National Labor Relations Board V. Murphy Oil Usa, Inc.: A Test Of Might, Elizabeth Storey
National Labor Relations Board V. Murphy Oil Usa, Inc.: A Test Of Might, Elizabeth Storey
Duke Journal of Constitutional Law & Public Policy Sidebar
National Labor Relations Board v. Murphy Oil USA pits two co-equal federal statutes head-to-head. The Federal Arbitration Act mandates that all arbitration clauses be enforced. The National Labor Relations Act grants employees the right to act collectively to bring claims against employers. The Supreme Court must decide whether arbitration clauses in employment contracts, which require employees to arbitrate work-related disputes on an individual basis, contravene the interests of the NLRA. This commentary argues that the Supreme Court should recognize how these arbitration clauses undermine and subvert the protections of the NLRA by disallowing employees to act collectively. By invoking the …
Alcohol Priming And Attribution Of Blame In An Acquaintance Rape Vignette, Elena V. Stepanova, Amy L. Brown
Alcohol Priming And Attribution Of Blame In An Acquaintance Rape Vignette, Elena V. Stepanova, Amy L. Brown
Faculty Publications
Research on nonpharmacological effects of alcohol shows that exposure to alcohol-related cues (i.e., alcohol priming) can increase behaviors associated with actual alcohol consumption. Attributions of responsibility to female victims in sexual assault scenarios are affected by whether or not alcohol was consumed by a victim and/or perpetrator. Victims often receive higher levels of blame if they consume alcohol prior to the assault. This work extends the research on nonpharmacological effects of alcohol into a novel domain of blame attribution toward rape victims. In two studies, participants in lab settings (Study 1; N = 184) and online (Study 2; N = …

The Role Of Catalytic Residue PKA On The Hydrolysis/Transglycosylation Partition In Family 3 Β-Glucosidases, Inacrist Geronimo, Christina M. Payne, Mats Sandgren
Chemical and Materials Engineering Faculty Publications
β-Glucosidases (βgls) primarily catalyze the hydrolysis of the terminal glycosidic bond at the non-reducing end of β-glucosides, although glycosidic bond synthesis (called transglycosylation) can also occur in the presence of another acceptor. In the final reaction step, the glucose product or another substrate competes with water for transfer to the glycosyl-enzyme intermediate. The factors governing the balance between the two pathways are not fully known; however, the involvement of ionizable residues in binding and catalysis suggests that their pKa may play a role. Through constant pH molecular dynamics simulations of a glycoside hydrolase Family 3 (GH3) βgl, we …

Fisheries Research Articles
Deepwater tropical fisheries provide an important source of income and protein to Pacific and Indian Ocean coastal communities who are highly dependent on fish for food security. The development of quantitative assessments and management strategies for these deepwater fisheries has been hindered by insufficient biological and fisheries data. We examine the age-specific demography of the pygmy ruby snapper Etelis carbunculus, an important target species in tropical deepwater fisheries, across 90° of longitude and 20° of latitude in the Pacific and Indian Oceans. Our results show that growth of E. carbunculus varies significantly between oceans and sexes and across latitudes …
Daphnia: A Possible Way To Combat A Deadly Amphibian Pathogen, Taylor Thomas
Daphnia: A Possible Way To Combat A Deadly Amphibian Pathogen, Taylor Thomas
Undergraduate Honors Theses
Globally there is a biodiversity crisis, with many groups of species threatened with extinction due to changes in the environment and human impacts. Amphibians are one such group and according to the IUCN, over 30% of amphibians are threatened by extinction. There are many factors have that can explain the decline of amphibians including pollution, habitat loss, climate change and disease. One factor is chytridiomycosis, an emerging infectious disease caused by the chytrid Batrachochytrium dendrobatidis. The chytrid enters the keratinized skin of the amphibian and asexually reproduces, where it disrupts host functions, often leading to host death.

