The advent of the affordable and accessible Internet in our society, especially in the urban areas, has changed the way our students can diversify their knowledge input today. Gone are the days when the students have to depend solely on ‘lectures’ delivered by their teachers in college. With wireless broadband, hotspots, cyber cafes, cloud computing, and the ‘free laptops’ around, it is essential for the students (and teachers) to posit the available online video lectures along with the classroom lecturers, prescribed syllabus and curricula in a holistic higher education approach. A cursory look at the various resources available on the …

Crimmigration: The Missing Piece Of Criminal Justice Reform, Yolanda Vazquez
Crimmigration: The Missing Piece Of Criminal Justice Reform, Yolanda Vazquez
Faculty Articles and Other Publications
Over the last decade, a new push for criminal justice reform has taken hold. While the moral and fiscal costs have been exorbitant over the last forty years, failing state budgets and bipartisan recognition of the “broken” system have finally caused legislatures, politicians, and advocates to reassess the costs and benefits of the criminal justice system. Breaking the “tough on crime/soft on crime” binary, the “smart on crime” motto has become a helpful tool in reform efforts aimed at reducing the number of individuals incarcerated and ensuring its fairness, regardless of race and socioeconomic status. Little attention, however, has been …

The vigilant defense of the attorney-client privilege by the courts is critical to preserving the integrity of the lawyer-client relationship. Accordingly, the Appellees’ attempt here to secure the client information from the client’s lawyer must be rejected with the same ardor as if the Appellees sought to swashbuckler through the lawyer’s entire file. If the principle that lawyer-client communications are sacrosanct were compromised in this case, the lessons from such a decision would eviscerate the attorney-client privilege in its entirety. Amici hope that their analysis will provide the Court with all of the constitutional, legal and practical reasons it needs …

The field of empirical research on public defense is in an early stage of development. Yet the field is also diverse, as a growing community of researchers applies training in disciplines ranging from law and criminology to economics and social psychology. These facts invite reflection on baseline questions about the field that may inform future work. For example, what factors shape our research agendas? What data, methods, and theories are in play? Do these new research agendas align with the research priorities of public defenders and the communities they serve? Should they do so? To begin exploring such questions, this …

An estimated 21.7 million people need treatment for their substance use problem. As barriers to treatment are removed with health care reform, this number will continue to grow. Simultaneous to this need for treatment, a workforce crisis is occurring in the addiction counseling field due to high turnover rates, an aging workforce, worker shortages, and lingering stigma about substance abuse. Given this climate, counselor education programs are challenged to develop programs that adequately train future counselors to address the unique needs of clients who are struggling with addiction and to better understand how students construct their knowledge regarding addictions and …

On Competence: (Re)Considering Appropriate Legal Standards For Examining Sixth Amendment Claims Related To Criminal Defendants’ Mental Illness And Disability, Sarah Gerwig-Moore
Articles
This Article addresses the questions of attorney error and client competency and examines the following issues: the origin and development of the legal tests for intellectual competency to stand trial or enter a plea and the tests for evaluating Sixth Amendment effective assistance of counsel claims; the range of state and federal approaches to circumstances when those two situations converge; and whether and how our legal tests should be shaped to best assess attorney error when the client likely has an intellectual disability or incompetence. When consideration of a defendant's mental illness or mental disability forms the basis of a …

Relational Criminal Liability, Steven R. Morrison
Relational Criminal Liability, Steven R. Morrison
Florida State University Law Review
“Relational criminal liability,” or one person’s criminal liability for the actions of another by way of a group of which both individuals are a part, generates a fundamental tension between collectivist and individualist approaches to liability. The collectivist approach, which reifies the group qua group, enables individuals to be liable for the acts of the group and the group to be liable for the acts of individuals. The individualist approach treats ind-viduals qua individuals, holding them liable only for their own conduct.
This tension sounds both in moral philosophy and legal theory. As to philosophy, Michael Bratman, Margaret Gilbert, and …
Innocent Until Born: Why Prisons Should Stop Shackling Pregnant Women To Protect The Child, Melanie Kalmanson
Innocent Until Born: Why Prisons Should Stop Shackling Pregnant Women To Protect The Child, Melanie Kalmanson
Florida State University Law Review
The practice of American prisons to shackle and otherwise restrain incarcerated, preg-nant women is problematic for several reasons. Such practices include shackling, chaining, and handcuffing pregnant inmates during their third trimester, transportation to and from medical facilities, labor and delivery, and postpartum recovery. Current discourse on this topic focuses primarily on how these practices invade the woman’s civil liberties, particularly the Eighth Amendment right against cruel and unusual punishment, and international human rights. Recent case law vindicates policy rationales for such practices—safety of others, safety of the woman herself, and securing flight risks.
These discussions overlook and this Note confronts …

