The application of international law and legal principles in cyberspace is a topic that has caused confusion, doubt, and interminable discussions between lawyers since the earliest days of the internationalization of the Internet. The still unresolved debate over whether cyberspace constitutes a fundamentally new domain that requires fundamentally new laws to govern it reveals basic ideological divides. On the one hand, the Euro-Atlantic community led by the United States believes, in broad terms, that activities in cyberspace require no new legislation, and existing legal obligations are sufficient. On the other, a large number of other states led by Russia and …

This chapter explores recent research by critical theorists concerning theories of (under)development. Drawing from the research of Thomas McCarthy, Axel Honneth, Jurgen Habermas, Amy Allen, Nancy Fraser, and others, the author explores some of the divergent responses critical theorists have given toward the theory and practice of global developmental assistance. Some theorists defending a strong modernist approach to development (e.g., McCarthy, Habermas and Honneth) appear to endorse a logic of development that works within a domesticated model of capitalist markets and lending practices; others (Allen and Fraser) reject this approach. The chapter raises questions about how development that fits within …

The most widely accepted theories as to how primates select medicinal organisms are based on smelling-tasting bitter, and most of the times toxic, plants (Etkin & Ross, 1982; Johns, 1990). In primates, however, the senses of smell and taste are not as dominant as vision, an evolutionary trait which has been proven to be one of the most favored. I present a perspective claiming that aposematism, the conspicuous coloration displayed by toxic organisms, may play an important role in human recognition of medicinal organisms. This article explores the possible implications and consequences arising from the use of an artificial intelligence construct as a weapon of mass destruction. The digital age has ushered in many technological advances, as well as certain dangers. Chief among these pitfalls is the lack of reliable security found in critical information technology systems. The idea of punishing aggressive war is routinely presented as having been first conceived of in the wake of the First World War. This conventional narrative is incorrect; the intellectual seed for the project had begun to take root long before, in the reactions to the interstate conflicts of the nineteenth century. This article explores one of the most significant moments from aggression’s unappreciated ‘pre-history’; Chancellor Bismarck’s pursuit of a trial before an international criminal court of the Franco-Prussian War’s (1870-1) French ‘intellectual originators and instigators.’ Although the proposal ultimately failed to attract the political and public support necessary for …

As neoliberal policies embed themselves in all aspects of public (if not private) life, freedom of expression and academic freedom are being degraded and denigrated in the university, in the popular press, in the law, and in public life. The influence of intellectual property rights and proprietary claims surrounding patents are muzzling freedom of thought by corporate interests. Universities and the freedom of academic researchers to explore their fields have become casualties on this neoliberal battlefield. This Article argues that laws created to curtail the spread of deadly contagious diseases need to be drafted and implemented in ways that maximize acceptance of an affected communities’ cultural and religious beliefs. When laws are put in place that are inconsistent with community mores, the overall goal of stopping an epidemic is threatened. Communities often distrust government and other relief organizations who mandate rules and regulations that impinge their religious and cultural beliefs; thus, these regulations geared at helping communities can paradoxically undermine the goal of preventing the spread of infectious disease.

Ammonium urate nephrolithiasis frequently develops in common bottlenose dolphins (Tursiops truncatus) managed under human care but is rare in free-ranging common bottlenose dolphins. In other species, the dietary cation–anion difference (DCAD) can affect ammonium urate urolith formation by increasing proton excretion as ammonium ions. Therefore, differences in diet between the 2 dolphin populations could affect urolith formation, but the DCAD of most species consumed by free-ranging and managed dolphins is unknown. To compare the nutrient composition of diets consumed by free-ranging and managed bottlenose dolphins, samples (n = 5) of the 8 species of fish commonly consumed …

The measure of central tendency is the most commonly used tool in statistical data analysis. The ability to determine an ``average'' provides a way to locate data centrality. Central tendency is usually determined by one of three methods. One can calculate the mean, median or midrange of a sample set. However, does the best method to determine the central point of a distribution vary with the types of distributions involved? In this paper we attempt to determine which methods are best used for several different distributions. Specifically we will examine the Normal, Uniform, and Cauchy distributions.

The cross-cultural ethnographic literature has traditionally used the label male “homosexuality” to describe sexual relationships between biological males without considering whether or not the concept encompasses primary sexual attraction to adult males. Although male androphilia seems to be found in all national populations, its universal existence in tribal populations has been questioned. Our goal is to review previous cross-cultural classifications and surveys of male same sex behavior to present a system that does justice to its varied expressions, especially as it is informed by contemporary sexuality research. Contemporary anti-terrorism legislation has raised concerns about the global evolution of law and crime control. National and global anti-terrorism frameworks include broad definitions of terrorist crimes and exceptional measures, which risk violating the rule of law and criminal justice. While these frameworks have been broadened since 9/11, the experience of the Arab world shows that wide sweeping anti-terrorism frameworks existed well before this time. This dissertation investigates the origin of current anti-terrorism laws and measures, arguing that colonialism and neo-colonialism contributed to the shaping of counter-terrorism law and policy in two case studies: Egypt and Tunisia.
