"A Degree Is A Part Of The Puzzle, But Only A Piece.” Understanding How Employers Determine The Value Of Academic Credentials, Brenda Kaspari Jan 2017

"A Degree Is A Part Of The Puzzle, But Only A Piece.” Understanding How Employers Determine The Value Of Academic Credentials, Brenda Kaspari

Theses and Dissertations

With the skyrocketing costs of higher education and the increased scrutiny of how educational institutions prepare graduates for the workplace, this dissertation explored how the “outsiders,” or employers, view and determine the value of academic credentials. Using the premise of credentialism, this grounded theory, qualitative study addressed two major questions; first, how do employees evaluate academic credentials, and second, what factors are important to employers?

Through the interviews, it was discovered that there were gray areas when determining the value of a college credential. There were three critical findings. First, college degrees are a valuable credential, yet there are issues …

Stigma And Restoration Of Civil Rights To Felons, Kimberly Paige Pithey Jan 2017

Stigma And Restoration Of Civil Rights To Felons, Kimberly Paige Pithey

Theses and Dissertations

Millions of people in the United States are banned from basic civil rights including participation in voting, jury duty, applying for government assistance, and owning a firearm because they have had a felony conviction. There is limited research on attitudes regarding the restoration of civil rights to felons. This thesis uses Goffman’s theory of stigma to examine whether public support for the restoration of rights to felons is associated with knowledge of felony convictions and whether an individual knows someone with a felony conviction. This study used an online survey of college undergraduates (N = 362) to explore two hypotheses …

Amicus Brief In Jae Lee V. United States, Jenny M. Roberts Jan 2017

Amicus Brief In Jae Lee V. United States, Jenny M. Roberts

Amicus Briefs & Court Filings

This amicus brief was filed on behalf of the Immigrant Defense Project, the Immigrant Legal Resource Center and the National Immigration Project of the National Lawyers Guild in support of the petitioner in Jae Lee v United States, No. 16-327. The Supreme Court ruled in favor of Mr. Lee, holding that Lee met his burden of showing that his attorney's erroneous advice about deportation prejudiced him. The Court found that it would not have been irrational for Lee to reject the plea he accepted and go to trial, despite the fact that he was "almost certain" to lose at trial. …

Still Runnin’ The Underground: A Critical Case Study Of An Adolescent African American Male Reflecting On School, Dalisha Shante Williams

Theses and Dissertations

Despite the vast amount of research on effectively educating African American students, there are few studies capturing the educational narratives of African American students, and specifically Black males, in their own words. Much of the literature focuses on dismal statistics and outcomes concerning African American male students. Drawing upon Woodson’s (1933) timeless critique of the miseducation of the Negro, Afrocentricity in education (Asante, 1987; King & Swartz, 2014,2016) emancipatory pedagogies, and Ladson-Billings’ (1994) theory of culturally relevant pedagogy, this study explores one adolescent African American male’s reflections on school. Using a critical case study methodology, one participant, Merrick, participated in …

Green Vs. White: An Examination Of Of Media Portrayals Of Radical Environmentalists And White Supremacists, Laurence Pedroni Jan 2017

Green Vs. White: An Examination Of Of Media Portrayals Of Radical Environmentalists And White Supremacists, Laurence Pedroni

Master's Theses

The rise of the Trump presidency has highlighted not only the white supremacist history of the U.S., but also reflects danger to the survival of the species in the form of wholesale climate change denial. These ideologies are not unique to Trump or his cabinet, instead reflecting long standing U.S. policy. This research seeks to examine how the U.S. media supports and propagates propaganda to support these hegemonic goals. Relevant literature and research seem to suggest that because radical environmental movements often challenge the hegemony of capital accumulation, they might be portrayed as more violent and a greater terrorist threat …

Bail Reform In Colorado: A Presumption Of Release, Joshua J. Luna Jan 2017

Bail Reform In Colorado: A Presumption Of Release, Joshua J. Luna

University of Colorado Law Review

Interest in bail reform has ebbed and flowed in the United States since the 1960s. Recently, a condemning look at bail administration and pretrial detention across various jurisdictions has pushed bail reform to the policy forefront at both the national and state levels. In 2013, Colorado's General Assembly reformed its bail statute to decrease reliance on monetary bail and promote pretrial services programs in an attempt to prevent unnecessary pretrial detention of low-income defendants who present low risks for flight and threat to community safety. This reform was a much-needed step in the right direction. But the new bail statute …

