Examining 8th Grade Students Disciplinary Literacy Of Science Material, Chelsie P. Doughty Jan 2018

Examining 8th Grade Students Disciplinary Literacy Of Science Material, Chelsie P. Doughty

Masters Theses

Education standards are shifting to reflect a skills-based, rather than a content-centered, curriculum that focuses on students being literate across all disciplines. This study focuses on the skills of critical thinking, close reading, and text-based writing as it applies to the scientific and historical disciplines. Eighth grade students engaged in a text-based writing assignment that required evaluation of multiple sources to support their claims. Student responses were analyzed textually and verbally as it related to the content. Findings included the ability to identify students' struggles and successes with close reading, writing claims, evaluating evidence for importance, and connecting documents to …

Prisons, Policing, And Pollution: Toward An Abolitionist Framework Within Environmental Justice, Ki'amber Thompson Jan 2018

Prisons, Policing, And Pollution: Toward An Abolitionist Framework Within Environmental Justice, Ki'amber Thompson

Pomona Senior Theses

Environmental Justice defines the environment as the spaces where we live, work, and play. The Environmental Justice (EJ) Movement has traditionally used this definition to organize against toxics in communities. However, within EJ work, prisons or policing have often not been centralized or discussed. This means that the approximately 2.2 million people in prison are excluded from the conversation and movement. Additionally, communities and activists are identifying police and prisons as toxics in their communities, but an analysis of policing and prisons is largely missing in EJ scholarship. This thesis explores the intersection between prisons, policing, and pollution. It outlines …

The Efficacy Of Best Management Practices On Peak Discharge And Contaminant Loads In Agricultural Drainage Systems, Blue Earth River Watershed, South-Central Minnesota, Usa, Zach Hilgendorf Jan 2018

The Efficacy Of Best Management Practices On Peak Discharge And Contaminant Loads In Agricultural Drainage Systems, Blue Earth River Watershed, South-Central Minnesota, Usa, Zach Hilgendorf

All Graduate Theses, Dissertations, and Other Capstone Projects

Conversion of native land cover to row crop agriculture and anthropogenically modified hydrology, correlates with increases in peak discharge, annual discharge, sediment and nutrient loads in agricultural land-use dominated watersheds within the Mississippi River basin. This results in environmental issues related to turbidity, eutrophication-hypoxia, loss of biodiversity, natural resource degradation, reduction in tourism, and more. In no place is this more obvious than the ever-growing "Dead Zone" in the Gulf of Mexico. The Minnesota River basin, the largest tributary to the Mississippi River in Minnesota, is a disproportionately large contributor of sediment (~80-90%), nitrogen (~56%), and phosphorus (~45%) to the …

African-Centered Pedagogy: Exploring Black Male Identity And Achievement Through An African-Centered Lens, Kenneth Turner Jr.

All Graduate Theses, Dissertations, and Other Capstone Projects

This mixed method study researched African-centered pedagogy and examined if it made a difference for Black males in middle school. The study examined what it meant to be Black for the participants through administering the Multidimensional Model of Black Identity (MMBI) which measures Black males' connections to their own cultural group. Students were asked three semi-structured questions about their experiences in school. In addition, MCA test scores and GPA were compared. Twenty-four middle school students participated for two different middle school types in Minnesota: one traditional school and one African-Centered school. Findings revealed that there were substantially different scores on …

Behind The Steele Curtain: An Empirical Study Of Trademark Conflicts Law, 1952-2016, Tim W. Dornis Jan 2018

Behind The Steele Curtain: An Empirical Study Of Trademark Conflicts Law, 1952-2016, Tim W. Dornis

Vanderbilt Journal of Entertainment & Technology Law

The law on international trademark disputes is founded on precedent from 1952. Steele v. Bulova Watch Co. is the first and only Supreme Court decision addressing the question of how far the Lanham Act should be extended beyond the United States' national borders when international infringement is at issue. The decision laid the foundation for a three-pronged test that focuses on the factors of defendant nationality, effects on US commerce, and conflicts with foreign law. Although international trademark conflicts have multiplied dramatically--particularly throughout the last decade--there has been no systematic and comprehensive account of the actual state of the law. …

