When Are Debtors And Creditors Bound To The Provisions Of Confirmed Reorganization Plans?, Gabriella Labita
When Are Debtors And Creditors Bound To The Provisions Of Confirmed Reorganization Plans?, Gabriella Labita
Bankruptcy Research Library
(Excerpt)
Generally, when a debtor files for protection under chapter 11 of the United States Bankruptcy Code (the “Bankruptcy Code”), a plan of reorganization is filed at some point with the bankruptcy court. The court then holds a hearing to determine whether the judge will confirm the reorganization plan. The judge will confirm the plan if it meets the criteria of Section 1129 of the Bankruptcy Code, which requires, among other things, that any payments made in connection with the plan are reasonable. A plan of reorganization is a significant component of a debtor’s emergence from bankruptcy, as it affects …

Anything you do in bankruptcy can and will be used against you in bankruptcy. Prior to the commencement of a bankruptcy case, perhaps courts should issue this Miranda-esque warning to the parties. At least, if the bankruptcy court had, Plymouth LLC (“Plymouth”) might have saved approximately $800,000 that it spent acquiring a lien against Princeton LP’s (“Princeton”) vacant office park in the Township of Lawrence, New Jersey. Recently, the United States Court of Appeals for the Third Circuit held that Plymouth’s claim against Princeton in Princeton’s bankruptcy case was disallowed for violating New Jersey’s tax sale law pursuant to …

Each year, the government awards millions of dollars in federal grants to fund scientific research. Despite this huge allocation of resources, the government’s claim in such funded research may be limited should the receiving institution become a debtor in bankruptcy. Last year, the United States Bankruptcy Court for the District of Massachusetts allowed the destruction of government funded research to benefit the debtor estate.

(Excerpt)
The United States Bankruptcy Code (the “Bankruptcy Code”) allows a trustee a debtor-in-possession (“DIP”) to assume or reject a collective bargaining agreement (“CBA”). Courts are split on whether a trustee or DIP may reject an expired collective bargaining agreement under section 1113 of the Bankruptcy Code. In general, a collective bargaining agreement may be rejected notwithstanding the labor standards afforded to employees by the National Labor Relations Act (“NLRA”). In particular, under the NLRA, an employer that is party to a CBA is obligated to bargain with its employees until the employer either enters into a new contract or …

Primed To Lead: A Case Study Of Global Leader Education In South Korea, Landis Garrel Fryer
Primed To Lead: A Case Study Of Global Leader Education In South Korea, Landis Garrel Fryer
Dissertations
Drawing students from an international audience, some higher education institutions are educating global leaders through business school programs. This is an instrumental case study of one such program€”the Global Masters of Business Administration (Global MBA) at Korea University Business School. This dissertation analyzed interviews, onsite observations, and documents with the concepts of globalisms and cosmopolitanism as a framework. the findings uncovered programmatic features designed to educate global leaders and participant considerations of global leader characteristics. the conclusion situated these considerations and findings within existing leadership theory and placed the case as an example of shared cosmopolitanism and global leader education …
The Role Of Notch-1-Mediated Repression Of Pten On Growth And Cancer Stem Cell Survival In Trastuzumab Resistant, Her2+ Breast Cancer, Andrew Thomas Baker
The Role Of Notch-1-Mediated Repression Of Pten On Growth And Cancer Stem Cell Survival In Trastuzumab Resistant, Her2+ Breast Cancer, Andrew Thomas Baker
Dissertations
Trastuzumab targets the ErbB2 (HER2) receptor on breast cancer cells to attenuate HER2 driven tumor formation. Trastuzumab reduces both downstream PI3K/Akt and MAPK pathway signaling as well as the breast cancer stem cell (BCSC) population. BCSCs are hypothesized to be responsible for tumor recurrence, metastasis, as well as drug resistance. Today, resistance to trastuzumab remains a major clinical problem for women diagnosed with HER2+ breast cancer. Attenuation of PI3K/Akt and MAPK pathways may occur through the tumor suppressor, PTEN. Women with HER2+ breast tumors expressing less PTEN and increased PI3K/Akt or MAPK activity have worse overall outcome. Previously we have …
Patriots And Practical Men: British Educational Policy And The Responses Of Colonial Subjects In India, 1880-1890, David Thomas Boven
Patriots And Practical Men: British Educational Policy And The Responses Of Colonial Subjects In India, 1880-1890, David Thomas Boven
Dissertations
