Komunikasi Ritual Penggunaan Aplikasi Whatsapp: Studi Konsumsi Berita Lewat Group Whatsapp, Oemar Madri Bafadhal

JURNAL KOMUNIKASI INDONESIA

Missed The Mark: The Supreme Court Of Missouri’S Faulty Application Of Strict Scrutiny To The Right To Bear Arms, Abigail E. Williams Apr 2017

Missed The Mark: The Supreme Court Of Missouri’S Faulty Application Of Strict Scrutiny To The Right To Bear Arms, Abigail E. Williams

Missouri Law Review

The discussion of the scope and potential limitations of the Second Amendment has been at the forefront of the United States’ political debate in recent years. Prior to 2008, Second Amendment jurisprudence was unclear as to what could constitute a lawful restriction of an individual’s right to bear arms. In 2008, the U.S. Supreme Court, in District of Columbia v. Heller, affirmed the Second Amendment guarantee of the right to bear arms, holding that a Washington, D.C., law that prohibited possessing handguns in the home was unconstitutional. The Court further indicated that nothing in the opinion “should be taken to …

Leaving Behind Self-Righteousness: Using Mutual Respect And Compromise To Solve Emerging Conflicts Between Religious Liberty And Same-Sex Marriage, Benjamin Issa Apr 2017

Leaving Behind Self-Righteousness: Using Mutual Respect And Compromise To Solve Emerging Conflicts Between Religious Liberty And Same-Sex Marriage, Benjamin Issa

Brigham Young University Prelaw Review

This paper attempts to provide a reasonable framework for thinking about religious liberty issues following the Supreme Court's decision in Obergefell v. Hodges. Following the decision in that case, which requires states to wed same-sex couples, there has been a national debate about when - and if - religious business owners can discriminate based on sexual orientation. This issue pits religious liberty organizations against LGBT rights organizations, and leaves both sides feeling demonized and misunderstood. This paper advocates a more nuanced approach, and suggests that reasonable compromise is possible if we are willing to leave behind self-righteousness and instead engage …

Property Rights And Freedom: The Keys To Improving Life In Indian Country, Adam Crepelle, Walter E. Block Apr 2017

Property Rights And Freedom: The Keys To Improving Life In Indian Country, Adam Crepelle, Walter E. Block

Washington and Lee Journal of Civil Rights and Social Justice

American Indians are at the bottom of nearly every indicator of welfare and have been since the founding of the United States. The present paper focuses on but two of the causal agents: lack of private property rights and a dearth of economic freedom. Although addressing these issues will not solve all of Indian country’s problems, strengthening property rights and improving economic freedom will generate opportunities for American Indians to improve their economic and social well-being. This recommendation is easy to implement and aligns well with tribal culture pre-contact.

Keeping Gideon’S Promise: Using Equal Protection To Address The Denial Of Counsel In Misdemeanor Cases, Brandon Buskey, Lauren S. Lucas

Fordham Law Review

The Sixth Amendment of the U.S. Constitution guarantees criminal defendants the right to counsel, and the U.S. Supreme Court has made clear that right is applicable to all defendants in felony cases, even those unable to afford a lawyer. Yet, for defendants facing misdemeanor charges, only those defendants whose convictions result in incarceration are entitled to the assistance of counsel. The number of misdemeanor prosecutions has increased dramatically in recent years, as have the volume and severity of collateral consequences attached to such convictions; yet, the Court’s right to counsel jurisprudence in this area has remained stagnant. Critics of the …

Etsu Today - Spring 2017, University Marketing And Communication, East Tennessee State University

ETSU Today [magazine]

Through the passage of time over the past 105 years on our campus, much change has occurred. We opened as East Tennessee State Normal School in 1911 to prepare teachers. As the institution underwent a series of name changes – East Tennessee State Teachers College, State Teachers College, East Tennessee State College, and finally East Tennessee State University – our campus transformed as well. New academic departments were added, buildings were constructed, athletic teams were formed, and our student population grew. In July 1972, ETSU was placed under the governance of the Board of Regents. Just two years later, the …

The Promise Of Justice: Are Public And Private Defense Equal?, Alicia Linzmeier Apr 2017

The Promise Of Justice: Are Public And Private Defense Equal?, Alicia Linzmeier

Honors Theses

This thesis attempts to uncover whether or not differences in unclassified felony and first-degree felony case outcomes arise as a result of the type of counsel representing the defendant. The types of defense counsel addressed in this project include public defenders, appointed counsel, and private counsel. This research project specifically focuses on Butler, Greene, and Montgomery Counties in Ohio, in order to cultivate large enough samples for statistical testing. The felony cases that were examined include aggravated murder, murder, rape, voluntary manslaughter, and kidnapping. Existing research (Cohen, 2014; Levine, 1975; Hartley, Miller, and Spohn, 2010; and Williams, 2002) largely shows …

Eliminating Circuit-Split Disparities In Federal Sentencing Under The Post-Booker Guidelines, Elliot Edwards Apr 2017

Eliminating Circuit-Split Disparities In Federal Sentencing Under The Post-Booker Guidelines, Elliot Edwards

Indiana Law Journal

This Note will explore the rarely discussed consequences that result when courts of appeals freely interpret the Sentencing Guidelines. This Note will not address appellate review of sentences in general, nor will it discuss disparities caused by trial courts. Instead, the discussion below will address a very specific situation, namely when a court of appeals vacates a sentence because, in its estimation, the trial court misapplied the Guidelines. Part I will relate the history of the recent sentencing re-form movement in America, noting particularly which bodies have the authority to decide sentencing policy. Part II will then analyze the interpretive …

