The Criminal Justice Black Box, Samuel R. Wiseman Jan 2017

The Criminal Justice Black Box, Samuel R. Wiseman

Scholarly Publications

"Big data "-- the collection and statistical analysis of numerous digital data points -- has transformed the commercial and policy realms, changing firms' understanding of consumer behavior and improving problems ranging from traffic congestion to drug interactions. In the criminal justice field, police now use data from widely dispersed monitoring equipment, crime databases, and statistical analysis to predict where and when crimes will occur, and police body cameras have the potential to both provide key evidence and reduce misconduct. But in many jurisdictions, digital access to basic criminal court records remains surprisingly limited, and, in contrast to the civil context, …

Toward The Anthropology Of White Nationalist Postracialism: Comments Inspired By Hall, Goldstein, And Ingram’S “The Hands Of Donald Trump”, Jeff Maskovsky Jan 2017

Toward The Anthropology Of White Nationalist Postracialism: Comments Inspired By Hall, Goldstein, And Ingram’S “The Hands Of Donald Trump”, Jeff Maskovsky

Publications and Research

This article explains Donald Trump’s brutal political effectiveness in terms of his white nationalist appeal. It locates the intellectual, popular, and policy imperatives of Trumpism in a new form of racial politics that I am calling white nationalist postracialism. This is a paradoxical politics of twenty-first-century white racial resentment whose proponents seek to do two contradictory things: to reclaim the nation for white Americans while also denying an ideological investment in white supremacy. The article shows how Trump’s excoriation of political correctness, his nostalgia for the post–WWII industrial economy, his use of hand gestures, and his public speaking about race …

Agent Narc Is Not Your Client: Reflections On The Proper Understanding Of The Relationship Between Prosecutors And Investigating Agencies, Carrie Leonetti Jan 2017

Agent Narc Is Not Your Client: Reflections On The Proper Understanding Of The Relationship Between Prosecutors And Investigating Agencies, Carrie Leonetti

UC Law Constitutional Quarterly

Assistant United States Attorneys increasingly conceive federal lawenforcement agents as their "clients" in criminal prosecutions. As both a descriptive and normative matter, this cannot be right. As a descriptive matter, official interpretations by the Department of Justice, the bench, the bar, and academic commentators almost always reject this "client" conception. It is inconsistent with the conception of prosecutorial obligations espoused by Brady v. Maryland, the American Bar Association model rules of ethics, federal statutes, and evidentiary law. As a normative matter, it could have serious implications for the law of attorney malpractice, prosecutorial immunity, the disclosure of favorable evidence to …

Rhetorical Commonsense And Child Molester Panic--A Queer Intervention, Ian Barnard Jan 2017

Rhetorical Commonsense And Child Molester Panic--A Queer Intervention, Ian Barnard

English Faculty Articles and Research

This article considers how contemporary representations of child molesters in scholarly, political, and popular culture participate in projects that revolve around the recuperation of heteronormativity. I argue that these multimodal obsessions with child molestation displace the resilience of entrenched homophobic fears, prejudices, and dispositions, giving the lie to the commonplace that the political advance of same-sex marriage in the United States signals the apotheosis of gay rights. My analysis focuses on two representative popular and scholarly texts: the long-running television series Law and Order: SVU and a scholarly article about the Jerry Sandusky case published in jac. The former …

The Complexity Of Public Attitudes Toward Sex Crimes, Laura L. King, Jennifer R. Roberts Jan 2017

The Complexity Of Public Attitudes Toward Sex Crimes, Laura L. King, Jennifer R. Roberts

Criminal Justice Faculty Publications and Presentations

Previous research suggests that public opinion about crime is nuanced as it has been found to vary greatly depending upon the type of questions asked and the amount of information provided. Few have similarly examined the complexity of public attitudes specifically about sex crimes. A survey was administered to a sample of U. S. residents utilizing the factorial survey method. The results suggested that specific details about the offense, offender, and victim had a significant effect on perceptions. The findings point to discrepancies between policy and public opinion, as well as to the importance of educating the public about the …

Youth Participatory Action Research (Ypar) And Critical Epistemologies: Rethinking Educational Research, Limarys Caraballo, Brian D. Lozenski, Jamila J. Lyiscott, Ernest Morrell Jan 2017

Youth Participatory Action Research (Ypar) And Critical Epistemologies: Rethinking Educational Research, Limarys Caraballo, Brian D. Lozenski, Jamila J. Lyiscott, Ernest Morrell

Publications and Research

Knowledges from academic and professional research-based institutions have long been valued over the organic intellectualism of those who are most affected by educational and social inequities. Participatory research recognizes what Antonio Gramsci described as “the intellectual and political power of ‘organic intellectuals’ from whom counter-hegemonic notions derive,” which presents a “fundamental challenge to what ... John Gaventa called ‘official knowledge’ as the sole legitimate claim to truth” (Fine et al., 2004, p. 4). Unlike positivist and postpositivist epistemological traditions and research methods that rely on the objectivity and expertise of university-sanctioned researchers (Isenhart & Jurow, 2011; Noffke, 1997), participatory action …

