The Semantics Of Suspicion In The Writings Of Desmoulins, Ivy Francisco José Gilbert
The Semantics Of Suspicion In The Writings Of Desmoulins, Ivy Francisco José Gilbert
Electronic Theses and Dissertations 2020 - Present
An exacting command of language in his employ, journalist Camille Desmoulins was arguably one of the most dangerous and cunning players in the political arena of revolutionary France. His work is a clear synthesis of linguistic and political theory but what, precisely, made it so effective? When his work is regarded collectively, a theme emerges wherein Desmoulins uses language designed to categorically perpetuate suspicion. Using the principles of lexical semantics, rhetoric, and connotation, this project seeks to examine the semantic undercurrents of Desmoulins’s works as they relate specifically to the public perception of suspicion, and to define the linguistic parameters …
Reflections On The Challenge Of Inez Moore: Family Integrity In The Wake Of Mass Incarceration, Ann Cammett
Reflections On The Challenge Of Inez Moore: Family Integrity In The Wake Of Mass Incarceration, Ann Cammett
Fordham Law Review
The U.S. Supreme Court case Moore v. City of East Cleveland has long been celebrated as affirming constitutional rights related to family integrity. The Moore holding specifically confirmed the Court’s obligation to scrutinize housing ordinances that regulate a traditional family’s household composition. By comparison and extension, one might assume that alternative family formations would trigger similar scrutiny, but the Court has been loath to extend these protections. Apart from the Court’s failure to increase protections beyond traditional extended families, an interesting phenomenon has gone largely unexplored in this jurisprudential framework. In the wake of late twentieth-century mass incarceration, lawmakers and …
John Moore Jr.: Moore V. City Of East Cleveland And Children’S Constitutional Arguments, Nancy E. Dowd
John Moore Jr.: Moore V. City Of East Cleveland And Children’S Constitutional Arguments, Nancy E. Dowd
Fordham Law Review
This Article is divided into three parts. First, I retell the story of Moore from John Jr.’s perspective and frame his potential claims. Second, I explore constitutional arguments under existing doctrine, using contemporary equal protection and substantive due process analyses. Finally, I suggest how a children’s rights perspective might be even more persuasive as a strategy for John Jr. as well as for achieving opportunity and equality on behalf of contemporary children living amid and affected by structural inequalities that impact their developmental capacity.
Riding The Wave Or Drowning?: An Analysis Of Gender Bias And Twombly/Iqbal In Title Ix Accused Student Lawsuits, Bethany A. Corbin
Riding The Wave Or Drowning?: An Analysis Of Gender Bias And Twombly/Iqbal In Title Ix Accused Student Lawsuits, Bethany A. Corbin
Fordham Law Review
This Article offers the first empirical analysis of dismissal trends in reverse Title IX cases and highlights that most courts erroneously dismiss these lawsuits at the 12(b)(6) stage. Through a misinterpretation of plausibility pleading, these courts hold that accused perpetrators have not shown causal evidence of discrimination at the outset of the lawsuit. This prodismissal approach, however, violates Swierkiewicz v. Sorema N.A.’s proclamation complaint. This Article proposes a more flexible causal pleading scheme that satisfies Twombly, Iqbal, and Swierkiewicz and ensures accused perpetrators receive their day in court. Alternatively, this Article argues for limited predismissal discovery in …
Jail Isolation After Kingsley: Abolishing Solitary Confinement At The Intersection Of Pretrial Incarceration And Emerging Adulthood, Deema Nagib
Fordham Law Review
In 2015, the U.S. Supreme Court held that allegations of excessive use of force in pretrial detention are subject to an objective standard. However, it is unclear whether the objective standard extends to claims arising out of different factual circumstances. The Second Circuit’s recent decision in Darnell v. Pineiro to extend Kingsley v. Hendrickson to conditions-of- confinement cases provides hope. This Note argues that Kingsley should extend to solitary confinement litigation—particularly the isolation of emerging adults in pretrial detention. Solitary confinement is a widespread practice in the criminal justice system, but the implications of its use in pretrial detention have …