This dissertation focuses on the interplay between educational policy implemented by the British colonial authorities in India and the religious and ethnic communities impacted by these policies. It first considers educational policies promulgated from the earliest days of rule by the British East India Company until the Hunter Commission of 1882. Following this survey, the dissertation considers Indian reactions to these systems and colonial structures of education between 1880 and 1890. Those colonizing India had planned to use education as a means of stabilizing and strengthening their own rule on the subcontinent. As the British colonizers steadily overran the subcontinent, …

UNAVOIDABLE PRESSURE ULCER: AN ETHNONURSING STUDY
In an effort to improve patient safety and the quality of care in the acute care setting, there has been an increased focus on the prevention of adverse events believed to be avoidable. Hospital-acquired pressure ulcers (HAPU) have been listed as one of those adverse events, and hospitals are no longer reimbursed for related costs. However, there are patient conditions and clinical situations in which a pressure ulcer can be deemed unavoidable. In acute care, unavoidable means that the patient developed a pressure ulcer even though the provider …
Cellular Determinants Of Coronavirus Entry Routes, James Thomas Earnest
Cellular Determinants Of Coronavirus Entry Routes, James Thomas Earnest
Dissertations
Coronaviruses (CoVs) represent some of the greatest modern threats to global health. CoVs are zoonotic viruses that generally cause respiratory or enteric infections. The ability of CoVs to move between species and into human populations ensures that CoVs will remain important and dangerous pathogens. Therefore, understanding how CoVs infect different hosts is vital to human health.
CoVs are enveloped and must undergo fusion of viral and host membranes to initiate infection. Viral glycoproteins, called Spike (S) proteins, are responsible for host cell binding and carrying out the membrane fusion reaction. S proteins store energy in their folded, pre-fusion conformation that …
We Can Do Better: Evaluating An Intervention Remedying Caseworkers’ Negative Racial Bias Towards African American Families Involved In Child Welfare, Adrianne Michele Fletcher
We Can Do Better: Evaluating An Intervention Remedying Caseworkers’ Negative Racial Bias Towards African American Families Involved In Child Welfare, Adrianne Michele Fletcher
Dissertations
Given that U.S. history documents the severing of African-American family ties by isolating parents from each other and their children under slavery, it is imperative that the child welfare system be free of any echoes of that holocaust. Yet many scholars and practitioners who lament negative racial attitude, both implicit and explicit, may continue to contribute to the over-representation of African-American children in the U.S. child welfare system. This study proposes to examine a subcategory of practitioner attitudes, those about the caregivers’ race, and how those attitudes can be altered through a reflective educational experience. Drawing from pre-existing research about …
Research Practices Of Music Educators: A Review Of The Journal Of Research In Music Education, Clifton Brent Mcreynolds
Research Practices Of Music Educators: A Review Of The Journal Of Research In Music Education, Clifton Brent Mcreynolds
Dissertations
Music Education researchers face the same challenge of producing valid, reliable, and thorough work as any field in education. A content analysis was conducted on the Journal of Research in Music Education from 2011-2016 to determine what research trends were occurring and whether or not those trends are continuations of existing literature. Investigation included distributions of research designs as well as the four components Crotty recommended for quality research. Findings supported previous research indicating more qualitative studies within the journal. Also, for those articles having three or four of Crotty’s components, qualitative coding of these components were categorized into constructive-where …
The Effects Of Alcohol And Traumatic Brain Injury On Neural Stem Cell Responses, Son Trung Ton
The Effects Of Alcohol And Traumatic Brain Injury On Neural Stem Cell Responses, Son Trung Ton
Dissertations
Traumatic brain injury (TBI) is a major source of disability in modern societies. However, there are no good pharmacological strategies for treating long-term TBI complications because we do not fully understand the injury processes that occur afterward. Moreover, a significant percent of patients entering the emergency room with TBI have a blood alcohol level above the legal limit. Alcohol use and intoxication is a widespread issue in our society. Binge drinking is the most common way in which alcohol is consumed, and alarmingly, Americans of all age groups binge drink on a frequent basis. Despite the prevalence of alcohol intoxication …