A Model For Implementing Residential Mental Health Treatment In Nys Correctional Settings, Lauren K. Gillis Jan 2017

A Model For Implementing Residential Mental Health Treatment In Nys Correctional Settings, Lauren K. Gillis

Antioch University Dissertations & Theses

Like the community, correctional institutions have been ill-prepared in providing care to persons with serious mental illnesses (SMIs) who engage in combative behaviors, in what generally seems to amount to innocuous social interactions. These persons have been increasingly incarcerated over the past several decades because of violent behaviors, severely complicating the effort to provide effective mental health treatment for this population. Even though correctional residential mental health units have been instituted, successfully implementing what works has shown to be, at best, transient in these settings. Through the emergence of implementation science principles, though, there is now a pathway to implement …

Background/Purposes/ Aims: Human trafficking (HT) is a threat to human rights globally. Studies indicate between 28% and 87% of HT victims encountered a health care professional during their trafficking period. Nonetheless, little is known about the health care needs of victims of HT. The purpose of this study was to examine the health care needs of a self-identified group of trafficked women in San Diego County, California.

Conceptual Basis: The Model of Human Trafficking and Health by Zimmerman et al. (2011) was used to identify multiple determinates of health following the trafficking period including demographic factors (age at assessment, age …

Capital Jurors In An Era Of Death Penalty Decline, Brandon L. Garrett, Daniel Krauss, Nicholas Scurich Jan 2017

Capital Jurors In An Era Of Death Penalty Decline, Brandon L. Garrett, Daniel Krauss, Nicholas Scurich

Faculty Scholarship

The state of public opinion regarding the death penalty has not experienced such flux since the late 1960s. Death sentences and executions have reached their lowest annual numbers since the early 1970s and today, the public appears fairly evenly split in its views on the death penalty. In this Essay, we explore, first, whether these changes in public opinion mean that fewer people will be qualified to serve on death penalty trials as jurors, and second, whether potential jurors are affected by changes in the practice of the death penalty. We conducted surveys of persons reporting for jury duty at …

The Boom And Bust Of American Imprisonment, Brandon L. Garrett Jan 2017

The Boom And Bust Of American Imprisonment, Brandon L. Garrett

Faculty Scholarship

We are teetering at the edge of a mass incarceration binge. Lawmakers are reconsidering overly harsh criminal punishments. At the same time, eight years later, people are still furious that elite criminals and CEOs avoided criminal punishment in the wake of the last financial crisis. Many have complained that no Wall Street bankers went to jail. What do these conflicting tendencies mean? In this book review, first, I discuss the new book by business professor Eugene Soltes titled "Why They Do It," which explores psychological research on risk-taking by corporate criminals. Second, I discuss law professor Sam Buell's "Capital Offenses," …

Examining What Factors Affect High School Students’ Educational Aspirations, Kalle T. Pray Jan 2017

Examining What Factors Affect High School Students’ Educational Aspirations, Kalle T. Pray

College of Graduate Studies: Theses & Dissertations

This study sought to examine the factors that influenced a high school student’s educational aspirations. This study used data collected by the High School Longitudinal Study (HSLS) 2009-2013 to examine how a student’s engagement, interest, attitudes toward math teacher, counselors helping with college materials, and meeting with a counselor influence a student’s educational aspirations. The findings suggest that student engagement, student interest and meeting with a counselor were significant predictors of higher educational aspirations even after controlling for being white, female, academic track, and family income. Counselors helping with college material was also a predictor of higher educational aspirations, however …

Fostering Legal Cynicism Through Immigration Detention, Emily Ryo Jan 2017

Fostering Legal Cynicism Through Immigration Detention, Emily Ryo

Faculty Scholarship

Every year, tens of thousands of noncitizens in removal proceedings are held and processed through an expanding web of immigration detention facilities across the United States. The use of immigration detention is expected to dramatically increase under the Trump administration’s mass deportation policy. I argue that this civil confinement system may serve a critical socio-legal function that has escaped the attention of policymakers, scholars, and the public alike. Using extensive original data on long-term immigrant detainees, I explore how immigration detention might function as a site of legal socialization that helps to promote or reinforce widespread legal cynicism among immigrant …

Sub Judice And Free Speech: Balancing The Right To A Fair Trial Against Freedom Of Expression In Israel, Boaz Shnoor, Doron Menashe

San Diego International Law Journal

Over the past few years, a relatively large number of cases have arisen in Israel, in which media publications have allegedly influenced criminal proceedings. The Supreme Court of Israel has issued a number of inconsistent decisions regarding such publications.

