Parameters Of Child Protective Services In The Commercial Sexual Exploitation Of Minors, Taliah Ahdut
Parameters Of Child Protective Services In The Commercial Sexual Exploitation Of Minors, Taliah Ahdut
Seattle University Law Review
The purpose of this Note is to critique the current paradigm in place for resolving the sex trafficking of youth in Washington and compare it to the current model utilized in Minnesota. The Minnesota model should be used to provide a framework for Washington to revise its current model because Washington’s current model allows for sexually exploited youth to be funneled in and out of the criminal justice system, limiting the chances for trafficked victims to reach out to members of the community for assistance. These changes could ultimately increase the opportunities for trafficked youth and position them in the …

Serving Their Country And Their Communities? An Exploratory Study Of The Impact Of Military Presence On County-Level Crime Rates, Rocio A. Paez
Serving Their Country And Their Communities? An Exploratory Study Of The Impact Of Military Presence On County-Level Crime Rates, Rocio A. Paez
Theses and Dissertations
Criminologists have long established an association between social disorganization factors and crime. The majority of criminological literature on social disorganization, however, has overlooked the role that certain social institutions play into the equation. Specifically, the degree to which military presence, manifested by the exposure to the military institution and its personnel, influences local areas has yet to be examined from a criminological perspective. This dissertation was designed to extend this body of research by envisioning the military as a social institution salient in understanding variation in the of crime and delinquency across communities. To accomplish this, I relied on data …
Adolescent Networks: An Exploratory Study Assessing Bullying Victimization And Outcomes Of Social Capital On School Avoidance, Kristen Nicole Sobba
Adolescent Networks: An Exploratory Study Assessing Bullying Victimization And Outcomes Of Social Capital On School Avoidance, Kristen Nicole Sobba
Theses and Dissertations
Bullying victimization has been found to lead to several detrimental effects including depression, anxiety, poor academic achievement, and, in extreme cases, suicidal tendencies. One consequence that has not been studied as extensively is school avoidance. School avoidance can lead to further emotional problems and school dropout, therefore, addressing ways to deter this problem is imperative for future research. The purpose of this dissertation was to identify correlates of school avoidance in addition to understanding the moderating relationship of bullying victimization and social capital on school avoidance. It was expected that social capital would serve as a buffer to bullying victimization, …
A Constitutional Critique On The Criminalization Of Panhandling In Washington State, Drew Sena
A Constitutional Critique On The Criminalization Of Panhandling In Washington State, Drew Sena
Seattle University Law Review
Individuals who have lost everything—their homes, jobs, and dignity—are often forced to live on the street. Those with no reasonable alternative can find themselves relying on the generosity of others just to survive. In response, citizens petition, legislatures enact, and officers enforce laws that criminalize signs of visible poverty. Municipalities have made considerable attempts to remove visible poverty from their cities by drafting legislation that disproportionately punishes people experiencing homelessness. This Note focuses on a particular subset of such legislation, laws that criminalize panhandling. Section I of this Note provides an overview of the First Amendment and the protection of …