Linking The Public Benefit To The Corporation: Blockchain As A Solution For Certification In An Age Of "Do-Good" Business, Margaret D. Fowler Jan 2018

Linking The Public Benefit To The Corporation: Blockchain As A Solution For Certification In An Age Of "Do-Good" Business, Margaret D. Fowler

Vanderbilt Journal of Entertainment & Technology Law

As part of its now-infamous emissions scandal, Volkswagen spent tens of millions of dollars on advertising geared toward environmentally conscious consumers. The scandal is an example of "greenwashing," which, along with the corresponding term "fairwashing," represents the information asymmetry present in product markets that involve claims of social and environmental responsibility in companies' production practices. As consumers and investors demand responsible production practices from both traditional corporations and entities organized under the newer corporate form known as public benefit corporations (PBCs), it becomes even more important to verify that those entities' supply chains are, in fact, meeting standards for the …

Data At The Docks: Modernizing International Trade Law For The Digital Economy, Andrew D. Mitchell, Neha Mishra Jan 2018

Data At The Docks: Modernizing International Trade Law For The Digital Economy, Andrew D. Mitchell, Neha Mishra

Vanderbilt Journal of Entertainment & Technology Law

The World Trade Organization (WTO) has been slow so far in responding to the various challenges arising from the integration of electronic commerce into cross-border trading activities. This slow response in the multilateral system is largely attributable to the complex, multifaceted nature of digital trade or electronic commerce, coupled with the conflict among countries on issues of Internet regulation and digital development. Nonetheless, international trade agreements, particularly at the WTO, play an important role in the creation of a secure, predictable, and trustworthy global regulatory framework for digital trade, and therefore, need to be reformed in a timely and meaningful …

Corporate Cybersecurity: The International Threat To Private Networks And How Regulations Can Mitigate It, Eric J. Hyla Jan 2018

Corporate Cybersecurity: The International Threat To Private Networks And How Regulations Can Mitigate It, Eric J. Hyla

Vanderbilt Journal of Entertainment & Technology Law

Cyberattacks are occurring at an accelerating pace. Foreign nations are increasingly utilizing hacking as a tool for economic gain, acts of aggression, or international political expression. At risk are US consumers'personal data, private firms' bottom line, and the economies'integrity. In response, federal and state lawmakers have issued a series of disparate, uncoordinated policies seeking to strengthen cybersecurity practices. However, recent events indicate that these policies are less than ideal. This Note suggests that a unified response to cybersecurity is required and calls for the establishment of a single, central federal agency with authority over all cybersecurity regulations. Such an agency …

Agency Panic: A Reckoning Of Place, Brock M. Mickelsen Jan 2018

Agency Panic: A Reckoning Of Place, Brock M. Mickelsen

Graduate Student Theses, Dissertations, & Professional Papers

Agency Panic: A Reckoning of Place may be best described as a type of documentation of a conversation between the Gates of the Mountains Wilderness and myself, one where a mutual language is not spoken but one where some understanding can be reached none-the-less. By moving through the landscape without goals or intentions a physical exchange ensues, a push and pull, a call and response, intimacy is gained through tactile experience. Through the use of wet-plate collodion photography I am able to create imagery that engages directly with the place. Its vulnerability records a conversation between two acting powers, artist …

In Case Of Emergency: Local Medical Services And Emergency Air Transportation In Southeast Alaska, Kourtney B. Johnson Jan 2018

In Case Of Emergency: Local Medical Services And Emergency Air Transportation In Southeast Alaska, Kourtney B. Johnson

Graduate Student Theses, Dissertations, & Professional Papers

Alaska, often referred to as “The Last Frontier”, is a vast, geographically diverse and sparsely settled landscape. Although many popular reality shows tend to exaggerate and dramatize life in Alaska, they do point to an important fact: when an emergency occurs, or someone experiences serious health complications, immediate access to sufficient medical services may not be available. Much of the state’s population faces barriers to accessing needed medical care due to large distances between communities and limited road networks due to coastal locations or challenging terrain.

