Economic Analysis Of The Interaction Between National Legal Systems: A Contribution To The Understanding Of Legal Diversity And Legal Unity, Hugues Bouthinon-Dumas
Journal of Civil Law Studies
Scholars increasingly use expressions such as “regulatory com-petition” or even “law market” to illustrate the new global legal system and the rivalry between national laws. This paper scrutinizes the legitimacy of the application of such economic concepts to legal systems’ interactions. An economic analysis could allow us to, more precisely, delimit the factors of convergence (leading to unity) and divergence (leading to diversity) between national legal systems due to competitive strategies (namely differentiation and alignment) and the consequences for the regulation of legal systems’ interactions.

The corporate human rights development was fueled by the increasing amount of fines imposed on both European and national level. For many years, the jurisprudence of the ECtHR has classified administrative, including competition law enforcement as a quasi-criminal process during which human rights shall be respected to a certain extent. This paper strives to explain the evolution of competition law enforcement in Hungary, with procedural safeguards protecting undertakings having come close to the level of protection provided under criminal law. The Supreme Court Decision No.22 P / HAM / 2018 has canceled Permenkumham Number 1 Year 2018 because it contradicts Law Number 18 Year 2003. In theory, law school rankings merely describe law schools as they are, providing basic details about each school that may be relevant to prospective law students. In practice, however, law school rankings have a tremendous influence on law students and the legal profession. For better or for worse, the rank of a given student’s school will often have a substantial impact on the arc of his or her legal career.
Rankings also have a tremendous influence on law schools themselves. One source of this influence is that a high ranking draws strong candidates, and strong candidates reinforce the high ranking. …

Review of law sciences
The article discusses the legal issues of using artificial intelligence in jurisprudence. The author analyzes the legislation and law enforcement practice of foreign countries such as the USA, Great Britain, Australia, Russia, Kazakhstan, as well as the resolution of the European Parliament and the WIPO materials on the use of artificial intelligence. The features of the legislation and practice of the Republic of Uzbekistan on the use of artificial intelligence are revealed. In conclusion, the author gives reasonable conclusions on the improvement of legislation in relation to artificial intelligence in jurisprudence.

Outcome prediction has always been an important part of practicing law. Clients rely heavily on their attorneys to provide accurate assessments of the potential legal consequences they face when making important decisions (such as whether to accept a plea bargain, or risk a conviction on a much more serious offense at trial). And yet, notwithstanding its enormous importance to the practice of law (and notwithstanding the handsome legal fees it commands), outcome prediction in the law remains a very imprecise endeavor. Incentivizing Transparency: Agricultural Benefit Corporations To Improve Consumer Trust, Kathryn Smith

In the face of inadequate, often abysmal agricultural practices and laws that enable them, producers who provide the social good of transparency should receive a benefit. Amidst the debate that all benefit corporations should qualify for special tax treatment, this Comment proposes the development of a federal benefit corporation class offering special tax treatment to worthy agricultural producers. By reallocating current agricultural subsidies, Congress can feasibly correct the agricultural industry’s failure to adequately inform consumers.

It is well established that home conditions are linked to the health outcomes of occupants. There are over 880,000 housing units in Clark County, Nevada; nearly half of those are renter-occupied units (ROUs). Currently, there is limited research on the characteristics of environmental hazards found in Clark County ROUs and the strength of habitability statutes created to protect tenants from substandard housing. Understanding how renters in Clark County are affected by environmental hazards in ROUs and the processes by which landlords and tenants resolve grievances related to those hazards would benefit public health. The state is a powerful force in private life; families that challenge its framework face erasure or sanction. From what ideals do these families deviate? This paper investigates that question in relation to childrearing. Through a content analysis of three court-approved parenting courses for separating or divorcing parents, I explore what constitutes proper parenting in the eyes of the state. Drawing from the literature on ideologies of family and self, I find courses 1) make efforts to explicitly challenge dominant ideologies of family and parenting while implicitly naturalizing them and 2) grapple to reconcile the logics of intensive parenting and …

The US Department of Education is supposed to use its computers to match its borrowers who now suffer from total permanent disabilities based on Social Security or Veteran Administration rolls. If the borrower has been disabled for more than five consecutive years, then deductions for unpaid student loans are supposed to cease.
A report from the U.S. Government Accountability Office, a federal agency that reviews government work, shows that the program, now a computerized system that matches Social Security numbers, fails to identify thousands of individuals who deserve student debt relief.

This Capstone explores the potential for museums to be agents of social change in their communities through exhibition interactives that promote civic engagement. Derived from two linked movements of the progressive education pedagogy and the community-centered museum, these interactives allow museums to take an active role in their communities. Three recent case studies that encouraged and empowered their visitors to take action in their communities are analyzed. This analysis reveals key factors that enabled the three institutions to collaborate and co-create with community members to create these interactives. Improving Access To Justice By Enforcing The Free Speech Clause, Michele Cotton

State laws often make it a crime for a nonlawyer to give a person “legal advice,” even though it is speech of a sort that is usually protected by the First Amendment. As this article demonstrates, appellate courts have been unanimous in their conclusion that such speech is not protected, seemingly settling the issue. However, this article shows that these decisions are scattershot in their approaches, unconvincing in their reasoning, and inept at applying existing First Amendment precedents. In fact, Supreme Court jurisprudence indicates that unauthorized practice of law restrictions against nonlawyers giving legal advice violate the Free Speech Clause. …

In this nonpayment case, the tenant moved to dismiss the petition. The court ultimately dismissed the petition considering the evidentiary materials: cancelled checks, petitioner's rent ledger, and Dss/HRA printout. The evidence presented shows that landlord reflected DSS/HRA payments in the rent ledger, but not in the rent demand. Rather, petitioner "appears to have simply taken the amount assertedly due to date and divided it by the monthly rent to arrive at the breakdown in the rent demand." Judge Lutwak concludes that the evidence establishes that "monies received in and for the months listed in the rent demand were not reflected …

After studying the Civil War and the Reconstruction era in depth, I was required to choose one aspect of the Reconstruction era and write a historiography based on it. I researched how historians studied and interpreted the role of the Freedmen's Bureau, which was an agency established immediately after the end of the Civil War. I studied how these interpretations of the success of the Freedmen's Bureau's changed over time. I began by producing an annotated bibliography of the eight scholarly sources. I wrote three drafts and conferenced with my professor as well as the Write Place consultants. I revised …