Does The End Justify The Means? The Clumsy And Circuitous Logic Of Blood Test Admissibility In Criminal Prosecutions In State V. Cormier, Kyle T. Macdonald
Does The End Justify The Means? The Clumsy And Circuitous Logic Of Blood Test Admissibility In Criminal Prosecutions In State V. Cormier, Kyle T. Macdonald
Maine Law Review
In State v. Cormier, the Maine Supreme Judicial Court, sitting as the Law Court, was asked to determine whether a Maine statute requiring law enforcement officers to test the blood of all drivers for intoxicants following a fatal motor vehicle collision violates the Fourth Amendment of the United States Constitution when the operation of the statute allows for the admission of those blood test results in a future criminal trial of the driver. In determining that the procedures of title 29-A, section 2522 of the Maine Revised Statutes are not violative of the Fourth Amendment, the Law Court effectively confirmed …
Rewriting Hockey's Unwritten Rules: Moore V. Bertuzzi, Patrick K. Thornton
Rewriting Hockey's Unwritten Rules: Moore V. Bertuzzi, Patrick K. Thornton
Maine Law Review
The word “enforcer” or “hockey goon” does not appear in the 2007–2008 National Hockey League (NHL) rulebook. However, every player and coach knows the meaning of those words. Hockey has always had its share of enforcers or “goons” that have protected star players. Steve Moore, former Harvard captain, and his parents have sued NHL tough-man Todd Bertuzzi, the Vancouver Canucks, and the partnership that owned the Canucks for an on-ice incident that occurred between Moore and Bertuzzi on March 8, 2004. Dedicated hockey fans have followed the lawsuit, but with the “incident” now over four years old many have forgotten …
The Role Of The State Attorney General In Preventing And Punishing Hate Crimes Through Civil Prosecution: Positive Experiences And Possible First Amendment Potholes, Amy Dieterich
Maine Law Review
On July 3, 2006, Lewiston, Maine resident Brent Matthews threw a pig's head as "a joke" into the town's only mosque, frequented primarily by Somali refugees, during evening services. Because of Matthews' "joke," members of the mosque were required by Islamic law to clean the desecrated area seven times, attendance at the mosque decreased, and some members said they feared physical harm. Unfortunately for Matthews, Maine is one of eight states that has given its Attorney General the authority to seek a civil remedy for a violation of a citizen's civil rights, which can be pursued concurrently or exclusively of …
Recollections Of My Time In The Civil Rights Movement, Melvyn H. Zarr
Recollections Of My Time In The Civil Rights Movement, Melvyn H. Zarr
Maine Law Review
A while back, in November 2007, some students came down after class and asked me why I never told any personal stories during class. I gave them my standard reply that class time was too valuable for the telling of "war stories." "Well," they countered, "would you be willing to tell your 'back story' after class?" I had no objection to that, as long as they would set it up. I half-expected nothing further to come of it, but the students did set it up, publicizing it to the whole law school community. On the appointed day, an overflow crowd …
Regulating A “Pariah” Industry: The Need For A Responsive Approach In Gambling Markets, Melissa Rorie
Regulating A “Pariah” Industry: The Need For A Responsive Approach In Gambling Markets, Melissa Rorie
UNLV Gaming Research & Review Journal
Gaming regulators are uniquely positioned state agents, who must consider contradictory goals in their day-to-day actions. They must protect the public (and maintain the legitimacy of government) but are also responsible for ensuring that the gaming industry provides needed revenue to the state. To that end, regulators are not only responsible for promoting the legitimacy of the government but also, to some extent, must consider how they can encourage the legitimization of a previously illegal behavior. Prior research has examined regulators’ attempts to balance such “structural contradictions” through their licensing process, but little research has been done on regulatory responses …
Opportunity Lost, Opportunity Found: A Proposal To Amend Maine's Rule Of Evidence 404 To Admit "Prior Acts" Evidence In Domestic Violence Prosecutions, Tina Heather Nadeau
Opportunity Lost, Opportunity Found: A Proposal To Amend Maine's Rule Of Evidence 404 To Admit "Prior Acts" Evidence In Domestic Violence Prosecutions, Tina Heather Nadeau
Maine Law Review
In 2008, thirty-one people were the victims of homicide in the state of Maine. Even more startling: nineteen of these homicides stemmed from domestic violence, possibly the largest number of domestic-violence-related killings in the state's history. This means that nearly 70 percent of Maine's homicides in 2008 were the result of domestic violence. Amendments made in 2007 (and implemented in February 2008) to Maine's Criminal Code have criminalized particular instances of domestic violence as “enhanced” crimes of violence. This allows prosecutors to consider “prior acts” of domestic abuse when deciding how to charge a criminal defendant accused of a domestic-violence-related …
"Another Day" Has Dawned: The Maine Supreme Judicial Court Holds Laboratory Evidence Subject To The Confrontation Clause In State V. Mangos, Reid Hayton-Hull
"Another Day" Has Dawned: The Maine Supreme Judicial Court Holds Laboratory Evidence Subject To The Confrontation Clause In State V. Mangos, Reid Hayton-Hull
Maine Law Review
The Sixth Amendment's Confrontation Clause guarantees criminal defendants the right to “confront witnesses against them.” Specifically, the Clause ensures a criminal defendant's right to confront witnesses who testify against him by the unique medium, or “crucible,” of cross-examination. Although federal and state rules of evidence prohibiting hearsay and the Confrontation Clause are designed to protect similar interests, whether or not admission of a piece of evidence violates a defendant's rights under the Confrontation Clause is a separate analysis than whether that same piece of evidence is admissible under a rule of evidence. In 2004, the United States Supreme Court held …
The Supreme Court's Long And Perhaps Unnecessary Struggle To Find A Standard Of Culpability To Regulate The Federal Exclusionary Remedy For Fourth/Fourteenth Amendment Violations, Melvyn H. Zarr
Maine Law Review
On January 14, 2009, the United States Supreme Court decided Herring v. United States. In Herring, the defendant moved to suppress evidence that he alleged was seized as a result of an arrest that violated the Fourth and Fourteenth Amendments to the U.S. Constitution. The Supreme Court approved the decision below to deny suppression of the evidence. The decision set off a flurry of speculation that the Fourth Amendment exclusionary rule would not see its 100th birthday in 2014. A headline in the New York Times of January 31 declared: “Supreme Court Edging Closer to Repeal of Evidence Ruling.” Another …
Establishing Guidelines For Attorney Representation Of Criminal Defendants At The Sentencing Phase Of Capital Trials, Adam Lamparello
Establishing Guidelines For Attorney Representation Of Criminal Defendants At The Sentencing Phase Of Capital Trials, Adam Lamparello
Maine Law Review
In Strickland v. Washington, the United States Supreme Court issued a seminal holding that single-handedly rendered it nearly impossible for a capital defendant to demonstrate that he was the victim of ineffective assistance of counsel at the underlying trial or at sentencing. Indeed, due in substantial part to the fact that "Strickland was not intended to impose rigorous standards on criminal defense attorneys," the Court found ineffective assistance of counsel in only one case over the next sixteen years. Critically, however, during this time, both state and federal courts bore witness to some of the most horrific examples of death …

