Social Contract: The Distributive Significance Of A Native Nation’S Patent Agreement With Allergan, Anne Monjar Nov 2018

Social Contract: The Distributive Significance Of A Native Nation’S Patent Agreement With Allergan, Anne Monjar

Northwestern Journal of Technology and Intellectual Property

In 2017, pharmaceutical giant Allergan announced an innovative new agreement with the Saint Regis Mohawk Tribe of upstate New York. Allergan was to transfer ownership of the patent of its successful dry eye drug Restasis to the Tribe in exchange for an exclusive licensing agreement. The hope was that the Tribe’s sovereign immunity would protect Allergan’s patent from validity challenges, in which the patent was already embroiled, while allowing them to retain its profits.

The agreement drew immediate outrage from policymakers who saw the agreement as a multi-billion-dollar corporation exploiting a legal loophole to unfairly secure its monopoly. Ultimately, the …

“Can I Get Your Digits?”: Illegal Acquisition Of Wireless Phone Numbers For Sim-Swap Attacks And Wireless Provider Liability, Nathanael Andrews Nov 2018

“Can I Get Your Digits?”: Illegal Acquisition Of Wireless Phone Numbers For Sim-Swap Attacks And Wireless Provider Liability, Nathanael Andrews

Northwestern Journal of Technology and Intellectual Property

In a SIM-swap attack, a hacker uses text messages sent to a wireless customer’s phone number to reset passwords and access critical accounts. These SIM-swap attacks are often targeted at cryptocurrency (e.g., bitcoin) holders and can result in thousands or even millions of dollars in losses. Wireless providers are often the weakest point exploited by hackers in SIM-swap attacks. These hacks are even more insidious because they rely primarily on social vulnerabilities rather than technical skill: hackers pressure accommodating customer service agents or bribe wireless provider employees in order to gain control of a wireless providers account and phone number. …

School-Age Child Care Teachers’ Perceptions Of Quality Programming In Southeastern Michigan, Angelita S. Jacobs Nov 2018

School-Age Child Care Teachers’ Perceptions Of Quality Programming In Southeastern Michigan, Angelita S. Jacobs

CUP Ed.D. Dissertations

Parents look to child care programs to provide supervised oversight for their children when they are unable to provide the care. Quality school-age care is important because program type and staff-student interactions can affect the participant’s engagement and belonging as well as promote social-emotional and character development. Perceptions of quality programming with school-agers have not received the same attention and research interest as services for younger children. I examined school-age child care teachers’ perceptions of experiences and challenges with operating quality programs in one school district in southeastern Michigan to better understand their perspectives. The study was guided by two …

A Qualitative Comparison Case Study Evaluation Of The Emotional Intelligence Of College Health Care Business Students, Cheryl Nutter Nov 2018

A Qualitative Comparison Case Study Evaluation Of The Emotional Intelligence Of College Health Care Business Students, Cheryl Nutter

CUP Ed.D. Dissertations

Health care is undergoing significant transition in practice models, payment structures, and assessment strategies requiring health care leaders to adapt to support transition and lead change (Larkin, 2015; Miles, 2017). There is speculation that current health leaders lack the necessary awareness to connect the patient’s needs with critical business decisions (Quy, 2017). If this ability is lacking in current employees, academic institutions should evaluate college students to determine if there is a gap in knowledge that can be identified. Using emotional intelligence (EI) as the conceptual framework, this study aims to evaluate EI in college health care management (HCM) business …

Experiences Of Faculty In The Design And Development Of Sustainability Education In Higher Education Curricula: A Case Study Of A Southeastern College, Tina Wilson

CUP Ed.D. Dissertations

Sustainability is a global concern; sustainability education is a logical and necessary response to that concern. There is very little research regarding the integration of sustainability concepts in higher education curriculum and delivery of instructional strategies. Sustainability education in higher education is a multifaceted phenomenon studied through a variety of lenses. The lens for this qualitative, descriptive single case study was curriculum design and development from the experiences and perspectives of a faculty involved in the process. The case study college was one of several institutions of higher education that responded to campus interest and expectations regarding sustainability education. This …

Science teacher professional development is complex. Phases in a teacher’s career necessitate different professional learning opportunities. Furthermore, knowledge bases, practices, and attributes need to be cultivated during these times. For science teachers, it is not always evident how to link professional learning opportunities progressively toward different outcomes, including being a department head, teacher leader, curriculum developer, or even master teacher. In order to spur a discussion about purposeful teacher learning, we use a theory of transformative learning to examine research pertaining to the professional learning of science teachers. The result is a conceptual framework that suggests that teachers should build …

Understanding Stem Identity Construction: An Ethnography Of An All-Girls Stem Club, Pasiewicz Marie Loyola Nov 2018

Understanding Stem Identity Construction: An Ethnography Of An All-Girls Stem Club, Pasiewicz Marie Loyola

College of Education Theses and Dissertations

This qualitative ethnography follows 11 high-school girls through their experiences in an all-girls after-school STEM club in a privileged school setting. This study uses Gee’s concept of identity and a feminist poststrutural framework to understand their experiences and how they use the club to re/construct their gendered STEM identities. Through interviews, focus groups, observations, and document analysis, this study found that the after-school club offers girls a space to not only learn about STEM, but also provides a space for girls to understand the gendered nature of their interactions with peers and adults in STEM classrooms. Data shows that girls …

Direct Crystal Formation From Micronized Bone And Lactic Acid: The Writing On The Wall For Calcium-Containing Crystal Pathogenesis In Osteoarthritis?, Anna A. Bulysheva, Nardos Sori, Michael P. Francis

Bioelectrics Publications

Introduction

Pathological calcium-containing crystals accumulating in the joints, synovial fluid, and soft tissues are noted in most elderly patients, yet arthritic crystal formation remains idiopathic. Interestingly, elevated lactic acid and bone erosion are frequently among the comorbidities and clinical features of patients with highest incidence of crystal arthropathies. This work shows that bone particulates (modeling bone erosion) dissolve in lactic acid and directly generate crystals, possibly presenting a mechanism for crystal accumulation in osteoarthritis.

