justice In Canada, Lisa Moore, Mitchell Perlmutter, Trevor C. W. Farrow

Canadian Forum on Civil Justice

As a ubiquitous aspect of everyday life, it should come as little surprise that legal problems have a tremendous cumulative cost on society. Assessing the cost of civil, family and criminal justice problems in Canada is a complex and multifaceted undertaking, owing in part to the number of agencies involved in the administration of justice, the various types of justice system expenses, and the intangible and ‘knock on’ costs that often result from experiencing legal problems. Further, costs can be examined in monetary, temporal, personal, physical health, mental health and other terms. The monetary costs are of course the most …

Social And Economic Adversity Experienced By Canadians And Everyday Legal Problems, Ab Currie, Lisa Moore

Canadian Forum on Civil Justice

As part of a national study on the Cost of Justice by the Canadian Forum on Civil Justice (CFCJ), over 3,000 adults in Canada were asked about their experiences with civil and family justice problems and their views on the justice system in Canada. Additionally, survey participants were asked generally if over several years they had experienced ongoing issues with debt, finding or securing good and affordable housing or with unemployment. These specific areas were canvassed as possible indicators of larger, persistent issues related to social adversity in their lives. This paper draws on findings from the Everyday Legal Problems …

History And Harvard Law School, Bruce A. Kimball, Daniel R. Coquillette Dec 2018

History And Harvard Law School, Bruce A. Kimball, Daniel R. Coquillette

Fordham Law Review

In their seminal article, Alfred Konefsky and John Henry Schlegel saw institutional histories of law schools as the graveyard of academic reputations. So why write institutional histories? Due to the leadership of Robert Kaczorowski and William Nelson, and the generosity of Fordham University School of Law and New York University School of Law, an important conference took place between July 2 and July 4, 2018, at New York University’s Villa La Pietra outside of Florence. The purpose was to encourage good institutional history and to define its value. We had recently published the first volume of a new history of …

A Framework For Thinking About Law School Affordability, Sandy Baum, Accesslex Institute

Commissioned Research

This research report, authored by Sandy Baum, Ph.D., explores the most constructive ways to think about the affordability of legal education in the context of trends in law school enrollment, prices, debt and employment. However, the report cautions that law school affordability cannot be evaluated through simple metrics; it must be measured by taking into account the lifetime value of the investment. The report was commissioned by AccessLex Institute to add to the public discourse about what makes law schools affordable for students in different circumstances.

Education Doctoral

Research confirms that a comprehensive, replicable healthcare model for services while incarcerated, and a reentry program that recognizes both the medical and social needs of the incarcerated are beneficial for the individual, and the community. In this qualitative descriptive study, the intention was to add to the body of knowledge; the elements required to provide comprehensive medical and social services while incarcerated and when transitioning …

Breaking The Silence: Holding Texas Lawyers Accountable For Sexual Harassment, Savannah Files

St. Mary's Journal on Legal Malpractice & Ethics

Following the 2017 exposure of Harvey Weinstein, the #MeToo movement spread rapidly across social media platforms calling for increased awareness of the prevalence of sexual harassment and assault and demanding change. The widespread use of the hashtag brought attention to the issue and successfully facilitated a much-needed discussion in today’s society. However, this is not the first incident prompting a demand for change.

Efforts to bring awareness and exact change in regards to sexual harassment in the legal profession date back to the 1990s. This demonstrates that the legal profession is not immune from these issues. In fact, at least …

A Conversation With The Honorable Rosalie Silberman Abella And Dean Matthew Diller, Rosalie Silberman Abella, Matthew Diller

Fordham Law Review

DEAN MATTHEW DILLER: This year we are leading up to our celebration of 100 Years of Women at Fordham Law School. In September 1918, the Fordham Law faculty voted to admit women, and we are planning to celebrate that in style. But tonight perhaps is a bit of a teaser for that. Justice Rosalie Silberman Abella is a woman of firsts. She is the first Jewish woman to sit on the bench of the Supreme Court of Canada, and before the Supreme Court, when she was appointed to the Ontario Family Court in 1976, she became the first Jewish woman …

Conflicts Of Interest And Law-Firm Structure, Cassandra Burke Robertson Dec 2018

Conflicts Of Interest And Law-Firm Structure, Cassandra Burke Robertson

St. Mary's Journal on Legal Malpractice & Ethics

Business and law are increasingly practiced on a transnational scale, and law firms are adopting new business structures in order to compete on this global playing field. Over the last decade, global law firms have merged into so-called “mega-brands” or “mega-firms”—that is, associations of national or regional law firms that join together under a single brand worldwide. For law firms, the most common mega-firm structure has been the Swiss verein, though the English “Company Limited by Guarantee” structure is growing in popularity as well, as is the similar “European Economic Interest Grouping.” All of these structures allow related entities to …

Tracking Colorado Legislation, Robert Linz

Other Faculty Publications

When the 72nd General Assembly commences in January 2019, many researchers will want to follow the developing legislation. In the Second Regular session of the 71st General Assembly, the House considered 441 bills and the Senate considered 280 bills on a wide range of subjects, both controversial and mundane.1 Researchers need a way to sift through this large amount of legislation so they can track legislation pertinent to them through the legislative process. h e General Assembly’s website offers one approach. So too do commercial services, which of er not only access to the status of legislation and documents created …

China’S Belt And Road Initiative And Asean’S Maritime Cluster, Hans-Dieter Evers, Thomas Menkhoff Dec 2018

China’S Belt And Road Initiative And Asean’S Maritime Cluster, Hans-Dieter Evers, Thomas Menkhoff

Research Collection Lee Kong Chian School Of Business

This paper centres around China’s Belt and Road Initiative (BRI) and makes a case for further examining the possible effects of the complementary ‘Maritime Silk Road’ on Southeast Asia’s maritime clusters with reference to Singapore, Malaysia and Indonesia. Port development with “Chinese engagement” from Port Klang in Malaysia to Sri Lanka to Gwadar in Pakistan to some Gulf state ports to Piraeus in Greece provides a string of valuable pearls in the form of harbours from which adjoining areas can be serviced through feeder vessels or railway lines by Chinese government-linked companies. Whether China’s heavy investments in land and maritime …

Ip Rights And Indigenous Rights: Between Commercialization And Humanization Of Traditional Knowledge, Julie Yassine Dec 2018

Ip Rights And Indigenous Rights: Between Commercialization And Humanization Of Traditional Knowledge, Julie Yassine

San Diego International Law Journal

The relevance of traditional knowledge is undeniable, but the only question that remains is how to protect it. Does IP law provide adequate and sufficient protection for traditional knowledge? Can it accommodate the particularities of indigenous groups without affecting their aspirations and inspirations? Applying IP law to traditional knowledge is highly contested by indigenous communities, as it can effectively lead to a community’s partial or total commercialization, which requires some efforts to “humanize” it for further adaptation to the context of indigenous rights.