Are Universities Providing Non-Stem Students The Mathematics Preparation Required By Their Programs?: A Case Study Of A Quantitative Literacy Pathway And Vertical Alignment From Remediation To Degree Completion, Charles Merritt Allen
UNLV Theses, Dissertations, Professional Papers, and Capstones
Informed by Gagne's belief in the necessity of prerequisite knowledge for new learning, and Bruner's Spiral Curriculum Theory, the objective of this case study was to explore the postsecondary pathway from remedial mathematics, through one gateway mathematics course, and into the quantitative literacy requirements of various non-STEM programs of study. Particular attention was directed towards analyses of the vertical alignment of course content between: (1) the two consecutive remedial mathematics courses (Beginning Algebra and Intermediate Algebra), (2) the two remedial courses and the gateway course (Fundamentals of College Mathematics), and (3) the gateway course and the quantitative literacy needs of …
The Impact Of The 2016 Election On The Financial Performance Of Major Healthcare Companies, Joshua T. Blotter
The Impact Of The 2016 Election On The Financial Performance Of Major Healthcare Companies, Joshua T. Blotter
All Graduate Plan B and other Reports, Spring 1920 to Spring 2023
Healthcare reform was a significant political issue during the November 2016 US general elections, and played an important role in campaigning and political discourse leading to the election. Donald Trump, the Republican presidential candidate, and Republicans running for congressional office, campaigned on a platform advocating for the repeal and replacement of the Patient Protection and Affordable Care Act of 2010 (ACA), among other changes. Hillary Clinton, the Democratic presidential candidate, and Democrats running for congressional office, campaigned on a platform that included support for the ACA, as well as increased regulations on the pharmaceutical industry and health insurers, among various …

Information Security Awareness: Antecedents And User Satisfaction Perspective, Yazan Alshboul
Masters Theses & Doctoral Dissertations
In the fast-changing business world of today, organizations heavily rely on information systems to efficiently perform various business tasks. Using information systems involves some risks, particularly risks related to cybersecurity. Most organizations develop technical and procedural measures to protect their information systems. However, relying only on technical based security solutions is not enough. Organizations must consider technical security solutions along with social, human, and organizational factors (employees). The human element represents the employees (insiders) who use the information systems and other technology resources in their day-to-day operations. Employees’ information security awareness, specifically information security policy (ISP) awareness, is essential to …
Predictors Of Attitudes Towards Law Enforcement Among Hispanics Living In The U.S.-Mexico Border Region, Ivan Avila
Predictors Of Attitudes Towards Law Enforcement Among Hispanics Living In The U.S.-Mexico Border Region, Ivan Avila
Theses and Dissertations
Previous research has shown that minorities hold negative attitudes towards members of law enforcement. Contact with law enforcement has been shown as a major predictor of attitudes towards law enforcement among minorities. Research on this subject has primarily focused on Blacks’ attitudes towards police. Hispanics have been the focus of only a small amount of research on police contact and attitudes towards law enforcement. This study examined contact and attitudes towards several law enforcement entities: local police, state troopers, and border patrol agents. The current study took place along the U.S.-Mexico border, an area with a high population of Hispanics, …

The Influence Of Sport Participation On Youth Binge Drinking., Jason Nicholson
Electronic Theses and Dissertations
This dissertation is an examination of the influence of sport participation on binge drinking among African-American youth. The dissertation is divided into five chapters, covering introduction, literature review, methodology, results, and conclusion. Chapter one describes the problem of binge drinking among African-American youth, focusing on the many deleterious consequences and rates of use. It also examines the problem theoretically through the criminological theories of social bond theory and social learning theory to argue for an understanding of binge drinking by African-American youth. Chapter two examines similar work by previous authors and further details our theoretical premises and their relation to …

A Spatial Analysis Of The Relationship Between Violent Neighborhood Crime Rates And Alternative Gentrification Indicators In Louisville, Ky (2010-2016)., George A. Noonan
Electronic Theses and Dissertations
This study analyzes recent findings analyzing coffee shops as alternative indicators of gentrification and the spatial relationship to violent crime. This thesis seeks to add to this literature by providing additional alternative gentrification indicators such as breweries, distilleries and wineries. The change in number of coffee shops, breweries, distilleries and wineries may impact crime rates and multiyear average incidences of homicide and robbery in the city of Louisville, KY. The first hypothesis states that gentrification decreases multiyear average robberies per census tract from 2010 to 2016. The second hypothesis states that gentrification decreases multiyear average homicides per census tract from …
Moral Time And Homicide Investigations., David Stuart Lapsey Jr.
Moral Time And Homicide Investigations., David Stuart Lapsey Jr.
Electronic Theses and Dissertations
Previous literature explores the many dimensions of homicide investigations, including case and individual characteristics, evidence and investigative activities. However, little research delves into situational characteristics and their relationship to specific homicides, charge severity sought by prosecutors and sentence length given to homicide offenders. The current study sampled homicide cases (N=68) to gather baseline information and data regarding judicial outcomes. Donald Black’s Theory of Moral Time (2011) is tested and utilized as the study’s conceptual framework for the study’s hypotheses.

