Foreword: Continuity In The Presidency: Gaps And Solutions, Matthew Diller
Foreword: Continuity In The Presidency: Gaps And Solutions, Matthew Diller
Fordham Law Review
This symposium issue featuring a report and articles on the Twenty-Fifth Amendment and the presidential succession system is perfectly timed. Its release comes in the final month of the year that marked the fiftieth anniversary of the Twenty-Fifth Amendment’s ratification and at a moment of unprecedented public discussion of the Amendment. Yet, in Fordham Law School’s unique history with the Twenty-Fifth Amendment, auspicious timing is not unusual.
The Bipartisan Bayh Amendment: Republican Contributions To The Twenty-Fifth Amendment, Joel K. Goldstein
The Bipartisan Bayh Amendment: Republican Contributions To The Twenty-Fifth Amendment, Joel K. Goldstein
Fordham Law Review
It is appropriate that Senator Birch Bayh has been widely recognized as the author and person most responsible for the Twenty-Fifth Amendment. His work was indispensable, and he was helped by other Democrats and nonpartisan actors including the American Bar Association and John D. Feerick, among others. Yet the Amendment was also the product of bipartisan cooperation. Important provisions were based on work done during the administration of President Dwight D. Eisenhower, and Eisenhower and his Attorney General, Herbert Brownell, played important roles in supporting Bayh’s proposal as did other Republicans in and out of Congress. Republicans like Representative Richard …
"A Dr. Strangelove Situation": Nuclear Anxiety, Presidential Fallibility, And The Twenty-Fifth Amendment, Rebecca C. Lubot
"A Dr. Strangelove Situation": Nuclear Anxiety, Presidential Fallibility, And The Twenty-Fifth Amendment, Rebecca C. Lubot
Fordham Law Review
This Article is a revisionist history of the ratification of the Twenty-Fifth Amendment, which establishes procedures for remedying a vice presidential vacancy and for addressing presidential inability. During the Cold War, questions of presidential succession and the transfer of power in the case of inability were on the public’s mind and, in 1963, these questions became more urgent in the shadow of the Cuban Missile Crisis. Traditional legal histories of the Amendment argue that President John F. Kennedy’s assassination was both the proximate and prime factor in the development of the Amendment, but they do not account for the pervasive …
American Equal Protection And Global Convergence, Holning Lau, Hillary Li
American Equal Protection And Global Convergence, Holning Lau, Hillary Li
Fordham Law Review
Commentators have noted that equal protection doctrine is in a state of transformation. The nature of that transformation, however, is poorly understood. This Article offers a clearer view of the change underway. This Article is the first to reveal and synthesize three major trajectories along which the U.S. Supreme Court has begun to move. First, the Court has begun to blur the line that it previously drew between facial discrimination and disparate impact. Second, the Court has begun to collapse its previously established tiered standards for reviewing discrimination. These two trajectories combine to produce a third trajectory of change: by …
Back To The Drawing Board: Revisiting The Supreme Court's Stance On Partisan Gerrymandering, Robert Colton
Back To The Drawing Board: Revisiting The Supreme Court's Stance On Partisan Gerrymandering, Robert Colton
Fordham Law Review
In the United States, state legislatures have drawn voting districts to achieve desired election results for hundreds of years. Dating back to the James Madison presidency, various legislatures and iterations of the U.S. Supreme Court have wrestled with the legal and constitutional issues that stem from the practice known as “gerrymandering.” While courts and legislatures have, at times, been successful in eliminating some of the more sinister uses of the tactic, such as racially motivated district-line drawing, gerrymandering inspired by partisan motives remains. Continual improvements in technology coupled with an increasingly divided political culture mean that partisan gerrymandering is at …

Multidrug-resistant Staphylococcus aureus (MDR S. aureus) is predominately present in humans and animals. Staphylococcal enterotoxin (SE) is one of the representative toxins produced by S. aureus. The drug resistance patterns, presence of eighteen SE genes and staphylococcal cassette chromosome (SCCmec) in S. aureus strains isolated from human cellulitis, septicemia, mastitis and farmed ruminant mastitis were investigated and analyzed. Methicillin-resistant S. aureus (MRSA) and methicillin-sensitive S. aureus (MSSA) accounted for 51.35% (76/148) and 48.65% (72/148), respectively. Both MSSA and MRSA carried sea (15%), seb (30.8%) and sek (27.5%) genes. Eighty percent of the MRSA strains (52/65) belonged to SCCmec types I, …

Effects Of Monosodium Glutamate On Heart Beat And The Embryonic Development Of Zebrafish, Naowarat Suthamnatpong, Aranya Ponpornpisit
The Thai Journal of Veterinary Medicine
The effect of monosodium glutamate (MSG) on zebrafish, Danio rerio, embryo was investigated at different concentrations of ten-fold dilution of ten times lesser than the median lethal concentration (LC50). Zebrafish embryos in the MSG treated groups (40,000 ppm and 80,000 ppm) reached highest mortality rate at 100 % within 48 hpf and 96 hpf which is significantly different (p<0.05) from negative control group. According to the Probit analysis, the LC50 of MSG on zebrafish embryo at 48 hpf and 96 hpf were 15,200 ppm and 10,300 ppm, respectively. Under the observation, effects based on the toxicity endpoint composed of lethal, sublethal and malformation effects appeared within 144 hpf. Exposure to MSG at 1,500 ppm and 150 ppm significantly produced sublethal effects and malformation development to zebrafish embryo. MSG induced cardiotoxic effects in zebrafish embryo was observed at 15, 150 and 1,500 ppm. Our results demonstrate that zebra fish embryo is a good model for the detection of toxic potential of chemical substances. Also, our data suggest the need to reconsider the safety of MSG and elucidate its mechanism of adverse reaction in further studies.

