Daniel Defoe's Protestant Roman Catholics. Global Religion, Colonialism, And The Limits Of Toleration In The Farther Adventures Of Robinson Crusoe, David Alvarez Jan 2018

Daniel Defoe's Protestant Roman Catholics. Global Religion, Colonialism, And The Limits Of Toleration In The Farther Adventures Of Robinson Crusoe, David Alvarez

English Faculty publications

In Daniel Defoe's The Farther Adventures of Robinson Crusoe (1719), the Protestant protagonist treats Roman Catholics with a friendly tolerance, which seems at odds with his violence towards idolaters. Placing the novel within the history of secularity reveals that Crusoe can tolerate Roman Catholics because their religion is represented in Protestant terms. In his global travels, an implicit Protestantism shapes his understanding of "religion," which cannot accommodate idolaters. To promote a proper form of religion that he can tolerate, Crusoe turns to violence.

Consequential Damages And Exclusion Clauses, Victor P. Goldberg Jan 2018

Consequential Damages And Exclusion Clauses, Victor P. Goldberg

Faculty Scholarship

Contracts often include language excluding compensation for consequential damages. However, the boundary between consequential and direct damages is a blurry one. Courts have used concepts like foreseeability, natural result of the breach, and collateral business in their attempts to define the boundary. Those categories, I argue, are not particularly helpful. I consider three classes of cases: wrongful termination, delay, and breach of warranty. This paper argues that lost profits, when referring to the change in value of the contract after a wrongful termination would be direct damages; the hard case involves terminated dealers who had been paid indirectly for retailing …

From Corporate Law To Corporate Governance, Ronald J. Gilson Jan 2018

From Corporate Law To Corporate Governance, Ronald J. Gilson

Faculty Scholarship

In the 1960s and 1970s, corporate law and finance scholars gave up on their traditional approaches. Corporate law had become “towering skyscrapers of rusted girders, internally welded together and containing nothing but wind.” In finance, the theory of the firm was recognized as an “empty box.” This essay tracks how corporate law was reborn as corporate governance through three examples of how we have usefully complicated the inquiry into corporate behavior. Part I frames the first complication, defining governance broadly as the company’s operating system, a braided framework of legal and non-legal elements. Part II adds a second complication by …

The Missing Hyperlink — An Empirical Study: Can Canadian Laws Effectively Protect Consumers Purchasing Online?, Mariella Montplaisir Jan 2018

The Missing Hyperlink — An Empirical Study: Can Canadian Laws Effectively Protect Consumers Purchasing Online?, Mariella Montplaisir

Canadian Journal of Law and Technology

Canadian consumer protection legislation applicable to online transactions generally works by a two-pronged method: first, private international law rules ensure that in most cases, consumers can sue in their home province under that province’s law; and, second, a wide range of substantive obligations are imposed on merchants, and failure to comply with these obligations provides consumers with a right of cancellation. This study considers the private international law rules applicable to online consumer contracts, and discusses the unique jurisdictional challenges presented by online transactions. This study also provides an overview of Canadian legislation applicable to online consumer transactions, and examines …

Government Surveillance Accountability: The Failures Of Contemporary Canadian Interception Reports, Christopher Parsons, Adam Molnar Jan 2018

Government Surveillance Accountability: The Failures Of Contemporary Canadian Interception Reports, Christopher Parsons, Adam Molnar

Canadian Journal of Law and Technology

Real time electronic government surveillance is recognized as amongst the most intrusive types of government activity upon private citizens’ lives. There are usually stringent warranting practices that must be met prior to law enforcement or security agencies engaging in such domestic surveillance. In Canada, federal and provincial governments must report annually on these practices when they are conducted by law enforcement or the Canadian Security Intelligence Service, disclosing how often such warrants are sought and granted, the types of crimes such surveillance is directed towards, and the efficacy of such surveillance in being used as evidence and securing convictions.