Methods and results

Micronized human bone (average particle size of 160 μm x 79 μm ) completely dissolved in lactic acid in 48 hours, and in …

A Soldier’S Faith: The Civil War Experiences And Reflections Of William Porcher Dubose, Robert B. Slocum

Theology Faculty Research and Publications

The noted Episcopal theologian William Porcher DuBose was a seminarian when the American Civil War began. He was torn between continuing his studies for ordination and joining the Confederate Army. He felt duty bound to defend his homeland, and he served heroically, wounded in combat, and taken as a prisoner of war. Troubled by the senselessness and inhumanity of war, he was eventually ordained and served as a military chaplain. He devoted himself to faith and ministry when he realized his country and culture were lost. DuBose vividly presents his views on war and faith in his wartime correspondence with …

Law & Laundry: White Laundresses, Chinese Laundrymen, And The Origins Of Muller V. Oregon, Emily Prifogle Nov 2018

Law & Laundry: White Laundresses, Chinese Laundrymen, And The Origins Of Muller V. Oregon, Emily Prifogle

Articles

This article uses the historian’s method of micro-history to rethink the significance of the Supreme Court decision Muller v. Oregon (1908). Typically considered a labor law decision permitting the regulation of women’s work hours, the article argues that through particular attention to the specific context in which the labor dispute took place — the laundry industry in Portland, Oregon — the Muller decision and underlying conflict should be understood as not only about sex-based labor rights but also about how the labor of laundry specifically involved race-based discrimination. The article investigates the most important conflicts behind the Muller decision, namely …

Self-Assembly Of Polycyclic Supramolecules Using Linear Metal-Organic Ligands, Bo Song, Sneha Kandapal, Jiali Gu, Keren Zhang, Alex Reese, Yuanfang Ying, Lei Wang, Heng Wang, Yiming Li, Xiaopeng Li

Chemistry Faculty Publications

Coordination-driven self-assembly as a bottom-up approach has witnessed a rapid growth in building giant structures in the past few decades. Challenges still remain, however, within the construction of giant architectures in terms of high efficiency and complexity from simple building blocks. Inspired by the features of DNA and protein, which both have specific sequences, we herein design a series of linear building blocks with specific sequences through the coordination between terpyridine ligands and Ru(II). Different generations of polycyclic supramolecules (C1 to C5) with increasing complexity are obtained through the self-assembly with Cd(II), Fe(II) or Zn(II). The assembled structures …

Creatine has been extensively researched and is well-supported as one of the most effective dietary supplements available. There is overwhelming support within the literature regarding the ability of creatine to augment performance following short term (5–7 days) and long-duration supplementation periods. There is also strong support for creatine regarding its safety profile and minimal risk for adverse events or any negative influence on markers of clinical health and safety. Recent research has also highlighted the ability of creatine to confer several health-related benefits in select clinical populations in addition to offering cognitive benefits. Creatine is also a popular supplement of …

© 2018 Society for Endocrinology Published by Bioscientifica Ltd. STAT5A (signal transducer and activator of transcription 5A) is a transcription factor that plays a role in adipocyte development and function. In this study, we report DBC1 (deleted in breast cancer 1 - also known as CCAR2) as a novel STAT5A-interacting protein. DBC1 has been primarily studied in tumor cells, but there is evidence that loss of this protein may promote metabolic health in mice. Currently, the functions of DBC1 in mature adipocytes are largely unknown. Using immunoprecipitation and immunoblotting techniques, we confirmed that there is an association between endogenous STAT5A …

DNA methylation is an important epigenetic modification that undergoes dynamic changes in mammalian embryogenesis, during which both parental genomes are reprogrammed. Despite the many immunostaining studies that have assessed global methylation, the gene-specific DNA methylation patterns in bovine preimplantation embryos are unknown. Using reduced representation bisulfite sequencing, we determined genome-scale DNA methylation of bovine sperm and individual in vivo developed oocytes and preimplantation embryos. We show that (1) the major wave of genome-wide demethylation was completed by the 8-cell stage; (2) promoter …

Pediatrics Faculty Publications

BACKGROUND

Red blood cell (RBC) transfusion decreases intermittent hypoxemia (IH) events beyond the first week of life. This benefit may be related to improved perfusion to the respiratory control network. Perfusion index (PI) is a perfusion measure provided by the pulse oximeter. We hypothesized that the benefit in IH after RBC transfusion is associated with an increase in PI. In addition, we assessed the value of PI and clinical measures in predicting the effect of RBC transfusion on IH.

STUDY DESIGN AND METHODS

We prospectively enrolled infants less than 30 weeks' gestation age. PI and oxygen saturation (SpO2) …

When Congress implemented inter partes review (IPR) and other patent post-grant proceedings through the passage of the America Invents Act (AIA) in 2011, it provided that petitioners would be estopped in later proceedings from raising grounds for invalidity that they "raised or reasonably could have raised during that inter partes review." 35 U.S.C. § 315( e )(2). However, substantial uncertainty in courts' interpretation of this provision causes an enormous impact on an accused patent infringer's decision of whether and on what grounds to petition for review. One reading of the statutory estoppel provision suggests that "during that inter partes review" …
