The Foundations Of Modern Criminal Law And Gender Inequality, Catalina P. Correa
Seattle Journal for Social Justice
Modern penal theory, like prevalent western theories of law, adopts a determined model of autonomy, one in which people are separable from social and family contexts. Taken to the criminal law context, this model proposes people can be defined without taking into account the social context. The use of prisons thus presupposes that individuals can be removed from their communities and families to be reeducated, readapted, treated or—in the retributive approach—simply punished. This notion of autonomy, however, hides from sight the group of people who not only maintain family ties with the men and women in prison, but who also, …

Do Flashbulb Memories Transmit Across Generations? 9/11 As A Case Study, Shanique Meyler

Psychologists have only recently begun to examine the extent to which personal memories transmit across generations. When they have, they typically focus on family stories (see Merrill & Fivush, 2016) or memories of historical events (Svob & Brown, 2012). The present study extends this line of research to flashbulb memories, or memories of an individual’s circumstances when first learning about a consequential, historical event (Brown & Kulik, 1977). To this end, the present study examines the extent to which flashbulb memories surrounding the events of the terrorist attacks on 9/11 transmit to the next generation. This feature documentary focuses on how the criminal justice system is reluctant to charge people with a ‘hate crime.’
Imam Maulana Akonjee and his assistant, Thara Uddin were shot last year in broad daylight in Queens. Fighting for justice follows the Akonjee family, focusing on their son Saif. Since losing his father, Saif has been thrust into a new role, as head of household to this devastated family. Deferring his dreams for a career — Saif is responsible for taking care of his mother, siblings and their children.

Conversations surrounding school discipline have largely focused on the ways that schools and their punitive policies have funneled students into the criminal justice system through the school to prison pipeline. Recently, there has been an increase in scholarship from scholars who argue that schools are not only funneling students into prisons, but that schools and prisons operate as a nexus – the two working symbiotically to discipline and punish students of color, predominantly Black male students (Meiners, 2010; Sojoyner, 2013). This mixed methods study employed an instrumental single-bounded case approach to explore how a policing executive develops and sustains an ethically performing organization, given the phenomenological "policing power - public trust" relationship. Policing is foundational to rule of law and ethical performance in policing is fundamental to developing and sustaining a healthy policing power - public trust relationship. A review of relevant policing literature reveals a history of tension and conflict in this complex relationship. The purpose of this research study was to explore how the embodiment of aspects of anger may integrate within anger management counseling. Through this research, the first step was taken in exploring the physical expression of anger as an intervention tool in anger management counseling. Culturally-responsive pedagogies require moving beyond blanket assumptions about learners to focus deeply on local meaning-makings. This narrative analysis case study examines the ways a 20-year-old African American man challenges the negative educational identity with which he is forced to contend as he navigates a large and complex urban public school system. The ways in which Jamahl, a seeker of a High School Equivalency, refuses interpellation as an uneducated learner destined to be “nothin'” provides insight as to how formal education might be more responsive to learners' negotiation of deficiency discourses. The rising need, cost, and debt for postsecondary education has increased attention and scrutiny on its value, and colleges and universities must underscore outcomes beyond employment of graduates. Psychological well-being is a promising area to expand the value of postsecondary education. Using correlations, multiple regression, and multivariate analysis of variance (MANOVA), this study seeks to contribute to an emergent body of empirical knowledge about the impact of postsecondary education on students’ well-being by specifically examining the relationship between participation in cocurricular and extracurricular experiences and students’ well-being defined by their sense of meaning in life and work. Understanding Behavioral Health And Treatment Engagement With Former Users Of Prenatal Substances: A Strengths-Focused Mixed Methods Inquiry, Jennifer G. Benson, Peggy Maclean, Andrew Hsi, Sarah J. Erickson

Accessible services for users of prenatal substances are lacking, and treatment engagement is poor with services that are available. Furthermore, legal consequences are often punitive, which ultimately damages the well-being of mother and child. Milagro and FOCUS are two New Mexico programs that provide comprehensive, coordinated care, including medication-assisted treatment, to former users of prenatal substances during pregnancy (in the Milagro Program) and for three years post-birth (in the FOCUS Program). This mixed methods study explored the lived experiences of women from this complex, high-risk population, using a high-engagement sample of women who utilized services at both Milagro and FOCUS. …

This Article addresses touch DNA, chemical analysis of skin traces, and the implications for crime scene investigation, arguing that changes in how trace evidence is analyzed require alterations in the law’s approach to its use. Part I discusses the history of traditional DNA analysis. Part II examines the emergence of touch DNA and related technologies and how they differ from traditional DNA analysis. The Investigative Dynamics Of The Use Of Malware By Law Enforcement, Paul Ohm

The police have started to use malware—and other forms of government hacking—to solve crimes. Some fear coming abuses—the widespread use of malware when traditional investigative techniques would work just as well or to investigate political opponents or dissident speakers. This Article argues that these abuses will be checked, at least in part, by the very nature of malware and the way it must be controlled. This analysis utilizes a previously unformalized research methodology called “investigative dynamics” to come to these conclusions. Because every use of malware risks spoiling the tool—by revealing a software vulnerability that can be patched—the police will …

Carpenter V. United States And The Fourth Amendment: The Best Way Forward, Stephen E. Henderson

We finally have a federal ‘test case.’ In Carpenter v. United States, the Supreme Court is poised to set the direction of the Fourth Amendment in the digital age. The case squarely presents how the twentieth-century third party doctrine will fare in contemporary times, and the stakes could not be higher. This Article reviews the Carpenter case and how it fits within the greater discussion of the Fourth Amendment third party doctrine and location surveillance, and I express a hope that the Court will be both a bit ambitious and a good measure cautious.

The Unreasonable Rise Of Reasonable Suspicion: Terrorist Watchlists And Terry V. Ohio, Jeffrey Kahn

Terry v. Ohio’s “reasonable suspicion” test was created in the context of domestic law enforcement, but it did not remain there. This Essay examines the effect of transplanting this test into a new context: the world of terrorist watchlists. In this new context, reasonable suspicion is the standard used to authorize the infringement on liberty that often results from being watchlisted. But nothing else from the case that created that standard remains the same. The government official changes from a local police officer to an anonymous member of the intelligence community. The purpose changes from crime prevention to counterterrorism. …

Sexual violence and rape culture are substantial issues in our society and on our college campuses. The goal of this project is to provide research that investigates rape culture on college campuses as a human rights violation and ways to address it in an intersectional manner through human rights education. The research for this project, conducted through a literature review, provides the ability to look at rape culture through a human rights education lens.