Gender Inequality, Intersectionality, And Violence Against Women: A National- And State-Level Analysis Of Violence Against Women Trends, Cheyonna Sewell
Gender Inequality, Intersectionality, And Violence Against Women: A National- And State-Level Analysis Of Violence Against Women Trends, Cheyonna Sewell
Dissertations
Violence against women declined with other forms of violence during the 1990s. Nevertheless, the most popular macro-level theory regarding violence against women, which suggests that changes in gender inequality are associated with changes in the level of violence against women, has been studied primarily cross-sectionally and with mixed findings. In fact, the nature of the relationship between gender inequality and violence against women is undecided. One hypothesis, amelioration, suggests that as gender inequality decreases, and the genders become more equal, violence against women will also decrease (the inverse is also true that as gender inequality increases, violence against women will …

Vols 31-36 (2014-2019)
The Fall 2017 print edition of the Alaska Justice Forum features two stories on crime rates — in relation to criminal justice reform and in relation to police staffing — that caution using crime rates as a single factor to determine policy. A story on Crisis Intervention Teams shows how specialized responses are helping law enforcement deal with calls from individuals with mental illness and/or substance use disorders. The Fall 2017 online edition includes expanded versions of print stories and a video (with transcript) on property crime rates in Alaska.

How Do You Determine The Right Size Of A Police Department? Don’T Look To Crime Rates., Troy C. Payne
Vols 31-36 (2014-2019)
Studies have shown that changing the number of police officers has no effect on crime rates. This article explains why and describes alternative measures. An accompanying chart compares rates of violent crime in Alaska for 1986–2015 with the number of police officers per 1,000 residents for the same period.

Crime Rates And Alaska Criminal Justice Reform, Brad A. Myrstol, Pamela Cravez
Vols 31-36 (2014-2019)
Definitive conclusions about the impact of Senate Bill 91 on the rate of property crimes in Alaska are not possible for a number of reasons, including that the most current data cover less than six months following implementation of the first phase of the law. Accompanying figures show rates of incidents of shoplifting, motor vehicle theft, burglary, and larceny theft reported to police in 1985–2016.

When Mental Illness Becomes A Police Matter, Uaa Justice Center
Vols 31-36 (2014-2019)
Mental illness is not a police matter in and of itself and most people with mental illness (MI) are not involved in the criminal justice system. When police do interact with an individual with MI, care needs to be taken not to label the person as the problem but to focus on behavior that causes harm to self and others.

Needle Acquisition Patterns, Network Risk And Social Capital Among Rural Pwid In Puerto Rico, Ian Duncan, Patrick Habecker, Roberto Abadie, Ric Curtis, Bilal Khan, Kirk Dombrowski
Publications and Research
Background: People who inject drugs (PWID) take on significant risks of contracting blood-borne infection, including injecting with a large number of partners and acquiring needles from unsafe sources. When combined, risk of infection can be magnified.
Methods: Using a sample of PWID in rural Puerto Rico, we model the relationship between a subject’s number of injection partners and the likelihood of having used an unsafe source of injection syringes. Data collection with 315 current injectors identified six sources of needles.
Results: Of the six possible sources, only acquisition from a seller (paid or free), or using syringes found on the …