Comparisons Of Artifact Correction Procedures For Meta-Analysis: An Empirical Examination On Correcting Reliabilities, Lei Zhao
Dissertations
This study reviewed some challenges and issues in artifact correction meta-analysis, particularly around using reliability estimates to correct for measurement error. Two individual correction procedures—the Hunter-Schmidt procedure and the procedure developed by Raju, Burke, Normand, and Langlois (the RBNL procedure)—are addressed in this research. The purpose of this study is to use real-world data to examine the differences between meta-analytic estimations produced by the two artifact correction procedures and those by the traditional bare-bones meta-analysis procedures, under the condition of inter-dependent reliabilities. The impact of this inter-correlation on meta-analysis results needs investigation when artifact indicators, such as reliability of predictor …
Investigating Novel Methods Of Interaction With Pharmaceutically Relevant Enzymes, Cory T. Reidl
Investigating Novel Methods Of Interaction With Pharmaceutically Relevant Enzymes, Cory T. Reidl
Dissertations
Metalloproteins requiring one or more metal ions for normal function make up 30% of all known proteins, and many critical biological pathways contain at least one metallo-enzyme. Di-nuclear metallo-proteins constitute a large class of these proteins yet we currently lack effective methods of inhibiting these enzymes for the development of new medical therapies, particularly for the discovery of new antibiotics. Our work has focused on developing novel functionalities that selectively interact with di-nuclear catalytic centers, and we are targeting three separate di-zinc-metallo-enzymes that are unique to bacteria and play key roles in their growth and development. These enzymes are DapE, …
The Internalization Of The Model Minority Stereotype, Acculturative Stress, And Ethnic Identity On Academic Stress, Academic Performance, And Mental Health Among Asian American College Students, Hanna Yun-Han Chang
Dissertations
Previous studies in Asian American psychology literature on cultural factors of acculturation and ethnic identity have yielded mixed findings in its relation to psychological outcomes. Furthermore, there is a gap in the knowledge base regarding the internalization of the model minority stereotype and its impact on Asian Americans. Due to Asian Americans' tendency to value academic excellence as a result of socialization by cultural values and family upbringings, this study examined the effects acculturative stress, ethnic identity, and the internalization of model minority on academic stress, academic performance, and mental health.
Results of this study indicated that acculturative stress significantly …

Aging Well In 21st Century America: Towards A Theological Ethics Of Aging, Chrisitan Cintron
Dissertations
As Third Agers transition into life after work they are faced with a renewed challenge, living the good life. The normative images emanating from the social and cultural landscape allow Third Agers to either envision and live their new life, or adopt a course set out for them. These new lives require a re-discovery and re-defining of the self, a reinterpretation of one's role in society, and relationship to others. As with other phases of life, individuals need guidance when confronted with images of living well that are contradictory or perhaps antithetical to what they imagined for themselves. Various social …
Mutual Regulation Of Crp And N(Epsilon)-Lysine Acetylation In Escherichia Coli, Robert James Davis
Mutual Regulation Of Crp And N(Epsilon)-Lysine Acetylation In Escherichia Coli, Robert James Davis
Dissertations
Post-translational modifications, such as N(epsilon)-lysine acetylation, are known to alter the behavior of transcriptional regulators in eukaryotes, but very little is known about the consequences of acetylation on transcriptional regulation in bacteria. Here, I provide evidence that a global transcriptional regulator of carbon metabolism, cAMP Receptor Protein (CRP), promotes both enzymatic and non-enzymatic lysine acetylation in E. coli. Non-enzymatic lysine acetylation occurs when cells ferment acetate, such as during growth on high concentrations of glucose. Intriguingly, CRP can be non-enzymatically acetylated on several lysines, including lysine 100 (K100). I provide evidence that neutralization of the K100 positive charge, as would …
Simulation Using A Standardized Patient To Measure Perception And Congruency Of Spiritual Care For A Veteran From Three Perspectives To Inform Nursing Education And Practice, Mary E. Desmond
Dissertations
Spiritual care refers to a purposeful process of helping another find meaning and purpose
