Léon Duguit And The Social Function Of Property In Argentina, M. C. Mirow Jan 2018

Léon Duguit And The Social Function Of Property In Argentina, M. C. Mirow

Faculty Publications

Despite its early introduction to Argentina in 1911, the doctrine of the social function of property was not quickly appropriated into the Argentine legal system. Only after a period of more than thirty-five years did this concept of property find expression in this country through the Constitution of 1949, the Peronist constitution drafted under the guidance of the Arturo Enrique Sampay. Duguit's writings formed part of a broader understanding of the social function of property that was informed by various scholars and sources, and particularly by works on Christian humanism and the social doctrine of the Roman Catholic church. Although …

Sing Your Ethnicity Aloud! Grundtvigian Danes At The Intersection Of Denmark And America, Tina Langholm Larsen

The Bridge

Most people familiar with Danish American history have encountered a narrative about the allegedly quick and unproblematic assimilation of Danish immigrants in the US, as presented here on the website of the Museum of Danish America: “Danes assimilated quickly, aided by the fact that they were white, northern european, and Protestant. Furthermore, Danes are practical and believed that assimilating into American society promised greater rewards than hanging onto their Danish identity and traditional ways.”1 even though this master narrative does, to some extent, capture the larger trajectory of the Danish immigrant experience, it disregards those Danish immigrants who played a …

Human Rights Protection: The Role Of Institutional Capacity And Selective Adaptation, Pitman B. Potter Jan 2018

Human Rights Protection: The Role Of Institutional Capacity And Selective Adaptation, Pitman B. Potter

All Faculty Publications

This paper will examine the potential application of selective adaptation and institutional capacity to the understanding of international human rights norms and practices. Enforcement of international human rights norms depends on the capacity of intermediary institutions; that is, their ability to perform their assigned tasks. Institutional performance is in turn contingent on domestic political and socio-economic conditions, and as such, local conditions of rapid socio-economic and political transformation pose particular challenges. The other key concept in this paper, selective adaptation, describes a process by which practices and norms are exchanged across cultural boundaries. The dynamic of selective adaptation can operate …

This thesis explores scholarship relevant to assembling a historically informed performance practice of Brahms’s three Violin Sonatas, Opp. 78, 100, and 108 in the nineteenth-century Germanic violin tradition of which, Joseph Joachim was its greatest proponent. This inquiry, which primarily examines surviving evidence of Joachim, his pedagogical ilk, and the circle of Brahms, engages with a variety of 19th and early 20th century Germanic musical and textual evidence, including nineteenth-century musical editions, correspondence and other archival materials, and early recorded performances to propose a historically informed style. In presenting this historiography of materials relevant to forming a historically informed interpretation …

Student Engagement In Higher Education: Measuring The Differences In Community Engagement, Stanley S. Ebede Jan 2018

Student Engagement In Higher Education: Measuring The Differences In Community Engagement, Stanley S. Ebede

Dissertations and Theses @ UNI

In U.S. education system, the growing gap in the engagement of various groups and types of students is wider than ever (Darling-Hammond, 2015). Therefore, there is a need to bridge the gap in engagement by ensuring that either personal or social circumstances such as gender, student status, ethnic groups etc. are not obstacles to achieving educational potential in higher education (Williams & Whiting, 2016; Greene, Marti, & McClenney, 2008; McClenney & Marti, 2006). Using both longitudinal and cross-sectional perspectives advocated by Fuller, Wilson and Tobin (2011); Gordon, Ludlum, and Hoey (2008); and Astin and Lee (2003), this study examined students’ …

The Changing Nature Of Death Qualification And Its Interaction With Attitude Salience, Brendan Busch Jan 2018

The Changing Nature Of Death Qualification And Its Interaction With Attitude Salience, Brendan Busch

CMC Senior Theses

Death qualification is a problematic aspect of capital trials, as death qualified jurors have higher conviction rates than non-death qualified jurors. The current study examines whether the death qualification process itself affects juror decision-making via attitude salience effects.

Participants (n=90) recruited from the venire juror pool at the Santa Ana Superior Court were asked to read a trial transcript and decide guilt or innocence and whether they would sentence the defendant to death. Half of the participants were given a survey determining death qualification before they read the trial (making death qualification salient), while the other half were given the …