Politics, Technology, And Libertarianism, Thomas J. Perry
Politics, Technology, And Libertarianism, Thomas J. Perry
Honors Projects
In recent years, technology has started to play a major role in the U.S. political climate. Specifically, it has created a platform for outside groups, such as libertarians, to have their voices heard. This brought forward an important research question: How has technology helped or hindered the ability of individually focused libertarians to organize for collective action? Through the exploration of previous research, two major findings are discovered: 1) technology and the growth of individualism in politics are intertwined and 2) technology and individualism both have ties to libertarianism. The implications of libertarianism are analyzed further through the study of …
Stability Of Synthetic Cathinones In Oral Fluid Samples, Briana Miller, Jiyoung Kim, Marta Concheiro
Stability Of Synthetic Cathinones In Oral Fluid Samples, Briana Miller, Jiyoung Kim, Marta Concheiro
Publications and Research
Synthetic cathinones are new stimulant drugs derived from cathinone that have been sold as “legal highs” worldwide. These compounds can elicit powerful effects such as delusions, hallucinations as well as other potentially dangerous behavior. New analogs with varying effects and potencies are constantly introduced in the market to evade legislation, and they are not detected by routine screening and confirmation methods. Oral fluid is an alternative matrix of increasing interest in forensic toxicology. Its collection is non-invasive and easily supervised, and positive drug findings typically reflect recent drug exposure. The focus of this research was to develop a method for …
The Impact Of Trial Penalty And Evidence Strength On Plea Deal Decision-Making, Yaritza Diaz
The Impact Of Trial Penalty And Evidence Strength On Plea Deal Decision-Making, Yaritza Diaz
Theses, Dissertations and Culminating Projects
Despite its popular use in the U.S. legal system, research on plea bargaining and the factors that affect plea bargain decision-making is limited. Although it has been argued that plea bargaining is necessary to the efficiency of the courts (Williams-Fisher, 2005), critics of the practice argue that offers of leniency relative to the threat of the trial penalty may be coercive, so much so that even innocent defendants can be compelled to plead guilty (Bibas, 2004; Givelber, 1996). Others have argued that defendants are at a disadvantage in the negotiations because they are rarely privy to the evidence held by …

Do Juvenile Offenders Hold To The Child Saving Mentality? The Results From A Survey Of Juvenile Offenders Placed On Court Mandated Juvenile Probation, Katelynn R. Adams
Electronic Theses and Dissertations
The juvenile justice system was established as a result of an unprecedented movement pioneered by the child savers. Child savers strived to protect America's children from physical and moral harm. Since the juvenile justice system's inception, research has focused extensively on the effectiveness of the juvenile system. Numerous studies have observed the perceptions of the general public, juvenile probation officers, and juvenile correctional staff regarding the juvenile justice system. The current study examined actual participants in the juvenile justice system to assess their opinions of the system that was designed to serve, protect, and rehabilitate them into active members of …

