This is the first of a series of essays wherein we analyze the U.S. Supreme Court’s decision in South Dakota v. Wayfair. In this essay, we tackle some of the more immediate interpretive questions raised by the Wayfair opinion, such as how a state should approach substantial nexus. As part of our analysis, we offer advice to state governments. Specifically, we recommend that states take note of the features of South Dakota’s law that appealed to the Court and replicate or improve on these to the extent possible. The well-publicized deaths of several African-Americans—Tamir Rice, Philando Castile, and Alton Sterling among others—at the hands of police stem from tragic interactions predicated upon well-understood practices analyzed by police scholars since the 1950s. The symbolic assailant, a construct created by police scholar Jerome Skolnick in the mid-1960s to identify persons whose behavior and characteristics the police view as threatening, is especially relevant to contemporary policing. This Article explores the societal roots of the creation of a Black symbolic assailant in contemporary American policing.

Though there is no question that the Book of Mormon’s primary purpose is to impart an understanding of the gospel of Jesus Christ, this message is generally embedded by its editors and authors in very distinct historical and political settings. This is particularly true of Mormon, who often crafted his narratives so that a given prophetic ministry intersected and interacted with the sociopolitical concerns of the contemporary Nephite population. One such concern emerging again and again in Nephite history was their identity or relationship as Israel.

During the last week of his ministry, Christ was asked what the great commandment was, and in his answer he suggested two, the last being “love thy neighbor as thyself ” (Mark 12:31). Though not stated by Christ, this commandment, found in Leviticus 19:18, is then followed by a similar commandment to love the stranger “as thyself ” (19:34). These two principles reflected one of the great principles of the law—the care for the marginalized outsider.1 Yet the plight of the marginalized was not only realized in the law, it was also found in the writings of the prophets. The current constitutional torts system under 42
U.S.C. § 1983 affords little relief to victims of
government wrongdoing. Victims of police brutality
seeking accountability and compensation from local
police departments find their remedies severely limited
because the municipal liability doctrine demands
plaintiffs meet near-impossible standards of proof
relating to policies and causation.
This Article provides a revisionist historical account
of the origin of the Supreme Court's municipal liability
doctrine. Most private claims for damages against
cities or police departments do not implicate the
doctrine's early federalism concerns over protracted
federal judicial interference with local governance.

Violence, Aggression, And Ethics: The Link Between Exposure To Human Violence And Unethical Behavior, Joshua R. Gubler, Skye Herrick, Richard Price, David A. Wood

Can exposure to media portrayals of human violence impact an individual’s ethical decision making at work? Ethical business failures can result in enormous financial losses to individuals, businesses, and society. We study how exposure to human violence—especially through media—can cause individuals to make less ethical decisions. We present three experiments, each showing a causal link between exposure to human violence and unethical business behavior, and show this relationship is mediated by an increase in individual hostility levels as a result of exposure to violence. Using observational data, we then provide evidence suggesting that this relationship extends beyond the context of …

This article is the first step in a major research project on Canadian disaster law. As such, the article's first objective is to map the terrain of the law in Canada that governs disasters. To provide context for this exercise in mapping, the article focuses on the circumstances surrounding the 2016 Fort McMurray wildfire ('the Beast'). Focusing on the 'the Beast' also gives rise to the article's second objective: a critical examination of the ways in which Canadian disaster law fails to reflect foundational social science research on disaster harm. Smallmouth bass (Micropterus dolomieu) are an important sportfish in the Susquehanna and Potomac River Basins of the Chesapeake Bay drainage. However, population declines in portions of the Susquehanna, fish kills and reports of visible abnormalities such as melanistic spots have raised concern among the public and resource managers. Although the etiology or risk factors associated with melanistic lesions are unknown, there is a propensity to attribute the abnormality to contaminants. Melanistic lesions of smallmouth bass were assessed using histopathology and gene expression analysis to evaluate the cellular and molecular changes compared to normal skin. Urban agriculture (UA) is part of the broader alternative food movement and a potential avenue through which to “do” food justice work. UA projects in the urban Global North are frequently motivated by social and food justice goals. Despite these guiding ideals, UA projects in America are rife with internal contradictions, including those related to racial inequalities, complex gentrification dynamics, and funding realities. Transgender individuals report facing incidents of discrimination often in all aspects of their lives (James et al., 2016). A potential way to combat the discrimination transgender people face is through reducing transgender prejudice. However, it is not yet known what comprises transgender prejudice. Some research has found that emotions may be the more predominant determinant of prejudice, as opposed to stereotypes (Dasgupta, Desteno, Williams, & Hunsinger, 2009; Haddock, Zanna, & Esses, 1993a; Smith, 1993). Respirators are a common form of protection when working in environments where workers are exposed to harmful agents. One exposure that has not been rigorously tested is cigarette smoke. Air sampling was conducted to test the effectiveness of four different respirators N95 Respirators for various concentrations of cigarette smoke and seal conditions and for different respirators. The Moldex 2200, Moldex 2300 (exhalation valve), Gerson 1730, and 3M 8210V (Exhalation valve) were used for testing. Given the data loss, productivity, and financial risks posed by security breaches, there is a great need to protect online systems from automated attacks. Completely Automated Public Turing Tests to Tell Computers and Humans Apart, known as CAPTCHAs, are commonly used as one layer in providing online security. These tests are intended to be easily solvable by legitimate human users while being challenging for automated attackers to successfully complete. Traditionally, CAPTCHAs have asked users to perform tasks based on text recognition or categorization of discrete images to prove whether or not they are legitimate human users.
