Part I begins with a primer on the laws of copyright. It provides an overview of the statute's history, as well as some background on particular doctrines developed through case law. Part II introduces the history of postmodern dance and the choreographer Trisha Brown, whose work will function as a case study herein. Part III analyzes Brown's work as it relates to the statutory language of copyright law and the doctrines of originality, functionality, idea/expression dichotomy, and fixation. Community college presidents serving rural populations in the state of Oklahoma have been forced to take on new responsibilities related to institutional fundraising due to multiple economic challenges including continued budgetary shortfalls and limited resource allocation. Review of the academic literature addressing this subject exposed a wide variety of rationales associated with this leadership shift, as well as successful presidential approaches to fundraising in modern higher education. This qualitative study of rural community college presidents in Oklahoma examined the rationale for expanded presidential roles in fundraising, while outlining a number of other essential roles, characteristics, professional backgrounds, and stressors that …

LGBT older adults, like many older Americans in the United States, rely on a network of service providers as they age–for community programming and congregate meals, for health care, and for housing ranging from independent living to skilled nursing. Research finds that a majority of these services are offered by religiously affiliated organizations.

The report was launched with a panel discussion program hosted at Columbia University's Union Theological Seminary on Friday, December 15th, 2017, detailing the increased risks LGBT older adults face as a result of recent religious exemption laws and policies.

In the frame of its partnership with Uongozi – Tanzania, CCSI drafted a brief that reviews recent international gas developments, the outlook in this regard and implications for the development of proposed offshore gas projects in Tanzania. As the country aims to benefit from its gas discoveries by increasing its domestic gas use, it also outlines some of the trade-offs and considerations that need to be taken into account when negotiating the domestic gas allocation.

CCSI submitted an amicus brief to the Constitutional Court of Colombia concerning the Tutela hearing of Mansarovar Energy Colombia Ltd. v. Tribunal Administrativo del Meta (The Consulta Popular of Cumaral, Meta). The hearing concerned a challenge by Mansarovar Energy Colombia Limited of a municipal-wide referendum (the Consulta Popular) concerning whether or not the extraction of hydrocarbons should be permitted in the municipality of Cumaral. The municipality voted 97% against allowing the extraction of hydrocarbons.

In December 2017, CCSI sent comments to the World Bank regarding its Draft Guidance Note for Borrowers ESS5: Land Acquisition, Restrictions on Land Use and Involuntary Resettlement.

CCSI’s overarching comments on the Guidance Note were that:

  • Its description of affected persons and their rights contradicts and undermines international consensus on land governance supported by the Bank
  • It fails to provide any guidance on when involuntary resettlement should be considered unavoidable or how Borrowers can prioritize project designs that actually minimize displacement or other harms
  • It fails to put rights-holders (or “affected stakeholders”) at the center of solutions

The United Nations Special Rapporteur on extreme poverty and human rights, Professor Philip Alston, will conduct a country visit to the United States in December 2017. In response to his call for input, CCSI sent a submission focused the United States’ role in the international investment regime, and the United States’ international investment agreements (IIAs), noting that the IIAs to which the US is a party raise tensions, and can potentially create conflicts, with the US’s human rights obligations, including those that apply extraterritorially, and exacerbate conditions of poverty, extreme poverty and inequality.

This Article explores how host governments’ legal obligations can affect or constrain their ability to address “land grievances,” which are defined as concerns raised by local individuals or communities in response to negative impacts of land-based investments. Obligations under international investment law, international human rights law, and investor-state contracts can be in tension or can directly conflict with one another, creating complexity for governments seeking to respond to land grievances. Lake sturgeon Acipenser fulvescens were once widely distributed throughout the Laurentian Great Lakes. However, widespread overharvest and habitat degradation has diminished their numbers. The lower Niagara River, NY contains one of the few remaining recovering populations of lake sturgeon in New York State. The goal of this study was to characterize the trophic position of lake sturgeon in the context of an invasive species dominated food web and to describe their movement patterns and residency within the lower Niagara River. Magical Realism, arguably one of the most important literary forms to develop in the 20th century, is rarely discussed as a film genre, though there are notable film adaptations of magical realist novels. This thesis explores the film adaptation of Salman Rushdie’s Midnight’s Children to demonstrate how a magical realist novel may be adapted to a visual form, and still maintain the aesthetic sensibilities—and political implications—of the literary original. Disturbance because of human activity, including recreation on wildlands, can affect bird behavior which in turn can reduce breeding success, an important consideration for species of management concern. We observed Golden Eagles (Aquila chysaetos) during the breeding season to determine whether the probability of flushing was affected by the type of recreationist, distance to encounter, eagle nest attendance, or date. We monitored eagles in 23 nesting territories from distant (600-1,200 m) observation points and recorded recreation activity within 1,200 m of eagles in the Owyhee Front of southwestern Idaho. Across much of North America, populations of American Kestrels (Falco sparverius) have been in decline for decades (Farmer et al. 2008, Farmer and Smith 2009, Smallwood et al. 2009a, Paprocki et al. 2014, Sauer et al. 2014). Hypothesized causes of kestrel declines include predation by Cooper's Hawks (Accipiter cooperii; Farmer et al. 2008), pathogens (e.g., Nemeth et al. 2006), habitat loss (Sullivan and Wood 2005, Farmer et al. 2008, Bolgiano et al. 2015), pesticides (Smallwood et al. 2009a, Rattner et al. 2015), and climate change (Steenhof and Peterson 2009b), yet no hypothesized factor has been supported …

Detailed blood flow information has been recognized as the key information for diagnosis of vascular diseases, such as vascular stenosis and aneurysms. Optical flow method (OFM) is an emergent technique as a tool to analyze the digital x-ray subtraction angiographic images of blood vessels to obtain the detailed blood flow distribution in vascular systems. A brief review isconstructed to discuss the status, applicability, accuracy and future direction of the optical flow technique in the physical study of vascular flow.

The purpose of this master’s project thesis is to explore and implement the necessary professional museum practices to care for and preserve the private Vietnam War-era slide collection of Kenneth L. Swain Jr., an Air Force veteran. Through museum practices presented by leading museum professionals, the slide collection was examined and a plan implemented for slide care and maintenance. In conjunction with the preservation of this slide collection, an exhibition was curated in honor of Swain’s unique photo-documentary slide collection.

Preschoolers that have obtained Non-Accidental Injury (NAI) from familial child abuse are in need of having a unique place for neurorehabilitation in correlation with traditional therapies. My thesis project suggests adding an exhibit annex to an existing giant panda exhibit that will give preschoolers an opportunity to help develop new neuropathways when exposed to mediation and creative activities. Meditation and creative activities are being examined by neuroscientists as an aid in neuroplasticity after brain injury. Despite the growing recognition of the critical role of post-sale service on the salesperson-customer relationship, few studies have explored how salesperson service behaviors (SSB) are enhanced through tools such as sales-based customer relationship management (CRM) technology and social media. Using dyadic salesperson-customer data within a business-to-business context, this study analyzes the direct effects of sales-based CRM technology on the behaviors of diligence, information communication, inducements, empathy and sportsmanship. Additionally, the study examines the interactive effects of sales-based CRM technology and social media on these behaviors. The results indicate that sales-based CRM technology has a positive influence on SSBs and that …