In this Article, we will study the sub judice prohibition, analyze the concern of undue influence of media publications in criminal cases in light of contemporary behavioral literature, discuss the various approaches found in contemporary Israeli case law, and propose a new and better model.

The Impact Of After School Tutoring On Math Achievement: Perceptions Of African American Males And Those Who Teach Them, Eric L. Brown Jan 2017

The Impact Of After School Tutoring On Math Achievement: Perceptions Of African American Males And Those Who Teach Them, Eric L. Brown

Dissertations

Despite increases in overall academic achievement, African American males continue to struggle in the area of mathematics. Data from the National Assessment of Educational Progress (NAEP) indicates that eighth grade African American males had the lowest levels of mathematics success of all subgroups in 2013, with only 13% performing at or above the proficient performance level in math. An approach to increasing the academic achievement of African American males has been to provide extended learning time beyond the typical secondary education experience. After school programs are one such example. Many studies indicate that after school programs have had some positive …

Particular attention is given to the essential role of strong leadership and to the challenges faced when implementing such a program within the bureaucracy …

Project Safe Neighborhoods In Chicago: Looking Back A Decade Later, Ben Grunwald, Andrew V. Papachristos Jan 2017

Project Safe Neighborhoods In Chicago: Looking Back A Decade Later, Ben Grunwald, Andrew V. Papachristos

Faculty Scholarship

Project Safe Neighborhoods (PSN) is a federally funded initiative that brings together federal, state, and local law enforcement to reduce gun violence in urban centers. In Chicago, PSN implemented supply-side gun policing tactics, enhanced federal prosecution of gun crimes, and notification forums warning offenders of PSN’s heightened criminal sanctions. Prior evaluations provide evidence that PSN initiatives have reduced crime in the first few years of their operation. But over a decade after the program was established, we still know little about whether these effects are sustained over an extended period of time. This Article examines PSN Chicago, an anti-violence program …

Cumulative Constitutional Rights, Kerry Abrams, Brandon L. Garrett Jan 2017

Cumulative Constitutional Rights, Kerry Abrams, Brandon L. Garrett

Faculty Scholarship

Cumulative constitutional rights are ubiquitous. Plaintiffs litigate multiple constitutional violations, or multiple harms, and judges use multiple constitutional provisions to inform interpretation. Yet judges, litigants, and scholars have often criticized the notion of cumulative rights, including in leading Supreme Court rulings, such as Lawrence v. Texas, Employment Division v. Smith, and Miranda v. Arizona. Recently, the Court attempted to clarify some of this confusion. In its landmark opinion in Obergefell v. Hodges, the Court struck down state bans on same-sex marriage by pointing to several distinct but overlapping protections inherent in the Due Process Clause, including the right to individual …

Understanding The Sexual Assault Disclosure Experiences Of Deaf Women, Noëlle Opsahl, Lawrence H. Pick Jan 2017

Understanding The Sexual Assault Disclosure Experiences Of Deaf Women, Noëlle Opsahl, Lawrence H. Pick

JADARA

Deaf women experience sexual assault at a significantly higher rate than the general hearing population, but the research is scarce on Deaf women’s disclosure patterns — the act of telling someone about a personal experience of sexual assault. This phenomenological study explored the disclosure experiences of three female Deaf survivors. The survivors reported themes of power dynamics, revictimization, helpful versus hurtful reactions, met versus unmet expectations, and Deaf community issues. All survivors experienced post-disclosure resiliency and growth, despite having experienced wounding social reactions. These results are discussed in relation to potential service provision for survivors and support providers.

Nature Vs. Nurture Vs. Nerd, Jason Imbrogno, Luis Quintero Jan 2017

Nature Vs. Nurture Vs. Nerd, Jason Imbrogno, Luis Quintero

Journal of Business, Industry, and Economics

We develop an intuitive model to predict the commission of a crime by juveniles in the US using an extensive set of information on the individuals. We have background data on demographics, family composition, socioeconomic status, family relationships, and schooling outcomes. These variables are broadly categorized into three groups: Nature (variables such as family and home environment characteristics which do not directly imply the active involvement of the youth), Nurture (variables involving the individuals’ relationship with his family that require his active participation), and Nerd (variables describing schooling and other studying characteristics such as time spent reading for fun or …
