Cumulative Sexual Victimization And Mental Health Outcomes Among Incarcerated Women, Jennifer Hartsfield, Susan F. Sharp, Sonya Conner
Cumulative Sexual Victimization And Mental Health Outcomes Among Incarcerated Women, Jennifer Hartsfield, Susan F. Sharp, Sonya Conner
Dignity: A Journal of Analysis of Exploitation and Violence
This research explores the relationship between three different types of self-reported sexual victimization and subsequent mental health problems in a sample of incarcerated women. Previous literature establishes a link between victimization histories and poor mental health outcomes. This study focuses on sexual victimization experienced as a child, as an adolescent and as an adult, both individually and cumulatively, in relation to entering prison with a mental health diagnosis as well as reporting current depressive symptoms while incarcerated. Each type of victimization is significantly related to both prior mental health diagnosis and current depression in prison. Furthermore, there is an additive …
Policing The Boundaries Of Whiteness: The Tragedy Of Being “Out Of Place” From Emmett Till To Trayvon Martin, Angela Onwuachi-Willig
Policing The Boundaries Of Whiteness: The Tragedy Of Being “Out Of Place” From Emmett Till To Trayvon Martin, Angela Onwuachi-Willig
Faculty Scholarship
This Article takes what many view as an extraordinary case about racial hatred from 1955, the Emmett Till murder and trial, and analyzes it against the Trayvon Martin killing and trial outcome in 2012 and 2013. Specifically, this Article exposes one important, but not yet explored similarity between the two cases: their shared role in policing the boundaries of whiteness as a means of preserving the material and the psychological benefits of whiteness. This policing occurred in a variety of forms, including: (1) maintaining white racial separation; (2) facilitating cross-class, white racial solidarity; (3) articulating blackness, and specifically black maleness, …
Hard Bargaining In Plea Bargaining: When Do Prosecutors Cross The Line?, Cynthia Alkon
Hard Bargaining In Plea Bargaining: When Do Prosecutors Cross The Line?, Cynthia Alkon
Faculty Scholarship
Well over 90 percent of all criminal cases in the United States are resolved by plea bargaining and not by trial. This means that how plea bargaining works impacts nearly every criminal defendant. However, there are few restrictions to protect defendants in the negotiating process. One serious problem is that prosecutors regularly use hard bargaining tactics such as exploding offers, threats to add enhancements, take-it-or-leave-it offers, and threats to seek the death penalty. These hard bargaining tactics contribute to the often highly coercive atmosphere of plea bargaining that can lead innocent defendants to plead guilty. Pressure to plead guilty can …

Breaking Through Gridlock To Protect Human Rights: The Case For A Congressional Human Rights Committee, Joanne Sweeny
Breaking Through Gridlock To Protect Human Rights: The Case For A Congressional Human Rights Committee, Joanne Sweeny
San Diego Law Review
Congressional gridlock does more than frustrate the populace; it has far-reaching effects, particularly for human rights abuses. From Ferguson, Missouri to Flint, Michigan, government abuses of power and civil rights violations increasingly concern those within the United States. Existing executive bodies, although able to investigate, lack the political power to force Congress to act to remedy these abuses and neither Congress nor state legislatures have offered any solutions. In response, activists have begun to approach international bodies such as the United Nations to voice their concerns, which has also allowed them to re-characterize their plights as human rights issues. If …

The last part of this article briefly considers the legal framework governing state responsibility and individual criminal responsibility for those that assist armed groups that detain people in ways that violate international law.