A Novel Ultra-Low Interfacial Tension Nanofluid For Enhanced Oil Recovery In Super-Low Permeability Reservoirs, Derong Xu, Baojun Bai, Ziyu Meng, Qiong Zhou, Zhe Li, Yao Lu, Hairong Wu, Jirui Hou, Wanli Kang

Geosciences and Geological and Petroleum Engineering Faculty Research & Creative Works

The exploration and development of super-low permeability reservoirs have become a global focus in recent years. However, conventional flooding systems commonly face problems of high injection pressure and poor displacement efficiency in super-low permeability reservoirs. Thus, it is imperative to find new flooding agents that tackle such problems. In this study, a novel ultra-low interfacial tension (IFT) nanofluid was formulated, consisting of surfactants to achieve ultra-low IFT and silica nanoparticles to reduce injection pressure. The compatibility test between the surfactants and silica nanoparticles in 10,000 mg/L NaCl solution at 90 °C was conducted to ensure their adaption to harsh reservoir …

Unpacking Students’ Writer Identity In The Transition From High School To College: A Mixed Methods Study, Marcie J. Walsh Jan 2018

Unpacking Students’ Writer Identity In The Transition From High School To College: A Mixed Methods Study, Marcie J. Walsh

Theses and Dissertations

Since the 1975 publication of Newsweek’s article asserting that “Johnny” can’t write, many have continued to support the claim that students graduating from American high schools and universities can’t write. This criticism has led many students to believe the problem lies exclusively with them. Efforts to improve students’ writing have had little effect, as reflected in continually concerning scores on the National Assessment of Educational Progress. Recently, researchers have begun to suggest that the problem should be addressed by working to change students’ identification as a bad writer. Two constructs have emerged from these efforts: writer and authorial identity. Research …

Using The Frog Epidermis To Uncover Desmosome Function And Regulation In The Developing Embryo, Navaneetha Krishnan Bharathan Jan 2018

Using The Frog Epidermis To Uncover Desmosome Function And Regulation In The Developing Embryo, Navaneetha Krishnan Bharathan

Theses and Dissertations

The desmosome is one of the major cell adhesion junctions found in the epithelia, heart, and hair follicle. Described as a “rivet” that hold cells together, it provides these tissues with the integrity to withstand the tremendous forces they face in everyday life. Defects in this junction can lead to devastating diseases where patients are susceptible to skin infections and cardiovascular defects. Limited treatments exist for diseases of the desmosome, and strategies do not target all symptoms. Therefore, delineating the function and regulation of desmosomes is of paramount importance for the development of prevention and treatment strategies. The Xenopus laevis …

The Progress On Mapping Ubiquitin Signaling Using Photocrosslinking Mono And Di-Ubiquitin Probes And Other Ubiquitin Moieties, Courtney N. Braxton Jan 2018

The Progress On Mapping Ubiquitin Signaling Using Photocrosslinking Mono And Di-Ubiquitin Probes And Other Ubiquitin Moieties, Courtney N. Braxton

Theses and Dissertations

Ubiquitin (Ub) is a small, 76 amino acid, and post-translational modification (PTM) protein in eukaryotes. Modification of a substrate protein via the covalent attachment of the C-terminal glycine of Ub to the ε-amino group of lysine residues in a substrate is termed ubiquitination. Unlike, other PTM proteins, Ub can form polyUb chains at one or more of its seven lysine residues. (K6, K11, K27, K29, K33, K48, and K68). The consequence of these different polymerization sites is altered biological response with different polyUb linkages conferring different fates to target proteins. Unfortunately, the study of these chains have been limited by …

A Familiar House, William Lenard Jan 2018

A Familiar House, William Lenard

Theses and Dissertations

The landscapes of my home in Connecticut are important to me. When I was young, I went to the woods for seclusion and comfort. While I wandered through the woods, I discovered a passion for storytelling. Now that I no longer live in New England, I miss the familiar landscapes of home. As a way to portray my sentiment, I write poetic narratives and create objects to illustrate natural landscapes.

I combine my interests of classic Americana art and literature with brutalist architecture and modern furniture to create immersive installations. I work with concrete and hardwood to materially bridge the …

The Political Nature Of The Paris Commune Of 1871 And Manifestations Of Marxist Ideology In The Official Publications Of The Central Committee, Emily M. Jones Jan 2018

The Political Nature Of The Paris Commune Of 1871 And Manifestations Of Marxist Ideology In The Official Publications Of The Central Committee, Emily M. Jones

Theses and Dissertations

Historians originally claimed that the 1871 Paris Commune was inspired by Karl Marx. Since the 1960s, however, this assertion has been rejected by scholars who either claim that Marx had no influence over the Paris Communards or do not address the possibility that this influence existed. Many scholars have also claimed that the Commune was not political in any way, but was a rebellion inspired by patriotism, bitterness for the Versailles government’s capitulation of Paris to Prussia, or a spontaneous reaction to hostility from the national army’s attempt to disarm the indignant, rapidly organizing Parisian workers who called for municipal …
