The Effect Of International Ngos On Influencing Domestic Policy And Law, Ashley Macarchuk Jan 2018

The Effect Of International Ngos On Influencing Domestic Policy And Law, Ashley Macarchuk

CMC Senior Theses

This thesis attempts to understand the impact of international human rights and environmental NGOs on affecting domestic policy and law. In particular, it looks at how State-NGO relations, civil society, and accountability affect the success of international NGOs in enacting change in domestic policy. The focus is on four countries with some of the largest human rights and environmental abuses: Argentina, China, India, and Russia. Through these countries, this thesis shows that NGOs have the most influence when State-NGO relations are strong, civil society is active, and NGOs are accountable to both the State and citizens. A key component to …

Climate And Crime: Examining The Relationship Between Extreme Weather Events And Crime Rates In The United States, Erin Tully Jan 2018

Climate And Crime: Examining The Relationship Between Extreme Weather Events And Crime Rates In The United States, Erin Tully

CMC Senior Theses

This study attempts to determine whether there is a relationship between extreme weather events and crime rates. Due to the increasing effects of climate change, it is critical we understand the societal effects of extreme weather. Here, a panel data fixed effects regression was used to analyze state and year level data. It was hypothesized that there would be a relationship between crime and extreme events, but the results did not show a statistically significant relationship. Further research with increased geographic and temporal controls is encouraged.

Disparities Between American And Chinese Perceptions On Chinese Foreign Policy, Zijia He Jan 2018

Disparities Between American And Chinese Perceptions On Chinese Foreign Policy, Zijia He

CMC Senior Theses

There has been a dangerous gap between American and Chinese perceptions of Chinese foreign policy, a gap contributing to acceptance of the Thucydides Trap. With the help of a theoretical framework and empirical evidence, this paper aims to summarize and understand the differences, in an effort to help overcome them and prevent a self-fulfilling prophecy. The author identifies five variables that shape perceptions and then categorizes Chinese foreign policy along several dimensions. Using the South China Sea and the Belt and Road Initiative as case studies, the author finds that US and Chinese interpretations of Chinese behavior along these dimensions …

Waterways - Soon Dry, Aiyanna Cameron-Lewis Jan 2018

Waterways - Soon Dry, Aiyanna Cameron-Lewis

CMC Senior Theses

This paper explores the historical and contemporary situation of waterways in Los Angeles. It examines the birth and growth of metropolitan LA and contrasts this narrative with the current and pressing issues of drought and gentrification. This contrast raises the question of the sustainability of human growth in resource-scarce regions. From this analysis it forwards a nuanced perspective of the hypothesis that the dynamics of environmental degradation in the LA region threaten human growth. It suggests that this degradation comes as a result of egocentric human development projects by the elite. This paper examines all of this through the lens …

The Influence Of Home Country Factors On Immigrant Entrepreneurship In The U.S., Kayalin Akens-Irby Jan 2018

The Influence Of Home Country Factors On Immigrant Entrepreneurship In The U.S., Kayalin Akens-Irby

CMC Senior Theses

This paper uses a Poisson regression model to determine the effects of entrepreneurial conditions of home countries on immigrant founded startup activity in the United States. The study determines that the most relevant factors are innovation, internal market dynamics, governmental support and policies, financing, and internal market openness. It then analyzes the change rates of these entrepreneurial conditions between 2007 and 2017 in China, India, and the United States to determine the implications of changing power dynamics in the global economy on flows of immigrant entrepreneurship and innovation in the global entrepreneurial ecosystem. The study finds that after being in …

Intergenerational Land Conflict In Northern Uganda: Children, Customary Law And Return Migration, Sandra F. Joireman Jan 2018

Intergenerational Land Conflict In Northern Uganda: Children, Customary Law And Return Migration, Sandra F. Joireman

Political Science Faculty Publications

Northern Uganda is in transition after the conflict that ended in 2006. While its cities are thriving and economic opportunities abound, the social institutions governing land access are contested, the land administration system is changing, and the mechanisms available to address conflicts over resources have themselves become a venue for authority claims. This article examines the intergenerational nature of land conflicts in northern Uganda, focusing on the interplay of customary law, return migration and the development of a market in land. There are three contributions to existing literature: (1) a discussion of children's property rights under customary and statute law …