in life through a mutual connection. Providing spiritual care is a professional nursing mandate, yet nurses report barriers in education and practice. Veterans want spiritual care to promote quality of life, and to cope with military experiences and chronic conditions. Patients report receiving less than desired spiritual care and nurses report infrequent provision of spiritual care. It is also unclear how congruent patients and nurses are in their perceptions of spiritual care. A spiritual care simulation and performance checklist was developed using a review of the …

Making Use Of Teacher Mentors: Understanding The Impact Of Teacher-Student Relationships On Student Academic Achievement, Sara Haas
Dissertations
The University of Chicago Consortium on Chicago School Research (CCSR) has determined that if a high school student completes freshman year with the necessary course credits to be promoted to tenth grade and has no more than one F for one semester/course in a core content area then they are considered on track to graduate high school within four years and ultimately be college and career ready (Allensworth & Easton, 2005). The CCSR did further research and published a report examining the factors that indicated what a middle grades student would need to be on track as high school freshman …
An Exploration Of Elementary Teachers' Beliefs And Perceptions About Science Inquiry: A Mixed Methods Study, Linda Hamadeh
An Exploration Of Elementary Teachers' Beliefs And Perceptions About Science Inquiry: A Mixed Methods Study, Linda Hamadeh
Dissertations
In order for science-based inquiry instruction to happen on a large scale in elementary classrooms across the country, evidence must be provided that implementing this reform can be realistic and practical, despite the challenges and obstacles teachers may face. This study sought to examine elementary teachers' knowledge and understanding of, attitudes toward, and overall perceptions of inquiry-based science instruction, and how these beliefs influenced their inquiry practice in the classroom. It offered a description and analysis of the approaches elementary science teachers in Islamic schools reported using to promote inquiry within the context of their science classrooms, and addressed the …
Self-Serving Cognitive Distortions, Externalizing Behaviors, And School Exclusion Among Adolescents With Emotional Disturbance, Claudia Hernandez
Self-Serving Cognitive Distortions, Externalizing Behaviors, And School Exclusion Among Adolescents With Emotional Disturbance, Claudia Hernandez
Dissertations
Students of color and students with disabilities, especially those with Emotional Disturbance (ED), are at increased risk for exclusionary discipline and juvenile justice involvement (Skiba, Arredondo & Williams, 2014). Within exclusionary discipline research, students' behaviors and discipline referrals are examined, but students' maladaptive thinking patterns or cognitive distortions remain largely unexplored. Within juvenile justice research, however, the cognitive distortions of incarcerated youth have been widely studied. The overarching hypothesis for the current study was that students' self-serving cognitive distortions would be related to their externalizing behaviors, as measured by office discipline referrals (ODRs), and these ODRs would be related to …
Characterization Of Multi-Albumin Pegylated Complexes Synthesized Using "Click" Chemistry As Drug Delivery Systems, Jonathan Alejandro Hill
Characterization Of Multi-Albumin Pegylated Complexes Synthesized Using "Click" Chemistry As Drug Delivery Systems, Jonathan Alejandro Hill
Dissertations
Due to its ability to transport hydrophobic materials through the bloodstream, human serum albumin has become an intriguing component for drug delivery systems. The most pressing concerns with current albumin-based systems are the risk of pathogenic transfer associated with human-sourced blood proteins, the negative effect on osmotic pressure due to administration of a large dose of albumins, the potential immune response and loss of biological activity due to heavy modification of these albumins, and the need for organic solvents for preparation of these products. Key residues in the two main drug binding sites, DS1 and DS2, are conserved in bovine …
The Blackboard And The Colorline Madeline Morgan And The Alternative Black Curriculum In Chicago Schools 1941-1945, Michael Hines
The Blackboard And The Colorline Madeline Morgan And The Alternative Black Curriculum In Chicago Schools 1941-1945, Michael Hines
Dissertations
On May 28, 1942, Chicago Public Schools adopted a new curriculum with the rather mundane title Supplementary Units for the Course of Study in Social Studies. Although the title was less than provocative, the content was revolutionary, both for Chicago and for the nation. The Supplementary Units marked one of the first times that a major American public school system had adopted African American history as part of its standard, citywide social studies curriculum. The story of the development, adoption, and implementation of this curriculum intersects issues of race, politics, history, and education. At its center are the efforts of …