Substantive And Procedural Silence, Erin Sheley
Substantive And Procedural Silence, Erin Sheley
Tennessee Law Review
Empirical work shows that perceptions of the procedural fairness of the criminal justice system turns on whether it gives individuals and communities a "voice," or a forum in which to tell their stories. If the system imposes unwanted silence on a party its legitimacy in the eyes of the public decreases. Despite the extensive literature on the many specific applications of silence in the justice system, no attempt has yet been made to break down the relationship between the victim's silence and the defendant's across the disparate doctrines of criminal law, or the importance of these interconnections to the expressive …

The body of 19-year-old Sinoxolo Mafevuka was found in a communal toilet in the Cape Town, South African urban township of Khayelitsha. Sinoxolo had been viciously raped, strangled to death, and her body discarded, with her head under the toilet seat and her genitals displayed openly. Tragically, while Sinoxolo’s murder is a particularly brutal example, using a neighborhood toilet in many informal settlements is an incredibly dangerous activity, and there are estimates that 10.5 million South Africans do not have ready access to toilets. “Women, children and men of all ages are frequently robbed, raped, assaulted and murdered on the …

Poor Support/Rich Support: (Re)Viewing The American Social Welfare State, Wendy A. Bach
Poor Support/Rich Support: (Re)Viewing The American Social Welfare State, Wendy A. Bach
Scholarly Works
Since at least the 1970s a variety of scholars have redefined the U.S. social welfare state to include not only traditional benefit programs (for example Food Stamps and social security) but also a variety of tax benefits that are “hidden” or “submerged” forms of “welfare for the wealthy.” Including these benefits in the overall picture of U.S. social welfare provision reveals a system that is both larger in size than popularly believed and that, in addition to providing some support for the poor, distributes significant benefits regressively, to households with substantial wealth. Although a variety of scholars and policy analysts …

A Principled And Legal Approach To Title Ix Reporting, Merle H. Weiner
A Principled And Legal Approach To Title Ix Reporting, Merle H. Weiner
Tennessee Law Review
Institutions of higher education identify "responsible employees" to further their compliance with Title IX. Responsible employees typically report instances of campus gender-based violence to the institution, usually to the Title IX coordinator. Unfortunately, most colleges and universities make virtually every employee a responsible employee. This "wide-net" approach to reporting, sometimes referred to as universal mandatory reporting, produces two categories of related unintended consequences: (1) it weakens the autonomy of victims when they need their autonomy most, thereby undermining their sense of institutional support and aggravating their psychological and physical harm from the assault; and (2) because of these negative consequences, …

Beyond The Legalization Of Marijuana: Economics Of Marijuana As A Drug And Herbal Supplement, Ryan T. Freer
Beyond The Legalization Of Marijuana: Economics Of Marijuana As A Drug And Herbal Supplement, Ryan T. Freer
Electronic Theses and Dissertations
Normative studies misunderstand a crucial aspect of cannabis legalization: they have not critically analyzed how the pharmaceutical industry might react when synthetic cannabinoid compounds could be incorporated into new products. I argue that when marijuana is federally legal, there will be two independent market developments in: i) the cannabis market, which includes botanic cannabis and herbal supplements sold in retail nutrition stores; and ii) the FDA-approved ethical drug market. How does the drug industry's monopolistic pricing structure lend itself to strategic pricing for these new synthetic cannabinoids? How much competition can we expect between dispensaries and nutrition shops selling herbal …
Working The Front Lines Of Intimate Partner Violence: Responders' Perceptions Of Interrole Collaboration, Lisa N. Magruder
Working The Front Lines Of Intimate Partner Violence: Responders' Perceptions Of Interrole Collaboration, Lisa N. Magruder
Electronic Theses and Dissertations
Intimate partner violence is an epidemic that requires collaboration among responding professionals. As such, community coordinated responses, which unite responders from multiple IPV-serving agencies, have been suggested as a best practice. Despite their use over the past several decades, there is a lack of concrete evidence for their success. Moreover, problems noted among responders decades ago, such as differing philosophical beliefs around IPV, are still noted in more recent literature. Using an instrument-development variant of a fixed, exploratory, sequential mixed-methods design, this dissertation aimed to gain a better understanding of the collaboration experiences of IPV responders.
The qualitative sequence involved …