Access To Knowledge And The Global Abortion Policies Database, Joanna Erdman, Brooke Johnson Jan 2018

Access To Knowledge And The Global Abortion Policies Database, Joanna Erdman, Brooke Johnson

Articles, Book Chapters, & Popular Press

Research shows that women, healthcare providers, and even policy makers worldwide have limited or inaccurate knowledge of the abortion law and policies in their country. These knowledge gaps sometimes stem from the vague and broad terms of the law, which breed uncertainty and even conflict when unaccompanied by accessible regulation or guidelines. Inconsistency across national law and policy further impedes safe and evidence‐based practice. This lack of transparency creates a crisis of accountability. Those seeking care cannot know their legal entitlements, service providers cannot practice with legal protection, and governments can escape legal responsibility for the adverse effects of their …

Conflicts Over Extractivist Policy And The Forest Frontier In Central America, Anthony Bebbington, Laura Sauls, Herman Rosa, Benjamin Fash, Denise Humphreys Bebbington Jan 2018

Conflicts Over Extractivist Policy And The Forest Frontier In Central America, Anthony Bebbington, Laura Sauls, Herman Rosa, Benjamin Fash, Denise Humphreys Bebbington

Sustainability and Social Justice

Central America is characterized by an asymmetric forest transition in which net deforestation is a product of both forest loss and patches of forest resurgence. Forest loss is also associated with rights violations. We explore the extent to which extractive industry and infrastructure investments create pressure on forest resources, community rights and livelihoods. Drivers of this investment are identified, in particular: constitutional, legislative and regulatory reforms; energy policies; new financial flows; and ideas of development emphasizing the centrality of infrastructure in combining geographical integration and economic growth. We discuss forms of contentious action that have emerged in response to these …

A Tropic Understanding Of Street Art As Political And Social Advocacy, Lindsay K. Kosel Jan 2018

A Tropic Understanding Of Street Art As Political And Social Advocacy, Lindsay K. Kosel

Honors Theses and Capstones

Graffiti and street art has been prevalent in the past few decades taking stances toward social and political adversity, but there lacks discussion about how dialogue is provoked within street artwork. Through the detailed analysis of the visual display created by JR on the West Bank Wall, these paper places focus on the rhetorical function of how street artist utilize images as means for political and social advocacy. The display shifts the focus from trauma, dislocation, and victimhood to that of comedic relief in our “humanness”. The identification of tropes within a street art display indicates that they are in …

Testing International Legal Regimes: The Advent Of Automated Commercial Vessels, Aldo Chircop Jan 2018

Testing International Legal Regimes: The Advent Of Automated Commercial Vessels, Aldo Chircop

Articles, Book Chapters, & Popular Press

International shipping is on the eve of a new era where remotely controlled and partially or fully automated and unmanned Maritime Autonomous Surface Ships (MASS) will be carrying international trade. The regulation of navigation and shipping in the contemporary international law of the sea and international maritime law are premised on human presence and control onboard ships. Provisions of the United Nations Convention on the Law of the Sea, 1982 and several maritime conventions will need to be revisited to determine how MASS may be accommodated, and where not possible, what further legal development may be needed. Recently, the IMO …

Dialog About A New Asylum System, James C. Hathaway Jan 2018

Dialog About A New Asylum System, James C. Hathaway

Articles

The mechanisms for implementing the obligations under the Refugee Convention are fiawed in ways that too often lead States to act against their own values and interests, and which produce needless suffering amongst refugees. A five-point plan could revitalize the Refugee Convention. A managed and collectivized approach to the implementation of refugee protection obligations would include planning for refugee movements, embracing common but differentiated State responsibility and international administration of refugee protection.

