Missing Police Body Camera Videos: Remedies, Evidentiary Fairness, And Automatic Activation, Mary D. Fan
Missing Police Body Camera Videos: Remedies, Evidentiary Fairness, And Automatic Activation, Mary D. Fan
Georgia Law Review
A movement toward police regulation by recording is
sweeping the nation. Responding to calls for
accountability, transparency and better evidence,
departments have rapidly adopted body cameras.
Recording policies require the police to record more law
enforcement encounters than ever before. But what
happens if officers do not record? This is an important,
growing area of controversy. Based on the collection
and coding of police department body camera policies,
this Article reveals widespread detection and
enforcement gaps regarding failures to record as
required. More than half of the major-city departments
in the sample have no provisions specifying
consequences for not recording …
School-To-Prison-Pipeline: The Factors That Cause It, And How We Can Prevent It, Alison L. Wittig
School-To-Prison-Pipeline: The Factors That Cause It, And How We Can Prevent It, Alison L. Wittig
Cal Poly Humboldt theses and projects
The “School-to-Prison pipeline” is an ongoing challenge and trend in the public school system in America due to inequity in the educational system, discriminatory policies towards students and families of color, and a lack of resources aimed at supporting at-risk youth and the economically disadvantaged within the community. Public schools have made continued progress in shifting their disciplinary policies away from punitive, “zero tolerance” models and towards positive behavioral interventions, but there continues to be a disproportionate number of students ending up in the school-to-prison-pipeline from economically disadvantaged communities and homes. Lawmakers continue to create policies in an effort to …
Police Decision-Making And The Initial Detention Of Juveniles, Tessa G. Decunzo
Police Decision-Making And The Initial Detention Of Juveniles, Tessa G. Decunzo
Graduate Student Theses, Dissertations, & Professional Papers
Police decisions can have a direct impact on juvenile outcomes. These decisions are especially impactful in Montana as Montana law enforcement officers are provided statutory discretion pertaining to the decision to arrest and initially detain a youth. The goal of this study is to understand police officer decision-making as it pertains to the initial detention of juveniles and to inform future theory and policy. The research was guided by a focused hypothesis: The factors identified by law enforcement will be significant predictors of the factors associated with the likelihood of initial detention. In order to examine this issue, the current …

Ideology, Race, And The Death Penalty: “Lies, Damn Lies, And Statistics” In Advocacy Research, Anthony Walsh, Virginia Hatch
Criminal Justice Faculty Publications and Presentations
We use the literature on race in death penalty to illustrate the hold that ideology has on researchers and journalists alike when a social issue is charged with emotional content. We note particularly how statistical evidence become misinterpreted in ways that support a particular ideology, either because of innumeracy or because—subconsciously or otherwise—one’s ideology precludes a critical analysis. We note that because white defendants are now proportionately more likely to receive the death penalty and to be executed than black defendants that the argument has shifted from a defendant-based to a victim-based one. We examine studies based on identical data …

Cicig In Guatemala: The Institutionalization Of An Anti-Corruption Body, Greg M. Morano
Cicig In Guatemala: The Institutionalization Of An Anti-Corruption Body, Greg M. Morano
Honors Theses
When is the institutionalization of anti-corruption bodies possible in Latin America? Central America’s Cold War era internal conflicts destabilized the Northern Triangle’s governments and greatly weakened judicial institutions. The legacy of these conflicts led to the creation of parallel corrupt networks that infiltrated state institutions and perpetuated impunity and violence. However, in Guatemala, the institutionalization of the International Commission Against Impunity in Guatemala (Comisión Internacional Contra la Impunidad en Guatemala, CICIG) has improved the country’s ability to prosecute high-level corruption against the threat of powerful and corrupt state actors. A comparative analysis of the tenures of CICIG’s three commissioners reveals …

A Qualitative Exploration Of African American Students' Perceptions Of And Experiences With On-Campus Police, Rishawnda Lenett Archie
Masters Theses
This study examined African American students' perceptions of and experiences with police officers with particular emphasis on campus police in order to determine whether these perceptions and experiences could impact their college experience. Participants were seven African American students from urban areas who attended a midsize university in the rural Midwest during the fall 2017 semester, and who had some interaction with law enforcement. Data was collected from one-on-one semi-structured interviews. Questions were structured to elicit participants' direct or indirect prior experiences with police officers, their perceptions of police officers and campus police, and tacit impact that these experiences and …

Incarcerated, Transported And Bound: Constructing Community Among Transported Convicts From Britain To The Chesapeake, 1739-1776, Michael I. Bradley
Masters Theses
"Incarcerated, Transported, and Bound: Constructing Community among Convicts Transported from London to the Chesapeake, 1739-1776" explores the movement, migration, the malleability of identities, and development of communal ties among transported convicts. This thesis utilizes information on more than 3000 convicts brought to the colonial Chesapeake region. Precise details are currently available for more than two hundred transported convicts. In many cases the convicts can be followed from their birthplace to London to their trial and imprisonment, continuing to their transportation to the Americas, their new lives in the Chesapeake, and, in some cases, their flight and return to Great Britain. …
Pivotal Moments In Undergraduate Education: Retention And Student Connection To Campus, Katie Sikora
Pivotal Moments In Undergraduate Education: Retention And Student Connection To Campus, Katie Sikora
Masters Theses
Using qualitative methodology the researcher studied what pivotal moments keep students connected to their institution. The researcher conducted five one-on-one interviews with students of varying backgrounds and involvements and found that participants experienced pivotal moments while attending their mid-sized, mid-western, public university. Participants described pivotal moments through helping others, working towards their future goals, and experiencing leadership opportunities that caused them to grow as a student. Family pressure, people on campus, and having more opportunities in college contributed to the pivotal moments that students experienced. Specifically, this mid-sized, mid-western institution's mentors, faculty members, and the close-knit feeling of campus contributed …

