Hidden History: The Whitewashing Of The 1917 East St. Louis Riot, Samanthé Bachelier
The Confluence (2009-2020)
A bloody riot erupted in East St. Louis in the summer of 1917 that resulted in the massacre of dozens of African Americans. Bachelier argues that the history of the history of the riot is also telling about views about race both at the time and since.

Exploring And Understanding Differences Between Deliberate And Impulsive Male And Female Burglars, Amber N. Sanders, Joseph B. Kuhns, Kristie R. Blevins
Exploring And Understanding Differences Between Deliberate And Impulsive Male And Female Burglars, Amber N. Sanders, Joseph B. Kuhns, Kristie R. Blevins
EKU Faculty and Staff Scholarship
Relying on rational choice theory, we compare burglars’ varying levels of offense planning to understand differences among types of burglars. Surveys were collected from a sample of incarcerated male and female burglars in three states. Participants answered questions detailing aspects of a burglary including motivations, target selection, deterrents, and techniques. Comparisons were made between 119 deliberate (32%) and 257 impulsive (68%) burglars. Deliberate burglars focused on obtaining cash, whereas impulsive burglars were more motivated by drug habits. Impulsive burglars were more easily dissuaded from a target when multiple obstacles are present. Burglars consider how many obstacles they may have to …
An Avoidable Conundrum: How American Indian Legislation Unnecessarily Forces Tribal Governments To Choose Between Cultural Preservation And Women's Vindication, Catherine M. Redlingshafer
An Avoidable Conundrum: How American Indian Legislation Unnecessarily Forces Tribal Governments To Choose Between Cultural Preservation And Women's Vindication, Catherine M. Redlingshafer
Notre Dame Law Review
This Note makes two arguments concerning the state of American Indian legislation, and then proposes an alternative. First, this Note argues that the recently enacted legislation regarding criminal justice in American Indian societies will work to encourage cultural assimilation and result in the loss of tribal traditions and autonomy. In effect, the legislation is putting tribes in an impossible position: it is unfairly coercing them to choose between (1) the preservation of their own culture and customs, and (2) the ability to prosecute those victimizing their members. Second, this Note argues that even if a tribe decides to risk its …
The Effect Of Text Color And Text Grouping On Attention And Short Term Recall Memory, Emily Haynes
The Effect Of Text Color And Text Grouping On Attention And Short Term Recall Memory, Emily Haynes
Honors College Research
This study sought to discover whether there was a connection between the attentional draw of a word, as represented by text color and grouping, and the likelihood of it being transferred into short term recall memory. College students at Harding University in Searcy, Arkansas were given one of six timed memory test scenarios and asked to recreate the list to the best of their ability. The students were then asked to complete a series of post-test questions designed to measure their perception of their own performance on the test. The students were also asked to complete a demographics questionnaire that …

Exploratory Study Of Retention And Efficacy In Female Domestic Minor Sex Trafficking Residential Programs, Sarah Beth Lister
Exploratory Study Of Retention And Efficacy In Female Domestic Minor Sex Trafficking Residential Programs, Sarah Beth Lister
Selected Honors Theses
If the problem of sex trafficking was not difficult enough to manage, the restoration process of survivors certainly is; specifically in treating survivors who do not want to be rescued and have no intention of changing once they are. Due to a myriad of reasons, primarily including trauma, many female victims of Domestic Minor Sex Trafficking (DMST) are refusing treatment and running away from facilities that attempt restoration. This study seeks to ascertain the various reasons that girls run, as well as the strengths and challenges that care providers have found in their healing process. Qualitative results assessed from three …

Can Community Policing Increase Residents' Informal Social Control? Testing The Impact Of The Chicago Alternative Policing Strategy, Robert M. Lombardo, Chistopher M. Donner
Criminal Justice & Criminology: Faculty Publications & Other Works
This study examines whether community policing can build informal social control. Specifically, this paper assesses the impact of the Chicago Alternative Policing Strategy (CAPS) in Chicago neighborhoods. The data for this research are drawn from both the Community Survey of the Project on Human Development in Chicago Neighborhoods (PHDCN) and the CAPS Prototype Panel Survey. Bivariate and multivariate methods are used to analyze data gathered from 8782 residents nested within 343 neighborhood clusters. Initially, community policing was found to increase informal social control, but this effect was rendered non-significant after controlling for theoretically and empirically relevant variables. Several social (dis)organization …
Courting Disaster: Climate Change And The Adjudication Of Catastrophe, R. Henry Weaver, Douglas A. Kysar
Courting Disaster: Climate Change And The Adjudication Of Catastrophe, R. Henry Weaver, Douglas A. Kysar
Notre Dame Law Review
Do we court disaster by stretching the bounds of judicial authority to address problems of massive scale and complexity? Or does disaster lie in refusing to engage the jurisgenerative potential of courts in a domain of such vast significance? This Article examines global climate change adjudication to shed light on these questions, focusing particularly on cases that seek to invoke the norm articulation and enforcement functions of courts. The attempt to configure climate-related harms within such substantive frameworks as tort and constitutional law is fraught with analytical and practical difficulties. Yet the exercise, we argue, is essential. Against the backdrop …