Implicit Bias In Daily Perceptions And Legal Judgments, Keith B. Maddox, Samuel R. Sommers

University of Michigan Journal of Law Reform

In today’s demonstration, we explored the audience’s positive and negative associations with blacks and whites. The demonstration is an adaptation of the Implicit Association Test (www.projectimplicit.net), a computer-based task designed to explore mental connections between various concepts. Participants were presented with a list of concepts (stereotypically black and white names, pleasant and unpleasant concepts) in a column down the middle of a screen along with the response categories (black/white or Pleasant/Unpleasant) along the left and right sides. When reading a word, participants were asked to categorize it by slapping the knee (left or right) that corresponds to the category displayed …

Race, Rhetoric, And Judicial Opinions: Missouri As A Case Study, Brad Desnoyer, Anne Alexander Jan 2017

Race, Rhetoric, And Judicial Opinions: Missouri As A Case Study, Brad Desnoyer, Anne Alexander

Faculty Publications

This Essay studies the relationship between race, rhetoric, and history in three twentieth century segregation cases: State ex rel. Gaines v. Canada, Kraemer v. Shelley, and Liddell v. Board of Education. Part I gives a brief overview of the scholarship of Critical Race Theory, majoritarian narratives and minority counter-narratives, and the judiciary’s rhetoric in race-based cases. Part II analyzes the narratives and language of Gaines, Kraemer, and Liddell, provides the social context of these cases, and traces their historical outcomes.

The Essay contends that majoritarian narratives with problematic themes continue to perpetuate even though court opinions have evolved to use …

Protein Found At The Scene Of The Crime: The Potential For Using Proteomics For Identification, Gavin R. Tisdale Jan 2017

Protein Found At The Scene Of The Crime: The Potential For Using Proteomics For Identification, Gavin R. Tisdale

Dissertations and Honors Papers

Hair has long been collected from crime scenes as part of trace evidence. Originally, hair was used for some exclusionary purposes—only general qualities about an unknown source could be determined. Eventually, DNA was used to help identify the source but only if the root was still attached. Within the last two years, however, two major studies have used proteomics—the study of human protein sequences—to extract and identify protein sequences in an unknown source in order to match it to a known source. These two studies support the same hypothesis: proteomics is currently a viable method for narrowing down the source …

Investigative Journalism And Counter Terrorism Laws, Clive Walker Jan 2017

Investigative Journalism And Counter Terrorism Laws, Clive Walker

Notre Dame Journal of Law, Ethics & Public Policy

Since terrorism is now perceived as a primary and pervasive threat to state security, many states have adopted broad legal definitions of “terrorism” and, upon that basis, have enacted correspondingly expansive policing powers and criminal offences. As a dramatic instance of how these approaches, which affect major Western jurisdictions such as the U.S. and U.K., this paper will focus on the paradigm case of David Miranda. In August 2013, Miranda was transporting computer materials (including files from security agencies) supplied by Edward Snowden, a former contractor with the U.S. National Security Agency, to journalist Glenn Greenwald to assist ongoing disclosures …

Failure To Protect: Our Civil System's Chronic Punishment Of Victims Of Domestic Violence, Kate Ballou Jan 2017

Failure To Protect: Our Civil System's Chronic Punishment Of Victims Of Domestic Violence, Kate Ballou

Notre Dame Journal of Law, Ethics & Public Policy

This Note examines the effectiveness and enforceability of civil restraining orders in domestic violence cases in the wake of Town of Castle Rock v. Gonzalez, which held that there is no constitutional right to the enforcement of a restraining order. This Note analyzes the impact of Gonzales and the effectiveness of various restraining order statutory schemes more broadly. This Note subsequently addresses that as a result of experiencing continued contact from their attackers, victim mothers are more likely to have their children removed by the state in child welfare proceedings, due to the established presumption in most family courts that …

What Impact Is Felony Disenfranchisement Having On Hispanics In Florida?, Angel E. Sanchez Jan 2017

What Impact Is Felony Disenfranchisement Having On Hispanics In Florida?, Angel E. Sanchez

Honors Undergraduate Theses

This research produces original empirical estimates of Hispanics in Florida’s Dept. of Corrections (FDOC) and uses those estimates to measure the impact felony disenfranchisement is having on Hispanics in Florida. Research institutions find that data on Hispanics in the criminal justice system, particularly in Florida, is either lacking or inaccurate. This research addresses this problem by applying an optimal surname list method using Census Bureau data and Bayes Theorem to produce an empirical estimate of Hispanics in FDOC’s data. Using the Hispanic rate derived from the empirical FDOC analysis, the rate of Hispanics in the disenfranchised population is estimated. The …