Statutory Progress And Obstacles To Achieving An Effective Criminal Legislation Against The Modern Day Forms Of Slavery: The Case Of France, Bénédicte Bourgeois
Statutory Progress And Obstacles To Achieving An Effective Criminal Legislation Against The Modern Day Forms Of Slavery: The Case Of France, Bénédicte Bourgeois
Michigan Journal of International Law
In August 2013, the French Parliament passed a statute meant to bring domestic law into conformity with several European legal instruments recently adopted. The statute explicitly addressed for the first time contemporary forms of slavery, servitude, and forced labor by establishing a set of four offenses that criminalize these three types of severe labor exploitation. For lawmakers as well as for many stakeholders in the fight against modern-day slavery, that achievement marked the culmination of a series of piecemeal amendments to criminal law and narrow advances in case law, which gradually enhanced the penal repression of modern-day slavery over the …

Rewiring The Anger: Learning New Responses In The Therapeutic Community, Emma Marie Burleson
Rewiring The Anger: Learning New Responses In The Therapeutic Community, Emma Marie Burleson
Electronic Theses and Dissertations
Extensive research has been conducted in correctional settings on the effects that therapeutic programs that utilize cognitive-behavioral therapies have on recidivism rates and cognitive-behavioral changes among inmates. Research on anger management programs in correctional settings has shown that there are measurable effects on the anger levels of participants based on quantitative pre-testing and post-testing. The present study sought to build on this research in a unique way by conducting qualitative research to examine the personal perceptions of inmates that have graduated from a therapeutic program in a maximum security prison. The study focused on participants’ perceived changes in how they …
Workplace Harassment And Attitudes Towards Lgbt People: Differences Across Human Service Occupations In South Florida, Daniel Sheridan, Joseph Zolobczuk, Kiet Huynh, Debbiesiu L. Lee
Workplace Harassment And Attitudes Towards Lgbt People: Differences Across Human Service Occupations In South Florida, Daniel Sheridan, Joseph Zolobczuk, Kiet Huynh, Debbiesiu L. Lee
Florida Public Health Review
Research documents that discrimination and harassment directed toward lesbian, gay, bisexual, and transgender (LGBT) individuals are ongoing and prevalent in the workplaces in the United States. However, no studies have identified the specific occupations wherein LGBT-discrimination and harassment are most severe. Furthermore, no study has examined how prepared and comfortable employees feel in addressing discriminatory situations. Utilizing a dataset comprised of 1,691 participants, in this exploratory study we sought to identify whether differences in workplace environment toward LGBT individuals existed across four human service occupations (mental health, medicine, education, and public and private government-related non-profit community organizations). We found that …
A Quantitative Examination Of The Impact Of Protective Orders On Teen Dating Violence, Sonia Ann Layne
A Quantitative Examination Of The Impact Of Protective Orders On Teen Dating Violence, Sonia Ann Layne
Walden Dissertations and Doctoral Studies
Teen dating violence is a national epidemic with prevalence similar to levels of adult dating and domestic violence. Some states order of protection laws currently fails to protect most teen victims experiencing dating violence. The purpose of this experimental, quantitative study was to determine to what extent domestic violence statutes impact the reporting of teen dating violence in states that provide statutory protection of teen dating violence victims. The advocacy coalition framework was used for the study's theoretical foundation. The research questions focused on differences between the strength of state's advocacy coalition programs, and the prevalence of female teens reporting …
Pre-Employment Polygraphs And Ohio Law Enforcement Officers' Perceptions Of Police Misconduct, Peter Thomas Piraino
Pre-Employment Polygraphs And Ohio Law Enforcement Officers' Perceptions Of Police Misconduct, Peter Thomas Piraino
Walden Dissertations and Doctoral Studies
Despite convincing evidence of the polygraph instrument's lack of scientific validity and reliability in assessing deceptiveness in individuals, public-sector organizations in the United States continue to use the polygraph examination as a pre-employment screening tool. In addition to its lack of acceptance in the scientific community, little is known about the effectiveness of polygraph examinations, given as part of pre-employment screening, in predicting future misconduct in law enforcement officers. Two theoretical frameworks, Baumgartner and Jones' punctuated equilibrium model of policy change and Alvesson and Spicer's theory of functional stupidity, provided the theoretical foundation for this study. The purpose of this …

Black Male Probationers' Perceptions Of Juvenile Probation Officers' Role In Reducing Recidivism, Fern H. Clarke
Walden Dissertations and Doctoral Studies
The high recidivism rate of Black male juvenile offenders is a problem in the United States that continues to be of great concern. Probation has gained popularity as being a means of addressing and reducing the high recidivism rates of juvenile offenders. However, there is a lack of research regarding Black male juvenile probationers' perceptions of their probation officers' role in reducing their recidivism. This study examined the following: a) the predictive relationships between Black male probationers' perceptions of their probation officers, their perceptions of the probation officers' job, and their recidivism within 3 years of being place on probation; …