The East Africa Dialogue Series:Youth, Urbanization, Growth & Inequality, Alex Awiti, Bruce Scott
East Africa Institute
While nationalism and sovereign assertions are on the ascendancy, we live in a world that has never been more connected. But as East Africans, our common challenges and shared aspirations transcend geography and politics. Moreover, globalization, technology, climate change, disease pandemics and terrorism have weaved nations into interdependent social and geopolitical realities. The objective of the East Africa Dialogue Series (EADS) was to gather reliable evidence and make such evidence available to a wide range of stakeholders who then use the evidence to stimulate dialogue, debate, reflection and action to address urgent challenges. The dialogue series focused on three challenges; …
Growing Up Fast: Implications For Foster Youth When Independence And Early Adulthood Collide, Brenda M. Morton
Growing Up Fast: Implications For Foster Youth When Independence And Early Adulthood Collide, Brenda M. Morton
Faculty Publications - College of Education
Foster care alumni face overwhelming challenges as they transition from care to independence. Torn between their desire to be independent, yet acknowledging they need support, they struggle to find their footing. Adopting a survivor self-reliance mind-set, they set out to earn a bachelor's degree on their own. As they struggle, they compare themselves to non-foster peers who, by enlarge, have a support system enabling them a prolonged entrance to adulthood, which provides a safety net. Without a safety net, and with a focus on independence, decisions youth from foster care make, result in few alumni earning a bachelor's degree.

International Investment Law Through The Lens Of Global Justice, Steven Ratner
International Investment Law Through The Lens Of Global Justice, Steven Ratner
Law & Economics Working Papers
The last decade has witnessed a series of criticisms from states, NGOs, and scholars of international investment law’s rules and procedures. Running in parallel, and for a longer period, political philosophers have developed theories about what would constitute a just international economic order. Yet international law and philosophy have not directly engaged with one another regarding the justice of international investment law. This article attempts to breach that gap by analyzing the key critiques of investment law from the perspective of theories of global justice. Philosophical approaches are useful for appraising investment law because they offer a rigorous framework for …
Ex Parte Seizures Under The Dtsa And The Shift Of Ip Rights Enforcement, Yvette Joy Liebesman
Ex Parte Seizures Under The Dtsa And The Shift Of Ip Rights Enforcement, Yvette Joy Liebesman
The Business, Entrepreneurship & Tax Law Review
The ex parte seizure provision of the Defend Trade Secrets Act is another step in a long line of legislation that shifts the costs of private enforcement to the public, which already has a toehold in copyright and trademark law. The ex parte provision—which is not incorporated into any state trade secret law—relieves rights owners of two “burdens.” First, it relieves the trade secret owner of the burden of actually having to compete in the marketplace. Second, it relieves the trade secret owner of the burden of the costs associated with the discovery process of a lawsuit. The effect of …

Defense Counsel And Public Defence, Eve Brensike Primus
Defense Counsel And Public Defence, Eve Brensike Primus
Book Chapters
Public-defense delivery systems nationwide are grossly inadequate. Public defenders are forced to handle caseloads that no one could effectively manage. They often have no funding for investigation or expert assistance. They aren’t adequately trained, and there is little to no oversight of their work. In many jurisdictions, the public-defense function is not sufficiently independent of the judiciary or the elected branches to allow for zealous representation. The result is an assembly line into prison, mostly for poor people of color, with little check on the reliability or fairness of the process. Innocent people are convicted, precious resources are wasted, and …

Change In Police Organizations: Perceptions, Experiences, And The Failure To Launch, Joseph A. Schafer, Sean P. Varano
Change In Police Organizations: Perceptions, Experiences, And The Failure To Launch, Joseph A. Schafer, Sean P. Varano
Arts & Sciences Faculty Publications
Studies and accounts of change in police organizations frequently emphasize case studies of specific efforts enacted during relatively discrete periods of time in one or a few agencies. The narratives often emphasize the success of change efforts or seek to explain why initiatives failed in the case study agency. While instructive, such accounts do not provide broader insights into successes and failures with change across longer periods of time, differing types of change, and diverse organizational contexts. Using survey data from mid-career police supervisors attending the FBI National Academy program, this study considers change experiences. In particular, consideration is given …
United Nations Against Slavery: Unravelling Concepts, Institutions And Obligations, Vladislava Stoyanova
United Nations Against Slavery: Unravelling Concepts, Institutions And Obligations, Vladislava Stoyanova
Michigan Journal of International Law
The article starts with a section containing a historical description (Part I). The turn to broader historical accounts is apposite since the engagement of international law with slavery, servitude, and forced labor predates the emergence of international human rights law. It is also important to clarify whether there is any continuity between these earlier engagements of international law and Article 8 of the ICCPR. When it comes to slavery, it is important to consider the practices to which this label was attached and how this still influences the contemporary understanding of the term. Notably, the terminological fragmentation between slavery and …