Effect Of Aggregate Mineralogy And Concrete Microstructure On Thermal Expansion And Strength Properties Of Concrete, Jinwoo An, S. Sonny Kim, Boo Hyun Nam, Stephan A. Durham
Civil Engineering Faculty Publications
Aggregate type and mineralogy are critical factors that influence the engineering properties of concrete. Temperature variations result in internal volume changes could potentially cause a network of micro-cracks leading to a reduction in the concrete's compressive strength. The study specifically studied the effect of the type and mineralogy of fine and coarse aggregates in the normal strength concrete properties. As performance measures, the coefficient of thermal expansion (CTE) and compressive strength were tested with concrete specimens containing different types of fine aggregates (manufactured and natural sands) and coarse aggregates (dolomite and granite). Petrographic examinations were then performed to determine the …

Biodegradation Of Nr Latex-Based Materials Via A Carbon Dioxide Evolution Method, Shabinah F. M. S., Hashim M. Y. A.
ASEAN Journal on Science and Technology for Development
NR as a natural polymer has biodegradable characteristics and their existence was examined using CO2 evolution methods. The CO2 molecule produced by micro-organism metabolisms in the degradation system was quantified using a conventional acidimetric method. An aerobic system was determined as most suitable condition to be examined under this method. The presence of O2 in the system would help micro-organisms to destabilize the natural polymer. The material of LATZ, HA film and NR gloves showed significant weight loss and were able to produce CO2 evolution curves after 45 days in the biodegradation system compared to synthetic polyisoprene films. Gel permeation …

Maternal Depressive Symptoms And Child Behavior Among Mexican Women And Their Children., Emily P Flynn, Esther O Chung, Emily J Ozer, Lia C H Fernald
Articles, Abstracts, and Reports
Over 50% of mothers in rural Mexico have high depressive symptoms, and their children's health and development are likely to be negatively affected. A critical question is whether children vary in their vulnerability to the effects of high maternal depressive symptoms according to their indigenous ethnicity, maternal education, or household wealth. Our sample included 4442 mothers and 5503 children from an evaluation of Mexico's social welfare program. Maternal depressive symptoms were assessed using the Center for Epidemiologic Studies Depression (CES-D) Scale, and child behavior was measured using an adapted version of the Behavior Problems Index (BPI). Multiple linear regression models …

On 2017 June 8 at 02:01:16.49 UTC, a gravitational-wave (GW) signal from the merger of two stellar-mass black holes was observed by the two Advanced Laser Interferometer Gravitational-Wave Observatory detectors with a network signal-to-noise ratio of 13. This system is the lightest black hole binary so far observed, with component masses of 12 +7 -2 M⨀ and 7 +2 -2 M⨀ (90% credible intervals). These lie in the range of measured black hole masses in low-mass X-ray binaries, thus allowing us to compare black holes detected through GWs with electromagnetic observations. The source’s luminosity distance is 340 +140 -140 Mpc, …

A Right To Record: An Analysis Of The Legal Issues Surrounding Cell Phone Videos Of Police Violence, Katherine E. Milburn
A Right To Record: An Analysis Of The Legal Issues Surrounding Cell Phone Videos Of Police Violence, Katherine E. Milburn
Theses
Smartphones have become ubiquitous in modern society, increasing the likelihood of being caught on camera. On July 17th, 2014, a cell phone video of Staten Island police officers wrongfully killing Eric Garner reignited a national controversy on the nature of police violence, and set off a wave of citizen-surveillance through cell phones. By reviewing prior 1st and 4th Amendment court cases, I argue that citizens do indeed have a right to record on-duty police officers, and police do not have the right to conduct a warrantless search or seizure of a phone. Although a case involving citizen-surveillance of law enforcement …

Inferences About The Distribution, Merger Rate, And Evolutionary Processes Of Compact Binaries From Gravitational Wave Observations, Daniel Wysocki
Theses
We are living through the dawn of the era of gravitational wave astronomy. Our first glances through this new window upon the sky has revealed a new population of objects. Since it first began observing in late 2015, the advanced Laser Interferometer Gravitational-Wave Observatory (LIGO) has detected gravitational waves three times, along with an additional strong candidate -- and there shall be orders of magnitude more in the years to come. In all four cases, the waveform's signature is consistent with general relativity's predictions for the merging of two black holes. Through parameter estimation studies, estimates on features such as …

Neighborhood Cohesion, Neighborhood Disorder, And Cardiometabolic Risk, Jennifer N. Robinette, Susan T. Charles, Tara Gruenewald
Psychology Faculty Articles and Research
Perceptions of neighborhood disorder (trash, vandalism) and cohesion (neighbors trust one another) are related to residents’ health. Affective and behavioral factors have been identified, but often in studies using geographically select samples. We use a nationally representative sample (n = 9032) of United States older adults from the Health and Retirement Study to examine cardiometabolic risk in relation to perceptions of neighborhood cohesion and disorder. Lower cohesion is significantly related to greater cardiometabolic risk in 2006/2008 and predicts greater risk four years later (2010/2012). The longitudinal relation is partially accounted for by anxiety and physical activity.

