Faith-Based Law Schools: Making Mission Matter, Veryl Victoria Miles
Faith-Based Law Schools: Making Mission Matter, Veryl Victoria Miles
Scholarly Articles
A faith-based law school offers unique values to the legal profession and larger community. However, this faith-based identity requires attention by the dean, faculty, administration, student body, and community. Without attention to a faith-based identity, a law school can quickly lose its religious uniqueness.
This Article makes the case that a faith-based law school needs to consider “the essentials” to making its mission matter. First, the faith-based school must make a mission statement that incorporates its church’s religious values and traditions. Second, the faith-based law school needs to create a mission-based environment. This environment can only be achieved if the …

Publications and Research
As of January 2016, New York joined a select number of states in regulating mold. The New York State Department of Labor has approved mold-related training courses in three levels, ranging from two to four days. These include the mold abatement worker, mold remediation contractor, and mold assessor courses. In this presentation we share the experience obtained to date from delivering the above referenced courses and challenges as an approved training provider. We also evaluate the relative effectiveness of the mode of delivery as it relates to different audiences.

A Less Corrupt Term," Supreme Court Round-Up For Ot 2016, Kevin C. Walsh, Marc O. Degirolami
Scholarly Articles
In these unusually turbulent times for the presidency and Congress, the Supreme Court’s latest term stands out for its lack of drama. There were no 5–4 end-of-the-term cases that mesmerized the nation. There were no blockbuster decisions.
Even so, the Court was hardly immune to the steady transformation of our governing institutions into reality TV shows. Over the weekend leading into the final day of the term, speculation ignited from who-knows-where about the possible departure of its main character, Justice Anthony Kennedy. To us, the chatter seemed forced—as if the viewing public needed something to fill the vacuum left by …
Originalist Law Reform, Judicial Departmentalism, And Justice Scalia, Kevin C. Walsh
Originalist Law Reform, Judicial Departmentalism, And Justice Scalia, Kevin C. Walsh
Scholarly Articles
Drawing on examples from Justice Antonin Scalia's jurisprudence, this Essay uses the perspective of judicial departmentalism to examine the nature and limits of two partially successful originalist law reforms in recent years. It then shifts to an examination of how a faulty conception of judicial supremacy drove a few nonoriginalist changes in the law that Scalia properly dissented from. Despite the mistaken judicial supremacy motivating these decisions, a closer look reveals them to be backhanded tributes to judicial departmentalism because of the way that the Court had to change jurisdictional and remedial doctrines to accomplish its substantive-law alterations. The Essay …
Religious Accommodation, Religious Tradition, And Political Polarization, Marc O. Degirolami
Religious Accommodation, Religious Tradition, And Political Polarization, Marc O. Degirolami
Scholarly Articles
A religious accommodation is an exemption from compliance with the law for some but not for others. One might therefore suppose that before granting an accommodation, courts would inquire about whether a legal interference with religious belief or practice is truly significant, if only to evaluate whether the risk of political polarization that attends accommodation is worth hazarding. But that is not the case: any assessment of the significance of a religious belief or practice within a claimant's belief system is strictly forbidden.
Two arguments are pressed in support of this view: (1) courts have institutional reasons for acquiescing on …

My task is to say what remains of property rights. My answer is: quite a lot. We have reason to be optimistic about the constitutional status of private property. To explain why, I will relate a short story about property jurisprudence in Anglo-American law. It is a story not merely about property, but also about ordered liberty. Thus, this story is not just for property scholars; it holds valuable lessons for scholars and jurists who are interested in other aspects of American constitutionalism as well. Accounts of property rights often begin with the familiar treatise of John Locke. My account …

Consequences Of Job Stress For The Psychological Well-Being Of Teachers, Irvin Sam Schonfeld, Renzo Bianchi, Peter Luehring-Jones
Consequences Of Job Stress For The Psychological Well-Being Of Teachers, Irvin Sam Schonfeld, Renzo Bianchi, Peter Luehring-Jones
Publications and Research
This chapter examines research on the relationship between job stressors and mental health (depressive symptoms, burnout, and mental disorders such as depression) in teachers. Teachers are exposed daily to job stressors (e.g., student disruptiveness) that have been linked to adverse mental health effects. Epidemiologic research indicates that when compared to members of other groups, teachers experience higher rates of mental disorder, although some studies question that conclusion. Large-scale studies indicate when compared to members of other occupational groups, teachers are at higher risk for exposure to workplace violence, with its adverse mental health consequences. Longitudinal research has linked teaching-related stressors …

