What The Future Holds: The Changing Landscape Of Federal Indian Policy, Kevin Washburn
What The Future Holds: The Changing Landscape Of Federal Indian Policy, Kevin Washburn
Faculty Scholarship
Since first described by Chief Justice John Marshall, the United States has been deemed to have a moral and legal “trust responsibility” to the American Indian tribal nations that gave way so that the United States could exist. For nearly two centuries, the trust responsibility reflected a paternalistic view toward Indian tribes. As the United States has developed a more enlightened policy characterized by greater respect for “tribal self-governance,” tribal governments have experienced a renaissance. Federal policy has moved away from federal control and toward tribal empowerment. As a result, the trust responsibility’s paternalistic features have come to seem anachronistic, …

Persistent Offenders In The North West Of England, 1880-1940: Some Critical Research Questions, David J. Cox, Steve Farrall, Barry Godfrey
SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)
This article examines the concept of the persistent offender as a group within society, and the presumed impact of that discrete group upon society via a case study of offending in Crewe between 1880 and 1940. The findings of persistent offending in Crewe challenge the assumptions and prejudices of the period, about the links between unemployment and crime and the extent to which crime was an enduring ‘career’. There were no ‘hardened’ persistent offenders in the sample of the type envisaged by contemporary comment, though the role of drink in offending was sustained; and there was no clear ‘type’ of …

Undiscovered Country: Towards A History Of The Criminal 'Underworld', Heather Shore
SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)
The concept of the underworld is a central feature in popular histories of crime and criminal behaviour but one that has tended to be dismissed by academic historians as somewhat nebulous and indefinable. This article seeks to bridge this gap by suggesting that the construction of a chronological history or model of the underworld can further understandings of societal attitudes towards crime and criminality. Drawing on case studies and snapshots of deviant cultures and behaviours from the eighteenth century to the 1960s the discussion highlights the role of the underworld and its relationship with social panics and social network theories …

On Historical Contextualisation: Some Critical Socio-Legal Reflections, Lorie Charlesworth
SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)
This article examines the relationship of historico-legal studies to the wider context of socio-legal studies. It issues a challenge to rethink the nature and role of legal history in the light of socio-legal theory and the extent to which it out to be used by legal scholars. The discussion explores the benefits to socio-legal studies of interdisciplinarity. It suggests that historical reconstructions that contextualise the law should be properly acknowledged as a subgenre at least of the socio-legal movement, not simply perceived as an add-on methodology.

Convicted Murderers And The Victorian Press: Condemnation Vs. Sympathy, Martin J. Weiner
SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)
Almost half of those receiving the death sentence in late-Victorian and Edwardian England were reprieved. The process of deciding which murderers were to hang and which were to be spared became an increasingly public one, thanks to the growing intervention of the press. This intervention grew alongside the accelerated expansion in the numbers and circulations of newspapers in the second half of the nineteenth century. As the press became a larger part of national life, its more 'popular' and its more local segments carved out for themselves a new and ever more prominent role as major participants in public discourse …

Unpalatable In Word Or Deed: Hostility, Difference And Free Expression, Ian Bryan
SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)
This article conducts a review of the principal tools used in English criminal law, from the early modern period to the present, to impose limits on free expression, particularly the freedom to exhibit hate‘, in pursuit of social order and to police the boundaries at which the acceptable is segregated from the unacceptable. Against this historical backdrop, the article assesses the controversial Racial and Religious Hatred Act 2006, pointing to (dis)similarities with the preceding Bill and with the incitement to racial hatred measures on which the 2006 Act is modelled. The discussion also explores whether, in light of European and …

Child On Child Killing: Societal And Legal Similarities And Dissimiliarities 1840-1890 And 1950-2000, Samantha Pegg
SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)
This thesis contributes to research regarding social perceptions and legal responses to child criminality. It challenges existing preconceptions regarding the predictability of moral panic in such cases and the social perceptions of, and legal responses to, acts of child on child killing. It also challenges the efficacy of the moral panic model in successfully explicating the rise of moral panic. An in-depth study of two case examples, the Bulger case 1993 and the Burgess case 1861 is undertaken through the theoretical framework of the moral panic model. In order to establish conceptualisations of children at the time they are subsumed …

'Don't Look Now' - Masculinities, Altruistic Fear And The Spectre Of Self: When, Why And How Men Fear For Others, Loretta Trickett
SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)
This article draws on the contentious concept of the fear of crime and in particular focuses on two factors which, it is argued, have been afforded insufficient consideration in the 'fear of crime' debate, those of gender and age, and uses them to examine a form of 'fear' that has also been neglected; that of 'altruistic' fear. Based on data from a qualitative study with men and boys the article argues that the concept of a gendered selfhood is fundamental to understanding how men worry about other people. The traditional conceptualisation of altruistic fears is thereby contested and suggestions are …

Cognitive Maps Of Educators' Attitudes Toward Unauthorized Immigrants: A Multidimensional Scaling Perspective, Kerry Pecho
Cognitive Maps Of Educators' Attitudes Toward Unauthorized Immigrants: A Multidimensional Scaling Perspective, Kerry Pecho
Theses and Dissertations
Legislative acts, political discourse, and social movements have highlighted how who immigrants are and where they are from play a substantial role in how they are received. Ewing (2012) noted that decisions regarding the U.S. immigration system are “often shaped more by public fears and anxieties than by sound public policy” (p. 2). The media often ignore the multiple challenges faced by immigrants and instead focus solely on their legal status (Nittle, 2012). Experiencing prejudice, on an individual and institutional level, has detrimental effects on the individual’s physical well-being, emotional well-being, and achievements and success in life. Research has indicated …
