The Missing Hyperlink — An Empirical Study: Can Canadian Laws Effectively Protect Consumers Purchasing Online?, Mariella Montplaisir
The Missing Hyperlink — An Empirical Study: Can Canadian Laws Effectively Protect Consumers Purchasing Online?, Mariella Montplaisir
Canadian Journal of Law and Technology
Canadian consumer protection legislation applicable to online transactions generally works by a two-pronged method: first, private international law rules ensure that in most cases, consumers can sue in their home province under that province’s law; and, second, a wide range of substantive obligations are imposed on merchants, and failure to comply with these obligations provides consumers with a right of cancellation. This study considers the private international law rules applicable to online consumer contracts, and discusses the unique jurisdictional challenges presented by online transactions. This study also provides an overview of Canadian legislation applicable to online consumer transactions, and examines …
Government Surveillance Accountability: The Failures Of Contemporary Canadian Interception Reports, Christopher Parsons, Adam Molnar
Government Surveillance Accountability: The Failures Of Contemporary Canadian Interception Reports, Christopher Parsons, Adam Molnar
Canadian Journal of Law and Technology
Real time electronic government surveillance is recognized as amongst the most intrusive types of government activity upon private citizens’ lives. There are usually stringent warranting practices that must be met prior to law enforcement or security agencies engaging in such domestic surveillance. In Canada, federal and provincial governments must report annually on these practices when they are conducted by law enforcement or the Canadian Security Intelligence Service, disclosing how often such warrants are sought and granted, the types of crimes such surveillance is directed towards, and the efficacy of such surveillance in being used as evidence and securing convictions.

A Novel Ultra-Low Interfacial Tension Nanofluid For Enhanced Oil Recovery In Super-Low Permeability Reservoirs, Derong Xu, Baojun Bai, Ziyu Meng, Qiong Zhou, Zhe Li, Yao Lu, Hairong Wu, Jirui Hou, Wanli Kang
Geosciences and Geological and Petroleum Engineering Faculty Research & Creative Works
The exploration and development of super-low permeability reservoirs have become a global focus in recent years. However, conventional flooding systems commonly face problems of high injection pressure and poor displacement efficiency in super-low permeability reservoirs. Thus, it is imperative to find new flooding agents that tackle such problems. In this study, a novel ultra-low interfacial tension (IFT) nanofluid was formulated, consisting of surfactants to achieve ultra-low IFT and silica nanoparticles to reduce injection pressure. The compatibility test between the surfactants and silica nanoparticles in 10,000 mg/L NaCl solution at 90 °C was conducted to ensure their adaption to harsh reservoir …

Unpacking Students’ Writer Identity In The Transition From High School To College: A Mixed Methods Study, Marcie J. Walsh
Unpacking Students’ Writer Identity In The Transition From High School To College: A Mixed Methods Study, Marcie J. Walsh
Theses and Dissertations
Since the 1975 publication of Newsweek’s article asserting that “Johnny” can’t write, many have continued to support the claim that students graduating from American high schools and universities can’t write. This criticism has led many students to believe the problem lies exclusively with them. Efforts to improve students’ writing have had little effect, as reflected in continually concerning scores on the National Assessment of Educational Progress. Recently, researchers have begun to suggest that the problem should be addressed by working to change students’ identification as a bad writer. Two constructs have emerged from these efforts: writer and authorial identity. Research …
Using The Frog Epidermis To Uncover Desmosome Function And Regulation In The Developing Embryo, Navaneetha Krishnan Bharathan
Using The Frog Epidermis To Uncover Desmosome Function And Regulation In The Developing Embryo, Navaneetha Krishnan Bharathan
Theses and Dissertations
The desmosome is one of the major cell adhesion junctions found in the epithelia, heart, and hair follicle. Described as a “rivet” that hold cells together, it provides these tissues with the integrity to withstand the tremendous forces they face in everyday life. Defects in this junction can lead to devastating diseases where patients are susceptible to skin infections and cardiovascular defects. Limited treatments exist for diseases of the desmosome, and strategies do not target all symptoms. Therefore, delineating the function and regulation of desmosomes is of paramount importance for the development of prevention and treatment strategies. The Xenopus laevis …

