A Transcultural Perspective On Nonpharmacological Treatment Of Postpartum Depression: A Systematic Review, Amanda W. Leyva
A Transcultural Perspective On Nonpharmacological Treatment Of Postpartum Depression: A Systematic Review, Amanda W. Leyva
Honors Undergraduate Theses
Despite PPD’s global extent, scarce research that addresses culturally competent alternative interventions exists. The purposes of this thesis were to 1) analyze the existing literature on non-pharmacological treatment of PPD in the US and across selected cultures; 2) determine the effectiveness of cross-cultural non-pharmaceutical therapy; and 3) examine and suggest ways health care providers can integrate non-pharmacologic interventions into PPD treatment in the US. The systematic electronic search comprised the databases Cumulative Index to Nursing and Allied Health Literature, Medline, PsycINFO and SAGE Research Methods. Searches were limited to English language, peer reviewed, and research articles between 2007 and 2017. …
The Federal Arbitration Act And Independent Contractors, Richard Frankel
The Federal Arbitration Act And Independent Contractors, Richard Frankel
Cardozo Law Review de•novo
The misclassification of employees as independent contractors is one of the most serious problems affecting the American workforce. It deprives workers of important employee benefits, civil rights, and wage and hour protections, and deprives the federal and state governments of billions of dollars in tax revenue annually. While workers can seek redress in the courts, businesses are trying to take away that right as well by forcing workers to submit their disputes to binding mandatory arbitration under the Federal Arbitration Act (FAA). Section 1 of the FAA, however, creates an exemption for transportation workers, stating that “nothing herein contained shall …

Climate change threatens our world and way of life. Intelligent development and investment could mitigate the worst threats of climate change, while simultaneously providing continuous growth for the global economy. The New Climate Economy proposes efforts to combat this ecological collapse that would result in $30 trillion in new annual economic growth by 2030. Stockholm Resilience Center agrees, giving a framework based on global ecological systems that calls for five critical tasks that can bring growth and stability: Renewable energy
Sustainable local food production
New development models, based on what has worked globally
Reduction of wealth inequity

Evaluating Effects Of Deficit Irrigation Strategies On Grain Sorghum Attributes And Biofuel Production, Bairen Pang, Ke Zhang, Isaya Kisekka, Scott Bean, Meng Zhang, Donghai Wang
United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications
With reduced water resources available for agriculture, scientists and engineers have developed innovative technologies and management strategies aimed at increasing efficient use of irrigation water. The objective of this research was to study the impact of deficit irrigation strategies on sorghum grain attributes and bioethanol production. Grain sorghum was planted at Southwest Research-Extension Center near Garden City, KS, under five different irrigation capacities (1 inch every 4, 6, 8,10, or 12 days) and dryland in 2015 and 2016 growing seasons. Results showed average kernel weight, kernel diameter and test weight of grain sorghum increased as irrigation capacity increased, whereas kernel …

Sorting Out White-Collar Crime, Miriam H. Baer
Sorting Out White-Collar Crime, Miriam H. Baer
Faculty Scholarship
Our federal criminal code defines crimes, but declines to sort its fraud offenses according to degrees of harm or culpability. Although state prosecutors routinely charge crimes such as homicide or robbery in varying degrees, the federal code’s core fraud statutes are noticeably flat. There is no such thing as first- or second-degree fraud in the federal code.
Amidst a roiling debate as to whether the federal government overcriminalizes or underenforces white-collar crime, scholars have lost sight of the federal code’s lack of gradation. This Article seeks to remedy this neglect, particularly in regard to fraud crimes. Drawing examples from federal …
Administrative Guidance And Genetically Modified Food, Edward L. Rubin, Joanna K. Sax
Administrative Guidance And Genetically Modified Food, Edward L. Rubin, Joanna K. Sax
Faculty Scholarship
One of the most controversial issues in administrative law, the use of guidance, is exemplified by the regulation of one of the most controversial areas in modern society: genetically modified (GM) food. The appropriate use of guidance versus notice and comment rulemaking is a much-debated issue in administrative law. While agency officials generally assert that they are using guidance to express an agency’s thoughts about how to comply with a specific statutory provision or agency rule, the practical consequence is that the regulated party will hesitate to disobey, even if it believes that the guidance goes beyond the requirements of …
Veterinary Lien Laws: Hypocrisy In A Healing Profession, Mark I. Weinstein
Veterinary Lien Laws: Hypocrisy In A Healing Profession, Mark I. Weinstein
Faculty Scholarship
This Article discusses the problem of veterinary lien laws that treat companion animals as inanimate objects, in a modern society that often views pets as members of the family. Historically, pets, like automobiles, were subject to possessory liens. If an automobile owner couldn't pay the repair bill, the mechanic could keep possession of the car or sell the car to recoup costs. Veterinary lien laws treat companion animals in a similar fashion. If the owner cannot not pay the veterinary bill in full, the veterinarian is often permitted to keep possession of the companion animal until the bill is paid. …
Interrogation Or Experimentation? Assessing Non-Consensual Human Experimentation During The War On Terror, William J. Aceves
Interrogation Or Experimentation? Assessing Non-Consensual Human Experimentation During The War On Terror, William J. Aceves
Faculty Scholarship
The prohibition against non-consensual human experimentation has long been considered sacrosanct. It traces its legal roots to the Nuremberg trials although the ethical foundations dig much deeper. It prohibits all forms of medical and scientific experimentation on non-consenting individuals. The prohibition against non-consensual human experimentation is now well established in both national and international law.
Despite its status as a fundamental and non-derogable norm, the prohibition against non-consensual human experimentation was called into question during the War on Terror by the CIA's treatment of "high-value detainees." Seeking to acquire actionable intelligence, the CIA tested the "theory of learned helplessness" on …
The Rise Of Self Sidelining, Leslie Culver
The Rise Of Self Sidelining, Leslie Culver
Faculty Scholarship
This Article coins the term "self sidelining" as an experience emanating from two theories: impostor phenomenon and gender sidelining. The impostor phenomenon is a well-established psychological construct that describes the inability of some high-achieving women and men to internalize success. Gender sidelining, recently popularized in legal scholarship, describes the undermining of women's achievements, as compared to men, that are unactionable as legal discrimination. In view of these theories, this Article contends that when internal fraudulent feelings (imposter phenomenon) are perceived to be externally validated by male gender preference (gender sidelining), women consciously or subconsciously discipline themselves to forgo their professional …