Isis In America: A Sociohistorical Analysis, Kathryn Joanne Ratcliff
Graduate Theses and Dissertations
During the summer of 2014, the terrorist organization Islamic State (commonly referred to as Islamic State in Iraq and Syria, or ISIS) garnered international attention after its unprecedented territorial acquisitions and violence in the Middle East. Today, ISIS vies with al-Qaeda for leadership of the global Islamic Extremist movement and has extended its violence all over the world, including the United States. U.S. based supporters generally choose to engage with the ideology in one of three categories: as a foreign fighter, domestic plotter, or domestic non-plotter. Despite this threat, there is very little quantitative research concerning U.S. ISIS supporters and …
An Analysis Of Material Support Of Terrorism And Violent Plots: Scale And Success, Ian David Brecht
An Analysis Of Material Support Of Terrorism And Violent Plots: Scale And Success, Ian David Brecht
Graduate Theses and Dissertations
Following the attacks on September 11, 2001, material support of terrorism charges have served as a cornerstone in the U.S. Government’s fight against terrorism. However, empirical research looking at the usage of material support charges is lacking. The primary focus of this study is to determine if material support charges are related to increases in terrorist attack success and scale. Using the American Terrorism Study (ATS), 177 post-9/11 Islamic Extremist-linked court cases including material support charges and 140 terrorist incidents were coded and analyzed using chi-square, logistical regression, and linear regression models. Results revealed that material support charges are related …
A Study Of Innovation In Model Project Design: Addressing Mental Health Symptoms Among Co-Occurring Substance Use And Mentally Ill Clients Who Are Homeless In A Local Community Clinic Setting, Isis Dian Martel
Graduate Theses and Dissertations
Homeless persons with co-occurring substance use combined with mental illness constitute a particularly vulnerable subgroup with complex service needs. Unfortunately, the capacity to deliver critical treatment services has been extremely limited causing many from this population to remain untreated. Untreated co-occurring disorders can lead to a host of difficulties for both the individual and the community (Bouchery, Harwood, Sacks, Simon, & Brewer, 2011). Developing community based intervention services in Arkansas is a key activity necessary in strategically addressing this problem (Barbee, Gonzales, & Shelor, 2016). In partnership with the Arkansas Division of Behavioral Health Services, a local community treatment provider …
Examining The Phenomenon Of Dropping Out Of High School Through The Perspectives And Experiences Of The African American Male, John L. Colbert
Examining The Phenomenon Of Dropping Out Of High School Through The Perspectives And Experiences Of The African American Male, John L. Colbert
Graduate Theses and Dissertations
We expect all students to achieve and succeed in school, yet current data shows that 23.6% of African American students in Arkansas drop out of school (Bailey & Dziko, 2008). The African American male high school dropouts are much higher than the number of male dropouts from other ethnic groups. As the researcher reviewed the current data about African American dropouts, it was the impetus behind this study. Although many have discussed and written about African American male dropouts in educational forums, essays, short stories, dissertations, and even movies, few have captured the experiences of the African American males in …
“Good Guys Do Rape”: An Examination Of College Student Perceptions Of Sexual Assault Perpetrators, Taylor Blythe Martinez
“Good Guys Do Rape”: An Examination Of College Student Perceptions Of Sexual Assault Perpetrators, Taylor Blythe Martinez
Graduate Theses and Dissertations
When people think of a typical sexual assault, they rely heavily on preconceived notions of sexual violence, which often represents stereotypical rape scenarios. Many stereotypical depictions of perpetrators tend to be centered around individuals who are strangers, mentally ill, lonely, with poor or impoverished upbringing. How perpetrators and victims are depicted impact the likelihood of others believing victims and attributing guilt to perpetrators. This may contribute to societal endorsement of acquaintance rape as not real compared to stereotypical rape scenarios. The current study examines how college students, and in particular fraternity men and sorority women, view perpetrators of sexual assault. …

African-American Perceptions Of Community-Oriented Policing Programs, Adrian L. Griggs
Honors Theses
Reports of police killings of unarmed African-American men have been commonly featured on the news in recent months. Protests in response to those incidents have occasionally turned into riots, and the tension between the minority community and police remains unchanged. There is always a racial variable implicit whenever the African-American community policing debate arises. Researchers have conducted studies on this challenge and have examined differences in perceptions of police officers between African Americans and other racial groups. Studies have been conducted that examine why there might be less satisfaction with police among African Americans but have not considered how these …

Illegal, Unreported And Unregulated Fishing: The Impacts And Policy For Its Completion In Coastal West Of Sumatera, Sri Asih Roza Nova
Indonesian Journal of International Law
For coastal States, IUU fishing is a classic problem. This issue has become a thorn in the flesh, despite being attempted various ways to overcome them, but until now it still has been resolved yet. IUU fishing action can cause many problems, such as increasing poverty of coastal communities, making bankruptcy of fisheries industry, damaging ecosystems and fish habitat in the ocean, disrupting stability of security coastal countries, damaging of diplomatic relations between the coastal States and so on. To that end, this article tries to analyze more deeply about IUU fishing and it’ problems in Indonesia