To convey the magnitude and rapidity of current climate change and the severity of predictions for the next century, I present essential climate science information using four key sets of data and contextualize that information with personal anecdotes. I then consider the reasons for the large gap between the scientific consensus about anthropogenic climate change and public perceptions of that consensus. With several known challenges to climate change education in mind, I offer four recommendations for teachers that map relevant social psychology to pedagogy: (1) establish a learning community that works to disrupt in-group favoritism and reduce attribution bias; (2) …
Environmental And Climate Justice Along The Brahmaputra River In Northeast India, Costanza Rampini
Environmental And Climate Justice Along The Brahmaputra River In Northeast India, Costanza Rampini
Faculty Publications, Environmental Studies
The glaciers of the Himalayas are the source of all of Asia’s major rivers and are crucial to Asia’s water supply, economies, and livelihoods. The Himalayan region is uniquely vulnerable to the impacts of anthropogenic climate change, while also becoming one of the most dammed regions in the world. This case study explores the unequal distribution of the impacts of climate change and dam building along the Brahmaputra River in Northeast India. It examines how the combined impacts of these two processes negatively affect local communities and explores environmental and climate justice issues. In discussing climate change impacts and hydropower …

In this article we study if investor's sentiment measured by an intensity of Google searches may be used to predict future changes of the Effective Federal Funds rate. We find that online searches for “fed funds rate”, “fed interest rate”, “fed reserve”, “fed reserve rate” and “federal interest rate” are associated with next week decrease of the Effective Federal Funds Rate. Google searches for “fed rate hike” and “fed raise rates” are associated with next week increase of the Effective Federal Funds Rate even after we control for a number of macroeconomic indicators. We also find that intensity of Google …

There is no shortage of tax rules that address energy and natural resources in some manner. There are taxes on most types of fuel, tax credits for energy saving devices, and various tax incentives to encourage specified activities such as use of LED lighting or energy efficient heaters. In addition, numerous proposals are offered annually by lawmakers at the federal, state and local levels that also address conservation, energy and innovation in conservation and energy-efficiencies.How do we know if existing rules and proposals are appropriate for a tax system? Principles of good tax policy can be applied to them to …

The main advantage of software defined networking (SDN) is that it allows intelligent control and management of networking though programmability in real time. It enables efficient utilization of network resources through traffic engineering, and offers potential attack defense methods when abnormalities arise. However, previous studies have only identified individual solutions for respective problems, instead of finding a more global solution in real time that is capable of addressing multiple situations in network status. To cover diverse network conditions, this paper presents a comprehensive reactive system for simultaneously monitoring failures, anomalies, and attacks for high availability and reliability. We design three …

Within The House Of Bondage: Constructing And Negotiating The Plantation Landscape In The British Atlantic World, 1670-1820, Erin M. Holmes
Theses and Dissertations
My dissertation is a comparative study of the plantation landscape in South Carolina, Barbados, and Virginia between 1670 and 1820 that explores how the built environment (landscape, architecture, and material culture) shaped interactions between enslaved people and free, white workers and slaveholders. Instead of simply the home of the planter class, the plantation house was more than a living space or a work space; it was a workshop for the creation of a distinctly American culture.
The vastly different houses built in each colony reflect the transformation of the built environment in the New World that began during the second …

Broke But Not Without Hope: Exploring Exits From Housing First And Returns To Homelessness, Jennie Ann Cole
Theses and Dissertations
“…he succeeded in giving the impression of being broke but not without hope.”
Nels Anderson, The Hobo, 1923
Introduction: This research offers a thick and rich, multidimensional and situational look, into a Housing First program in Charlotte, North Carolina. This dissertation focuses on individuals who have experienced chronic homelessness who exit Permanent Supportive Housing (PSH) programs that employ a Housing First (HF) model and return to homelessness. The ultimate goal of my research was to address the gap in knowledge service providers have in housing retention for the chronically homeless and to break the cycle of misunderstanding around why people …
Smartphone Use And Mindfulness: Empirical Tests Of A Hypothesized Connection, Darren Todd Woodlief
Smartphone Use And Mindfulness: Empirical Tests Of A Hypothesized Connection, Darren Todd Woodlief
Theses and Dissertations
The current study is the first test of a newly developed conceptual model of the effect of smartphone use on mindfulness. Previous research has shown the capacity for mindfulness is strongly associated with increased psychological well-being (e.g. higher self-esteem and lower perceived stress, anxiety, and psychological distress). We argue that smartphones can be used in an automatic and mindless or experientially avoidant way, and that this use can lead to a decreased capacity for mindfulness, with adolescents being most vulnerable to this potential impact. Components of mindfulness, such as the capacity for sustained attention and the areas of the brain …

Song Of The Scapegoat: How Silence Augments Kenneth Burke’S Notion Of The Scapegoat In Political Rhetoric, Mary Elizabeth Smith
Theses and Dissertations
President Donald Trump ascended to the US’s highest hall of power through rhetoric that scapegoated marginalized groups, such as Muslims, Hispanics, immigrants, foreigners, and others. This work considers the executive order President Donald Trump released January 27, 2017, and its revision released March 06, 2017, for how it exemplifies Kenneth Burke’s notion of the scapegoat, specifically as outlined in A Grammar of Motives and A Rhetoric of Motives. These executive orders have come to be known as the “Muslim Ban” due to the way they implicate Muslims in charges of terrorism, harm, and danger and affect the lives and movement …