Conviction Integrity Units Revisited, Barry Scheck Apr 2017

Conviction Integrity Units Revisited, Barry Scheck

Articles

“Conviction Integrity Unit” has become a brand name that has good public relations value for an elected official. But what does it really mean? Is it just a fashion accessory, a flashy but empty appellation intended to convey the idea that the office is extremely serious about correcting wrongful convictions and holding its own members accountable for errors or acts of misconduct, but really is not? Is conviction integrity nothing more than a passing fad, a nebulous slogan without real meaning that is good for propaganda purposes, but will not bring about any serious change in the way business is …

Relevance Of Personal Interaction Factors Between Customers And Sales Representatives In The Automotive Business, Michael Stros, Timothy C. Heinze, David Riha Apr 2017

Relevance Of Personal Interaction Factors Between Customers And Sales Representatives In The Automotive Business, Michael Stros, Timothy C. Heinze, David Riha

Journal of Applied Marketing Theory

The purpose of this paper is to determine the personal factors in sales that are most relevant to the formation of positive consumer impressions and resulting sales effectiveness. The research enables scholars and practitioners to better understand the personal sales process and develop more efficient sales approaches. The study utilized an observational design methodology. Personal selling scenarios were filmed and shown to respondents who completed a consumer impression and sales effectiveness survey. Video content was also coded for statistical analysis. The resulting data was analysed via a multiple-regression model. A conceptual personal sales model was developed, and the model suggests …

Suggestions In Writing Center Tutorials, Chin Wah Teo

School of Education and Leadership Student Capstone Theses and Dissertations

The purpose of this study was to investigate the types of suggestions made by a non-native speaker (NNS) of American English during writing center tutorials, and students’ perception of the suggestions made by the tutor. Four tutorials, two with native English speakers (NS) and two with NNS, were audio recorded and transcribed for instances of suggestions. Suggestions were analyzed according to several categories: 1) hedging and directness, 2) syntactic form, and 3) writing concern addressed. Stimulated recall interviews were conducted to determine the perception of the students. Findings of the study revealed that the NNS received more unhedged and direct …

Collateral Consequences: Living In The Shadow Of A Conviction, Alex Bernas, Kim Bottenberg, Christian Carroll, Brett Clark, Reagan Eggert, Mackenzie Feeley, Alexa Gutierrez, Beth Hopkins, Kimberly Kenney, Jordan Mccroskey, Michelle Murphy, Sheldon Weiss, Brent Willman, Kelsey York

Honors Undergraduate Research

Over the course of fifteen weeks, fourteen students and two professors explored the Criminal Justice System and the immense challenges faced by citizens as they attempt to reintegrate into their communities after being incarcerated. Through the lens of Systems Thinking, a system pioneered and described by Peter Senge, we dissected seemingly unrelated experiences to identify behaviors and patterns that have been intrinsic in the Criminal Justice System since “tough on crime” policies emerged into the early 1970’s. During this time, criminal justice and public opinion moved from a more rehabilitative stance to one of punishment and punitive vengeance on those …

Amnesty For Even The Worst Offenders, Jay Butler Apr 2017

Amnesty For Even The Worst Offenders, Jay Butler

Faculty Publications

In recent years, global policy makers have declared that heads of state must be held accountable through criminal prosecution for internationally wrongful acts. Scholars too have insisted that the international system’s embrace of accountability excludes or renders illegal the granting of amnesty. This Article argues that that position is too narrow and uses the ongoing conflict in Syria, as well as other contemporary examples, to examine some of consequences of the clamor for prosecution.

The Article rejects the binary juxtaposition of amnesty and accountability in current international legal scholarship, and instead seeks to broaden the terms of the conversation by …

Neighbors Link's Parent-Child Together Program: Supporting Immigrant Parents' Integration To Promote School Readiness Among Their Emergent Bilingual Children, Carola Otero Bracco, Judith Eisenberg

Publications and Research

The authors of this article describe Neighbors Link, a multi-service community and worker center in suburban Westchester County, NY. This organization created Parent-Child Together in the belief that supporting immigrant parents' integration and social inclusion, in activities that also engage long-term community residents, would improve school readiness outcomes for preschool children. A key assumption in the program design is that immigrant parents are best supported when teaching respects their home language and incorporates their home culture and customs. Among the program's positive results has been greater acceptance of the assets and strengths that immigrants bring to the community. The community, …

A Critical Analysis Of Grand Corruption With Reference To International Human Rights And International Criminal Law: The Case Of Nigeria, Florence Anaedozie Apr 2017

A Critical Analysis Of Grand Corruption With Reference To International Human Rights And International Criminal Law: The Case Of Nigeria, Florence Anaedozie

Doctoral

Grand corruption remains a domestic crime that is not directly addressed by the international human rights and international criminal law regulatory frameworks. Scholars argue that the right to a society free of corruption is an inherent human right because dignity, equality and participation significantly depend upon it. The academic discourse linking corruption to the violation of human rights is relatively new, no regional or global human rights instrument has referred specifically to corruption while anti-corruption treaties rarely refer to human rights. There is also insufficient research within this area, establishing the direct causal link between high-level corruption and systemic human …