Using Penchansky and Thomas’s five components of Access Theory (1981), this thesis explores factors …

The Influence Of Parental Perceptions On Early Childhood Educational Choices In Nigeria, Magdalene Uwadiogbu Okobah Jan 2018

The Influence Of Parental Perceptions On Early Childhood Educational Choices In Nigeria, Magdalene Uwadiogbu Okobah

Walden Dissertations and Doctoral Studies

The influx of women of childbearing age into the labor force, family dynamics of dual working parents as a result of economic factors, and weakening of extended family supports have increased demand for early childhood care and education programs in Nigeria. Consequently, a problem emerged in increased enrollment in ECCE programs that are deficient in terms of structural and process factors of child-caregiver ratio, group size, staff qualifications, health and safety practices, curriculum implementation, and parental engagement. The purpose of this study was to explore the factors that influenced parents' in their decision process for ECCE placement for their children …

Understanding The Micro-Situational Dynamics Of White Supremacist Violence In The United States, Steven Windisch, Peter Simi, Kathleen Blee, Matthew Demichele Jan 2018

Understanding The Micro-Situational Dynamics Of White Supremacist Violence In The United States, Steven Windisch, Peter Simi, Kathleen Blee, Matthew Demichele

Sociology Faculty Articles and Research

While substantial effort has been devoted to investigating the radicalization process and developing theories to explain why this occurs, surprisingly few studies offer explanations of the micro-situational factors that characterize how extremists accomplish violence. Relying on in-depth life history interviews with 89 former white supremacists, we analyzed the situational, emotional, and moral considerations surrounding white supremacist violence. Overall, we identified a variety of strategies white supremacists utilize for overcoming emotional and cognitive obstacles required to perform violent action. Furthermore, we also identified the callous effect of habitual violence. We conclude this article with suggestions for future research and recommendations for …

Women's Perceptions Toward Mobile Advertising, Shona Dolson Jan 2018

Women's Perceptions Toward Mobile Advertising, Shona Dolson

Walden Dissertations and Doctoral Studies

The use of technology is changing at a very rapid pace, and companies must strategically design advertising messages for the ever-changing devices and platforms. The general business problem was that business owners have not been able to maximize the profitability of mobile advertising messages directed at women. The specific business problem was that business leaders need strategies to enhance mobile advertising returns by targeting messages that incorporate women's perceptions of mobile advertising. The purpose of this case study was to explore how business leaders can enhance mobile advertising returns by incorporating women's perceptions of mobile advertising into the design of …

Impact Of Free Maternal And Child Health Services On Health Care Utilization In Jigawa State, Nigeria, Nura Ibrahim Kazaure Jan 2018

Impact Of Free Maternal And Child Health Services On Health Care Utilization In Jigawa State, Nigeria, Nura Ibrahim Kazaure

Walden Dissertations and Doctoral Studies

In spite of a decrease globally, the maternal mortality rate (MMR) in Nigeria and its

Jigawa State has remained persistently high. Few efforts to address the MMR in Nigeria have been undertaken. The purpose of this study was to investigate the impact of Jigawa State's Free Maternal and Child Health Program (JSFMCHP), education, employment, and parity of pregnant women on health care utilization (the outcome variable), as measured by antenatal care (ANC) visits. Anderson's behavioral model served as the study's theoretical framework. The sample size included 400 antenatal records of pregnant women who were randomly selected from the state's Health …

Determinants Of Low Birth Weight In A Population-Based Sample Of Zimbabwe, Paul Nesara Jan 2018