The Progress On Mapping Ubiquitin Signaling Using Photocrosslinking Mono And Di-Ubiquitin Probes And Other Ubiquitin Moieties, Courtney N. Braxton
Theses and Dissertations
Ubiquitin (Ub) is a small, 76 amino acid, and post-translational modification (PTM) protein in eukaryotes. Modification of a substrate protein via the covalent attachment of the C-terminal glycine of Ub to the ε-amino group of lysine residues in a substrate is termed ubiquitination. Unlike, other PTM proteins, Ub can form polyUb chains at one or more of its seven lysine residues. (K6, K11, K27, K29, K33, K48, and K68). The consequence of these different polymerization sites is altered biological response with different polyUb linkages conferring different fates to target proteins. Unfortunately, the study of these chains have been limited by …
A Familiar House, William Lenard
A Familiar House, William Lenard
Theses and Dissertations
The landscapes of my home in Connecticut are important to me. When I was young, I went to the woods for seclusion and comfort. While I wandered through the woods, I discovered a passion for storytelling. Now that I no longer live in New England, I miss the familiar landscapes of home. As a way to portray my sentiment, I write poetic narratives and create objects to illustrate natural landscapes.
I combine my interests of classic Americana art and literature with brutalist architecture and modern furniture to create immersive installations. I work with concrete and hardwood to materially bridge the …
The Political Nature Of The Paris Commune Of 1871 And Manifestations Of Marxist Ideology In The Official Publications Of The Central Committee, Emily M. Jones
The Political Nature Of The Paris Commune Of 1871 And Manifestations Of Marxist Ideology In The Official Publications Of The Central Committee, Emily M. Jones
Theses and Dissertations
Historians originally claimed that the 1871 Paris Commune was inspired by Karl Marx. Since the 1960s, however, this assertion has been rejected by scholars who either claim that Marx had no influence over the Paris Communards or do not address the possibility that this influence existed. Many scholars have also claimed that the Commune was not political in any way, but was a rebellion inspired by patriotism, bitterness for the Versailles government’s capitulation of Paris to Prussia, or a spontaneous reaction to hostility from the national army’s attempt to disarm the indignant, rapidly organizing Parisian workers who called for municipal …

The freedom to reimplement application program interfaces (APIs) in independently written software is the key issue at stake in Oracle America, Inc. v. Google Inc. In May 2016, on remand a jury found Google’s use of the Java API elements was a fair use. After the District Court declined to vacate the jury verdict, Oracle appealed for the second time to the Federal Circuit, claiming that it is entitled to a judgment in its favor on the fair use issue as a matter of law. This Article, which is a derivative work of the amicus curiae brief of 42 Intellectual …

Modern commercial contracts—those governing mergers and acquisitions and financial derivatives, for instance—have become structurally complex and interconnected. Yet contract law largely ignores structural complexity. This Article develops a theory of “contractual structuralism” to explain the important role of structure in every aspect of contract law, from the design of a contract to courts’ interpretation and enforcement.
For generations, scholars have debated whether a court should consider only the text of a contract or also consider broader context to determine parties’ intent. More recently, scholars have shown that parties can choose between textual and contextual interpretation by drafting a contract provision …
The Architecture Of Contract Innovation, Matthew Jennejohn
The Architecture Of Contract Innovation, Matthew Jennejohn

Contract law and the formal models of contract economics assume that agreements are fully customized. On the other hand, recent legal research highlights the role standardized terms play in contract design. Those lines of research overlook an important class of contracts between those extremes. Many contracts, such as the merger agreements studied here, are complex combinations of customized and standardized terms, and thereby achieve economies of both scale and scope. Such contracts are “mass customized,” to borrow a term from engineering research. This Article introduces a theoretical framework for understanding how mass customization of such complex agreements is achieved. It …
Defining The Accessibility Of A Literary Text: Contemporary Russian Literature In A Cefr B2 Russian As A Foreign Language Classroom, Sofya Yunusova
Defining The Accessibility Of A Literary Text: Contemporary Russian Literature In A Cefr B2 Russian As A Foreign Language Classroom, Sofya Yunusova
Russian Language Journal
In the last three and a half decades, a considerable number of publications in foreign-language methodology have addressed the use of literary texts (LTs) in foreign-language classrooms. While at the beginning of the twentieth century learning a foreign language still meant a close study of canonical LTs for linguistic and humanistic purposes following the grammar-translation method (Kramsch and Kramsch 2000; Iatsenko 2017b), by the middle of the century, literature was replaced by more functional models of learning (Carter 2007). The 1980s opened new perspectives on the didactic role of L2 literary reading, which are commonly associated with the confluence of …

Borscht, Bliny, And Burritos: The Benefits Of Peer-To-Peer Experiential Learning Through Food, Naomi Caffee, Colleen Lucey
Russian Language Journal
Like other disciplines in the humanities, Russian Studies faces an ongoing crisis of recruiting and retaining majors and minors for the longevity of undergraduate programs (Looney and Lusin 2018). Shrinking budgets and limited resources compound the problem as language and culture departments across the United States are asked to do more with fewer resources (Gerber 2015). In the context of an increasingly corporatized academy where language and cultural studies are marginalized, faculty in Russian Studies have a powerful means at their disposal to attract new students and build cross-campus alliances: the common language of food. Courses on foodways can reinvigorate …

Excerpt:
"In the Jātakas we get description of the Caṇḍālas which is rare as far as traces about this class from the early Indian past is concerned. In around eight stories we get description of the Caṇḍālas.1 Amongst those the Mātaṅ gaJātaka (No.497) is the most important story because of its sheer description which is comparatively more elaborate than the other stories. In this essay I shall not only be examining this particular story to see the everyday lives of the Caṇḍālas in the early historic period, but most importantly, I shall also be exploring those processes through which these …