Floral Symmetry Genes Elucidate The Development And Evolution Of Oil-Bee Pollinated Flowers Of Malpighiaceae And Krameriaceae, Farahnoz N. Khojayori
Theses and Dissertations
Specialization on insect and animal pollinators is thought to be the driving force for the evolution of floral traits. Specifically in the New World (NW), the oil-bee pollination syndrome has led to the convergence of floral characters in two distantly related families of core eudicots, Malpighiaceae and Krameriaceae. Both families display a flag-like structure that establishes a zygomorphic flower and floral oil rewards in epithelial elaiophores. These traits work concomitantly to attract and reward female oil-bees that help fertilize these flowers and in return receive oils. The underlying genetics of floral zygomorphy were studied in several clades of core eudicots, …

(First paragraph) It came as quite a shock at the time. I cannot recall exactly when it happened, but it certainly caught me by surprise. For most of my life, and certainly from elementary school (or “primary” school in the UK) through high school I had become used to seeing posters and books illustrating the “standard” map of the world: the Mercator projection. Of course, Greenwich, London, sat at longitude 0◦ (and still does!). And certainly I knew that planet Earth is spheroidal and that this flat projection distorted the shapes and areas (especially near the polar regions), but somehow …
Harmful Algal Bloom Mitigating Using Recycled Concrete Aggregate Coated With Fixed-Quat., Ikenna Ezeodurukwe
Harmful Algal Bloom Mitigating Using Recycled Concrete Aggregate Coated With Fixed-Quat., Ikenna Ezeodurukwe
Electronic Theses and Dissertations
Human activities generate surplus nutrients which may lead to algal bloom events in water resources along with serious ecological problems and thus substantial economic losses. Particularly, harmful algal blooms (HABs) represent toxic cyanobacterial blooms which produce cyanotoxins. The primary concerns of HABs are the exposures to a wide variety of cyanotoxins via ingestion of contaminated drinking water, inhalation during recreational activities, and consumption of contaminated fish and shellfish. However, conventional physical and chemical methods are not always possible to efficiently handle these HABs events. It is urgent to develop viable and rapid solutions to control HABs in field and mitigate …
The Sudanese Indigenous Model For Conflict Resolution: A Case Study To Examine The Relevancy And The Applicability Of The Judiyya Model In Restoring Peace Within The Ethnic Tribal Communities Of The Sudan, Abdul S. Wahab
Department of Conflict Resolution Studies Theses and Dissertations
This qualitative research case study explored the indigenous model of conflict resolution known as the “Judiyya,” in the South Darfur State, Sudan. The purpose of the study has been to understand the principles and practices of the Judiyya in maintaining peace among Darfuri tribal communities. Judiyya is a community-based, human-centered model that employs restorative and transformative principles in conflict resolution. The literature review provided context for a research project that addressed the following questions: What is the role of the Judiyya in the current situation? How does the model work? What are its decision-making processes? How does the Judiyya model …