Determinants Of Low Birth Weight In A Population-Based Sample Of Zimbabwe, Paul Nesara

Walden Dissertations and Doctoral Studies

Low birth weight (LBW) is a major public health concern globally. Despite its negative social and economic impact on the family and community at large, it has remained relatively unexplored at population level in Zimbabwe. The purpose of the study was to establish determinants of LBW using data from the 2015 Zimbabwe Demographic and Health Survey. The socioecological model was the conceptual framework for the study. A secondary analysis was conducted on 4,227 mother-infant dyads. Independent variables were duration of pregnancy, number of births within the past 5-year period, exposure to mass media, type of fuel used for cooking in …

Deconstructing And Reconstructing Identity: How Queer Liberation Organizations Deploy Collective Identities, Ben Anderson-Nathe, Joseph Nicholas Defilippis, Gita R. Mehrotra Jan 2018

Deconstructing And Reconstructing Identity: How Queer Liberation Organizations Deploy Collective Identities, Ben Anderson-Nathe, Joseph Nicholas Defilippis, Gita R. Mehrotra

The Journal of Sociology & Social Welfare

The mainstream gay rights movement has made significant strides toward its agenda, at least in part due to the movement’s claim that it represents all the interests of all LGBTQ communities. However, a queer liberation movement (QLM) led by queer people of color and other marginalized LGBTQ people has existed alongside the mainstream movement since its inception. This movement pursues a radically different agenda and employs organizing strategies distinct from those of the mainstream movement, centering the interests of those LGBTQ people most often left behind by the mainstream agenda. This paper examines how the QLM negotiates and deploys collective …

Asset Building And Property Owning Democracy: Singapore Housing Policy As A Model Of Social Investment And Social Justice, James Lee Jan 2018

Asset Building And Property Owning Democracy: Singapore Housing Policy As A Model Of Social Investment And Social Justice, James Lee

The Journal of Sociology & Social Welfare

This paper discusses a fundamental issue that continues to haunt Western welfare states: despite rising levels of social expenditures and a rigorous social investment-oriented social policy, poverty and acute social inequalities persist. Using the concept of Property Owning Democracy (POD) advanced by John Rawls, this paper argues that an asset-based housing policy might be able to improve social justice and reduce poverty. Using Singapore’s housing system as an example, this paper illustrates the connection between asset building and POD, and suggests that Singapore’s housing system, to some extent, fulfills the requirements of Rawls’ theory of justice in terms of maintaining …

Neither Limited Nor Simplified: A Proposal For Reform Of Illinois Supreme Court Rule 222(B), Michael S. Smith Jan 2018

Neither Limited Nor Simplified: A Proposal For Reform Of Illinois Supreme Court Rule 222(B), Michael S. Smith

Michigan Law Review

A limited and simplified discovery system should broaden access to courts, resolve disputes quickly, and expedite relief to injured parties. It should not incentivize procedural gamesmanship or increase the system’s complexity. Regrettably, Illinois’s “limited and simplified” discovery system does both. The initiation procedure for the simplified system, Rule 222(b), creates procedural traps and perverse incentives for both plaintiffs and defendants, and conflicting appellate interpretations of the Rule intensify the problem. This Note examines the flaws underlying the current simplified discovery scheme and argues for reform. It examines simplified discovery schemes in other states to recommend a new system for initiating …

#Sowhitemale - Federal Civil Rulemaking, Brooke D. Coleman Jan 2018

#Sowhitemale - Federal Civil Rulemaking, Brooke D. Coleman

Faculty Articles

116 out of 136. That is the number of white men who have served on the 82-year old committee responsible for creating and maintaining the Federal Rules of Civil Procedure. The tiny number of non-white, non-male committee members is disproportionate even in the context of the white-male-dominated legal profession. Were the rules simply a technical set of instructions made by a neutral set of experts, perhaps these numbers might not be as disturbing. But that is not the case. The Civil Rules embody normative judgments about the values that have primacy in our civil justice system, and the rulemakers—while expert—are …

