Race, Rhetoric, And Judicial Opinions: Missouri As A Case Study, Brad Desnoyer, Anne Alexander Jan 2017

Race, Rhetoric, And Judicial Opinions: Missouri As A Case Study, Brad Desnoyer, Anne Alexander

Faculty Works

This Essay studies the relationship between race, rhetoric, and history in three twentieth century segregation cases: State ex rel. Gaines v. Canada, Kraemer v. Shelley, and Liddell v. Board of Education. Part I gives a brief overview of the scholarship of Critical Race Theory, majoritarian narratives and minority counter-narratives, and the judiciary’s rhetoric in race-based cases. Part II analyzes the narratives and language of Gaines, Kraemer, and Liddell, provides the social context of these cases, and traces their historical outcomes.

The Essay contends that majoritarian narratives with problematic themes continue to perpetuate even though court opinions have evolved to use …

A Culture Of Silence: Exploring The Impact Of The Historically Contentious Relationship Between African-Americans And The Police, Mikah K. Thompson Jan 2017

A Culture Of Silence: Exploring The Impact Of The Historically Contentious Relationship Between African-Americans And The Police, Mikah K. Thompson

Faculty Works

The relationship between African-Americans and the police has traditionally been focused on authority, control, and the enforcement of laws we now acknowledge were racially discriminatory. This historical relationship, when combined with a modern-day narrative that the police disproportionately stop, arrest, and utilize deadly force against African-Americans, has resulted in pervasive, inter-generational fear and distrust of the police. Most African-Americans view police officers not as the heroic protectors they can call upon when in need of help or the hard-hitting investigators they would trust to look into a family member’s murder. Instead, many African-Americans believe police officers have bought into the …

Leaving "The Life:" Exploring Services For Women Exiting Prostitution, Katherine A. Cascio Jan 2017

Leaving "The Life:" Exploring Services For Women Exiting Prostitution, Katherine A. Cascio

Theses and Dissertations--Educational, School, and Counseling Psychology

Women in prostitution (WIP) are significantly more likely to experience mental health issues and trauma than the general population (Farley, 2003; Ling, Wong, Holroyd, & Gray, 2007; Rössler et al. 2010; Roxburgh, Degenhardt, & Copeland, 2008). Previous research addressing the mental health of WIP emphasizes treating trauma to help women exit, both trauma that predated entry into prostitution and trauma experienced during prostitution (Carter & Dalla, 2006; Farley, 2003). Very little research is available on services for WIP, leaving psychotherapists with limited guidance on providing effective mental health treatment. Although programs exist exclusively to assist women leaving prostitution, little is …

Separation Of Powers Metatheory, Aziz Huq Jan 2017

Separation Of Powers Metatheory, Aziz Huq

Public Law and Legal Theory Working Papers

Scholarship and jurisprudence concerning the Constitution’s separation of powers today is characterized by sharp disagreement about general theory and specific outcomes. The leading theories diverge on how to model the motives of institutional actors; on how to weigh text, history, doctrine, and norms; and on whether to characterize the separation-of-powers system as abiding in a stable equilibrium or as enthralled in convulsively transformative paroxysms. Congress’s Constitution—a major contribution to theorizing on the separation of powers—provides a platform to step back and isolate these important, if not always candidly recognized, disputes about the empirical and normative predicates of separation-of-powers theory—predicates that …

A Centralised Platform For Digital Forensic Investigations In Cloud-Based Environments, Shaunak Mody, Alastair Nisbet Jan 2017

A Centralised Platform For Digital Forensic Investigations In Cloud-Based Environments, Shaunak Mody, Alastair Nisbet

Australian Digital Forensics Conference

Forensic investigations of digital media traditionally involve seizing a device and performing a forensic investigation. Often legal and physical obstructions must be overcome so that the investigator has access to the device and the right to secure it for investigation purposes. Taking a forensic image of a hard disk may need to be done in the field but analysis can usually be performed at a later time. With the rapid increase in hard disk size, the acquiring of a forensic image can take hours or days. This poses significant issues for forensic investigators when potential evidence resides in the cloud. …

Biometric Cyberintelligence And The Posse Comitatus Act, Margaret Hu Jan 2017

Biometric Cyberintelligence And The Posse Comitatus Act, Margaret Hu

Emory Law Journal

This Article addresses the rapid growth of what the military and intelligence community refer to as ¿biometric-enabled intelligence.¿ This newly emerging intelligence tool is reliant upon biometric databases. This Article introduces the term ¿biometric cyberintelligence¿ to more accurately describe the manner in which this new tool is dependent upon cybersurveillance and big data¿s mass-integrative systems. It then argues that the Posse Comitatus Act of 1878, designed to limit the deployment of federal military resources in the service of domestic policies, will be difficult to enforce to protect against militarized cyberpolicing and cybersurveillance harms that may generate from the domestic use …

The Agile Court: Improving State Courts In The Service Of Access To Justice And The Court User Experience, Erika Rickard

Western New England Law Review

The access to justice movement is under new management. State court judges play a leading role in the policies and priorities to be implemented by legal aid organizations, bar associations, and other civil justice system stakeholders. This Article describes the context of the rise of judicial administration and the access to justice movement, and calls for a renewed focus for judicial leaders to improve the court system itself. Specific recommendations are (1) redesign of court processes; (2) user-focused, incremental, and iterative approach to organizational change; and (3) rigorous evaluation and evidence-based practice.