Parents Of War: A Grounded Theory Study Of The Experience Of Parenting Through The War Experience, Margaret Wilkie
Department of Conflict Resolution Studies Theses and Dissertations
This study focuses on experiences of refugee parents who have experienced war and displacement. There is a lack of academic research in the area of parenting and war, and this study hopes to begin to fill that gap. Research that is based on personal experiences is the ultimate guide to forming policy and programs that meet real needs. This study employed Grounded Theory methodology and in-depth interviewing to explore the questions of how parents manage to meet their own needs, the needs of their children, and overall cope with the experiences of war and displacement. Through intense analysis of interviews …

The devastating bat fungal disease, white-nose syndrome (WNS), does not appear to affect all species equally. To experimentally determine susceptibility differences between species, we exposed hibernating naïve little brown myotis (Myotis lucifugus) and big brown bats (Eptesicus fuscus) to the fungus that causes WNS, Pseudogymnoascus destructans (Pd). After hibernating under identical conditions, Pd lesions were significantly more prevalent and more severe in little brown myotis. This species difference in pathology correlates with susceptibility to WNS in the wild and suggests that survival is related to different host physiological responses. We observed another fungal infection, …

When hearing knocking on a door, a listener typically identifies both the action (forceful and repeated impacts) and the object (a thick wooden board) causing the sound. The current work studied the neural bases of sound source identification by switching listeners' attention toward these different aspects of a set of simple sounds during functional magnetic resonance imaging scanning: participants either discriminated the action or the material that caused the sounds, or they simply discriminated meaningless scrambled versions of them. Overall, discriminating action and material elicited neural activity in a left-lateralized frontoparietal network found in other studies of sound identification, wherein …

Why We Can’T “Just All Get Along”: Dysfunction In The Polity And Conflict Resolution And What We Might Do About It, Carrie Menkel-Meadow
Journal of Dispute Resolution
These are very troubled times. The polity is seriously divided; people who march for white supremacy and hate are called “nice and very good people” by an unhinged, but Constitutionally elected, President; relations between citizens of color and police are at a high level of hostility and distrust; Congress is unable to pass virtually any legislation; and policy differences over immigration, trade, taxation, and health care are so great that even a ruling party cannot get anything done. Perhaps the greatest challenge for our democracy now is learning how to deal with great value differences in the polity, enough so …
Value And Judgment In Investment Treaty Arbitration, Frederic Gilles Sourgens
Value And Judgment In Investment Treaty Arbitration, Frederic Gilles Sourgens
Journal of Dispute Resolution
Are international treaties consenting to the resolution of disputes between foreign investors and the host states to their investment still a good idea? Recent and not so recent criticism of such treaty provisions calls into question whether investor-state tribunals can act as neutral arbiters of such disputes. This criticism argues that tribunals are biased in favor of the business interests of investors—and therefore disfavor the state’s right to regulate. Responses to this criticism frequently have alleged the opposite: The arbitral tribunals constituted under international treaties are, if anything, too friendly towards the interests of states. They fail to protect the …

Environmental Law—Resuming Progress On Lead Poisoning: A Prime Indicator Of Civilization, Rick Reibstein
Western New England Law Review
Failing to adequately protect citizens against the threat of lead poisoning is an indication that our society is not fully civilized. There are many compelling reasons to take concerted action against lead: the seriousness of its harm, the preventability of poisoning, that all of society is affected, and that many actions are economically feasible. Even the most costly action, removal of the source, has an excellent cost benefit ratio. After reviewing the state of affairs and the reasons to take action, this Article provides an overview of some of the actions that can be taken. Mustering the ability to take …

Out, Proud, And African: One Man’S Journey As A Gay Ugandan Activist, John “Longjones” Abdallah Wambere
Western New England Law Review
The criminalization and stigmatization of homosexuality in Uganda have led to persecution, denial of essential services, and terrible health outcomes for the country’s LGBTIQ community. The Ugandan government, with the assistance of Western Christian fundamentalist groups, has introduced bills and legislations intended only to persecute and harm the gay community. Spectrum Uganda Initiatives works to reverse some of that damage through education, advocacy, and increased access to health care for gay men in Uganda. Co-founder John Wambere tells of his journey of self-discovery and activism in Uganda, and his decision to seek asylum in the United States while continuing to …

Who Supports Syrians? The Relative Importance Of Religion, Partisanship, And Partisan News, Brian Newman
All Faculty Open Access Publications
Who supports allowing Syrian refugees into the United States? As a candidate, Donald Trump clearly opposed doing so. In contrast, religious leaders across the broad spectrum of religious traditions in the United States have drawn on sacred texts to call their people to action in response to the Syrian refugee crisis. Many explicitly ask the government to resettle Syrian refugees in the United States. Thus, many Republicans may have experienced cross-cutting pressures. Analyses of three surveys from 2015 and 2016 found that party identification, ideology, support for Trump, partisan-news consumption, religious-service attendance, age, and education predicted support for bringing Syrian …