Addressing The Prior Appropriation Doctrine In The Shadow Of Climate Change And The Paris Climate Agreement, Kait Schilling Jan 2018

Addressing The Prior Appropriation Doctrine In The Shadow Of Climate Change And The Paris Climate Agreement, Kait Schilling

Seattle Journal of Environmental Law

Climate change is the new lens through which the world needs to view water. Such a viewpoint is prudent, as the western United States is in a state of water scarcity that requires a reevaluation of how fresh water resources are being used. Western states have entrenched themselves in a system of prior appropriation that ensures senior water users retain priority over, and protection from the impacts of, new water users. Unfortunately, allocating new water rights under prior appropriation has become difficult as streams are increasingly fully appropriated with no new water rights allocations available. Climate change is exacerbating this …

The Controversy Over Permit-Exempt Wells In Washington, Jean O. Melious Jan 2018

The Controversy Over Permit-Exempt Wells In Washington, Jean O. Melious

Seattle Journal of Environmental Law

In a groundbreaking 2016 decision commonly referred to as the Hirst decision, the Washington State Supreme Court recognized the interrelationship between land use and water use. The Court held that the state’s Growth Management Act required local governments to protect water resources through measures ensuring that new development would not deprive senior water users of their water rights. The decision focused on development relying on permit-exempt wells. Permit-exempt wells reflect a pioneer mentality that encourages dispersed development by allowing rural property owners and developers to appropriate water without obtaining a permit. Permit-exempt wells are subject to the state law of …

California Creek Quarry: Regional Persepctives And Uas Mapping, David A. Schwab Jan 2018

California Creek Quarry: Regional Persepctives And Uas Mapping, David A. Schwab

Graduate Student Theses, Dissertations, & Professional Papers

Western Montana hosts an abundance of lithic deposits useful for precontact stone tool manufacturing. Lithic sources likely factored prominently into patterns of settlement, trade, subsistence and mobility for past populations in the region. The mining of these lithic resources results in a unique land use area, a prehistoric quarry. Prehistoric quarries in Western Montana have received very little research or spatial documentation. This may be due in part to their abundance and often overwhelming size and extent. Providing even basic spatial documentation for large quarries can be prohibitively time consuming and expensive. One such understudied quarry site is the California …

Zoning And Complementary Incentives To Protect Farmland: A Case For Missoula County, Kaitlin Mccafferty Jan 2018

Zoning And Complementary Incentives To Protect Farmland: A Case For Missoula County, Kaitlin Mccafferty

Graduate Student Theses, Dissertations, & Professional Papers

Urban sprawl reflects an inefficient use of land that diminishes both rural landscapes and quality of life turning farms, ranches and open space into siloed suburban communities. This results in less walkable cities with more traffic and air pollution, among other negative consequences. Farmland constitutes a particularly important resource that often faces degradation or loss due to sprawl. Higher quality agricultural soils are particularly desirable for development because they are flat and well-drained. Farmland is also important for urban communities concerning food security, environmental health, and economic well being. As American cities continue to grow, farmland around urban areas has …

A Phenomenological Study Of People Living With Hiv In Montana, Mary E. Parrish Jan 2018

A Phenomenological Study Of People Living With Hiv In Montana, Mary E. Parrish

Graduate Student Theses, Dissertations, & Professional Papers

Rural states like Montana (MT) have unique considerations related to health care. Barriers to care, diagnostic testing and treatment, and availability and accessibility to timely care are of concern in rural areas. These considerations may be exacerbated for someone living with a chronic condition like HIV. Consequently, the primary purpose of this phenomenological study of people living with HIV (PLWH) in MT was to deepen understanding of their lived experience as it relates to the HIV health care continuum. This study captured the experience of PLWH in MT through in-depth qualitative interviews. A phenomenological approach allowed for an understanding of …