On Slowly Rotating Supercompact Schwarzschild Stars, Nelson Camilo Posada-Aguirre
Theses and Dissertations
In this Ph.D thesis, I will present results concerning to my doctoral research project submitted to the Department of Physics and Astronomy at the University of South Carolina. The thesis belongs to the area of Theoretical Physics, particularly, in the framework of Einstein’s Theory of General Relativity.
The project is the study of integral and surface properties of slowly rotating homogeneous masses in the gravastar limit R ! Rs, where Rs is the Schwarzschild radius. For this purpose we followed the perturbative method proposed by Hartle in 1967. In this model, the relativistic equations of structure for a slowly rotating …
Molecular Exploration Of Bioavailable Dissolved Organic Matter Across Aquatic Ecosystems, Yuan Shen
Molecular Exploration Of Bioavailable Dissolved Organic Matter Across Aquatic Ecosystems, Yuan Shen
Theses and Dissertations
Dissolved organic matter (DOM) in aquatic ecosystems is a large reservoir of reduced carbon that is mostly resistant to degradation. A small fraction of DOM cycles relatively quickly and is biologically utilized on timescales of days to months. This bioavailable DOM (BDOM) supports aquatic food webs, drives major elemental cycles, and is coupled to atmospheric CO2. Despite wide-ranging importance, bioavailability of DOM and its linkages to ecosystem properties (e.g., primary production, nutrients) are poorly characterized, particularly at the ecosystem level. Bioassay experiments are commonly used to determine BDOM, but this approach alters conditions and has limited spatial and temporal coverage. …
Glacial To Holocene Changes In Eastern Equatorial Pacific Deep-Water Chemistry And Circulation, Natalie E. Umling
Glacial To Holocene Changes In Eastern Equatorial Pacific Deep-Water Chemistry And Circulation, Natalie E. Umling
Theses and Dissertations
It has been hypothesized that the oceans store CO2 during glacial periods and then release it to the atmosphere, causing the onset of warm interglacial periods (Sigman and Boyle, 2000). Documenting this past transfer of CO2 between the oceans and atmosphere is of utmost importance for better understanding the impact that anthropogenic CO2 has and will have on Earth’s climate. The last deglaciation is a good analogue to modern increases in CO2 and temperature and is recent enough to be studied using radiocarbon. This period provides important insights into the nature of climate changes during the transition from glacial to …
High School Science Teachers’ Perceptions Of The Effects Of One-To-One Computing Devices On Student Engagement, Herbert S. Bocchino Iii
High School Science Teachers’ Perceptions Of The Effects Of One-To-One Computing Devices On Student Engagement, Herbert S. Bocchino Iii
Theses and Dissertations
The identified problem of practice for the present action research study centers on ways in which teacher-participants in a working class poor, rural, southern high school can use the iPads in daily science classroom activities to more effectively to engage these students in their classrooms and make the curriculum meaningful. Data in the form of classroom observations, semi-structured interviews, and teacher in-service seminars was collected over a six week period. The results of the present action research study indicate a need for more professional development for incorporating iPads into science coursework for these teacher-participants at RHS despite their claim that …
Analysis And Design Of A Highly Compact Ellipse-Shaped Ultra-Wideband Bandpass Filter (Uwb-Bpf) With A Notched Band, Xuetan Liu
Theses and Dissertations
Since the Federal Communications Commission’s endorsement of the frequency band of 3.1 – 10.6 GHz in 2002 to be unlicensed for wireless communication applications, various ultra-wideband bandpass filters (UWB-BPFs) have been proposed and designed. Different UWB-BPF configurations were presented in the past years to meet the very strict UWB-BPF specifications in terms of ultra-band requirement, low return loss, high rejection in notched bands. However, most of the previous works are limited by large dimension size, complex geometry, and high production cost.
The major objective of this work is to design a highly compact, simple geometry, and low-cost UWB-BPF, which passes …

Two Essays On Social Sharing Effects On Consumer Memories, Li Huang
Two Essays On Social Sharing Effects On Consumer Memories, Li Huang
Theses and Dissertations
Social sharing is universal in everyday life. Every day consumers share news, opinions, and personal experiences using different media, including face-to-face communications, cellphones, texting, email, and other social media platforms (e.g. Facebook, Twitter). Word-of-Mouth, a common type of social sharing has been found to be fundamental to marketing and has been shown to significantly impact firms’ sales and revenues. However little is known about the effects of WOM on consumer memories. Since consumer memory is an important variable in marketing due to its significant impact on consumer judgments and decisions, my dissertation addresses this gap and examines the effects of …