Civil Rights/Constitutional Law—Indebted To The State: How The Thirteenth Amendment’S Promise Of Abolition Holds Protections Against The Modern Debtors’ Prisons, Sarah Morgan Jan 2017

Civil Rights/Constitutional Law—Indebted To The State: How The Thirteenth Amendment’S Promise Of Abolition Holds Protections Against The Modern Debtors’ Prisons, Sarah Morgan

Western New England Law Review

Cash-starved municipalities regularly impose criminal justice debt on individuals too poor to pay. Local courts deny criminal debtors’ a meaningful inquiry into their ability to pay prior to being assessed sky-high fees, often predictably resulting in default on their payments. Nonpayment under these municipal schemes is enforced through imprisonment solely for the purpose of compelling repayment. Under these circumstances, criminal debtors find themselves in modern debtors’ prisons, a conceptual cycle of debt and imprisonment nearly impossible to escape. This Note will argue the modern debtors’ prison is peonage, coerced labor for the repayment of debt, which is prohibited under the …

Foreword: Symposium On Gender & Incarceration, Giovanna Shay

Western New England Law Review

The articles in this Symposium edition include four pieces on gender and incarceration. The first by Jen Manion discusses the gendered history of punishment itself. The second by Rachel Roth addresses reproductive justice issues in prison, including access to abortion for incarcerated women and the use of restraints in labor. Carol Strickman, of Legal Services for Prisoners with Children, writes about family ties, visitation, and parent-child programs. Finally, Terry Kupers describes how incarceration and the threat of prison sexual violence shapes gender roles, particularly toxic masculinity.

Lived Experiences And Coping Styles Of Alaskan Women With Opioid Use Disorders, Faith May Golden Jan 2017

Lived Experiences And Coping Styles Of Alaskan Women With Opioid Use Disorders, Faith May Golden

Walden Dissertations and Doctoral Studies

Death caused by opioid abuse has increased in recent years, and women in the state of Alaska have been significantly impacted by this opioid crisis. Previous researchers have indicated a possible connection between opioid use and sub-clinical PTSD criteria. The purpose of this grounded theory study was to develop a theory regarding the presence of PTSD diagnostic criteria in this population, to identify patterns in past traumas and other life stressors, and to investigate coping strategies in 43 Alaskan women who sought treatment for opioid use. Archived data in the form of therapy notes were analyzed using grounded theory techniques …

Sex Work And Mental Health: A Study Of Women In The Netherlands, Elizabeth J. Krumrei-Mancuso Jan 2017

Sex Work And Mental Health: A Study Of Women In The Netherlands, Elizabeth J. Krumrei-Mancuso

All Faculty Open Access Publications

This study examined how characteristics of prostitution and quality-of-life factors related to symptoms of depression and post-traumatic stress among 88 women engaged in prostitution in the Netherlands. Numerous factors were associated with elevated mental health concerns, including the experience of violence in prostitution, engaging in street prostitution, being motivated to engage in prostitution for financial reasons, having less confidence in one’s ability to find alternative work, desiring to leave prostitution, and sense of self-transcendence. In contrast, focusing on achievement, having a sense of fair treatment from others and society, and self-acceptance were associated with better mental health outcomes. Finally, mediation …

Time For Change: Aid, Ngos, And Transitional Justice In Bosnia-Herzegovina, Arnaud Kurze Jan 2017

Time For Change: Aid, Ngos, And Transitional Justice In Bosnia-Herzegovina, Arnaud Kurze

Department of Justice Studies Faculty Scholarship and Creative Works

This article examines Scandinavian donor practices in Bosnia-Herzegovina (BiH) with regards to post-conflict justice activities. BiH has been a laboratory of reconstruction, peace-building and transitional justice processes since the end of the war in 1995. While issues related to rebuilding and developing war-torn societies and their economies have attracted extensive scholarly attention, the question of international aid practices in transitional justice contexts remains widely understudied. Although the influence of nongovernmental organizations (NGOs) in reconciliatory transitional justice work has been growing, the relationship between international donors and local NGOs involved in these projects remains very limited. The objective of this study …
