Deepsouth Will Rise Again—The Argument In Favor Of The Federal Circuit's Holding In Promega Corp. V. Life Technologies, Christopher Ainscough

Two recent holdings from the United States Court of Appeals for the Federal Circuit in Promega Corp. v. Life Technologies Corp. have come under fire from members of the patent community. In Promega, the Federal Circuit held that i) 35 U.S.C. § 271(f)(1) does not require a third party to "actively induce the combination" of a patented invention, and ii) that a single component can be a "substantial portion" of the components of patented invention. In this Article, I argue that the Federal Circuit decided these issues correctly in light of the policy considerations that went into Congress's enactment …

The graft-versus-leukemia (GVL) effect in allogeneic hematopoietic stem cell transplantation (alloSCT) is potent against chronic phase chronic myelogenous leukemia (CP-CML), but blast crisis CML (BC-CML) and acute myeloid leukemias (AML) are GVL resistant. To understand GVL resistance, we studied GVL against mouse models of CP-CML, BC-CML, and AML generated by the transduction of mouse BM with fusion cDNAs derived from human leukemias. Prior work has shown that CD4+ T cell-mediated GVL against CP-CML and BC-CML required intact leukemia MHCII; however, stem cells from both leukemias were MHCII negative. Our previous study indicated that overexpression of nicotinamide phosphoribosyltransferase (NAMPT) aggravated acute lung injury, while knockdown of NAMPT expression attenuated ventilator-induced lung injury. Recently, we found that meta-carborane-butyl-3-(3-pyridinyl)-2E-propenamide (MC-PPEA, MC4), in which the benzoylpiperidine moiety of FK866 has been replaced by a carborane, displayed a 100-fold increase in NAMPT inhibition over FK866. Here, we determined the effects of MC4 and FK866 on cecal ligation and puncture (CLP) surgery-induced sepsis in C57BL/6J mice. In tissue engineering, an ideal scaffold attracts and supports cells thus providing them with the necessary mechanical support and architecture as they reconstruct new tissue in vitro and in vivo. This manuscript details a novel matrix derived from decellularized Wharton's jelly (WJ) obtained from human umbilical cord for use as a scaffold for tissue engineering application. This decellularized Wharton's jelly matrix (DWJM) contained 0.66 ± 0.12 μg/mg sulfated glycosaminoglycans (GAGs), and was abundant in hyaluronic acid, and completely devoid of cells. Cure rates of children and adults with acute myeloid leukaemia (AML) remain unsatisfactory partly due to chemotherapy resistance. We investigated the genetic basis of AML in 107 primary cases by sequencing 670 genes mutated in haematological malignancies. SETBP1, ASXL1 and RELN mutations were significantly associated with primary chemoresistance. We identified genomic alterations not previously described in AML, together with distinct genes that were significantly overexpressed in therapy-resistant AML. Defined gene mutations were sufficient to explain primary induction failure in only a minority of cases. Thus, additional genetic or molecular mechanisms must cause primary chemoresistance in paediatric and adult AML.

State parks are typically established to preserve natural or native habitats for wildlife while simultaneously providing recreational experiences for humans. However, because of their proximity to urban centers, the level of human visitation associated with state parks may be highly variable. Little information has been published regarding the effect of human visitation levels on wildlife escape behavior in state parks. The language that scientists use to frame biological invasions may reveal inherent bias - including how data are interpreted. A frequent critique of invasion biology is the use of value-laden language that may indicate context bias. Here we use a systematic study of language and interpretation in papers drawn from invasion biology to evaluate whether there is a link between the framing of papers and the interpretation of results. We also examine any trends in context bias in biological invasion research. Many plant seeds travel on the wind and through animal ingestion or adhesion; however, an overlooked dispersal mode may lurk within those dispersal modes. Viable seeds may remain attached or embedded within materials birds gather for nest building. Our objective was to determine if birds inadvertently transport seeds when they forage for plant materials to build, insulate and line nests. Limited information exists on the survival, movements, resource selection, and densities of pronghorn (Antilocapra americana) inhabiting sagebrush-steppe regions within the Dakotas. Primary objectives of this study were to develop a sightability model for aerial surveying and to document survival rates and movement patterns for pronghorn in western South Dakota. This investigation focuses on the determination of the architecture of the natural organic matter (NOM) contained within a soft coal-like material, an agricultural soil and a peat material. NOM has been extracted from bulk materials, fractionated, reassembled, then characterized by 13C Solid State NMR, Pulsed-Field Gradient NMR (PFG-NMR), and Small Angle Neutron Scattering (SANS). Interpretation of the data obtained by SANS has established that the majority of the components of NOM are mass fractals in solution and surface fractals in the solid state. Oral delivery is the most preferred route for drug administration. Oral drug delivery is limited by poor physicochemical properties of drugs and physiological barriers in the gastrointestinal tract. Swift foxes (Vulpes velox) were reintroduced into Badlands National Park between 2003 and 2006 after being nearly extirpated from South Dakota in the early 1900’s. Genetic analysis provided strong evidence that the reintroduction was successful, but viability analysis indicated the population may be in jeopardy with a high probability of extinction. Recently, the population has declined due to various biotic and abiotic factors (e.g., recent weather patterns, effects of plague [Yersinia pestis], and increased coyote [Canis latrans] numbers). Yellow Perch Perca flavescens represent a valued sport fish throughout their range and are an important prey species for piscivorous fishes. In South Dakota, two distinct population types of Yellow Perch have been characterized that differ in growth, survival, and recruitment patterns. Fast growth populations exhibit high growth rates, high mortality, low population density, and inconsistent recruitment. In contrast, slow growth populations are characterized by reduced growth rates, low mortality, high population density, and relatively consistent recruitment. Influenza B virus (IBV) is an important pathogen that infects humans and causes seasonal influenza epidemics. By using next-generation sequencing (NGS) approach, we analyzed total mRNAs extracted from A549 cells infected with B/Brisbane/60/2008, and identified four defective genomes in IBV with two from the polymerase basic subunit 1 (PB1) segment and the other two from the matrix (M) segment. Each of them can potently inhibit the replication of IBV. One derived from PB1 segment was able to interfere modestly with influenza A virus (IAV) replication. Birch (2017) develops an account of the precautionary principle requiring two pragmatic rules for its implementation. I support Birch's proposal but offer a cautionary note about relying on precautionary principles if one's ultimate goal is to emancipate animals from human domination.

Objective: The objective of this selective EBM review is to determine whether or not oral vitamin D supplementation is safe and effective for adults as therapy to improve symptoms associated with seasonal affective disorder (SAD) during wintertime.

Objective: The objective of this selective EBM review is to determine whether or not complimentary and alternative medicines are safe and effective in improving symptoms of adult patients over the age of 18 with active Crohn disease.

In this letter, silicon carbide (SiC) waveguide-based surface plasmon resonance optical sensor with an Ag-Au bilayer metal configuration was studied. The wide bandgap energy of SiC allows the sensor to operate in visible and near-infrared range. The spectrum of resonant wavelength with refractive index shows improved sensitivity and sensing resolution in the Au-Ag bilayer configuration than in the single Au layer configuration. A sensitivity of 2581 nm/RIU (refractive index unit) indicated by the shift of resonant wavelength with refractive index was observed from a refractive index range of n=1.34–1.36, showing that the sensor is desirable for sensing in a series …