Toughening Of Bisphenol-A Diglycidyl Ether-Based Epoxy By Modification With Hydroxyl-Terminated Liquid Natural Rubber, Pham H. L., Do B. T., Pham T. S., Le D. G.
ASEAN Journal on Science and Technology for Development
Hydroxyl-terminated liquid natural rubbers (HTNRs), prepared by the Photo-Fenton reaction, were used to modify bisphenol-A diglycidyl ether-based epoxy (DGEBA). A chemical link between HTNRs and the epoxy resin was promoted employing toluene diisocyanate. The reactions between elastomers and epoxy resin were followed by FTIR. The mechanical properties of the composites were evaluated and the microstructure was investigated using scanning electronic microscopy. The results showed that the impact resistance of HTNR-modified DGEBA was superior to that of the pure epoxy resin. For the composites with HTNR, the impact resistance increased with elastomer concentration up to 2.5 parts per hundred parts of …

Reaction To Safety Equipment Technology In The Workplace And Implications: A Study Of The Firefighter’S Hood, Brian W. Ward
Reaction To Safety Equipment Technology In The Workplace And Implications: A Study Of The Firefighter’S Hood, Brian W. Ward
The Qualitative Report
In the 1990s the firefighter’s hood became a standard article of safety equipment worn by municipal firefighters, eliciting a negative reaction among many of these firefighters. I used data from interviews with 42 firefighters to explain why this reaction occurred. Data analysis revealed that negative reactions ultimately stemmed from the hood’s disruption of autonomy, repudiation of the complex mental and physical skill needed to perform tasks required of firefighters, and hindrance in negotiating the life-threatening environment created by a fire. These findings indicate that when introducing new safety equipment technology to emergency response workers, their reaction to this equipment, and …
“It Is Non-Summit” And “It Is Abnormal” Unpacking Whiteness: Critiquing Racialized And Gendered Representations In Non-Summit (Bijeongsanghoedam)., Seonah Kim
Communication ETDs
In this thesis, I focus on a Korean entertainment show Non-Summit as a media text through which to investigate racialized and gendered representations of transnational identities in Korean media. Specifically, I examine discursive strategies through which foreign male characters are racialized and gendered in order to interrogate the hegemonic masculinity of White, Western, and heterosexual identities. On the basis of a critical textual analysis of Non-Summit, I discuss Non-Summit reproduces and distributes representations of White, Western, and heterosexual masculinity as dominant foreign identities. Furthermore, I examine the ideological implications of such discourse on the hegemonic foreign identities given the …

Syria And Colombia: A Study Of Intervention, Nicole E. Gomez
Open Access Theses
Civil war has persisted as a relevant topic of debate concerning U.S. foreign policy. On the international stage, getting involved in another nation’s civil war has become highly contentious. Following intervention in Vietnam, Korea, Somalia, and later in Libya, many argue towards a more isolationist U.S. stance. One of the mostly highly debated cases of civil war today is the case of Syria. While many are pushing for the U.S. to do more, many are sending a warning to stay away. Much closer to home, Colombia sought to control a drug-fueled civil war that erupted to a level that the …

Policy-critical, micro-level statistical data are often unavailable at the desired level of disaggregation. We present a Bayesian methodology for “downscaling” aggregated count data to the micro level, using an outside statistical sample. Our procedure combines numerical simulation with exact calculation of combinatorial probabilities. We motivate our approach with an application estimating the number of farms in a region, using count totals at higher levels of aggregation. In a simulation analysis over varying population sizes, we demonstrate both robustness to sampling variability and outperformance relative to maximum likelihood. Spatial considerations, implementation of “informative” priors, non-spatial classification problems, and best practices are …
