During the late 1700s, the Cumberland Gap in the Appalachian Mountain Chain became the main corridor that precipitated settlement into Kentucky. Along this frontier line, settlers had to contend with various Native American tribes, and settlement on the frontier from the beginning of colonization irrevocably altered the Native American way of life. The September 11, 2001 (9/11) attacks on the United States caused a series of military events, including the planning and deployment of troops to Afghanistan. In less than a month after that infamous September day, military Special Forces (SF) members and officers from the Central Intelligence Agency (CIA) were operating in Afghanistan. The SF and CIA members were faced with not only the difficult geographical terrain but were hampered by inadequate time to prepare for the complicated human terrain of the Afghan culture.

The article analyzes the constitutional basis of command responsibility as well as how this responsibility has been shaped by the Judicial Branch and Congress. It also briefly discusses the application of international law and human rights norms in the context of two models of future operations and the corresponding potential for command liability, beginning with the Commander in Chief. This article focuses on two principle areas of consideration. The first involves the use of non-military personnel who assist or take part in quasi-military roles. The Title IX religious exemption demonstrates how statutory religious exemptions can help further social change by neutralizing potential conflict with religious dissenters. Part of the reason for its success is that it is narrowly constructed and automatically applies to qualifying institutions. However, the regulations contradict the statutory text by potentially giving the Department of Education discretion to grant or deny exemptions. Were the Department to fully exercise this power, its actions would conflict with both the language of the statute and the Constitution. Containing Terrorism: A Dynamic Model, Giti Zahedzadeh

The strategic interplay between counterterror measures and terror activity is complex. Herein, we propose a dynamic model to depict this interaction. The model generates stylized prognoses: (i) under conditions of inefficient counterterror measures, terror groups enjoy longer period of activity but only if recruitment into terror groups remains low; high recruitment shortens the period of terror activity (ii) highly efficient counterterror measures effectively contain terror activity, but only if recruitment remains low. Thus, highly efficient counterterror measures can effectively contain terrorism if recruitment remains restrained. The efficacy of United States (U.S.) military forces is predicated on a condition of jointness, which enables members of different military services to overcome their cultural and experiential prejudices and operate interdependently. Joint Professional Military Education Phase (JPME) II, offered through the Joint Forces Staff College (JFSC), is the principal mechanism within the Department of Defense to reduce the inter-service prejudices held by military officers and to cultivate the optimal joint perspectives and attitudes associated with jointness. The U.S. Department of Defense (DoD) faces persistent fundamental change in its strategic and operating environments. This report suggests this reality is the product of the United States entering or being in the midst of a new, more competitive, post-U.S. primacy environment. Post-primacy conditions promise far-reaching impacts on U.S. national security and defense strategy. Consequently, there is an urgent requirement for DoD to examine and adapt how it develops strategy and describes, identifies, assesses, and communicates corporate-level risk. ISIS’s cultivation of social media has reinforced states’ interest in using automated surveillance. However, automated surveillance using artificial intelligence (“machine learning”) techniques has also sharpened privacy concerns that have been acute since Edward Snowden’s disclosures. This Article examines machine-based surveillance by the NSA and other intelligence agencies through the prism of international human rights.

Two camps have clashed on the human rights implications of machine surveillance abroad. The state-centric camp argues that human rights agreements like the International Covenant on Civil and Political Rights (ICCPR) do not apply extraterritorially. In this paper, we examine a system for encrypting data before storing in the Cloud. Adopting this system gives excellent security to stored data and complete control for accessing data by the client at different locations. The motivation for developing this personal encryption came about because of poor Cloud security and doubts over the safety of public encryption algorithms which might contain backdoors. However, side-channel attacks and other unwanted third-party interventions in Cloud security, probably contribute more to the poor security record history. Years after Typhoon Yolanda (international code name: Haiyan) struck Leyte island in the Eastern Visayas region in 2013, I conduct a feminist ethnographic research and inquire into the ways Waray women survivors make meaning of this super typhoon and how they mobilize disaster memory and symbolisms in their survival testimonies to engage in social repair. In showing how the women survivors (a) personify the storm; (b) explain order and safety in cycles and seasons; and (c) explain syncretic theologies pertaining to ideas of justice, I argue that they enact an ancient ferocity as a form of agency for survival.Keywords: anthropology …

Filipino writers of historical fiction have employed magical realism to incorporate people’s experiences into discussions of the nation’s violent history and present a possibility of revolution and hope, particularly with the fall of Ferdinand Marcos’s regime. However, Merlinda Bobis uses magical realism to represent the struggles of villagers who were caught between government forces and communist insurgents during the Total War in the late 1980s, thus focusing on preserving personal histories and memories. Students in four marketing classes participated in a pilot program where they used Yellowdig in the classroom. Yellowdig is a private network for collaboration targeted towards educational institutions to increase student engagement. Yellowdig seeks to engage students using a broad array of resources including videos, news articles, blogs and more. It offers a Facebook-like experience (a platform the majority of students are very familiar with) for ease of use. The social, economic, and political impacts – although less well known – would also be crippling and would reverberate throughout the world. This narrative study documents the experiences of seven Latina community educators through focus groups, interviews, and artifact data. Given the stigma of mental health (Bayer, 2005), a lack of culturally centered emotional curriculums (Boler, 1997; Boler & Zembylas, 2003) which are removed from structural oppression (Collins, 2002,1989; Crenshaw, 1991, 1993; hooks, 2014), educators, parents, and communities are in need of mental health promotion tools. According to the American Psychiatric Association (APA, 2015), approximately 70 million Americans annually are diagnosed with mental health issues that disable daily functioning.
