Does Government Contracting Have A Remedies Problem? A Response To Eric M. Singer, Competitive Public Contracts, Steven W. Feldman

In his provocative article, Competitive Public Contracts, Eric M. Singer claims that deficient contractor performance is inherent in government contracting. Singer asserts that, “fundamentally,” public purchasing has a “contract-remedies problem”—the absence of both any “credible threat” and any “effective contract remedy to deter or correct [contractor] misbehavior.” Unlike private buyers, who have plausible threats to motivate contractors to perform properly, governments are said to “often” labor under intrinsic and extrinsic limitations that undermine remedial alternatives. Consequently, Singer argues that governments (especially state and local agencies) have no “effective contract remedy” to induce improved contractor performance. Background

Malignant tumors are typically caused by a conglomeration of genomic aberrations—including point mutations, small insertions, small deletions, and large copy-number variations. In some cases, specific chemotherapies and targeted drug treatments are effective against tumors that harbor certain genomic aberrations. However, predictive aberrations (biomarkers) have not been identified for many tumor types and treatments. One way to address this problem is to examine the downstream, transcriptional effects of genomic aberrations and to identify characteristic patterns. Even though two tumors harbor different genomic aberrations, the transcriptional effects of those aberrations may be similar. These patterns could be used to inform treatment …

Pathological high-frequency oscillations are a novel marker used to improve the delineation of epileptogenic tissue and, hence, the outcome of epilepsy surgery. Their practical clinical utilization is curtailed by the inability to discriminate them from physiological oscillations due to frequency overlap. Although it is well documented that pathological HFOs are suppressed by antiepileptic drugs (AEDs), the effect of AEDs on normal HFOs is not well known. In this experimental study, we have explored whether physiological HFOs (sharp-wave ripples) of hippocampal origin respond to AED treatment. In this paper we propose that institutions like the Schools of the Christian Brothers play an important role as a counterweight to free market inequalities. First we explore the free market mechanism and draw attention to its negative externalities. Then we highlight the resemblance between these negative externalities and the context that inspired Jean Baptiste de La Salle to found the Schools of the Christian Brothers. We show how the Christian Brothers organization is inspired by ideals that are sharply distinct from those that govern a strictly capitalist system. The Nevada Supreme Court denied Archon Corporation’s petition for a writ of mandamus or prohibition challenging the denial of a motion to dismiss based on tolling of the statute of limitations. The court declined relief for the following three reasons; the statute-based argument that petitioners made to this court was not considered by the lower court, the court’s clarification of the law would alter the district court’s disposition because the district court made its decision on alternative grounds, and finally, because the district court denied the motion to dismiss without prejudice.

Sexual violence is a widespread traumatic event that has physical, psychological, financial, and spiritual implications for victims, their friends and family, and the community. The negative and long-term effects include poor health outcomes, depression, substance abuse disorders, and post-traumatic stress disorder. Many nurses who treat these patients are inadequately trained.

The treatment of nurses towards patients who are victims of sexual violence can mitigate or contribute to perceived revictimization of patients. Immobilization Of Invertase On Carboxymethylcellulose Prepared From Nata De Coco For The Inversion Of Sucrose, Fundador E.O.V., Fundador V.C. Sabularse, Revilleza M.A.J.R.

Nata de coco, the cellulose produced by Acetobacter aceti with coconut water as substrate, was used as starting material in the synthesis of carboxymethylcellulose after treatment with NaOH and monochloroacetic acid. The product, referred to as carboxymethyl-“nata” (CMN), had a degree of substitution of 0.76, a higher value than those previously reported. This was used in the immobilization of invertase via ionic interaction and adsorptive forces, which produced a viscous colloidal suspension. Agar was incorporated to facilitate pellet formation. Interactions between the agar and the CMN-invertase may have resulted from ionic interactions as well as H-bonding. The immobilized enzyme retained …

The purpose of this study was to examine quality indicators currently guiding the rigor of secondary career and technical education (CTE) programs of study in the United States. Quality indicators are desirable characteristics or expectations for a comprehensive and effective CTE program of study. As of May 2017, we were able to locate publicly accessible secondary CTE quality program standards/guidelines for 38 states. A majority (n=24) updated their secondary CTE quality program standards/guidelines within the last five years (i.e., 2012-2017). Raptors are considered to pose one of the greatest aviation bird strike risk. We investigated raptor bird strikes reported at the largest Spanish airport (Adolfo Suárez Madrid Barajas; AS-MB) from 2009 to 2016 to determine the factors contributing to the increased incidences and develop recommendations to mitigate the risks. We hypothesized that increased raptor bird strikes resulted from changes in foraging and dispersal patterns of Iberian Peninsula vultures (Aegypius spp. and Gyps spp.) after 2004-2005. When the U.S. Fish and Wildlife Service determined that greater sage-grouse (Centrocercus urophasianus; sage-grouse) did not warrant listing under the Endangered Species Act (ESA) in 2015, the agency recognized a coordinated effort of private landowners, nongovernmental organizations (NGOs), and state and federal agencies that effectively reduced threats to the species. This effort exemplified an alternative model to species conservation that relies on voluntary conservation of private landowners to preclude government regulation. Through one in-depth case study of private landowners’ voluntary sage-grouse conservation efforts in Lake County, Oregon, we explored features of these voluntary arrangements that motivate participating private …

Do Organic Solutes Trigger Particle Ingestion In The Ciliate Tetrahymena Pyriformis?, Fayth M. Boyer, Hannah L. Coltrain, Frank Corotto

Little is known regarding what triggers phagocytosis in ciliates. It is unclear as to whether these organisms will ingest inert particles without dissolved organic solutes to stimulate consumption. We fed the ciliate Tetrahymena pyriformis 3 µm polystyrene beads while the organisms were immersed in starvation medium, 0.8% glucose, and growth medium. T. pyriformis fed well in all three media. We find no evidence that Tetrahymena requires organic solutes to trigger ingestion of inert particles.

The pink shrimp Farfantepenaeus duorarum is one ecological indicator of the Biscayne Bay Coastal Wetlands (BBCW) project, which intends to increase mesohaline and oligohaline areal extent along southwestern Biscayne Bay nearshore areas. These changes were anticipated to benefit pink shrimp abundances. My dissertation tested whether increased mesohaline and oligohaline area within a 50-m strip of shallow-water shoreline area likely would increase pink shrimp densities. First, I carried out a comprehensive literature review that revealed polyhaline and/or euhaline salinity regimes generally maximized pink shrimp occurrence, abundance, growth, and survival. Based on panel data covering 114 countries in the world, this study investigates the direct, indirect and total effects of trade flows in environmental goods (EG) on total CO2 and SO2 emissions. Our system-GMM estimations reveal positive direct scale – [between-industry] composition effects prevailing on the negative direct technique – [within-industry] composition effects (if any), as well as compensating the significant indirect technique effects channelled by the stringency of environmental regulations and per capita income.