Mechanical & Aerospace Engineering Faculty Publications

With increasing demands in real-time or near real-time remotely sensed imagery applications in such as military deployments, quick response to terrorist attacks and disaster rescue, the on-board geometric calibration problem has attracted the attention of many scientists in recent years. This paper presents an on-board geometric calibration method for linear CCD sensor arrays using FPGA chips. The proposed method mainly consists of four modules—Input Data, Coefficient Calculation, Adjustment Computation and Comparison—in which the parallel computations for building the observation equations and least squares adjustment, are implemented using FPGA chips, for which a decomposed matrix inversion method is presented. A Xilinx …

From Corporate Law To Corporate Governance, Ronald J. Gilson Jan 2018

From Corporate Law To Corporate Governance, Ronald J. Gilson

Faculty Scholarship

In the 1960s and 1970s, corporate law and finance scholars gave up on their traditional approaches. Corporate law had become “towering skyscrapers of rusted girders, internally welded together and containing nothing but wind.” In finance, the theory of the firm was recognized as an “empty box.” This essay tracks how corporate law was reborn as corporate governance through three examples of how we have usefully complicated the inquiry into corporate behavior. Part I frames the first complication, defining governance broadly as the company’s operating system, a braided framework of legal and non-legal elements. Part II adds a second complication by …

The Constitution Comes To The County Unit: Georgia’S State Level Electoral College, David Crockett Jan 2018

The Constitution Comes To The County Unit: Georgia’S State Level Electoral College, David Crockett

Center for the Advancement of Public Integrity (Inactive)

As Prof. Akhil Amar outlines in his work, America’s Constitution: A Biography, the Philadelphia Plan and its outline of a stronger executive power inspired replication on the state level. States from Massachusetts to Georgia strengthened the power of their governors, with many granting them independent elections and a veto pen. Over time, most states replicated the Federal terms of office, and currently all but two states hold quadrennial gubernatorial elections balanced with biennial or other staggered legislative terms. Yet, even as many states replicated features of Article II, from the veto to the establishment of “supreme executive power,” nearly …

School of Geosciences Faculty and Staff Publications

This study mainly utilized the Soil and Water Assessment Tool (SWAT) together with SWAT-CUP, both free and open source software (FOSS), to construct a distributed hydrologic flow model for the Rokel-Seli River basin, Sierra Leone, in a bid to spatiotemporally evaluate the role of changes in land use/land cover (LULC) and microclimate on streamflow regimes. The model was informed by LULC data derived from three Landsat satellite images collected in 2002, 2010, and 2016. The LULC data was generated with the aid of several python libraries accessed through the FOSS Anaconda Navigator. LULC change analysis demonstrated that between 2002 and …

Why Less Property Is More: Inclusion, Dispossession, & Subjective Well-Being, David Fagundes Jan 2018

Why Less Property Is More: Inclusion, Dispossession, & Subjective Well-Being, David Fagundes

Faculty Articles

The twin notions of exclusion and possession dominate our cultural and legal conceptions of property. This Article uses the lens of hedonics—the emergent science of happiness—to make a case for the less appreciated notions of inclusion and dispossession. Evidence from this new field shows that owners maximize their welfare, not when they amass land and chattels and keep others away from them, but when they pursue the polar-opposite strategies of inclusion and dispossession, such as sharing their property, donating it to charity, or giving it away. This Article begins its defense of inclusion and dispossession by providing background about the …

Polar Opposites: Assessing The State Of Environmental Law In The World's Polar Regions, Mark P. Nevitt, Robert Percival Jan 2018

Polar Opposites: Assessing The State Of Environmental Law In The World's Polar Regions, Mark P. Nevitt, Robert Percival

Faculty Articles

Climate change is fundamentally transforming both the Arctic and Antarctic polar regions. Yet these regions differ dramatically in their governing legal regimes. For the past sixty years the Antarctic Treaty System, a traditional “hard law” international law treaty system, effectively de-militarized the Antarctic region and halted competing sovereignty claims. In contrast, the Arctic region lacks a unifying Arctic treaty and is governed by the newer “soft law” global environmental law model embodied in the Arctic Council’s collaborative work. Now climate change is challenging this model. It is transforming the geography of both polar regions, breaking away massive ice sheets in …

[First Paragraph] Coastal cities have been subjected to extreme weather events since the onset of urbanization. Climatic change, in particular sea level rise, coupled with rapid urban development are amplifying the challenge of managing risks to coastal cities. Moreover, urban expansion and changes and intensification in land use further pressure sensitive coastal environments through pollution and habitat loss.