Disordered Eating Treatment Programs For Adolescents And Emerging Adults: A Meta-Analytic Review Of Treatment Effectiveness And Moderators Of Treatment Success, Alexandra Kirsch
Disordered Eating Treatment Programs For Adolescents And Emerging Adults: A Meta-Analytic Review Of Treatment Effectiveness And Moderators Of Treatment Success, Alexandra Kirsch
Dissertations
This meta-analysis systematically reviewed interventions for disordered eating in the adolescent and young adult population. A systematic search identified 30 interventions that could be compared to controls and 88 specific interventions that could be compared to other specific interventions. An in-depth analysis of the current state of the literature is provided. Results indicated that eating disorder interventions were effective overall when compared to control for both eating disorder and non-eating disorder outcomes, with differential effects across diagnoses, outcome categories, and outcome source, as well as some maintenance of effects at follow-up. Additionally, multiple moderators of treatment effectiveness for eating disorder …
Elevated Hydrostatic Pressure Selectively Enhances Matricellular Gene Expression In Human Trabecular Meshwork Cells, Jonathan Lautz
Elevated Hydrostatic Pressure Selectively Enhances Matricellular Gene Expression In Human Trabecular Meshwork Cells, Jonathan Lautz
Dissertations
Primary open-angle glaucoma (POAG) is a progressive optic neuropathy
characterized by loss of peripheral vision secondarily associated with elevated intraocular pressure (IOP). Transforming growth factor (TGF)-β2 is markedly elevated in the aqueous humor (AH) of patients with POAG. It has been previously shown that TGF-β2 increases IOP, in part, by inducing expression and release of endothelin-1 (ET-1) and connective tissue growth factor (CTGF) within the trabecular meshwork (TM). ET-1 and CTGF may ultimately lead to increases in IOP by enhancing TM cell contractility and extracellular matrix (ECM) deposition. Here we confirm that TGF-β2 enhances mRNA content of ET-1, CTGF, and …
Transport For Early Modern London: London's Transportation Environment And The Experience Of Movement, 1500-1800, Noah Paul Phelps
Transport For Early Modern London: London's Transportation Environment And The Experience Of Movement, 1500-1800, Noah Paul Phelps
Dissertations
This dissertation investigates two closely related topics regarding London's transportation environment. The first was to determine the shape of early modern London's transportation infrastructure and determine who was responsible for its design, construction and maintenance. The second goal was to investigate the experiences of those moving about the city. In some cases, it was possible to find substantive information on London's transport milieu; for example, the number of gates and the size of the wall surrounding the city from Stow's 1598 Survey of London or the rules regarding street cleaning in London's Letter Books. In most cases, however, it was …
Cruzando Fronteras: The Immigration Experiences Of Central American Women, Cecelia Quinn
Cruzando Fronteras: The Immigration Experiences Of Central American Women, Cecelia Quinn
Dissertations
The present study explores the immigration experiences of Central American women. As violence and poverty mounts in the Northern Triangle; Guatemala, El Salvador, and Honduras, immigrants continue to migrate north. Immigrant women risk their lives seeking safety, opportunity, and reunions with loved ones. Central American women's immigration journeys are unique and they face the added dangers of gender-based violence. This exploratory, qualitative study guided by feminist standpoint theory allowed the women to tell their stories in their own language, as they saw fit. Twelve Central American Latinas shared their immigration experiences, responding to semi-structured interviews. Through interpretive phenomenological analysis and …

Forgetting How To Hate: The Evolution Of White Responses To Integration In Chicago, 1946-1987, Chris Ramsey
Dissertations
After the Supreme Court made restrictive covenants illegal in 1948, violence became the default response for numerous white communities across the South Side of Chicago when African Americans moved into €“ or just passed through €“ their neighborhoods. The civil rights movement's high-profile successes in the first half of the 1960s and the media attention Dr. Martin Luther King Jr.'s open housing marches on the Southwest Side of Chicago brought to segregation in the urban North made brute force unacceptable to the public at-large. White ethnic residents on Chicago's Southwest Side realized they could no longer resort to violent means …