Primary open angle glaucoma (POAG) is an optic neuropathy characterized by progressive loss of retinal structure and visual function of the eye and may eventually lead to blindness. Standard Automated Perimetry (SAP) is a standard clinical procedure used to assess and quantify the sensitivity (in decibels) of various locations in the retina in response to light stimuli presented at the respective retinal locations. Therefore, to detect POAG and to assess efficacy of treatment procedures, it is necessary to assess progressive loss of visual sensitivity at all retinal locations simultaneously. In this work, we present a new approach to detect glaucomatous …

The Advanced LIGO and Advanced Virgo observatories recently discovered gravitational waves from a binary neutron star inspiral. A short gamma-ray burst (GRB) that followed the merger of this binary was also recorded by the Fermi Gamma-ray Burst Monitor (Fermi-GBM), and the Anti-Coincidence Shield for the Spectrometer for the International Gamma-Ray Astrophysics Laboratory (INTEGRAL), indicating particle acceleration by the source. The precise location of the event was determined by optical detections of emission following the merger. We searched for high-energy neutrinos from the merger in the GeV-EeV energy range using the Antares, IceCube, and Pierre Auger Observatories. No neutrinos directionally coincident …

Chlorine-based sanitizers have seen wide spread use in food sanitation. The reaction of chlorine species with organic matter is a concern for two reasons. Available chlorine can be “used up” by organic compounds resulting in a lower amount of chlorine available for disinfection. Another concern is that some forms of chlorine can react with some organic compounds to form toxic halogenated disinfection byproducts (DBPs). Many studies have been conducted to evaluate the role of hypochlorous acid (HOCl) and hypochlorite ion (OCl−) in the production of DBPs with a particular interest in the production of trihalomethanes (THMs) and haloacetic acids (HAAs). …

NYMC Faculty Publications
Myelodysplasia (MDS) /myeloproliferative neoplasm (MPN) overlap syndrome has been described since the 2001 WHO classification as disorders that have both proliferative and dysplastic changes simultaneously. Specific disorders include chronic myelomonocytic leukemia (CMML), juvenile myelomonocytic leukemia (JMML), BCR-ABL negative atypical chronic myeloid leukemia (aCML) and unclassifiable MDS/MPN (MPN/MDS-U). Recurrent gene mutations in these conditions have been described. Among them, SETBP1 mutations have been identified in up to 32% of aCML, 24% of JMML, 18% of CMML and 10% of MDS/MPN-U patients. The mutation hotspot lies in the amino acid residues 858-871 in the SETBP1 protein. SETBP1 mutations in MDS/MPN overlap syndrome …

Mechanistic Studies Of The Iron And Molybdenum Nitrogenases, Derek Harris
Mechanistic Studies Of The Iron And Molybdenum Nitrogenases, Derek Harris
All Graduate Theses and Dissertations, Spring 1920 to Summer 2023
As a basic building block in many biological molecules the element nitrogen (N) is essential for life. Dinitrogen (N2) is abundant in Earth’s atmosphere, but this form is biologically unavailable. To be biologically available N2 must undergo an energy demanding reduction reaction to the fixed form, ammonia (NH3). The industrial Haber-Bosch process, which accounts for approximately 50% of the worlds fixed nitrogen, uses energy from fossil fuels to achieve high pressures and temperatures to facilitate the reaction. The energy used by Haber-Bosch accounts for approximately 2% of the world’s annual supply. The remainder of fixed nitrogen is produced biologically by …

Ethics And Bias In Machine Learning: A Technical Study Of What Makes Us “Good”, Ashley Nicole Shadowen
Student Theses
The topic of machine ethics is growing in recognition and energy, but bias in machine learning algorithms outpaces it to date. Bias is a complicated term with good and bad connotations in the field of algorithmic prediction making. Especially in circumstances with legal and ethical consequences, we must study the results of these machines to ensure fairness. This paper attempts to address ethics at the algorithmic level of autonomous machines. There is no one solution to solving machine bias, it depends on the context of the given system and the most reasonable way to avoid biased decisions while maintaining the …

911 Dispatchers: Their Role As Evidence Collectors, Brittany P. Kassis
Student Theses
911 dispatchers are often the first point of contact after an individual is in an accident, needs emergency assistance, or witnesses a crime. In an emergency involving a crime, a dispatcher can play an important role in assisting the investigative process and collecting evidence, such as an eyewitness’ description of the suspect. While trained in how to gather situational and locational information from a caller so that relevant first responders can be notified, dispatchers may not be trained on how the specific language they use with a caller can impact the caller’s memory for the event. Thus, if dispatchers are …
